Urgent! Seeking Information about a Boro Park Child Molestor.

The UOJ Archives - September 3, 2007

Dear UOJ,

After I wrote the article on August 2 about my experience with a predator (read here) I was contacted by someone with a horrifying story that demands immediate action. This reader identified the man in my story and he painstakingly relayed details of his own ghastly experiences with this monster over three decades ago. This child molester has been targeting innocent children (and young adults) in Boro Park for over thirty years and nothing has been done! I am seeking any information on BEREL GOLDMAN, such as where he lives and where he is employed. Action (within the parameters of the law) will be taken and I pity him (and his employer) if he is currently still in chinuch.

I shudder when I think of how many victims he must have ruined for so many years. UOJ, there is a fire raging in Boro Park and it must be extinguished! The attitude of cover-up in the chassidishe velt is fueled by a clannish attitutude that is worse than the shanda of the Kolko/Margulies/Scheinberg/Belsky fiasco.

Here is the tell-all email that was sent to me by someone who has never recovered from the pain he suffered as an innocent child.

UOJ & friends, this is not a sensational piece of yellow quasi-journalism. This is a serious matter that requires the help of your vast audience. I and this victim implore the community to provide further information on:

Berel Goldman
Age: mid-to-upper 50’s
Height: approx 5’6
Built: Stocky
Hair/Beard: black with streaks of gray
Skin color: olive
Eyes: blue (a little bloodshot)

This monster wears chassidishe garb and has been seen walking around Boro Park and Flatbush and often engages in seemingly harmless conversation with young men and children.

Email sent to me:

Hello,

It took me a few days to get the courage to write back to you since I am still haunted by this guy and it brings back to me very bad memories that will live with me for the rest of my life....
I would hope that this letter gets posted on the UOJ blog and gets to the appropriate channels so that we get rid of this pervert and molester once and for all...
I have kept this in me for many years and I want to get it out of my system at this time...
I am now in my lower forties now and this started around 35 years ago when I was in the fourth grade in the Bobover Yeshiva..
The guy who we are talking about was my rebbe that year and his name is Berel Goldman...
He was in his low twenties at that time, he was very strong and muscular and he used to take me and lift me up with his hands and seat me on his lap and flex his big muscles at me and ask me if i liked it and while on his lap he would touched me all over including my penis thru my pants.
One day in middle of the year after I got to sit on his lap again, he told me to come out of the classroom with him and he took me to the bathroom and he locked the door and he exposed his penis to me and told me to rub it with my hands, I get very scared and terrified but he grabbed my hand and forced me to rub him while he unzipped my pants and was fondling my penis until he masturbated, of course at that age I did not know what this was and I started to cry, he told me that I better not tell anybody or he would punish me...I was scared and did not .a week later he did it to another kid in the class..he happened to tell his mother about it, and she called my mother and told her that he did it to me also, my mother asked me about it and I told her what happened..My mother and the other lady went to the principal and told him, and the answer was that he can not do anything about it, since this rebbe is from a prominent family in the shul and he does not want to ruin their name, our parents were furious and I left the yeshiva for a different yeshiva for the rest of the year and returned only the following year..He continued being a rebbi for a few years until he was fired and the reason was because the principal's son was to enter his grade...
After he was fired, he went to the Viener Yeshiva and was fired from there too..
Since I know him from shul, I know that he did not stop and he continues to molest kids and teenagers in shuls and in yeshivas and in mikvas..
I wrote this email with my heart full of pain of what this guy did to me and to many others...

Thank You Very Much

  2. Aron "Tort Putz" Twerski is the nephew of the old Bobover Rebbe (R' Naftultchik's father). Twerski's mishpuche have jobs in the Bobover chinuch network. Some of them have powerful positions. I wonder if Twerski has a direct role in cover ups at Bobov.

He (Yochanan Berkowitz) created all these web pages (about himself) to google bomb his name into cleanliness. When he puts lots of positive information about himself on the internet, the negative info gets pushed down in the search results. There are companies out there you can pay to do this, he's probably using one of their services.

  6. I was very close to one of Twerski's relatives employed by Bobov from before my bar mitzva. One day, something terrible happened to me in shiddichim. Someone claimed that this guy tried messing me up. Because the source had no neemuness, I went to ask him myself. He denied it, but he wouldn't look me in the eye. I stopped visiting and calling him. I was so hurt it was like my heart was ripped out. One day I bumped into him by mincha and he pretended that he didn't recognize me. I used to think he was mamash a tzaddik. If I could believe that anyone was a two-face, he would be the last one I am choshesh. He had no lushen hora to report about me that maybe he had a chiyev. He was just saying when I was already in the middle that I'm not good enough in yichess and heimishkeit. That he can suggest other bucherim that are better.

I am crying as I write this. Because of what he did to me I almost went off the derech. But I know it is not the Toyra that it is the problem, it is him. Ober fort ich ken nisht farshtayen how someone I thought was a malach Elokim could do this.

For his commitment to "the advancement of justice, scholarship and the legal profession in the fields of tort and insurance law," Professor Aaron D. Twerski of Brooklyn Law School was given the ABA's 2007 Robert B. McKay Law Professor Award on Sunday during the group's meeting in San Francisco.

Mr. Twerski's publications include dozens of law review articles and books on tort and product liability law. He recently returned to Brooklyn Law, where he began teaching in 1986, after serving as dean of Hofstra University School of Law. Mr. Twerski is also special counsel at Herzfeld & Rubin.

Namesake of the award, presented by the ABA's tort trial and insurance practice section, is the late Robert B. McKay, former dean of New York University School of Law who headed an investigative commission into the 1971 inmate uprising at the Attica State Correctional Facility in upstate New York.

A Bradford Woods man filed a federal lawsuit against the operators of Post-Gazette Pavilion and the Washington County police who patrol it, claiming plainclothes officers roughed him up after a Jimmy Buffett concert.
Jerrold L. Shafran, 46, who filed the lawsuit Thursday in federal court, claims Hanover Officer Robert Patsilevas arrested him for walking on the wrong side of a Jersey barrier after the June 6, 2006 concert.

Shafran said he was attempting to leave the Post-Gazette Pavilion when he was accosted by a man dressed in a yellow Hawaiian shirt screaming that he had to move from the area he was walking. When Shafran did not immediately respond "the individual who was screaming at him, attacked him, threw him to the ground and handcuffed him," the lawsuit states.

Shafran pleaded no contest to a disorderly conduct charge, according to court records.

Internet sex sting nabs 13, Including Valley Torah Graduate David Mazlin

David Mazlin has been married less than two years. He has his pictures on onlysimchas.com. Here he is with his wife. David and his wife.

David stands 6′4". He played on the Valley Torah basketball team.

He studied at Ohr Yerushalayim in Israel. It’s a black hat Chofetz Chaim-type yeshiva.

David’s parents have one of the biggest homes in Valley Village.

The version being given by the family is that the wife was doing work under David’s screen name and this “underaged girl” started to harass her. When David got home from work, the wife sent him over to the girls house to tell her to leave the wife alone. This is how and when David was supposedly caught. That is their story. As community members, we are then left with some troubling questions. First, if she was doing work under her husbands name, what was she doing in a chat room even having a conversation? Second, if as she said, the girl was harassing her, why not just leave the chat room or block her from contacting her. Third, would anyone really send their husband over to someone’s house to do this and if so, why bring a gift? According to the paper and FBI stories, this conversation was not one day in the making. This sting was a result of a two month investigation. Just from having watched Dateline, every time they confront the predators, each one says the same thing, “It was an accident,” yet Dateline always has in his hands, several explicit pages of conversations that have gone back and forth. They do not set these operations up on a whim.

Developer Faces Criminal Charges for Neglecting Historic Greenpoint Market in Brooklyn

    Investigation of Mysterious Fire Continues
    By Sarah Ryley
    Brooklyn Daily Eagle
BROOKLYN — The case against Brooklyn developer Joshua Gutttman and his son, Jack, regarding the poor condition of their Greenpoint Terminal Market, was adjourned last week until late November.

The Guttmans have been charged with 434 counts of Failure to Maintain Privately Owned Waterfront Property, one count for each day they failed to repair dilapidated piers and crumbling bulkheads after being ordered to do so. Each count carries a fine of up to $5,000, totaling $2.17 million.

Governor Eliot Spitzer today announced that he has signed legislation ensuring that alleged victims of sex offenses will be able to get timely information from the criminal justice system that can help guide their medical treatment. Under this new law, New York courts can order that an indicted defendant be tested for the HIV virus. Previously, that information could only be requested and received at the time of a defendant’s conviction.

