Brooklyn District Attorney Charles Hynes wants a rabbi who fled to Israel 23 years ago after allegedly molesting four boys, extradited back to New York.
Hynes' request to the U.S. Justice Department that Rabbi Avrohom Mondrowitz face justice has been forwarded to the Israeli Ministry of Justice. Mondrowitz, a onetime popular child psychologist in Brooklyn's Borough Park, was indicted in February 1985 on charges of sexually abusing four boys, months after he fled.
Former Brooklyn District Attorney Elizabeth Holtzman tried for years to extradite Mondrowitz, but Hynes had resisted. Critics charged Hynes was afraid of offending the powerful Orthodox Jewish voting bloc and only changed his mind because of a change in the community's attitude toward pedophilia. His spokesman, Jerry Schmetterer, denied the allegation.
"That had no impact on our decision at all," he said, saying an amendment to the extradition treaty allowed Hynes to act.
Hynes' decision has brought some relief to the alleged victims, including a rabbi who told Hynes that Mondrowitz, a neighbor and father of his friends, had molested him at the age of 11 in the late 1970s.
Mondrowitz declined comment when reached by telephone in Israel.

I greatly appreciate the plaudits my work has received on this blog. And I do cherish the belief that both the publicity and the legal activism I helped bring to this case have made a difference.
But I must stress that a share of any credit due rightfully belongs to everyone who has helped to make an issue of this case, whether with the D.A.'s office, the press or one's local Orthodox rabbi.
And the greatest honor must be reserved for victims who risked opprobrium, ridicule and emotional trauma to demand the justice that is every victim's right and each community's obligation -- an obligation that, alas, our communities have been slow to respect.
Finally, though I can't speak for everyone, my own goal is not so much to punish Mondrowitz -- though he deserves to be punished if anyone does -- as to vindicate the victims' right to know that what was done to them was a crime. . . not an unfortunate occurrence, not a personal tragedy, but a crime for which their attacker, not themselves, was to blame.
And I also want each victim to know that his fellow human beings utterly detest and reject any suggestion that the vindication of his violated humanity (which is what the criminal justice system is supposed to be about) mattered less than a community's public image. My work will not be over while any doubt on that question still lingers.

A prominent Elizabeth surgeon, genealogist and published author has been arrested and charged with possession of child pornogra phy after federal agents found hundreds of pornographic movies and photos involving children on his home computer.
Neil Rosenstein, author of "The Unbroken Chain" and founder of the Jewish Genealogical Society of New York, was arrested by U.S. Im migration and Customs Enforcement on Tuesday and posted bail later that day after making an initial appearance in federal court in Newark.
The 62-year-old surgeon is one of 285 people who have been ar rested over the past year and a half through an ICE investigation known as "Operation Emissary," which identifies child pornography Web sites based overseas and tar gets their U.S. customers through online servers and credit card records.
According to the criminal complaint against him, Rosenstein's home computer was seized from an attic office on July 24 by ICE agents and searched for pornographic material. Among the files found were videos showing explicit sexual acts between adult men and prepubescent children.
ICE Deputy Special Agent in Charge Thomas Manifase said the videos described in the complaint are just a sampling of the "hundreds and hundreds of images" found on Rosenstein's computer. Manifase said the images were all downloaded from a Web site produced somewhere in Eastern Europe to which Rosenstein had purchased a membership using his credit card.
The site alerts would-be subscribers that subscribing is illegal, authorities said.
"There's no mistake this guy knew exactly what he was doing," Manifase said. "They're very disturbing images."
Manifase said Rosenstein's case was particularly important because of his work as a doctor and his prominent standing in the community.
"He had the trust of his patients," Manifase said. "Anytime we see someone in a position of trust -- a doctor, a schoolteacher -- we move quickly on those cases."
Rosenstein answered the door at his home yesterday morning, but declined to comment on the charges. His Westfield Avenue office appeared to be closed and had a "For Sale" sign on the front lawn.
His attorney, Leslie Stolbof Si nemus of South Orange, urged the public not to prejudge Rosenstein and to let all the facts come out in court.
"The public should remember that anybody charged with any crime has a right to be presumed innocent and is innocent until proven guilty beyond a reasonable doubt," Sinemus said. "This is a man who donates his time and effort to the poor of the community by way of surgical medical care ... and he shouldn't be judged prematurely."
In addition to the extensive two-volume work "The Unbroken Chain," Rosenstein has written several other books about Jewish genealogy and family research, including "Latter Day Leaders" and "Sages and Scholars."
If convicted of possessing child pornography, he could face up to five years in federal prison, Manifase said.

He fought for thier justice and healing even when they themselves shirked at going public, making his job so much harder. ReplyDeleteAll rhetoric and justified emotions aside for a minute, how are we to reconcile our glee for nailing these perverts to the judicial cross (to hang draw and quarter them), with the nagging suspicion that some or most of these vicious molesters were at one time theselves raped or molested as children and adults.
True, with help from parents, genuine professional therapists, siblings, friends and spouse, most victims will not turn to, or will cease molestation. However, what if these screwed-up souls never got proper counseling and support or were unfortunate to have the grand lineup of advocates like UOJ, Vikki Polin and Jewish Survivors blog in thier time of criticle need? What are we to think? Surely they were driven mad by thier horrifying experience! I'm not Chas VeShalom justifying any crimes they commited, but wont these histories cause significant trauma and phsycological "insanity" to these people and significantly contribute to thier mad deeds?
Folks, please go easy with answering me. I'm ecstatic that these monsters are comming home to the frier but every time we score a victory against a molester, these thoughts come up. I wish someone could post a good answer or analyses for the benefit of all of us. Maybe some significant study in these sad chain reactions could shed enough light on this that we can use this understanding to stop or at least stem this vicious cycle of some victims turning to abuse. The analogy to this sometimes contagious disease is perhaps the fictitious story of vampires bitting thier victims who in turn become vampires themselves.
Oh Lord, this tragic topis gets to me every time I think of it and it makes me ill. When will this madness stop.
To end on a good note, I wish all victims a speedy, complete healing and closure. And may we merit to stopping this horid deed forever NOW, so that we merit the coming of moshiach in our time.

ReplyDeleteJust for the record, that amendment was made in 1988, almost twenty years ago. Hynes took office in January, 1990. It took him 17 years to find out about the amendment.

The primary owner, the British putz Zissel Ellinson, went bankrupt and took investments from kollel yungerleit with him. He reopened, claiming he didn't have to pay anything back because only one division of the company went bust, so sholom al Yisroel and screw you.
The Haifa District Court convicted Asaf Ben David, a Palestinian who converted to Judaism, of contact with a foreign agent and conspiring to aid the enemy.

When warning children about potential molesters, it is very important to warn them to be careful of people who have mental illnesses. While this may seem obvious, these people ,who obviously have no control over their actions, are let to roam around and are treated condensingly. While in general they may be harmless, I have a friend who harbors memories of being molested as a three year old in a shul bathroom by a mentally ill fellow. When he told his parents, being unable to articulate what had happened made them misunderstand his experience as fear. Only years later was he able to actually explain to his parents what had happened, and understandably they were upset.(The perpetrater had since died). It has taken over thirty years for this fellow to recover; had someone watched out and warned years earlier, his life may have been different.