  18. We should get the Child Protective Services and the mayors office to investigate how Ohel determines who in adept to be a foster parent?. We can make a formal complaint and they will have to investigate.
How do they monitor whether the child is being exploited and abused by the foster parent. How do they choose foster parents. Do they have connections with Ohel and are in cozey relationship. All these things must be investgated.
Here is why people can exploit the children becoming foster parents. look at this website below and see what great benefits they offer. Ohel has to put in place some regulation and they need to be investigated so people do not exploit and abuse the foster kids like its reported on Luke fords blog

    http://www.5tjt.com/news/read.asp?Id=1436

The doctor is Susan Schulman, a pediatrician in practice for the last three decades in Borough Park (Brooklyn). The venue is the annual summer convention of the Association of Orthodox Jewish Scientists taking place at the Hudson Valley Resort outside of Ellenville in the Catskills.

On the sensitive issue of pornography, Dr. Schulman says that it is a relatively new but growing problem that has ruined many young people and has broken up a number of young marriages. She says that it is a complicated issue that community leaders are reluctant to publicly get involved in because of the extremely unsavory and sensitive nature of the subject matter.

Scarsdale, NY - On Tuesday, September 4th, at 8 p.m., Rabbi David Hartman will return to Westchester Reform Temple (WRT) in Scarsdale to give a talk entitled, “Can We Live with a Heart of Many Rooms?”

Acclaimed as one of the word’s greatest living rabbis, David Hartman is an American rabbi and philosopher of contemporary Judaism as well as an internationally renowned author. He is widely considered to be the world’s leading advocate of religious pluralism.

Rabbi Hartman studied with Rabbi Joseph Soloveitchik, the 20th century’s greatest Orthodox philosopher, and received his ordination from Yeshiva University in New York. He holds a doctorate in philosophy from McGill University in Montreal, where he served as a congregational rabbi.

In 1971, Rabbi Hartman immigrated to Israel with his wife, Barbara, and their five children.

With this vision, Hartman founded the Shalom Hartman Institute in Jerusalem in 1976. There he leads a team of research scholars in the study of classical Jewish sources and contemporary issues.

Your strong words deeply affected me. I deal with my own anger by getting involved in community affairs. Do what you have to do. Its therapeutic. You'll emerge stronger. Develop a project with concrete plans. Avoid speaking to rabbis, because they will try to stop you, or at least slow you down. You need a plan. There are days ahead with lots of quiet time. Think, think, think. Write down your mental notes, as soon as you are able. Collaborate with others if you can, but if you can't, just do it by yourself. Others will follow you. Hashem yisborach is the only true "rabbi".
Think outside the box. You will succeed. Be patient at times, and do not despair. At all times, just keep moving forward. Do not be afraid to make mistakes. You have taken the first step by writing on UOJ. Learn and study this subject as much as you can. Keep moving forward.

K'siva v'chasima tovah. Hashem should bless you and your wonderful son and entire mishpocha with much yiddishe nachas, parnossa, and gezunt.

    Most sincerely,

    A friend.

  24. The newspapers are now quoting Eckstein like he's some kind of expert.

Here's the rest of the story left out by the Agudah's Yankel Horowitz who wrote a toned down version in the Jewish Fress.

    http://www.recordonline.com/apps/pbcs.dll/article?AID=/20070817/NEWS/708170335/-1/NEWS

That night's get-together in Monticello was also worrisome to elders of this religious community because their children were dressed casually, drinking to the point of intoxication, and kissing — all of which violate their religious laws.

About 200 Orthodox youngsters were hanging out in parking lots around Hi-Cue Billiards on East Broadway. The popular gathering spot for religious summer residents includes a darkened lounge that turns into a disco-style dance club by night. This week, the village shut down the business, citing fire code violations.

Joseph Halpert, a 52-year-old Orthodox man who stays in Kiamesha Lake during the summer, was the first adult to arrive around 12:45 a.m. A friend had telephoned to say a group of rabbis and parents were going to intervene and offer help. Halpert watched quietly as youngsters in the parking lots around the pool hall cut loose. He said the kids included Hasidim and modern Orthodox.

"Inside the pool hall and spilling out into the street were hundreds of frum (religious) boys and girls hanging out, cavorting, drinking, and snorting drugs," Halpert wrote in a letter that has become the hottest topic on Orthodox Jewish Web sites and blogs.

In a phone interview, Halpert said, "I could clearly see that there was drug paraphernalia changing hands. I've seen a lot of things in my community, but I've never seen anything like this."

Most say the drug use was limited to marijuana.

Boys and girls were making out; girls had taken off long, traditional skirts to reveal shorter ones and most had been drinking alcohol, eyewitnesses said.

"This sort of stuff is unheard of in our society until recently," said Judah Eckstein, founder of the Jewish news Web site Yeshiva World. "It's against Jewish law."

A shoving match broke out between some Jewish elders and bouncers when the elders tried to enter the pool hall's dance club. Monticello police came to the scene around 1:30 a.m., but most of the kids had already been taken away, Halpert said. Police did not charge or arrest anyone. Police Chief Doug Solomon said no evidence of drinking or drug use was found.

"It's possible that it's happening, but there was no evidence found to support that kind of activity," he said.

Jewish community leaders had an emergency meeting with Village of Monticello officials the following week because they were unsure as to how to handle the situation.

During the past two years, Hi-Cue Billiards had become a popular hangout spot for young, Jewish summer residents in Sullivan County. Shaul Vaknin, owner of the pool hall, is Israeli and speaks Hebrew.

"The kids started to feel comfortable here," he said.

It began with only boys hanging out and playing pool. Then came drinking in the backroom club and parking lots. Girls started showing up, too. The girls always came in long skirts, but that changed this year when girls began wearing "flashy clothes," as Vaknin put it.

"One thing led to another and the girls were drinking and dancing with the boys," Vaknin said, noting that he consistently turned away people trying to get into the club who were already intoxicated. Vaknin also said his bouncers found people smoking marijuana in the parking lots.

Action from the Orthodox community was swift after the sinful sights of July 28. Vaknin and Rabbi Mordechai Jungreis organized a Saturday-night concert featuring a popular Jewish band for the boys at Hi-Cue Billiards. Bowling alleys in Liberty and Kiamesha were rented to keep the girls busy.

The Orthodox community was mostly immune to the drug persuasions that captured America in the '60s and '70s.

But during the past 10 years, rabbis said, drugs have started to penetrate their society. Look no farther than August in Sullivan County for proof, where police arrested five Orthodox boys in South Fallsburg for possession of marijuana, and another in the Town of Thompson for possession of marijuana and nine Ecstasy pills.

"Drug use is still far, far less than the community at large," said Rabbi Yakov Horowitz, who runs a program for troubled youth called Project Yes. "But it's an issue and these things don't get better unless you address them."

  28. This article also shows that apologists for David Mazlin are full of it.

    http://www.ocregister.com/news/valley-minor-sex-1804905-fbi-eimiller

    By SALVADOR HERNANDEZ
    The Orange County Register

In the undercover operation, men traveled from as far as Las Vegas to the San Fernando Valley to have sex with who they thought was a 12- or 13-year-old minor, said Laura Eimiller, spokeswoman for the FBI.

The arrests were part of a two-month investigation conducted by the FBI's Sexual Assault Felony Enforcement task force and the Los Angeles Police Department's Registration Enforcement and Compliance Team.

Also arrested were ... David Mazlin, 23, of Valley Village.

Authorities allege the men traveled to a house in the valley with the intention of having sex with a minor, but instead were taken into custody by FBI agents and LAPD officers.

During the two-month investigation, law enforcement officials posed as minors in online chat rooms. Dozens of adults from all over the country engaged the officers in online sexual conversations, Eimiller said.

David Avram Cohn, 49, of Woodland Hills, was also arrested on suspicion of attempted molestation.

Several investigations regarding the undercover operation are still pending, Eimiller said, and more arrests could be made.

    Yeshivas and money
    by: Rabbi Jeremy Rosen

In most Jewish schools one of the governors is given the responsibility for checking on parental finances when there is a request for help. Sometimes sadly these are heavy handed. Occasionally they are sympathetic and sensitive. It is notoriously difficult to know the true situation of many people’s finances, particularly if they are self-employed. There are millionaires whose wealth is entirely tied up in shares they cannot sell or in companies that reinvest. Some people have huge obligations and commitments. Others have none. It is never easy but it needs to be done.

As my children grew and graduated and went off to study in yeshivas or seminaries in Israel, I was always told what the fees were and asked to contribute the maximum, which I endeavoured to do according to my circumstances at the time. But, ah, but how times have changed.

Thanks to the power of political parties, yeshivas in Israel nowadays get all kinds of subsidies, capitations, and building grants. Yeshivas are flourishing and expanding exponentially, both in numbers and facilities, and the demand for places is rising all the time. My old yeshivas are positively luxurious compared to what they were. Many alumni, not only from the USA but in Israel too, have done remarkably well financially and you can see the results wherever you go in Israel’s yeshiva alleys.