As one of the country’s largest ultra-Orthodox Jewish organizations, Agudath Israel of America is hardly known as a liberal trailblazer. But in an effort to help an Orthodox teenager at loggerheads with his less observant father, the organization has forged an unusual alliance with progressive legal groups seeking to expand the scope of children’s First Amendment rights.
Joining a friend-of-the-court brief filed by an array of juvenile-rights groups and legal scholars, the New York-based advocacy group has waded into a bitter and long-standing custody battle that pits Kansas City, Kan., resident Robert Solko, 49, against both his ex-wife and their four children. The custodial parent since 2004, Solko renounced Orthodox Judaism sometime after his divorce 13 years ago. He now forbids his youngest child, 13-year-old Ephraim, to observe such Jewish rites as keeping kosher and wearing a yarmulke, according to advocates. The protracted feud came to a head last month when local police reportedly picked up the boy after he allegedly ran away from his father’s house during the Tisha B’Av holiday.
While the Solko case is particularly acrimonious, its general outlines are not uncommon: As divorce has become more common over the past generation and courts have grown more willing to grant custody to fathers, judges are increasingly being called upon to mediate religious disputes between divorced parents. At the same time, a series of legal decisions has expanded the rights of children and adolescents in several areas, including free speech, reproductive rights and religious expression. Jewish advocacy groups, meanwhile, are divided over how best to advocate for strong First Amendment protections for Jewish families. In one recent high-profile case, the American Jewish Congress — which often finds itself to the left of Orthodox groups on constitutional questions — argued that a Jewish father in Oregon has the right, as the custodial parent, to circumcise his 12-year-old son. Agudath Israel refused to join the brief in that case, officials say, because the organization feared it did not show enough deference for the rights of the child.
“Under the Constitution, children have certain independent free-exercise rights,” said Mordechai Biser, associate general counsel for Agudath Israel. “At what age they start, and how extensive they are, is a gray area in the law, but our position in the [Solko] case is that once a child becomes 13 years old and has very strong and clear beliefs — under this set of circumstances where [the opposition] is entirely at odds with the way both of the parents raised the child — those are rights that have to be given cognizance by the courts.”
Although neither Solko nor his ex-wife, Julie Ann Bergmann, 51, was raised in an Orthodox home, both had independently embraced Orthodoxy before dating, and as a married couple they spent six years living in Israel, where they became increasingly observant. After the couple divorced in the mid-1990s, Solko apparently became estranged from Orthodoxy, and transitioned to a level of observance more in line with Reform. Bergmann, meanwhile, went to live with their children — now ages 13, 18, 21 and 23 — in the ultra-Orthodox Flatbush neighborhood of Brooklyn, with the sons attending yeshiva day schools. The three oldest children, estranged from their father, currently live in Brooklyn. Bergmann relocated to Kansas City in 2004 after ultimately losing full custody of Ephraim and his brother, Moshe. She is currently seeking changes to the custody arrangement that would allow Ephraim to attend school in Brooklyn while spending summers with his father.
Both Bergmann and Solko declined to answer questions about their case.
In their amicus brief, Agudath Israel and its allies — which include a half-dozen child advocates at such law schools as the Boalt Hall School of Law at the University of California, Berkeley — argue that the final arbiter of the boy’s religious upbringing should not be the courts, or even his parents, but himself. Their brief argues that under both the U.S. Constitution and the Kansas State Constitution, minors enjoy First Amendment rights just as adults do.
The argument is an unusual one for Agudath Israel, which has in the past supported parental rights, backing, for example, parental notification laws for female adolescents seeking abortions.
Marc Stern, general counsel for AJCongress, said he was concerned that Agudath Israel might unwittingly help set a precedent “that children have their own rights, even in defiance of their parents,” which could make it harder for parents to make religiously motivated decisions on behalf of their minor children.
For example, one liberal legal scholar, James Dwyer, a professor at the William & Mary School of Law, has argued that the adequate protection of children’s rights requires substantial government regulation of religious schools.
In the Kansas case, documents reviewed by the Forward suggest that Robert Solko, having undergone his own religious evolution, is struggling to transmit his own Jewish, if non-Orthodox, beliefs to his son.
A parenting plan drafted by Solko in late 2005 stipulates that neither parent “should denigrate the other’s beliefs or allow such during their parenting time,” and lists “secular education” as the number two priority for the children, after their health.
The plan indicates a desire for both parents to “encourage their children to experience a wide range of activities and learning experiences.” It also requests that Ephraim be forbidden from praying while at school, and forbidden from wearing any religious garb, including a yarmulke.
Officials at Agudath Israel acknowledged that they themselves were motivated to get involved in the Solko case because it concerns a child who wishes to practice Orthodox Judaism, but insisted that they are comfortable with the possibility that not all cases would cut in their favor.
“As a matter of law, we wouldn’t argue that a 13- or 14-year-old child would have no rights if their parents were forcing them against their will, let’s say, to attend a religious school,” Biser said. “That would be an inconsistency, and that’s a position that I believe we have never taken.”

ReplyDeleteMy friends in Israel tell me Mondrowitz has attempted to escape from Israel. We knew that he would try that, and had his passport blocked, he can't leave.
Michael Lesher Esq. played a pivotal role in this case. He worked about ten years to get it to this point. Klal Yisroel owes him a huge debt as well as to Mr. Mark Weiss, the survivor who went public on Nightline.
Do not underestimate the roles of Steve, LVF...and thousands of wonderful and caring Jews who "paralyzed" the D.A.'s officefor days on end with their e-mails and phone calls.
And yes, I do appreciate all the heartfelt e-mails of support from all over, including politicians, attorneys, judges, mental health professionals and all people of good will. It has given me the strength to continue my work on this matter and others, against the odds!

It's been more than a week since Brooklyn D.A. Joe Hynes threatened to sue Harpers Magazine and writer Chris Ketcham over a piece that accused him, among other sins, of fudging his legal residence. We'll be checking in occasionally with Hynes's office over whether he'll be taking evidence of his residence to court.
D.A. office spokesman Jerry Schmetterer said he expects a retraction. "If they give the retraction we're not going to file a suit."
And by the way, why are officials of the D.A.'s office dealing with a libel suit that looks to me like personal, not public, business?
Will this investigation by Hynes open up a can of worms for Ohel???? They must be very scared at Ohel.

Yahoo News - TEL AVIV, Israel - Police arrested a reputed Israeli underworld figure Monday on an international warrant for smuggling drugs from the European Union to the United States, authorities said.
ReplyDeleteZe'ev Rosenstein (pictured, pants wetted) was arrested after an investigation that spanned three years and several countries. He is believed to be a dominant force on the world Ecstasy market, said David Tzur the Tel Aviv police commander.
Rosenstein's warrant called for his extradition to the United States, a process that could take several months. Federal documents released in Miami on Monday accused Rosenstein of trying to export 700,000 Ecstasy tablets to New York.
In December [2003], a bomb attack targeted Rosenstein -- the seventh attempt on his life -- leaving him with scratches but killing three passers-by and wounding 18 others in Tel Aviv. The attack was believed to have been ordered by rival mob bosses, police said.
There is a Mavis Rosenstein Phd who is a professor in England. It must be her who occasionaly flies there.

ReplyDeleteAs a victim of Mondrowitz's (I'm not one of the OHEL accusers, I'm a typical chassidishe guy in my 30s) I can only say that if he did teshuva would he not of had to contact me and ask mechila? He knows how to get my phone number. One has not fulfilled his teshuva obligations until he apologizes to his victims. What rishus is thier in wanting justice done to a man who wrecked your childhood and then some. Try to imagine an adult taking your child, fondling him for hours (and worse) then say after he ran off leaving your child a wreck for 20+ years that it is rishus to assure your soul-dead child that thier is accountability for the molester and some sort of closure for your son after all these years of suffering.
Please think before u make a statement, I at lease have thought out my positions for 20+ years. I have relived this hell again and again. Do you know what trauma is to a prepubescent child and fearing to tell anyone for years because Mondrowitz threatened me that he would hurt me and my parents and that I really loved him......... BTW, he made me kiss him when he was done using me.