The significant inflow of funds has had a deleterious impact on the morals of the yeshiva world. As the money has flowed in, so too has corruption, and now even extortion. I first became aware of all this when looking to place an American youngster in a post high school programme in Israel. The Year Off industry has spawned countless Israeli yeshivas catering to American high school graduates. The competition for places is fierce and as a result methods that, alas, are commonplace in American high schools, particularly in New York, are now transferring to Israel. Only a large donation up front will often get your child in to your place of first choice. Now, if Oxford or Harvard does this, well, what do you expect? But when a religious institution, supposedly educating young people in the highest values of Torah, descends to these pits it is a sad reflection on the state of the Black Hat world!

A nephew of mine (and don’t try to guess because I have more nephews than you can image) who happens to be very committed, very studious, and from every point of view the ideal student, was told that unless his parents come up with $150,000 they wouldn’t even examine him, and if they did he would be accepted without an examination. This was from two of the most highly regarded Black Hat yeshivas in Israel today. Both of them with palatial premises and no shortage of funds and on the basis of having heard through the grapevine, but with no evidence, that one of the parents had inherited some money.

I find this offensive on two grounds. If the money were going to poor teachers, perhaps I could understand, even if there was no due diligence to discover the facts or the nature and amount of the obligations the family has. But, in fact, I am pretty sure the money goes to the private accounts of the nepotistic families which own and run these institutions, because I have it on firsthand account that non-family teachers get very little and certainly not the pensions and expenses the ‘owning’ families get. Almost all yeshivas are family businesses in which birth usually plays a greater part in promotion than scholarship.

Secondly, it is one thing to ask for funds. It is another to reject a student, regardless of how good or studious he is, simply as a bargaining tool of pressure. Jewish education around the world is flourishing but in many places where there is no State support it is prohibitively expensive. We need to find and communities must find ways of funding their schools and Yeshivot.

What I am describing however is corruption pure and simple, and if this is the way the yeshivas are going then the outlook for Judaism as a spiritual and moral religion, an example to the wider world, as opposed to just another social phenomenon, is bleak indeed. The great and lamented Rav Yosef Kahaneman of Ponevez, Rav Leizer Yehuda Finkel of Mir, and Rav Chatzkel Sarna of Chevron must be turning in their graves. And I bet the guilty parties will be praying away with fake piety during Yom Kippur as if their hands and souls were clean.

So what was the "harrassment"? After the Black guy illegally tresspassed, Zimmerman tried taking a picture of him. When the Black guy then physically assaulted Zimmerman, Shmarya claims it's "illegal" for Zimmerman to pin the attacker down until police arrived.

All Shmarya has done is try to demonize Zimmerman and everyone else in Lakewood while puffing up the "honors student" Black guy as some poor "racism" victim of "Haredi" thugs.

A lawyer has now challenged Shmarya to explain how Zimmerman would be breaking the law anywhere.

So far, Shmarya is silent. He usually never gives up arguing so that he doesn't have to admit he lied or was mistaken.

  35. Ploni, the frequent email correspondent who tipped off Shmarya to Rabbi Gershon Tannenbaum's gross plagiarism in this week's Jewish Press, noticed this morning that Tannenbaum's column is missing from the Jewish Press website. It was still up Sunday.

So far, Jewish Press editor Jason Maoz has still not responded to SHmarya's email or phone call regarding Tannenbaum's plagiarism.

Ploni wonders if the Jewish Press will print a retraction? Will Rabbi Tannenbaum be suspended or fired? What, if any, consequences are there for a Jewish Press columnist who (grossly) plagiarizes?

Someone else comments that Tannenbaum is related to Klass. Does anyone know if and how that is true?

He has to keep on churning out the columns (do they pay him per word ?), it's hard, so he steals from elsewhere, what's wrong with that ? Did his friend Rabbi Jacob Klass say in his column that plagiarism is a problem ?

  37. Warning to men in BoroPark: Ohel Family Services has in the last few years been getting many government grants. One of them was for the purpose of opening a domestic violence center. In order to justify the money they receive Ohel must ensnare woman to come for counseling under the pretense that they are being abused. Ohel hires social workers and counselors and makes a nice fee off this. Once they sink their claws into the woman they don’t let go very easy because this is a major profit center for them. It can evolve into profit from divorce counseling, children counseling and the list goes on.

Here are the signs to look for if you suspect that your wife is getting involved with Ohel.

Modus operendi: The counselor will first try to get the woman to get her own cell phone so she can contact her discreetly. The counselor has the woman call Ohel at 718 851 6300 and leave a message for the counselor. The counselor will then call back with the appointment time probably when the husband is at work so he wont find out that they are sucking in his wife. Ohel will not come up on the caller id. The caller id will come up as 718646. If you see that your wife has called 718 851 6300 and then has a call back of 718646 you will know that she is in touch with Ohel and you better take action before its to late. Ohel will give her articles, books and lists of items to convince her that she is being abused. You will then hear her use words and talk in ways that she was not familiar with before. Watch out for these signs. Warning your wife could be involved with Joan Hertz of Ohel Domestic Violence.

This is being published for the benefit of the Jewish Community by Ohel Insider. I hope to post more information about Ohel and names of its counselors in the future. Anyone else that has information should also share it for the benefit of the community. This is a major scandal ready to break open. The Rabanim are unfortunately all quit about this. Some are paid fat salaries by Ohel to condone what they do.

  47. http://www.northcountrygazette.org/news/2007/08/27/home_care_crackdown/

The Attorney General’s industry-wide crackdown on fraudulent Medicaid home care providers has resulted in the convictions of a Brooklyn licensed home care services agency and its principals who stole millions from Medicaid by employing unqualified, uncertified home health aides and causing Medicaid to be billed for services never rendered.

“These individuals took advantage of a system that was ripe for abuse,” said Attorney General Andrew Cuomo. “They did so by knowingly recruiting unqualified home health aides in order to enlarge their workforce and increase their fraudulent billings.”

Nachem Singer, 43, of Division Ave., Brooklyn has pleaded guilty to third degree grand larceny, a D felony, for his role in a scheme that defrauded Medicaid of over $12 million dollars.

Ervin Rubenstein, 43, of 49th St., Brooklyn pleaded guilty to fourth degree grand larceny, an E felony, and the licensed home care service agency they operated, Immediate Home Care, Inc., located on Broadway in Brooklyn, pleaded guilty to second degree grand larceny, a C felony, and will pay $12.5 million in restitution.

Immediate Home Care, Inc. was authorized in 1994 by the Department of Health to operate as a licensed home care services agency. Between 2003 and 2006, Immediate’s revenues increased from approximately $3 million to over $52 million.

Immediate has employed at least 2,000 home health aides, including George Babuadze, Raisa Haypapetyan, Rima Petrosyan, Julieta Sephashvili, Elvira Bruce, Sahakanush Yuzbashyan, Miriam Schwinder, Vano Saralidze, Ketevan Saralidze and Hershl Schwartz, whose convictions for operating with phony certifications – announced last week – resulted from Operation Home Alone.

Medicaid requires home health care aides – who primarily care for elderly patients, administer medication, and provide services such as catheter care, colostomy care and wound care – to successfully complete a training program licensed by the Department of Health or the State Education Department. All aides must receive a minimum of 75 hours of training, including sixteen hours of supervised practical training conducted by a registered nurse and complete a written test conducted in English.

In addition to employing uncertified aides – and causing Medicaid to be billed for their work – Immediate Home Care recruited aides from training facilities where false certifications could simply be purchased, with little or no training provided. Two owners of such businesses – Mary Smalls, of Brooklyn-based Smalls Training and Counseling School and Laurette Escarment, of Queens-based On-Time Home Care Agency – have pleaded guilty to supplying hundreds of home health aides with false training certificates.

Some of the Immediate aides provided little or no care to patients at all, but would bill for their time – sometimes 24 hours in a single day – nonetheless, sometimes splitting the proceeds with their patients and with Singer and Rubenstein.
Further, Immediate Home Care caused Medicaid to be billed for aides who provided home care to their relatives. Under the Medicaid rules, services for close relatives, such as parents, spouses and in-laws, are not reimbursable, and for other relatives are only reimbursable under exceptional circumstances.

Singer and Rubinstein are due back in court for sentencing on Oct. 24.

Provisions establishing and regulating home health care in New York were set forth in Chapter 895 of the state laws of 1977. The aim was to create a “nursing home without walls,” reducing the costs associated with institutionalization and providing patients a greater level of comfort. Every month, more than 80,000 New Yorkers receive some sort of Medicaid-funded home health services – just over 54,000 of them live in New York City. In 2006, Medicaid spent nearly $1.3 billion on home health care. Because there is no centralized registry for home health aides, an accurate estimate of their numbers cannot be given.

Cuomo urged New Yorkers who suspect cases of Medicaid fraud to call the AG’s Medicaid Fraud Hotline, at 1-866-NYS-FIGHT (697-3444).

The investigation of fraud in the home health care industry, dubbed “Operation: Home Alone,” is ongoing

    OU Fresser said...
Aniyim need basic food but here's what the OU was busy with at the Prime Grill of Beverly Hills under the leadership of Dr. Rabbi Seth Mandel. As reported in the Jewish Fress newspaper:

At this 5 hour long evening fresser event you got to fress on blue marlin, shibuta, fleishig eggs, quail, partridge, pigeon, pheasant, Peking duck, sparrow, red deer, elk and yak. Dessert was faux locusts made of chocolate. At the last such fresser event, they had real locusts that they were going to get a Teimani to eat but he chickened out at the last minute and the OU came under criticism for having Levana's restaurant cook them in the first place.

Seth Mandel & company tried to get a giraffe to schecht for the fressers but they only found one that was available. It was old and with a price tag of $25,000.

The paper says that Drs. Zivotofsky & Greenspan came close to "hari kari" sakanna when trying to procure all this wild game fresserei. The newspaper misspelled hara kiri, besides picking a very modenna description. Japanese Samurai warriors would cut out their own bowels before falling into enemy hands.

The next day, the OU bused the fressers to Herzog wine cellars in Oxnard. On the third day the fressers were bused to a yogurt facility were Rabbi Aharon Shapiro explained the OU shita on cholov stam.

Consumer debt is at an all time high, as incomes stagnate. Retail sales are down (I don't care what the papers say) and consumer confidence is on the wane.

Add to that---the failed Iraqi war...general malaise of the populace--the Federal Reserve artificially pumping in money to a troubled cash poor banking system...a real 20% foreclosure rate in the sub-prime arena....and poof...1929 redux!

  73. There are several factors leading to a housing meltdown. Most people who bought a house in the last 5 years couldn't afford it and those properties will be back on the selling block soon. While some of them were swindled by crooks like the Pinters, most of them are just plain shmucks who were desperate to live if only for a short while in the house of their dreams. Others still have lost their jobs in the economic downturn. There are many, many variables that make it so the figures you see each month are not telling you the whole story. It is actually much worse than it actually seems. We know that UOJ doesn't pause for bubba meissas and I can tell you he mentioned this for good reason.

  74. Just picked this up off the wires

    By Pedro Nicolaci da Costa
Tue Aug 28, 2:57 PM ET

NEW YORK (Reuters) - Consumer sentiment took its sharpest plunge in nearly two years during August while home prices swooned in the second quarter, according to reports that show a heavy toll from the housing crisis.

As Wall Street was gripped by a credit squeeze, the Conference Board's index of confidence dropped nearly 7 points to 105.0, its lowest reading in a year.

For a country that relies on consumers for two-thirds of its spending, the figures suggested economic growth will remain subdued for the foreseeable future.

"My guess is we're heading for a consumer-led recession beginning in a few quarters," said Michael Metz, chief investment strategist at Oppenheimer & Co. "The consumption boom is over."

Most economists agree the housing downturn will put a serious damper on spending, but a majority still believe a recession can be avoided.

A report from S&P/Case-Shiller on Tuesday showed house prices across the nation declined by 3.2 percent in the second quarter compared with the same period last year. It was their worst decline in 20 years.

At the very least, though, falling prices appeared to be making home purchases more attractive. An index of home-buying intentions in the Conference Board's survey rose to their highest in a year.

    WORST DROP SINCE KATRINA

The confidence decline was the steepest since just after Hurricane Katrina devastated the Gulf Coast in 2005.

But the troubles dimming Americans' perceptions of the economy were man-made this time around.

The crisis that began in subprime mortgages -- loans made to high-risk borrowers -- has spread to other parts of the financial sector, crimping lending and stoking a generalized aversion to risk.

While stocks had since recovered the losses they suffered in August, the market was once again in turmoil on Tuesday as fears resurfaced that some key banks might have more exposure to the subprime mortgage sector than previously believed.

The Dow Jones industrial average was down more than 150 points at 13,164 in afternoon trade.

Worsening credit conditions were certainly getting attention from officials at the Federal Reserve. Minutes from the central bank's last meeting on August 7 showed it foresaw the need for a shift in policy if the situation deteriorated further.

Things have indeed gotten worse since then, and the Fed has responded by cutting the rate it charges to banks, known as the discount rate. It has also pumped more cash than usual into the banking system in an effort to revive lending.

Many believe it may have to cut benchmark interest rates to prevent the situation from getting out of control.

The two mild-mannered defendants – Bernard Fuchs, 22 years old, of 1639 45th Street, and Gershon Tannenbaum, 23, of 1537 41st Street, both in the Borough Park section – admitted that they had mailed brochures, pamphlets and other correspondence under the mythical name of Marlowe University in Mount Holly, N.J.

United States Attorney Robert A. Morse said that prospective students were bilked out of more than $200,000, having paid $400 to $500 apiece for baccalaureate, masters and doctorate degrees they never received.

“Marlowe University” never issued a diploma or conducted any courses and its administrators never intended it to, according to Emanuel A. Moore, an assistant United States attorney in charge of the Eastern District’s consumer protection division.

Postal inspectors said that the amount of the swindle probably would never be learned. A Federal warrant authorized a search of the Rabbinical Assembly Corporation, a Hebrew School at 1319 50th Street, Brooklyn, where the rabbis taught, but the search uncovered nothing.

The rabbis cleaned out all their own files at the school – including records of financial transactions – just before the search, a Postal Service spokesman explained. “The best we can do is to estimate the losses of their victims,” he said. “We learned that they made more than $2,500 in the three weeks preceding their arrest.”

Two Brooklyn rabbis who had withdrawn pleas of guilty to operating a bogus mail-order university again pleaded guilty in Federal Court in Brooklyn Friday and received suspended sentences and $250 fines.

The two, Bernard Fuchs, 22 years old, of 1639 45th Street and Gershon Tannenbaum, 23, of 1537 41st Street, admitted that they had collected $2,000 from prospective students who enrolled in the fictitious Marlowe University. Its only “campus” was a post office box in Mount Holly, N.J.

Judge George Rosling placed both men on one year’s probation and ordered them to repay the $2,000. An assistant United States attorney, Emanuel A. Moore, said that additional proceeds had been returned.

  83. Subprime inflicts new damage as banks seek cash By Mike Peacock
    56 minutes ago

LONDON (Reuters) - New evidence of damage wrought by the U.S. mortgage sector surfaced in the United States and Europe on Wednesday while banks demanded a record amount of cash at a euro zone money market auction.

Cheyne Finance Plc, a structured investment vehicle (SIV) managed by British hedge fund Cheyne Capital Management, said it was seeking to restructure after being forced to start selling assets to pay down debt.

Standard & Poor's downgraded Cheyne Finance sharply. Just two weeks ago, the agency said ratings on SIVs -- including the Cheyne vehicles -- were weathering turmoil caused by defaults on U.S. subprime mortgage lending mainly to poor people.

    Subprime Mortgage Woes Spreading

Subprime Mortgage Crisis Spreading to High-End Housing Market

NEW YORK (AP) -- The subprime mortgage crisis is spreading to a somewhat unexpected place: homes costing more than $500,000.
As lending has rapidly gotten more restrictive for borrowers taking out large loans, sales of expensive homes have fallen sharply around the country during what should be one of the busiest seasons for buyers and sellers, mortgage bankers and real estate agents say.

To some degree the change is due to difficulty getting financing, as borrowers are finding fewer lenders willing or able to fund "jumbo" mortgages, loans for amounts greater than $417,000. Such loans are too big to be guaranteed by government-sponsored housing finance agencies Fannie Mae, Freddie Mac or Ginnie Mae.

Given the troubles in the subprime sector, investor appetite for all types of mortgage loans not guaranteed by housing finance agencies has nose-dived.

Banks until recently were able to offload the risk of many jumbo mortgages by selling the loans to investors. But now, as investors burned by the subprime debacle have become extremely picky about what they will buy, banks are having to keep more of these loans on their own books and as a result are charging higher rates.

Some lenders -- such as Countrywide Financial Corp. -- have made a point of saying they're now most focused on making loans that can be guaranteed by Fannie and Freddie.

Other lenders have simply tightened up their lending standards, for example by no longer making jumbo loans to lenders who can't fully document their income, even if they make large down payments and have stellar credit histories.

The banks that are still making jumbo loans are charging substantially higher rates to compensate for the lack of investor demand. Borrowers who could have gotten rates as low as 6.5 percent in June are now having to pay as much as 9 percent.

But aside from the financial impact of higher rates, in certain high-priced real estate markets, the effect of the suddenly tighter lending environment is more psychological, mortgage bankers and real estate agents say, as buyers and sellers alike don't want to plunge into an uncertain future.