ReplyDeleteAll rhetoric and justified emotions aside for a minute, how are we to reconcile our glee for nailing these perverts to the judicial cross (to hang draw and quarter them), with the nagging suspicion that some or most of these vicious molesters were at one time theselves raped or molested as children and adults.
True, with help from parents, genuine professional therapists, siblings, friends and spouse, most victims will not turn to, or will cease molestation. However, what if these screwed-up souls never got proper counseling and support or were unfortunate to have the grand lineup of advocates like UOJ, Vikki Polin and Jewish Survivors blog in thier time of criticle need? What are we to think? Surely they were driven mad by thier horrifying experience! I'm not Chas VeShalom justifying any crimes they commited, but wont these histories cause significant trauma and phsycological "insanity" to these people and significantly contribute to thier mad deeds?
Folks, please go easy with answering me. I'm ecstatic that these monsters are comming home to the frier but every time we score a victory against a molester, these thoughts come up. I wish someone could post a good answer or analyses for the benefit of all of us. Maybe some significant study in these sad chain reactions could shed enough light on this that we can use this understanding to stop or at least stem this vicious cycle of some victims turning to abuse. The analogy to this sometimes contagious disease is perhaps the fictitious story of vampires bitting thier victims who in turn become vampires themselves.
Oh Lord, this tragic topis gets to me every time I think of it and it makes me ill. When will this madness stop.
To end on a good note, I wish all victims a speedy, complete healing and closure. And may we merit to stopping this horid deed forever NOW, so that we merit the coming of moshiach in our time.

There is no glee my friend. There is an intense sadness and anger, particularly at the rabbinical establishment; Torah Umesorah, Agudath Israel, and the numerous rabbis and yeshivas that permitted it to get so out of control.
My tears, however are for the victims of these monsters, molestors and rabbis, that could care less about anyone's welfare other than their own.
To them I say: I will nail every one of you and make your lives a living hell, worse than you can possibly imagine. You destroyed generations of my extended family, Klal Yisroel, and for this you will pay dearly.
Some sooner and some later; but I will get every one of you, I promise!

All the others jumped all over the oppurtunity to sue kolko and YTT. Michael Lesher is doing this because he believes that for our generation this is the tikkun haolam. So instead of us theorizing if moshiach will come this pesach because there is a bircas hachama on a certain day, we should learn something from this tzaddik's example and the good works of UOJ and his diligent deputized sidekicks.

SANTA MONICA, Calif. (MarketWatch) -- Toy makers must be freaking out. As their biggest time of the year for sales approaches, toy makers are dousing themselves to quell the flames of the Mattel scandal that has scorched the entire industry.
Moreover, retail sales have just been reported "soft" and that's no big lead in to the holiday sales rush.
Through the 20-20 hindsight lens, much of this could have been avoided. But Mattel has damaged its brand, as have others, and now it will have to rebuild its reputation.
Companies don't seem to get the fact that rebuilding a brand is more expensive that enacting corporate social responsibility programs to begin with. In other words, ethical considerations are more effective before rather than after a crisis.
Mattel,which is the world's largest toy maker, has recalled some 21 million toys since last August when it was found that many contained hazardous materials, including lead paint.
This week a Michigan pension fund filed a shareholder lawsuit against Mattel. It claims Mattel mishandled product safety procedures, which led to the toy recalls. Consumer groups have also filed lawsuits against the company for personal-injury claims.
Mattel has repented. It has made apologies and set up a new corporate responsibility organization reporting directly to the company's chairman and chief executive, Robert Eckert. The division will include a "product integrity policy and audit" function that will monitor Mattel and vendor facilities' compliance with the toy maker's product standards.
Other toy marketers too are racing to hold out their best practices efforts: Toys "R" Us announced it will initiate safety checks of all products on its shelves. The company says new "spot" checks of "thousands of toys" are already underway. They announced that it will test more than 65,000 children's products, including items already on its store shelves, for lead paint and any other safety issues.
But we're talking about toxins and kids here. There is no making up for endangering youth. Mattel should have realized long ago that it has a duty to provide more than just entertainment to young people.

In a statement, Mattel said that its lead-related recalls were overly inclusive, including toys that may not have had lead in paint in excess of the U.S. standards. Thomas Debrowski, Mattel's executive vice president for worldwide operations said, "Mattel takes full responsibility for these recalls and apologizes."
The toys in question were manufactured in China and many question why Mattel took full responsibility for the recalls and let the Chinese government off the hook. I think I know why: No matter the end culprit in the crime, it was Mattel's brand that was responsible for toys getting into children's hands.
When a new survey from Grant Thornton shows demand for corporate and environmental responsibility programs is rising, with 75% of business executives saying they can enhance profitability through them, it's a wonder that all manufacturers aren't embracing proactive initiatives.
WASHINGTON (Reuters) - Retailer J.C. Penney Co (JCP.N) recalled thousands of Winnie-the-Pooh doll play sets, wooden art boxes and horse-themed holiday ornaments because of unsafe levels of lead paint, the U.S. Consumer Product Safety Commission said on Thursday.

You have to look at the bigger picture, if it's true that he was molested as a child then his parents (if they knew) should have taken him to therapy, not let his sick mind to continue the abuse that was done to him.
The issue is not, great, we got him lets fry him alive. yes, we got him and god willing he will be put away for a long time, I dont care if it's in a mental institution if the jury decides he is crazy or if he gets put away in federal prison were the boys there will teach him a lesson or two on what abuse mean's.
The issue here is "coverup's", a very frightning word, there are sick people in this world and we will have to deal with them each when their time comes. but for rabbonim such as elya fisher or the higher ups at ohel that knew and got complaints about this molester to hush it up, for that I will not forgive them, weather its duvid m'olewski of leizerowitz fame or gruba lipa with the kolko victims revictimization and the others, its just avery frightning thought, to see the eyes of bnei yisrael look up to them as they sit on the various daises around town just like some mengela deciding who goes right and who goes left, thats right I called these so called rabbonim what they are "NAZIS".

Dearie, the plaintiffs claim that United Homes was behind a "fraudulent property-flipping scheme," and that they "bought damaged properties at foreclosure auctions or estate sales[,] performed some cosmetic repairs and, shortly thereafter, sold the properties, often at double the purchase price." The lawsuit targets both the company and their affiliated lawyers, appraisers, and lenders who participated in these schemes. A major accusation in the lawsuit is that these practices were targeted racially.
While it's not surprising that these types of practices were going on in Brooklyn in recent years (and most definitely in the Bronx as well), it is surprising that the allegations have stood up in court thus far. A recent motion to dismiss by the defendents was thrown out by the judge

ReplyDeleteSifra Tendler, the wife of Monsey Rabbi Moshe Dovid Tendler, has died.
Hundreds of people attended the funeral yesterday afternoon at a packed Community Synagogue in Monsey, the synagogue her husband led for decades.
After the service at the Maple Avenue shul, Sifra Tendler was buried in Brick Church Cemetery on Route 306, keeping with the Jewish tradition of burial within 24 hours of death.
She died yesterday after a lengthy illness. She was 79 and would have turned 80 on Nov. 11.
She is a daughter the late Moshe Feinstein, a renowned Orthodox Jewish rabbi whose religious rulings were accepted worldwide among Orthodox Jewry.
Rabbi Tendler, 80, is a leading Orthodox Jewish rabbi in the U.S. He is a professor of biology at Yeshiva University and an expert on medical ethics pertaining to Jewish law.
The Tendlers have five sons, three daughters and numerous grandchildren. Several of their children became rabbis, one is a doctor.
Several relatives live in Israel, which the Tendlers strongly supported.
The Tendlers recently returned from Israel, where one of their granddaughters was married.