"Showings are down, contracts written are down, and sellers are just as backed away as buyers are," said Lou Barnes, a partner in mortgage bank and brokerage Boulder West Financial Services in Boulder, Colo. The company arranges for financing on many higher-priced condominiums and houses in the state.

"I think the psychological damage is worse than the financial damage" which is already bad enough, he said. Even for buyers who have plenty of cash or can easily afford higher mortgage rates, the sudden change in the financing environment reduces "the ardor to buy a house unless you have to," he adds.

With numerous buyers and sellers sidelined, the higher cost of big mortgages is bound to put downward pressure on home prices should the lending environment stay tight for a long period of time, said Ellen Bitton, president of Park Avenue Mortgage, a mortgage bank and brokerage that does business in several states, including New York, Florida and Utah.

In New York, the most pronounced effect so far has been at the very top end of the market, for properties priced $25 million and above, said Dolly Lenz, vice chairman with Prudential Douglas Elliman.

"Every single person I have at the highest end is on hold. They're going to wait and see what happens," she said. "It has nothing to do with them being able to afford" properties or not, Lenz added. "It's a confidence thing. They somehow feel poorer, whether they are or not."

In California, where the median home price is well above $500,000, jumbo mortgages are as much as 44 percent of all mortgages issued in certain metro areas, according to data from First American LoanPerformance.

In and around San Francisco, where the median home price is about $1.1 million, the tougher financing environment has created a "hesitancy" and has led to some canceled escrows for buyers around the $1 million range, said Rick Turley, president of the San Francisco and Peninsula Region for Coldwell Banker Residential Brokerage.

    Fed: Don't panic.
We're here Bernanke & Co. didn't appear too worried about the credit crunch at their Aug. 7 meeting but said they were ready to cut rates, if needed.
By Paul R. La Monica, CNNMoney.com editor at large

NEW YORK (CNNMoney.com) -- When the Federal Reserve met on Aug. 7 and decided to leave a key interest rate alone, the central bank didn't appear overly concerned that problems in the subprime mortgage market would have a major impact on the broader economy, according to minutes of the meeting released Tuesday.

"Credit conditions for investment-grade businesses and prime households were relatively little affected by the market turbulence," the Fed noted in the minutes, adding that it "saw moderate economic expansion in coming quarters."

Of course, the Fed changed its tune a bit just 10 days later, as the credit crisis deepened. The Fed, on Aug. 17, cut the rate it charges banks for loans by half a percentage point, citing financial markets that had "deteriorated" as well as "tighter credit conditions and increased uncertainty." The so-called discount rate is a less powerful lever than the central bank's fed funds rate, which affects rates on many consumer loans and so far remains untouched.

    Read the August 7 minutes
But the Fed also acknowledged in the minutes from the Aug. 7 meeting that it might be forced to cut rates.

"The recent strains in financial markets posed additional downside risks to economic growth. Members expected a return to more normal market conditions, but recognized that the process likely would take some time, particularly in markets related to subprime mortgages," the Fed said.

"However, a further deterioration in financial conditions could not be ruled out and, to the extent such a development could have an adverse effect on growth prospects, might require a policy response. Policymakers would need to watch the situation carefully," the Fed continued.

With all that in mind, what's the most likely next move for the Fed?

Some have argued that the cut to the discount rate, combined with an injection of billions of dollars of cash into the banking system in recent weeks, have helped to stabilize financial markets.

That said, most investors still expect the central bank to cut the fed funds rate when it next meets on Sept. 18. The fed funds rate is an overnight bank-to-bank lending rate that affects rates on credit cards, home equity lines of credit and other consumer loans.

"My guess is that there will be increased pressure on the Fed to cut rates but it sounds like they may be reluctant to do that," said Phil Dow, director of equity strategy with RBC Dain Rauscher in Minneapolis. "But if credit problems prevail for some time, there is no question it will impact the economy."

    Crunch time for bloodied banks
The Fed has held the fed funds rate steady at 5.25 percent for its past nine meetings. But according to fed funds futures traded on the Chicago Board of Trade, investors are betting that a quarter-point rate cut is all but certain at the Sept. 18 meeting. What's more, investors are pricing in the strong likelihood of a second quarter-point cut before the end of the year.

Stocks, which were trading sharply lower before the minutes were released, fell further after they came out. The Dow wound up falling more than 280 points, or 2.1 percent, while the Nasdaq and S&P 500 each declined by about 2.4 percent.

Chris Probyn, chief economist with State Street Global Advisors in Boston, said the market might have surged based on what was in the Fed minutes, particularly the language about a possible "policy response," if the Fed had not already cut the discount rate. In other words, the minutes are kind of old news in light of the discount rate cut.

"Had it not been for the new policy statement issued on Aug. 17, which kind of makes this ancient history, this would have caused a stir. The market would have reacted more positively," Probyn said.

Nonetheless, Probyn thinks the Fed will cut rates at both its September and October meetings. In fact, Probyn said he would not be surprised if the Fed cut rates by a half of a percentage point in September in order to reassure Wall Street.

James Glassman, a senior economist with J.P. Morgan Chase, also said the Fed might need to cut rates more aggressively.

"I think the issue now is not a rate adjustment but what's the style and how many. This is a historic event and it may require a forcible response by the Fed," Glassman said.

Fed bends rules to help two big banks
Another economist said that investors might be disappointed by the minutes since they showed that the Fed did not truly understand how drastic credit problems were.

"The committee misjudged the severity of the financial storm that they were in the middle of. They saw signs of distress but not to the degree that has transpired," said Mark Zandi, chief economist Moody's Economy.com.

As such, Zandi predicted the markets probably won't regain confidence in the Fed until it cuts the fed funds rate, even though he thinks the Fed made the right move cutting the discount rate.

"The Fed has acted appropriately since the Aug. 7 meeting and they have proven since then that they do understand the problem. But investors won't feel good until we get a rate cut," he said.

Glassman agreed that even though the market is already widely banking on a rate cut, investors are not going to be satisfied until it actually happens.

"Days like today are a reminder that every time you think things are settled down, they are not. The markets not going to be able to settle down until investors understand where the Fed is heading," he said.

But even a rate cut might not be enough to soothe investors. The Conference Board reported Tuesday that its consumer confidence index posted its biggest monthly drop in nearly two years.

What's more, another report released Tuesday showed that housing prices nationwide dipped more than 3 percent in the second quarter from a year ago.

"The signal from stocks is that maybe the economy is going to slow down," said Steve Van Order, chief fixed income strategist with Calvert Funds in Bethesda, Md. "The markets could be concerned that a rate cut may be too little too late. The market is certainly sending a message that it is very worried right now."

Woman who claims cleric pressured her into a sexual relationship wants $1.3M in compensation

    August 29, 2007

    Sandro Contenta
    Staff reporter

A woman claiming she was coerced into a sexual relationship by a rabbi is suing the rabbi and a prominent Toronto synagogue for $1.3 million.

Richmond Hill resident Yona Nadler, 52, is suing Rabbi Tobias Gabriel and the Beth Tzedec Synagogue for breach of fiduciary duty and the pain and suffering she claims the relationship caused her and her marriage.

The lawsuit highlights an issue that has pushed some religious institutions into writing codes of conduct that govern relationships between clergy and members of their congregations.

Nadler's position is the rabbi abused the trust of a deeply religious woman, according to her lawyer Simona Jellinek.

Gabriel responded to a Toronto Star request for an interview by calling the allegations "groundless" and refusing further comment. His lawyer, Alf Kwinter, stressed none of the allegations have been proven in court. "He's going to vigorously defend this lawsuit," he added.

Kwinter described Gabriel's 13 years of service at the synagogue as "outstanding" and "exemplary." Beth Tzedec's website describes Gabriel as happily married.

The incident rocked the congregation Monday when a letter was sent to the synagogue's 6,000 members, three days after the Toronto Star made repeated requests to Beth Tzedec authorities for comment.

"Unfortunately, there is little doubt that the impropriety occurred," wrote Shep Gangbar, president of the Beth Tzedec Congregation, who called the situation "distressing."

While the synagogue "strongly affirms that such actions are improper and wrong," it is not legally liable for the actions of Gabriel, the letter states. "Beth Tzedec has never condoned or tolerated such behaviour and will never do so."

Beth Tzedec is prepared to provide financial compensation to Nadler, the synagogue's lawyer, Michael Royce, said yesterday.

Gabriel, who was hired as a cantor by Beth Tzedec, has accepted an agreement with the synagogue that will see him resign at the end of the year, Kwinter said. He will be paid until then, he added.

Gabriel, who is not the synagogue's chief rabbi, has been suspended and will no longer work at Beth Tzedec, Royce said.

This week, representatives of the New York-based Rabbinical Association, of which Gabriel was a member when the incidents are said to have occurred, will come to the synagogue to investigate the claims. The group runs the cantor classes Gabriel taught in the synagogue.

Beth Tzedec, in the affluent Forest Hill neighbourhood, practises the Conservative stream of Judaism. One of the country's largest synagogues, it was recently the site of Ed Mirvish's funeral.

In July 2006, Nadler was the only female in Gabriel's class for student cantors at the Bathurst St. synagogue when Gabriel became "friendly and flirtatious," according to a statement of claim filed by Nadler and her husband, Samuel, at Ontario's Superior Court last month.

Gabriel kissed Nadler in his office at the end of the course after she gave him "a small token of appreciation," the statement alleges. She "fled" the office "confused and shaken," the statement adds.

Gabriel then called her repeatedly while she vacationed in Israel, the statement alleges. It claims he "pressured" her into seeing him when she returned.

When they met, "Rabbi Gabriel began to kiss Yona and told her that he will take responsibility and that it would not be wrong to be intimate with him," the statement claims. He told Nadler "it is acceptable that she love two men," it alleges. The claim also alleges the relationship progressed to sexual intercourse.

"Did he use violence and rape her? No, he did not," Jellinek said. Nadler's husband, who learned of the relationship last September, is claiming $100,000 for the damage it caused to his marriage.

The claim alleges the synagogue knew that Gabriel "had previously engaged in sexual relations with another married woman who was attending the Beth Tzedec Synagogue while she was grieving the loss of one of her parents."

The statement of claim says Nadler relied on Gabriel as "an authority figure to give advice to her, to guide her and to protect her from harm."

"Gabriel knew or ought to have known that Yona would follow his instructions without resistance," it says. "Gabriel knew or ought to have known that he had Yona's absolute trust in all regards and that she would obey Gabriel's instructions and follow his advice in all matters."

Nadler refused to comment when contacted by the Star. Her husband, Samuel, said: "There's been incredible grief and publicity would only cause more."

The experience continues to cause Nadler "physical and mental stress," including "inability to trust others ... suicidal behaviour ... sexual dysfunction ... (and) marital discord and breakdown," the statement of claim says. It calls the alleged incident a "sexual assault."

The synagogue does not have a written policy governing conduct between employees and members of the congregation. But the New York-based Rabbinical Association strictly forbids sexual relationships, Royce said.

Kwinter accused Beth Tzedec of convicting Gabriel although none of the allegations have been proven.

"We're not talking about young children. ... Nothing here is alleged to be illegal," Kwinter said. "The allegations are being made against adults."

Rabbi Michal Shekel, executive director of the Toronto Board of Rabbis, would not comment on the case but noted that adultery contravenes one of the Ten Commandments.

More modern concerns about the power a cleric may have over a member of the congregation, particularly one seeking counselling, has resulted in different branches of Judaism – Reform, Conservative and Orthodox – writing codes of conduct, Shekel said.

In the United States, windows are being added to rabbis' offices when old synagogues are redesigned. It allows for privacy while ensuring that others can witness the meeting, Shekel added.

In a teacher-student relationship, concerns are similar to those in universities, where a teacher has power over whether a student makes the grade, Shekel said.

In the Anglican church, it used to be common for a young cleric to fall in love with, or marry, a parishioner, said Archdeacon Peter Fenty, executive assistant to the Anglican Bishop of Toronto.

But recent reforms, including a "Sexual Misconduct Policy" for staff and volunteers adopted by the General Synod in 2005, resulted in the Toronto diocese banning romantic relationships between a cleric and a parishioner, Fenty said.

When that happens, the parishioner is asked to seek another parish. It avoids embroiling the parish into conflict that may arise if the relationship breaks down, and preserves the integrity of the pastoral relationship, Fenty added.

"When are you the person's priest and when are you the person's lover? It is in the interest of the cleric, the parishioner and the church community that there be clarity," Fenty said.

Rabbi Reuven Tradburks, president of the Toronto-based Council of Orthodox Rabbis, said his Judaic movement prohibits any man or woman being alone together in a room unless they're married or closely related.

Single rabbis are permitted to date and marry members of their congregations but sex is the reserve of married couples, Tradburks added.

People who go to rabbis for wisdom and guidance have a right to expect high ethical and moral standards from representatives of the Torah, Tradburks said.

"People will say, `Well, if a rabbi can behave that way, who needs the whole religion; it must not be worth much if he can act like that,'" he said.

"I'm a person like anyone else and I have my failings, but that's an expectation people have a right to make: a rabbi should do things differently," he added.

Otisville — On behalf of federal prison inmates across the country, Moshe Milstein is hoping to make a federal case over Maimonides, the Rev. Rick Warren and other spiritual scribes.

Milstein and another inmate at the Otisville Federal Prison Camp last week filed a class-action federal lawsuit against the U.S. Bureau of Prisons. They contend that the feds violated inmates' constitutional rights of religious freedom and due process by restricting access to religious books.

Milstein, 61, was released from Otisville to a halfway house yesterday after serving a sentence for fraud involving mislabeled prescription drugs.

One of his lawyers, Moses Silverman of New York City, said that Milstein isn't looking for a payday. He's going to court because the Bureau of Prisons enacted a policy earlier this year that limits the number of religious books for each faith available in prison chapels.

"This is not a suit for damages. It's a suit to deal with what we consider the important issue of access to religious freedom and access to religious materials in prison," Silverman said.

Milstein, an Orthodox Jew, is one of two Otisville inmates suing. The other, John J. Okon, is a Christian. They sued over the book policy earlier this year but dropped it after a judge urged them to go through the prison's administrative process.

The lawsuit describes that effort as a bureaucratic dead end. So Milstein and Okon went back to court.

A Bureau of Prisons spokeswoman couldn't be reached yesterday, but the agency's position was outlined earlier this summer by a federal prosecutor after the three inmates first sued.

The prosecutor, Briand Feldman, told the judge that the dispute grew out of a 2004 Department of Justice review of how prisons choose the providers of Muslim religious services.

Feldman told the judge that the Justice Department review was done because of concern that prisons "had been radicalized by inmates who were practicing or espousing various extreme forms of religion, specifically Islam, which exposed security risks to the prisons and beyond the prisons to the public at large."

Silverman says the feds haven't explained why Warren's "The Purpose-Driven Life" or books by the 12th-century Jewish sage Maimonides are security problems.

"Frankly, I think the Bureau of Prisons policy here is incomprehensible," Silverman said. "I would think people of all political persuasions, from the right to the left, the left to the right, would agree that having people have access to religious literature would be a good thing."

August 29, 2007 -- Daddy got his gun - now Junior's got one, too.

Donald Trump Jr. joined his famous father among the ranks of pistol packers this year after the NYPD issued him a permit to keep a handgun at his home.

Trump Jr. recently made front-page news for his ugly legal battle with a rebel band of co-op owners who ousted him from the board of his dad's high-rise at 220 Riverside Blvd.

Also joining the gun-toting list this year was new Westchester DA Janet DiFiore. She and Queens DA Richard Brown are the only local district attorneys who pack heat.

But a few notable gunslingers no longer have licenses.

"""They include Seagram's scion Edgar Bronfman Sr.""" and former NYPD Commissioner Howard Safir, both of whom let their licenses lapse.

Joining the Trumps in the celebrity gun club are tough-guy actors - and longtime gun licensees - Robert De Niro and Harvey Keitel; film producer Martin Bregman; cosmetics heir Ronald Lauder, music czar Tommy Mottola and Marvel Comics CEO Isaac Perlmutter.

Shock jocks Howard Stern and the disgraced Don Imus are also members of the gun club, as are lawyers Barry Slotnick and Raoul Felder.

Wealthy publisher Robert Forbes, Republican Senate Majority Leader Joe Bruno and cabby activist Fernando Mateo have also retained their gun licenses.

TV news anchor John Roland, who let his license lapse last year, got his gun permit back in 2007.

Overall, the number of registered gun owners is down again this year.

Licenses dipped to 36,169 this year from more than 38,000 last year.

The number of premise licenses, which allow the user to keep a gun at a home or office, also went down - to 14,985 from 15,012 last year.

Carry permits, which let the holder strap on a gun, dropped to 2,516 this year from 2,555 last year.

The dip in the number of registered gun owners comes in the midst of a crackdown on guns by Mayor Bloomberg, who has bankrolled TV ads critical of gun lobbyists.

He even sued out-of-state gun stores for illegal sales of weapons.

The NYPD has the final say in approving gun-permit applications and can revoke an existing license or deny an application for any reason.

The privately held King City, California-based company and a spokesman from the U.S. Food and Drug Administration said there have been no reports of illness or problems related to the spinach.