I didn't realize that Brick Church cemetary with such an unlikely name & with the Church still operational would have any Jews buried there. The place is notorious for frum kids at risk hanging out there at night for drugs & sex. Sherrifs started chasing them away and hypocrite Mordechai Tendler hung a sign in his shul telling parents they are mechuyav to supervise their children at all times in case they associate with any kid have sex in the cemetary.

MICHAEL vividly remembers the knife pressed against his throat.
He was 11, face down in bed at an upstate summer camp for Jewish orphans, when his partially clad counselor mounted him and threatened to kill him if he screamed.
"I was telling him to stop because it really hurt," said Michael, now 19.
For nearly two months, between games, outdoor activities and Orthodox religious observances, Michael would return to the horror of his cottage and forced sex with the 24-year-old man, he recalled.
Michael said he saw the same counselor sexually abuse his roommate and best friend, Robert, also 11 at the time.
Robert remembers vague abuse, but not specific acts.
Along with Michael, he claims the attacks continued at the Ohel Children's Home and Family Service Group Home in Borough Park, Brooklyn.
Michael and Robert say their complaints to other staffers were ignored for a year, until a worker caught the counselor straddling Michael.
Police were called and Michael remembers telling sex-crimes investigators in June 1992 that he wanted "justice."
The two boys hid the scars of the abuse for nine years. And then, last month, they discovered what had happened to their attacker:
He walked.
Simcha Adler, now 33, plea-bargained charges of sodomy, sexual abuse and two counts of endangering the welfare of a child down to attempted sodomy, court records show.
His punishment: five years' probation and psychological counseling.
"It's a crime that he could walk away ... and have a normal life," said Michael, now a mailroom worker in Midtown. "This man ruined my life."
Robert vaguely remembers Ohel workers telling him that Adler had been given probation.
"I was [angry], but I couldn't do anything - I wasn't smart enough to do anything," said Robert, now a City College freshman who wants to be an optometrist.
"He should be in jail for the rest of his life," said Robert, who was placed in Ohel because he was sexually abused by his mother.
Michael and Robert have contacted lawyers to find out if they can properly punish Adler. They also want to know if Ohel - their legal guardian - can be held accountable for failing to vigorously nail the pedophile to a prison cell wall.
Although the statute of limitations for suing is three years, the countdown didn't begin until they turned 18.
Adler was arrested on June 22, 1992, and released on $2,000 bail, then plea-bargained his way to freedom on Aug. 12 - less than two months later.
Ohel should have screamed murder, but it didn't.
Ohel fired Adler in May 1992, after two years of employment, but agency officials wouldn't say whether his termination stemmed from the sexual abuse.
Adler was charged with entering Robert's room and sexually molesting him.
"I could feel him coming before he even got in to my room," Robert said. "I knew what was going on, and I would fall asleep - I guess I was in shock ... Then I would wake up again and realize he was still on top of me."
Adler also was charged with fondling Michael in the shower.
"The counselors would take the kids to the showers and they [the kids] would bathe in their shorts," Michael recalled. "He [Adler] always made me take my shorts off.
"I couldn't sleep at night because I didn't know when he would walk into my room."
Michael and Robert angrily charge Ohel swept the abuse "under the rug" to avoid a legal battle that might ruin its reputation.
A former Ohel employee told The Post the boys' allegations were not taken seriously or investigated by Ohel because Michael was thought to be a "liar."
Ohel spokesman Gerald McKelvey would not respond to the ex-employee's comments. "Because of confidentiality concerns, Ohel cannot comment directly on previous or former clients," he said.
But Ohel has a history of turning a blind eye to sexual abuse.
Now-retired sex-crimes Detective Sal Catafumo recently told The Post that his 1984 investigation of a bogus Borough Park rabbi who had reportedly molested "hundreds" of children - including some Ohel orphans - while working as a child counselor got nowhere when cops tried to question the agency.
"They weren't cooperating," Catafumo said. "Kids ... had complained to Ohel and it was swept under the rug ... [and] never reported ..."
The rabbi was indicted, but he fled to Israel.
McKelvey and Ohel CEO David Mandel deny that the agency ignored kids' complaints about both Adler and the fake rabbi.
McKelvey dismissed Catafumo's claims as "absolutely false," and said Ohel "cooperated fully with authorities in the matter and was deeply involved in the treatment of the victims in this case."
In general, said Mandel, "any allegations made by anyone are taken very seriously and are investigated."
The psychological trauma of the year long series of attacks is apparent in both Michael and Robert, who still live in Ohel housing because they don't have money, parents or any place to go.
Robert said he's never dated a girl because he wanted to focus on school. He spent the past summer watching TV and playing video games.

The owner of a Borough Park building where Adler, until recently, had been living told The Post that the former counselor - who married in December and moved to Jerusalem - admitted to her several years ago that he was a pedophile.
She said his confession came after Ohel officials knocked on her door and told her to keep an eye on her children.
"He [Adler] told me he was sexually abused [as a child]," said the woman, who requested anonymity.
Adler was sent to Ohel at age 3 after his mother died, said his foster mother, Barbara Ackerman, who added that he underwent extensive therapy following his arrest.
"Once it was brought to our attention, we watched him," she said. "He dealt with it and he handled it ... He is doing well."

There are PA plates in NY too. Chassidishe chevra sell temporary 30 day plates for a few hundred bucks with a tnay that if you get pulled over you don't tell the cop who you bought them from.

A ground-breaking guide has been published in the UK to help combat drug, sex and other addictions among strictly Orthodox Jews.
Believed to be the first of its kind anywhere in the world, the 130-page book, “Understanding Addictions” is trilingual, written in English, Yiddish and Hebrew.
Ranging from eating disorders, gambling and “shopaholism”, to internet porn and gambling, it has been produced by Talking Matters (TMA), a National Health-funded counselling agency set up in 2001 to promote stress prevention among the Charedi community.
Its purpose is to equip rabbis, teachers, parents and youth and community workers with the knowledge to identify problems and provide help in a “constructive and non-judgmental way”. Its contents include an illustrated guide to illicit drugs as well as an extensive list of Orthodox counsellors.
In the introduction, TMA’s founder and national director, José Martin, says that in the past people with such problems would be “shipped out” to other towns. “We pray that no child comes to harm in his life, but if s/he stumbles, it is our duty to help them up, not push them further into the quagmire.”
She told the JC that one motivation for compiling the book was learning a few years ago that an official Drug Action Team (DAT) in Manchester had a record of 10 Orthodox Jews. “By the time, they get to the DATs you’d never know they were Orthodox or even Jewish, it’s too late. Two or three died,” she said.
A report on mental health in the Charedi community that she helped compile earlier this year for the University of Central Lancashire Centre for Ethnicity and Health also found anecdotal evidence of drug-taking among strictly Orthodox youth. It recorded: “What has been quite shocking, even for the researchers, is the frankness with which some respondents said that‘There are teenage girls and boys using drugs like marijuana, cocaine and speed.’ This is alarming as it was always thought that the girls in particular, of Stamford Hill, were totally immune from such terrible things.”
Feedback from therapists also sheds light on what problems need to be addressed. “Life has changed,” Ms Martin said. “We didn’t have internet pornography 10 years ago.”
The publication is endorsed by a highly-respected strictly Orthodox rabbi, Dr Abraham Twersky, a psychiatrist with expertise in substance abuse and author of numerous religious books.
“We must get our heads out of the sand and realise that all social problems that exist in society at large may exist among Orthodox Jews as well,” he writes in the foreword, “and even if there may be a lesser incidence, the prevalence is significant. Families are being ruined and children suffer the consequences of parental addiction.”
Other rabbinical backing comes from Rabbi Dr Chanan Tomlin in Manchester, the chairman of Talking Matters, and Rabbi Azriel Schechter in Stamford Hill.
Ms Martin said that 300 copies had so far been sent out — mostly attracting positive reaction — “although there were three negative responses, including one who sent it back”.