The products were distributed in the continental United States and Canada under the Metz Fresh label. Recalled packages include 10-ounce and 16-ounce bags, as well as 2.5 and 4 pound bags shipped in cartons.

It is requested that a comprehensive probe be instituted into Ohel Family Services on a number of counts.

A through probe as to whether Ohel is warehousing mentally ill patients in halfway houses, drugging them up and not providing proper rehabilitation services. A through probe into Ohel family services handling of foster children, the relationship between Ohel and the foster parents. Are foster parents chosen by how much money they donate to Ohel. Are there cozy relationships between Ohel personnel and the foster parents. What is the relationship between Ohel and the social workers, counselors and therapists that Ohel employees. A through probe into Ohel Family services counseling services. Are the clients for which Ohel requests funding eligible to receive the services or does Ohel have its social workers file sham reports about its clients with false information so that Ohel can receive more money from the state and the city. Ohels reports scrutinized to insure that no false information is being reported. Are the social workers qualified to be hired by Ohel or are they in cozy relationships.
Anyone that has anything to add to this probe should post it and it will be taken into consideration.

  127. As noted previously, I notified the editor of the Jewish Press, Jason Maoz, of Rabbi Gershon Tannenbaum's plagiarism on Thursday 8-23-07. I sent an urgent email and followed up several hours later with a phone message. I emailed and called this week, as well, all with no response – until noon Wednesday.

Jason Maoz answered my email and explained the error Rabbi Tannenbaum made. In the process of explaining, it became clear Maoz was under the (incorrect) impression that Rabbi Tannenbaum had been working with the article's actual author, Dorothy Shapiro, even before the first column appeared.

I asked him again for a statement. After an exchange of emails, he gave one:

"We removed last week's Machberes oolumn from our website pending
clarification. Dorothy Shapiro told us that Tannenbaum had spoken with her
while he was working on the followup column that appears this week, adding
that she had no problem with his use of her material, though she would
have preferred being credited in last week's column. In this week's issue
Tannenbaum gives her that credit, and we also put an editor's note on top
of the column expressing regret at Tannenbaum's failure to credit her last
week. In addition, we restored last week's column to our website along
with an editor's note concerning Mrs. Shapiro's authorship. Tannenbaum has
been told in very strong terms that in the future he must be more careful
and precise in crediting any original sources."

I told him (before the statement above was written) that Rabbi Tannenbaum had not been working with Dorothy Shapiro before his first column – the one he stole from her – was printed. He first contacted her only after the Jewish Press was informed of the theft.

Rabbi Tannenbaum's excuse? He thought she had passed away.

Even so, Rabbi Tannenbaum did not attempt to contact the Catskills Institute, the publisher of that article or the family of Dorothy Shapiro – he simply stole the column from a supposedly dead woman and printed it as his own.

How do I know this? I spent a long time on the phone with Mrs. Shapiro, a kind, gentle woman who was willing to overlook the theft. I also contacted the head of the Catskills Institute who told me he had not been contacted by Rabbi Tannenbaum or the Jewish Press.

Jason Maoz says he did not contact the Catskills Institute because Dorothy Shapiro told him she owns the rights to the article. This is fine and, as far as I know, true. Still, one would think the Catskills Institute should have been contacted as a courtesy, if not to investigate further.

In the end, both Dorothy Shapiro and the Catskills Institute got some well deserved publicity, so in this respect, the affair worked out well for them.

But this does not and should not let Rabbi Tannenbaum off the hook:

Rabbi Tannenbaum had no contact with Dorothy Shapiro until after his theft was exposed.
Rabbi Tannenbaum is not a first time offender. He has a 30-year-record of fraud and theft including at least one (but I believe, two) criminal conviction(s), and an SEC record of violations. In other words, Rabbi Tannenbaum is no stranger to stealing.
Rabbi Tannenbaum should not be a leader of a rabbinic organization. But, sadly, he remains the director of the Rabbinical Alliance of America (Igud HaRabbonim), despite his crimes.

Rabbi Tannenbaum should not hold any public position in the Jewish community. Yet he 'pens' a weekly column for the Jewish Press, the largest independent Jewish weekly in America.

Both the Rabbinical Alliance of America and the Jewish Press are Orthodox Jewish organizations. By allowing Rabbi Tannenbaum to retain his positions without penalty, the Jewish Press and the RAA send a very negative message, a message that is received and understood by Jewish children, as well as by Jewish adults – theft, fraud and stealing are not disqualifications for Jewish leadership.

I do not believe either organization wants to send this message. But every day Rabbi Gershon Tannenbaum remains in their employ, it is that very message they both send.

I've been doing a lot of research. At this point it would be a huge problem if there was all of a sudden no Rubashkin. The other producers cannot make up the difference. Even now, Alle is struggling to meet demand from their customers and cannot always fill orders.

I wish I could just close down Rubashkin but there has to be a plan. Askonim have to help the others ramp up their production.

It could happen that the govt will close Rubashkin on their own. If that happened tomorrow, there would be a huge shortage of meat. Only the super rich could afford to put flanken in their cholent if they could even find any.

This is similar to those fed up with cover ups at the OU. If you close the OU, the entire backbone of industrial kashrus will be paralyzed.

Business fraud up 30% in 2007

70% of the cases of fraud took place before the holiday season.

    Globes correspondent 30 Aug 07

There has been a sharp 30% rise in the number of incidences of business fraud to more than 350, costing companies a total NIS 180 million says a report by Business Data Israel (BDI). 70% of these took place in the run-up to the Passover and New Year holiday season.

BDI says that the number of incidences of fraud in the weeks immediately before the Jewish New Year holiday, rose to around 15-20 a week, compared with three or four incidences a week, during regular periods. BDI attributes the increase to fraudsters' ability to dispose of the merchandise they have stolen quickly and get cash for it because of higher spending by consumers in the run up to the holidays, and poor supervision by suppliers under pressure from peak sales.

BDI says the incidences of fraud affect suppliers in various economic sectors. Fraudsters buy merchandise in bulk on credit, often making an initial payment in cash to win suppliers' confidence, and then vanish after carrying out a number of deals on credit, leaving heavy debts behind them.

The food and consumer products sector had the highest proportion of the total number of fraud incidences at 14%, followed by the telecommunications sector with 12%, home products - 11%, office equipment - 10%, and recreation and holiday services - 9%.

  147. Was anyone here at the big meeting last night in Queens?

For those of you unaware of what's going on, a Reform cong., due to a merger, was selling to a fanatical mosque. The alarm bells were sounded and money is being raised in almost every kehillah in Eastern Queens to keep it in Jewish hands. The mosque was going to plunk down $4 million which was matched by the Tribe. Hamas then donated another $4 million to outbid us. Many people are angry because they feel the Reform might be extorting the Orthodox and that any other putz can come along and say, hey I'm selling to the Arabs for $10 million. Give me the money.

It's the Lubob representative who will be given millions on a silver platter by mostly Modern Orthodox families, with a few yeshivish and chasidish types joining in, to build a community center.

A rabbi tells me that the Lubob told the committee recently something along the lines of, yeah, I know you guys don't like us Lubobs very much, but if you're giving me the building I'll take it.

Years ago, a chinese takeout restraunt in West Hempstead called Wing Wan turned Kosher. A smaLL gLATT MEAT SUPPLIER WAS SELLING THEM. (SORRY ABOUT THE CAPS). Three guys with big beards came in and said that if they wanted a lot of business, they would have to buy from Rubashkin. Otherwise, it would not be 'kosher' enough for the religous Jews.

The chinese owner, afaid that he would loose customers, bought everything from Rubashkin. A few months later, I asked the owner if any of those people ever came in. He said no, just the local people in West Hempstead. The owner felt stupid for falling for a stupid trick, while stopping business from a local supplier.

The way to close down Rubashkin to to stop buying from them. I called to book a large party for Sheva Berachos a few months ago. I called back a day later and asked if they used Rubashkin. They said yes. I politely said that some people will not eat Rubashkin and I would have to book elsewhere.

Restraunts in Lakewood now have to put up signs that they buy Rubashkin meat.

The answer - call up your local butcher or restaraunt and tell them that you do not eat Rubashkin. Slowly, it might work.

Anyone else have any other suggestions?

Alle and others need to be contacted and have contigency plans put in place to increase production capacity. The first step is to see to it that they can meet all their CURRENT demand which they do not.

    By Vicki Polin
    The Awareness Center, Inc.
    August 30, 2007

Something good can come out of a horrendous criminal act. The hope of The Awareness Center is that by reading about "Our Precious Children," other communities will also be inspired to create a program like this.

Recently the case of David Kramer broke in the St. Louis Jewish community. He was originally arrested and charged with exposing himself to a little boy in his apartment. At the time Kramer was a volunteer youth leader at Nusach Hari B'Nai Zion Synagogue (St. Louis, MO). Since then another arrest warrant was issued for David Kramer, this time the charges include sodomy.

Unfortunately, as in many communities there was a large group who rallied behind the alleged offender -- raising money to pay his bond and to help his family. Unfortunately, like in most communities there was very little support for the child survivor or the family. That is until a small group of people got together and started brainstorming.

The group was were outraged at what they saw was happening and wanted to make a difference. The answer they came up with was creating "Our Precious Children," a new organization and fund to help local children in the Jewish community.

"Our Precious Children" is sort of similar to the "Make A Wish Foundation" only this one is for Jewish sexually abuse children. Their primary goal is to help meet some of the financial needs sexually abused children and their family members in the St. Louis community. This includes helping to cover the costs of rape counseling or small things such as purchasing an IPOD for the child.

To learn more about them go to: http://ourpreciouschildren.com/

FYI: Rabbi Ze'ev Smason is an orthodox rabbi who understands the issues of survivors of sexual violence (child sexual abuse/assault). If you are a survivor living in the St. Louis area and would like to talk to a rabbi, he's a great choice. He can be reached at: 314-991-2100 or via e-mail: Pepshort613@ sbcglobal.net

  158. Singer Sued By Bronfman And WJC

    JTA Wire Service

    AUGUST 24, 2007 New York
The World Jewish Congress and its former president, Edgar Bronfman, each have filed a lawsuit against the organization's former top professional, Rabbi Israel Singer, according to multiple sources. The sources said that the separate suits were filed in recent days in the Supreme Court of New York County, but county officials could not be reached for confirmation.

One, filed by Bronfman, alleges that Singer did not pay back more than $500,000 in personal loans stemming from a 2004 investigation by the New York State Attorney General into the WJC's finances. As a result of that investigation, which found that Singer and others acted improperly, but not illegaly, with WJC funds, Singer was required to pay back more than $300,000 to the organization. He remained employed by the WJC until earlier this year, when he was abruptly fired by Bronfman over alleged financial improprities.

Singer, who steadfastly denied all the allegations, sent an e-mail dismissing the filings as "nuisance suits" that are "completely without merit." He described them as "a foolish and angry parting shot" from the WJC's outgoing secretary-general, Stephen Herbits.

According to sources, Bronfman loaned money to Singer to pay back the WJC and to pay for legal expenses relating to the attorney general's investigation. The suit, sources said, claims that Singer never paid back Bronfman. The WJC filed a separate, smaller suit against Singer involving expenses, according to sources close to Bronfman and the WJC.

  161. YATED NE'EMAN?

    ANALYSIS OF THE PARADOX PIECE

    Dear Editor,

Thank you for training your editorial lens on the brouhahagenerated by the Orthodox Paradox? article featured in the New York Times Sunday Magazine. Its an item that would have escaped my attention entirely (especially since the Yated long ago replaced the New York Times in our home), yet it has much food for thought in terms of hashkafa. Your editorial, ?Blinded?, rightfully touched on a part of that hashkafa thinking. But Yonason Rosenblum?s response two weeks ago left me more than a little disappointed. It didn?t just miss the mark; it created an impression that, how shall we say it, was not a Kiddush Hashem.
    Let me explain.

The New York Times article, of course, was a travesty by any measure. It was replete with specious reasoning and, above all, a shocking display of hubris, impudence and insolence, all wrapped in one. To expect acceptance by the Orthodox community while flaunting a demonstration of the most basic disregard for what everyone understands as a core value is unmitigated gall.

So what should the response be?

As far as I can see, there could have been one of three.

    A) An exposition on the hollowness of Modern Orthodoxy. This is where that road leads, you could have pointed out, buttressing the point with the story of what Rav Elchonon Wasserman told Rabbi Dov Revel, when he (Rav Elchonon) visited America in the late thirties. Before he left, he gave his recommendations for improvement to the heads of the respective yeshivos he visited. When Rabbi Revel asked, ?And what do you recommend for our yeshiva?? Rav Elchonon said, ?Nothing. Just change your name from Yeshivas Rabbi Yitzchok Elchonon to Yeshivas Rabbi Moshe Mendelsohn?? He then proceeded to detail to a visibly shocked Rabbi Revel how his yeshiva will ultimately lead down the road traveled by the father figure of Reform. Bringing a shiksa to your yeshiva and wanting to be part of the picture, literally and figuratively, is a demonstration of what Rav Elchonon foresaw seventy years ago. In short, it is a lesson on the fallacy of Modern Orthodoxy?s duality.

    B) An exposition on the audacity of the author. Knowing full well that marrying out of the faith was considered the cardinal sin for even the most unobservant Jew throughout the generations, he expects us to believe that he is applying the principles of Modern Orthodoxy and just taking them a step further. In short, he simply ignored the obvious: Even Modern Orthodoxy has a basic commitment to halacha, and marrying a shiksa is, after all is said and done, a clear violation of the corpus of law known as halacha.
Alternatively, you could have extracted a more positive point from the author?s attitude. As Rav Levi Yitzchok of Berdichiv might have said, ?You see, Ribono Shel Olam, even someone who marries a shiksa still can?t stand being cut out of the picture.? It?s clear that the author is, for all his smooth writing, a troubled soul. To some extent, that?s what you, dear editor, did the previous week - point out the fallacy in the author?s character which led him to write his piece. (Okay, so you?re not the Berditichiver, but it?s the same coin, just the other side.)

    C) Address the issue. That is, explain why we Yidden don?t marry a goy. It?s not out of prejudice that we feel we are special and chosen. It is our mission that?s special... In fact, any goy, black or white, oriental or Caucasian, who is willing to share our mission, is as special as we are. We are the least prejudiced among people in terms of race or background. But to build your life and establish your posterity with someone who doesn?t share that mission is reneging on the promise made by our forebears at Mt. Sinai. Deep stuff, maybe, but sometimes necessary to say. I know you could have done it if you tried.

Instead, what does Yonason Rosenblum tell us? Oh, this is all a sham. They never really cut him out of the picture on the basis of principle. You know why Noah Feldman and his Korean American friend didn?t make it to the Maimonides Hebrew Day School newsletter? The lens just wasn?t wide enough. Proof? Sixteen other Maimonides alumni met the same fate. And this, Rabbi Rosenblum proceeds to tell us, just shows how prejudiced the Times is and always has been. He continues on to speculate how this shows that they?re concerned about the emerging strength of Orthodoxy and are looking to discredit us out of fear or jealousy.

Come again, Rabbi Rosenblum. They really didn?t cut out Mr. Feldman and his goyata? You leave the impression that we Orthodox wouldn?t want to cut him out of a yeshiva class picture. After all, that?s not nice.

Huh? He posed with his non-Jewish female friend and he deserves to stay in the picture? If there was one positive feature in the whole story, it was that even Modern Orthodoxy has values and when push comes to shove, they will opt for Orthodoxy over Modern. And Yonason Rosenblum even took that out of the picture (pardon the metaphor).
Readers of the Yated deserve better. They deserve to be told the truth.

Maybe they didn't have the sophistication to write erudite bullshit painting themselves as true victims, but thhis business of intermarriage is not confined to the modern orthodox. of course all the right wing slogan shouters have jumped on this aberration as an example of what happens to Modern Orthodox . Bullshit. It happens across the board. Even ignorant, illiterate chassidim sommetimes snare themselves a shiksa, and not just in the bais zona.

Once again, a perversion of the halacha of Pidyon Shvuyim. Setting a sexual predator free so that he can attack again, while his victims suffer in anguish. When will the true rabbis speak up and explain that there is no Pidyon Shvuyim for rodfim? It is a contradiction within itself.

When the KCL (Lakewood Vaad Hakashrus) sent a Rabbi Shochet to Rubashkin, little did he realize that they made changes when he was there the few hours (there are videos to prove it).

The Lakewood kashrus Org & their Rabbinical etc should really be ashamed of themselves for allowing any Rubashkin any place. "children at risk" is a big "ach'reius". (Seforim say that neveilos & treifos cause it)

And the next one they fooled pretty easy is Zeev Rothchild from the NPGS Supermarkets in Lakewood. He thinks by "shtuppen" the yungerleit & their families with the "chaz'erei" he'll be able to cover his deficit on the Jackson supermarket.

The Westgate supermarket is going to be the next Rubashkin "chaz'erei" to feed the gullible.

The Westgate supermarket is owned partially by Rabbi Gornish's son.

Rabbi Gornish requires kashering if a caterrer used any Rubashkin,

There is no difference (all these are Rubashkin labels) if it's Supreme, Shor-Habor, KAJ, Arons, Zeilingold, Kesser etc THERE IS NO TRACEABILITY OF PRODUCT. All of it is only a label.

I have a box of labels (all hashgochas) that fell off a Rubashkin truck. The "goy' or the yid put on any label the caterer, butcher wants.