ReplyDeleteEyal Magid, a native of Israel, was arrested on Thursday, Oct. 4, at Chabad of Sherman Oaks for allegedly molesting a 7-year-old girl.
During the morning kiddush of the Shimini Atzeret holiday, synagogue members told the girl's parents that they had seen Magid, 28, lead the child down the stairs of the shul. After the parents questioned the girl, they immediately called the police, according to Rabbi Menachem Mendel Lipskier, assistant director of Chabad of Sherman Oaks.
Police have charged Magid with kidnapping with the intent to molest, which could carry a stricter sentence than kidnapping, an LAPD spokesman said. As of press time Tuesday, Magid was still being held with bail set at $600,000.
Magid was a "transient," Lipskier said. "He hung out a few months here, but he's kind of homeless." Magid had lived in Florida and Chicago, but "there were no concerns" about him, the rabbi said he found out after the incident.
Although the community already has in place education for parents and children about child safety, they are working with experts in the field for community education and preparedness, Lipskier said. "These are community issues -- and they're national issues."

MOUNT PLEASANT - Two teenage boys at Hawthorne Cedar Knolls are accused of sexually assaulting a 13-year-old girl on campus, the latest of several sex crimes reported at local residential treatment centers, police said today.
The boys, both 17, were charged with second-degree sexual misconduct, a misdemeanor, this morning in Mount Pleasant Town Court. They were remanded on $2,500 bail to the Westchester County jail, pending their next court appearances Thursday.
The Jewish Board of Family and Children's Services runs Cedar Knolls on Linda Avenue, which houses about 300 boys and girls, many from broken homes in New York City who have behavioral problems.
The alleged assault is the latest of several at Cedar Knolls and Pleasantville Cottage School, the town's other residential treatment center.
In November, three teens at Hawthorne Cedar Knolls are to be sentenced for the February rape of another 13-year-old girl there.
In light of the previous attacks, two state agencies are jointly investigating the two centers, partly to determine whether more should be done to secure the centers and surrounding communities.

Before a judge renders an opinion, he might rely on case law or consider precedents established by the U.S. Supreme Court. But this week at the federal court in Concord, Magistrate Judge James Muirhead reached for his copy of Green Eggs and Ham.
Muirhead channeled Dr. Seuss after an inmate mailed him a hard-boiled egg to protest his diet at the state prison.
"No fan I am of the egg at hand," Muirhead wrote.
He continued: "I do not like eggs in the file. I do not like eggs any style."
Then Muirhead ordered the egg destroyed.
"Today! Today!" he demanded. "Today I say! Without delay!"
Muirhead could not be reached for comment, but Daniel Lynch, deputy clerk at the U.S. District Court on Pleasant Street, confirmed that the egg had been tossed.
But the case, brought by inmate Charles Jay Wolff last September, is pending and set for trial.
In his lawsuit, Wolff, 61 and serving 10 to 20 years for aggravated felonious sexual assault, has accused prison officials in Concord of refusing to feed him a kosher and medically adequate diet. In addition to the proper foods, Wolff seeks $10 million from the state.
The case is complicated and has required a lot of attention from court and state officials. It seems the prison has succeeded in providing Wolff, who says he's Jewish, a kosher diet. The problem, according to court records, is that some of those kosher items aggravate Wolff's heart, diabetes and other medical conditions.
Wolff responded at one point by refusing to eat the main course of his dinner 29 out of 31 days to avoid digestive problems, court records said. After researching the matter and hearing from Wolff and prison officials, Muirhead concluded in August that the prison had not responded to Wolff's medical needs and instead given him the "run around."
Muirhead ordered the prison to come up with a plan to better meet Wolff's dietary needs.
Hard-boiled eggs are among the foods Wolff says he cannot tolerate, and it was his understanding the prison would serve him eggs another way. So when Wolff was recently served hard-boiled eggs, he fired off a complaint to the federal court - with a hard-boiled egg attached.
Wolff sent a copy of his complaint, and another hard-boiled egg, to the state attorney general's office, which is representing the prison in the lawsuit.
Andrew Livernois, the attorney handling Wolff's case for the state, said the egg arrived in a padded envelope taped to a piece of paper. It was intact and hadn't begun to smell. It's an unusual piece of correspondence, not as bad as others, Livernois said.
One attorney in his office once received a pleading coated in dried urine. And legend has it that another attorney received dirty underwear from a litigant. Plus, Livernois agreed, the egg from Wolff could have been soft-boiled, or not boiled at all.
Livernois said that egg was put out with the trash. Muirhead's ruling, meanwhile, is circulating around the office.
Prison officials enjoy Muirhead's ruling but also wonder how Wolff got his egg into the mail. Jeff Lyons, prison spokesman, said the prison does not search mail sent by inmates if it is marked "legal documents" and addressed to a court or attorney's office. It's likely, he said, that Wolff sent his eggs that way.
Muirhead's order will almost certainly land on one of the many websites devoted to humor in the court system, like lawhaha.com. He'll find himself in good company and among at least one other Dr. Seuss fan.
In 2006, a Florida bankruptcy judge responded in rhyme to a debtor who had failed to file necessary information in time and risked dismissal. "I do not like dismissal automatic / It seems to me to be traumatic."
Another bankruptcy judge, this one from Texas, cribbed lines from the Adam Sandler movie Billy Madison to chastise a defendant's incomprehensible argument. "What you've just said is one of the most insanely idiotic things I've ever heard," the judge wrote. "At no point in your rambling, incoherent response was there anything that could even be considered a rational thought."
Earlier this year, a Montana judge worked the names of Beatles songs into his order after a defendant referenced the group in his plea to the court. "As a result of your Hard Day's Night, you are looking at a Ticket To Ride that Long and Winding Road to Deer Lodge," the judge wrote. "Hopefully you can say both now and When I'm 64 that I Should Have Known Better."
Among the most circulated opinions from lawhaha.com is one issued last year by a Florida judge fed up with a pair of squabbling lawyers who could not agree on the site of an important deposition.
The judge ordered each lawyer to appear at a neutral site, or the courthouse steps, accompanied by one paralegal who would serve as a witness. There, the lawyers would play the game rock, paper, scissors to determine the deposition's location.

It is with great sadness that I write about this issue. I know the family and I respect the great Talmid Chacham that is his father. His name is Harav Yitzchok Mondrowitz. If that name sounds vaguely familiar it is probably not because of his Sefer but because of his son, Avrohom.
Avrohom Mondrowitz is a wanted man. The United States government, through the Brooklyn district attorney's office is seeking his extradition from Israel on sex charges: Four counts of Sodomy; eight counts sexual abuse.
I knew this fellow. We were in Telshe together. We are about the same age and were in the same Shiur there. His friends and family called called him Avremiel. He was always an upbeat person with a completely positive attitude toward Judaism. He was very careful in his Mitzva observance, and he learned well. And was well thought of by his Rebbeim. He is about the last person one would associate with sex abuse.
I left Telshe after tenth grade. The next time I saw him he was married, living in Chicago, and had become much closer to Ger, adopting all of their Minhagim, including the Levush… their style of dress, Shpoduk (Gerrer style Shtreimel) and all. My father davened in the same Shteeble with his father, Rav Yitzchok, who used to give Shiurim there. It was Rabbi Perlow’s Shteeble (The Novominsker Rebbe) before he moved to New York.
I saw Avrohom there occasionally, always smiling, always making others smile. After living in Chicago for a few years in the early seventies, he moved to Brooklyn so he could live in more of a Ger-style community which was practically non-existent in Chicago back then. I lost touch with him.
A few years later I saw an ad in the Jewish Press aimed at children with psychological problems: “Psychology Al Pi Halacha” it said, listing Dr. Avrohom Mondrowitz as the psychologist who would provide therapy… and it gave his phone number. I remember thinking, how wonderful that this Chasid that I knew… with an upbeat personality had gone to college, received a degree in psychology and was now treating young children with emotional problems.
Boy… was I ever wrong! It wasn’t quite that wonderful. It was in fact a shocking horror story that was then, of unheard of proportion.
I am told by various sources that he had no real degree. It was entirely made up… or it was one of those phony baloney ones you can buy. I don't really know. But in any case,instead of providing therapy for children with emotional problems he was causing permanent psychological damage to… who knows how many… children. He had found a way draw into seclusion and sexually abuse many victims. And he had the best cover one could devise, in case of being accused of wrongdoing: These were sick children! He has denied and continues to deny all charges. But the evidence is overwhelming. He realized that and “skipped town”. Ever since the early eighties he has been living in Israel.
This is real tough one for me to understand. He was from the best of families… well to do …Yerei Shamyim. He had a brilliant Talmid Chacham for a father, a real role model. His mother was a working registered nurse. And he had a younger brother who is wonderful human being with a family of his own. Outwardly Avrohom was a paragon of virtue, but secretly he was an uncontrollably perverted man who violated major Issurim in the Torah continuously for many years and hurt many people in the process.

Two brothers brutally beat a man with the leg of a wooden chair after accusing him of staring at their sister, authorities said yesterday.
Heim Sankari, 20, and Natan Sankari, 19, accosted the 32-year-old victim on Ocean Parkway and Avenue S in Gravesend at 5:36 p.m. Saturday, sources said.
A security guard in the area called 911 while the suspects fled.
Armed with descriptions, police scoured the neighborhood and arrested the brothers nearby on assault charges.
The victim, who is Jewish, initially refused to be taken by ambulance to the hospital citing religious reasons related to Yom Kippur. But he was later taken to Coney Island Hospital to be treated for cuts and a broken nose.

A Long Island teen whose father is Jewish was charged yesterday with attacking two Orthodox girls after screaming anti-Semitic remarks, police said.
Eva Adi, 17, of Hewlett allegedly claimed to be an "agnostic Nazi" during the assault in Cedarhurst, officials said.
Adi allegedly broke the nose of a 15-year-old victim and chased down and beat up another girl in the attack early Sunday morning, just hours after the solemn Jewish holiday of Yom Kippur ended.
She allegedly attacked the girls after calling herself a "Nazi" and saying, "We hate Jewish people," according to a criminal complaint.
Adi was charged with two felony counts of assault as a bias crime and was being held on $5,000 bail.
Detective Lt. Lawrence Feffer of the Nassau County Police said Adi's father is Jewish and her mother is Catholic.
Adi's father appeared at his daughter's arraignment in First District Court in Hempstead wearing a yarmulke.
Feffer said the ordeal began when the victims invited two boys who were hanging out with Adi to join them in Cedarhurst about 2 a.m. on Sunday.
The victims were sitting at the corner of Grant Place and Oakland Ave. smoking a hookah tobacco pipe when Adi and the others arrived, Feffer said.
After her friends left, Adi allegedly began spouting off anti-Semitic remarks at the girls and called herself an "agnostic Nazi" and "skinhead," Feffer said.
She then allegedly sucker-punched one of the victims, a Far Rockaway, Queens, girl, in the nose, breaking it.
"Eva chases another girl and punches her in the face and body," said Feffer, adding that a third girl managed to escape unharmed.
The father of the first attack victim told the Daily News yesterday that she remains stunned by the attack.
"She's got a broken nose. She's upset. She wants her privacy," the father said.
Adi's neighbors in Hewlett said they were surprised by the news.
"As far as I know, she's a very nice girl, great character," Jeffrey Bistrong, 20, said of Adi. "She's lively, very friendly."
At the scene of the attack, Sarica Termechi, 36, an Orthodox Jewish mother of three, was disgusted by the alleged crime.
"There's never any anti-Semitic anything in this neighborhood," Termechi said. "It's weird, really weird."
Feffer said police were searching for one of Adi's friends for questioning.

Claudius Benson II was suspended after being enrolled in Detroit's Old Redford Academy for three days this semester.
His mother says the 14-year-old has not had a hair cut in more than a decade because his family follows Jewish traditions and Old Testament passages prohibiting it.
The ACLU accuses the school of violating the student's Constitutional right to religious expression. The lawsuit also asks that the school grant Benson a religious accommodation and remove the suspension from his record.
A $25 million lawsuit against the Mormon church and the Boy Scouts alleges that child sex abuse has been widespread since the 1960s and little was done to prevent it.

North Korea has finally broken it's silence and strongly denied it secretly helped Syria develop a nuclear program, claiming the charge was fabricated by UOJ and U.S. hardliners to block progress in North Korea's relations with the world community.

The Syrian state-run newspaper Tishrin said in an editorial that the U.S. was fomenting the accusations to excuse Israel's incursion. It compared them to American claims in the lead-up to the 2003 invasion of Iraq that then-leader Saddam Hussein was developing weapons of mass destruction. The newspaper interviewed Rabbis Leopold Margulies and Israel Belsky who were in Damascus on a solidarity visit and to check on sources of human hair for wigs. They mentioned that UOJ and US Intelligence were using similar tactics after consulting with each other which is evident in UOJ's false charges against Yehuda Kolko and YTT.

ROYAL PALM BEACH — The 30-year-old woman knew that having sex with a 13-year-old boy was against the law.
But police say that didn't stop Alisa J. Rothenberg of Royal Palm Beach from having sex with the teen in the hot tub of her apartment complex.
Rothenberg, who is being held at the Palm Beach County Jail, has been charged with one felony count of lewd and lascivious battery, said Palm Beach County sheriff's spokesman Pete Palenzuela.
The teenager was visiting a relative's house on July 29 when the incident happened, according to an affidavit filed with police. At the time Rothenberg was dating the male relative.
Rothenberg and the boy were sitting in the Jacuzzi when she kissed him, the affidavit says. She then removed the boy's clothes and took her clothes off as well, the report states. The two then engaged in sex, the affidavit states.

A gay Emory University medical resident, facing felony charges in Clayton County for allegedly not disclosing he was HIV positive before having sex with a male teen, remained jailed this week in DeKalb County on unrelated road rage charges.
A Nov. 14 hearing on a motion to have Adam Lebowitz’s $50,000 bond revoked in DeKalb County was canceled after Lebowitz’s attorney, Craig Gillen, asked for an indefinite continuance in the DeKalb case. Lebowitz allegedly struck a woman in the face Nov. 1 in the road rage incident, according to a DeKalb arrest warrant.
Gillen said he does not comment on pending cases.
Lebowitz, 47, who also worked in the Grady Memorial Hospital emergency room, has been suspended from Emory pending the outcome of his case, according to officials. His medical license was also suspended Nov. 3 by the state medical board, according to the Associated Press.
Lebowitz’s felony charges stem from allegations made to Clayton authorities by a 16-year-old male who said he had consensual sex with Lebowitz twice in Clayton County in August. Lebowitz did not disclose he was HIV positive, according to Sheriff Victor Hill.
Hill said he did not know whether condoms were used or what sexual acts took place between Lebowitz and the 16-year-old.
A 1988 Georgia law mandates HIV-positive people disclose their status before engaging in sexual activity with another person. Conviction of such a crime is punishable by up to 10 years in prison.
Hill said the two met on the popular Myspace.com website.
The 16-year old Clayton County male learned of Lebowitz’s HIV status after seeing him on a television news report about his Nov. 2 arrest on charges of criminal attempt to commit aggravated child molestation against a 15-year-old boy in Coweta County, Hill said.
Coweta District Attorney Peter J. Skandalakis said Lebowitz also met the Coweta teen on Myspace.com. Lebowitz was arrested at the 15-year-old boy’s home Nov. 2 “with the intent to engage in sexual relations,” according to court documents.
The teen allegedly told his mother about Lebowitz making sexual overtures toward him on Myspace.com, leading her to call Coweta authorities who then set up a sting operation at the teen’s Newnan home.
Coweta sheriff’s deputies said they found condoms, lubricants and sleeping bags in Lebowitz’s 1997 GMC Jimmy SUV when they arrested him.
Computers from Lebowitz’s Decatur home have also been confiscated and the Atlanta FBI is working with Coweta and Clayton authorities in the case. Federal charges may be pending, according to Special Agent Stephen Emmett.
“We are supporting them in computer forensics and the investigation continues at this point,” he said. “This is a very fluid situation and federal charges are pending.”
Emmett declined to comment on what those federal charges might be.
Should Lebowitz make bond out of the DeKalb County jail, he would be sent to Coweta County to face charges there, Skandalakis said.
“We plan to indict him on our charges in January,” Skandalakis added.
Lebowitz went by the name “intrepidromantic” on his Myspace.com page. On one blog post dated April 27, 2006, Lebowitz wrote: “Going to Tampa, Apr 27-30!!! Looking for cute guys 18-40 for hang out or 18-30 for hookup while I’m visiting.
“Masculine, adventurous, educated, professional, relationship-oriented man from Decatur, GA (metro Atlanta) seeks great guys for friends or more. 5’9”, 170, red hair, blue eyes, moustache, goatee, hairy chest. The age of consent for sexual activity in Georgia is 16, so child molestation charges are not applicable in the Clayton case, Hill said.
Hill said two warrants have been taken out on Lebowitz in Clayton County, but the other cases in DeKalb and Coweta will likely have to be resolved before he can be arrested on the Clayton charges.
“He’ll eventually come here to answer to our charges,” Hill said.
In 2005, Gary Wayne Carriker, also a former Emory medical student, was prosecuted under the HIV disclosure criminal law in Fayette and Fulton Counties and sentenced to a total of four years in prison.
Carriker was convicted of not disclosing he was HIV positive to three metro-Atlanta men he had sexual relationships with, including having unprotected sex. A Fulton spokesperson at the time said Carriker’s was the first such gay-related case he knew of in the county’s prosecutorial history.

ReplyDeleteA suburban Boca Raton man celebrating his 25th wedding anniversary and a former Boca Raton resident were among 15 men arrested by the Broward Sheriff’s Office earlier this month in a sting targeting online predators.
During a two-week undercover operation, detectives posed as young boys and girls and chatted online with the men. They spent day and night in a Broward County home chatting with adults looking to have sex with children, authorities said.
One of the men who chatted with them was 50-year-old David Feffer, who lives west of Boca Raton, authorities said.
Using the AOL screen name CompAppInc, Feffer sent an instant message to a detective posing as a 15-year-old boy on Feb. 6, according to an arrest report.
Feffer asked the boy if he wanted “to get close to a dad type guy,” and if he was “good at keeping secrets,” the report shows.
Feffer told the boy he was married.
The next day, which happened to be Feffer’s 25th wedding anniversary, he drove to the undercover house to meet the boy.
He knocked on the front door and was arrested.
Authorities found condoms, lubricants and a picture of the boy in his Toyota Prius.
Feffer, a father of three, was charged with computer child exploitation and attempted lewd and lascivious battery.
Craig Feldman, 24, who now lives in Fort Lauderdale used the AOL screen name Canadianccaze while chatting with what he thought was a 16-year-old boy, authorities said.
Feldman’s sexually graphic conversation with the boy started at 10:55 a.m. on Feb. 7, according to an arrest report.
At 1:18 p.m., sheriff’s deputies saw his blue BMW pull into the driveway of their pre-arranged meeting spot.
Feldman, who had e-mailed the boy pictures of himself, got out of the car and walked toward the front door.
He was arrested before he could knock.
Feldman admitted to being there to meet for sex, but said he was not going to act on it, according to the report.
He was charged with computer child exploitation, attempted lewd battery and possession of drug paraphernalia.

ReplyDeletePORTLAND, Ore. (AP) - An 84-year-old woman accused of attempted rape involving an 11-year-old boy in her foster care has pleaded guilty to a lesser charge after confessing to having sex with the child, prosecutors said Thursday.
Georgie Audean Buoy, of The Dalles, a Columbia River town about 90 miles east of Portland, will serve 36 months in prison, said Leslie Wolf, chief deputy district attorney for Wasco County.
Buoy originally faced six separate charges but reached a plea agreement on a single charge, Wolf said.
She noted that Buoy had faced eight years in prison on the original charges but her "age and lack of prior criminal convictions had a significant impact with the resolution of this case."
In a taped confession, Buoy admitted having sex with the boy while he was in her care in 2004, Wolf said.
"Obviously, with this case, there is going to be a lot of disbelief so we wanted make sure people knew it was a confession," Wolf said.
She said that Buoy was a longtime member of the community and her church, and volunteered at the county jail.
Church officials were not immediately available for comment. Buoy's attorney, Andrew Carter, also was not immediately available.
Buoy pleaded guilty Thursday to attempted sex abuse in Wasco County Circuit Court in The Dalles. She must register as a sex offender after serving her sentence at the Coffee Creek women's prison in Wilsonville.
Buoy also must pay $5,000 to the victim, as well as up to $7,500 in restitution for counseling.
Buoy will be the oldest female inmate in the Oregon corrections system, according to the Oregon Department of Corrections.
But there is a 93-year-old male inmate in the prison system, and a 72-year-old female inmate at Coffee Creek, officials said.
District Attorney Eric Nisley said it was the only case in his memory involving sexual abuse of a boy by an elderly woman - but it was handled like any other case.
"When an adult victimizes a child, the sex of either partner is irrelevant - the damage is done and it's permanent," Nisley said.

ReplyDeleteNew York - A Port Chester police officer has been accused of a "sex crime" involving a child, authorities said today.
Jonathan Rubin, 37, of Rye Brook was arraigned yesterday on misdemeanor charges of endangering the welfare of a child and criminal mischief. They stem from his confrontations last month with a child and the child's grandmother, Westchester District Attorney Janet DiFiore said in a statement today.
Few details of the incident were given.
"It's a sex crime," DiFiore spokesman Lucian Chalfen said. "Because of that, there's really not much more we can say."
On Jan. 24, Rubin allegedly acted in a manner likely to be "injurious to the physical, mental and moral welfare of a child," in front of the grandmother.
The next day at noon, he allegedly tore the grandmother's clothing. She confronted him after finding two garbage bags filled with torn clothing, and he allegedly replied: "This is because she is trying to destroy my life."

MALAYSIA - Authorities are investigating reports that a missing Gresham soccer coach has been found dead in Malaysia.
Larry Cohen, who disappeared four years ago, was charged with sexually abusing former soccer players.
The Lake Oswego man was a coach for the West Villa Soccer Club in Gresham.
Cohen was out on bail on a $250,000 bond when he disappeared.
No cause of death has been announced.

ReplyDeleteA jury on Friday awarded $85,000 to a Nashville woman who sued an Artesia motel when her elementary school-aged daughters were exposed to pornography during their stay last summer.
Edwina McCombs and her daughters, then 8 and 9, were in Southern California to visit the girls' father when they checked into Value Lodge on Aug. 3, 2006. While McCombs used the bathroom, the girls channel-surfed for children's programming and encountered "hardcore and graphic pornography" with extreme close-ups of several sexual acts, said one of McCombs' attorneys, Eliot Krieger of Long Beach-based firm Jarvis and Krieger.
Several cover ups were reported on UOJ in 2005 and / or 2006. If a molester or sadistic abuser had a rich father, the yeshiva was paid off to keep the freak enrolled and to keep things quiet.

The yeshiva's secular studies dept was run by a gang of friends who also taught at the Catholic Bishop DuBourg HS. They were obviously gay but that didn't matter at the yeshiva as long as any teacher would accept the peanuts that Kleiman paid. I witnessed several advances by teachers on the students. Some of the students had gay tendencies or were otherwise vulnerable so it is entirely possible that something was going on. One teacher, the convicted pedophile James Funke, was a Priest who removed his clerical collar before coming to yeshiva.
The yeshiva never exercised it's fiduciary duty to notify the police that 2 child rapists from DuBourg were also teaching after hours at the yeshiva.

Priest and Teacher Charged with Sexual Assault

Discovery of pornographic materials in a Roman Catholic priest's room may result in additional charges against the cleric and a lay teacher already accused of sexually assaulting a 16-year-old boy, authorities said Friday.
The Rev. James Funke, who was charged with sexual assault Thursday, is accused of attacking the youth in early October at the rectory of St. Bernadette Catholic Church in Lemay, where he is associate pastor.
Funke is also a biology teacher at Bishop DuBourg High School in St. Louis, where the teenager is a student.
Jerome Robben, 44, a history teacher at DuBourg (AND a teacher at Kleiman's yeshiva), was also charged with sexual assault Thursday in St. Louis County Circuit Court. Police said Robben did not actually take part in the attack but encouraged the youth to submit. (Acording to the St Louis Post-Dispatch, police later charged Robben with rape & sodomy after reviewing videotapes that were made at Funke's apt)
About six former DuBourg students were being interviewed because they also may have been victimized.
Police seized a large quantity of what they called child pornography from the priest's room at the rectory said additional charges could be filed.
Both men were arrested Wednesday in an investigation prompted by a telephone call to a child-abuse hot line.
Officers said Robben and Funke both have given statements to police.
Detective Susan Carr said the victim's mother became suspicious of Funke's relationship with her son because the priest purchased things for the boy but never visited the family.
Carr said the youth told his mother about several incidents at the rectory after she questioned him. The mother took the boy to a counseling service, which called the hot line.
The victim was enticed rather than intimidated and consented to Funke's advances, detectives said. They said the priest bought beer for the boy and gave him money for a car.
Materials found at Robben's home included photographs, videotapes and commercial films, investigators said.
Funke and Robben were suspended pending the investigation's completion, school officials said.

St. Louis (AP) -- Four priests suspended by the Archdiocese of St. Louis amid allegations that they sexually abused children have been laicized, or permanently removed from the priesthood, the archdiocese said Friday.

The effort to remove the men began with a request from Archbishop Raymond Burke and required approval from the pope. The moves means they are forbidden to function or represent themselves in any way as priests. The action also means the archdiocese is no longer has responsibility for their support.
In a statement, Burke expressed regret for those harmed by the four former priests, and for abuse by any other member of the clergy. The statement said the archbishop "deplores the grave evil of sexual abuse of a minor and reiterates his and the archdiocese's concern for the welfare of all children."
A leader of the Survivors Network of those Abused by Priests, or SNAP, welcomed the news but said there are many other priests accused of abuse who are still working.
"It leaves still dozens of abusive priests in St. Louis who have not been defrocked," SNAP's David Clohessy said. "Fundamentally, we believe the archdiocese still has to take responsibility for protecting the public from these men."
Funke, 58, was ordained in 1974. He was sentenced in 1987 to 10 years in prison after pleading guilty to 10 counts related to the molestation of two teenage boys while teaching at DuBourg High School. In addition to serving seven St. Louis-area parishes, Funke taught at Mercy High School from 1976 to 1979, and at Bishop DuBourg from 1979 to 1986.

At Sing Sing Correctional Facility in Ossining, where he had been imprisoned before being transferred to Woodbourne, he became an acolyte of Rabbi Irving Koslowe, the prison’s Jewish chaplain who was best known for escorting Julius and Ethel Rosenberg to the electric chair. Dr. Friedgood became an Orthodox Jew, although he has identified only five practicing Jews among Woodbourne’s nearly 800 inmates, half the number required for a minyan, or quorum, under Jewish law.

Again, No Parole for Doctor Who Killed Wife in 1975

Charles E. Friedgood, formerly a wealthy heart surgeon from Long Island who almost got away with committing the perfect murder in 1975 but managed to talk himself into prison, could not talk himself out this week.
In the fifth rejection since serving the minimum of his 25-years-to-life sentence for the murder of his wife, Dr. Friedgood, at 89 the oldest inmate in a New York State prison, was denied parole yesterday.
The State Parole Board has the discretion to delay a rehearing for as long as 24 months, but said he could apply again in 18.
After interviewing him at Woodbourne Correctional Facility in the foothills of the Catskills on Tuesday, three commissioners unanimously concluded, “It is very clear you continue to manipulate the board with ambiguous, carefully crafted and evasive answers.”
They said that Dr. Friedgood misstated “material facts” about both the murder of his 48-year-old invalid wife in their Long Island home in 1975 and “the support and residence” available to him if he was released. He said in an interview with The New York Times last month that a Veterans Affairs hospital would accept him.
“If the board allowed these misrepresentations to result in release, it would substantially undermine respect for the law,” the board said. Its decision in part echoed the language of previous rulings.
Without elaborating, the board also said, “there is a reasonable probability that you would not live and remain at liberty again without violating the law and your release would be incompatible with the welfare of society” and would “so deprecate the serious nature of the crime.”
Dr. Friedgood injected his wife, Sophie, the mother of their six children, with an overdose — five syringes — of the painkiller Demerol. Ms. Friedgood had been in poor health. The death certificate listed the cause as a stroke.
But the police were suspicious because the doctor had signed the death certificate himself. Five weeks later, he was arrested trying to leave the country with more than $450,000 of his wife’s cash, negotiable bonds and jewelry. Prosecutors said he intended to flee to Europe to join a Danish nurse with whom he had fathered two children.
Dr. Friedgood did not testify at the trial but insisted as recently as in the interview with the Times that he merely intended to deposit the funds in Britain to shield them from potential tax claims by the government and that he had a return ticket to New York the next day.
He was convicted of second-degree murder in 1976.
Among those who favored parole was the former prosecutor, Stephen Scaring. He said recently of Dr. Friedgood: “If he had kept his mouth shut and answered no questions, he never would have been prosecuted. He believed he could talk his way out of everything. Instead, he talked his way into it.”
Dr. Friedgood, who has terminal cancer and has undergone numerous operations at state expense, insisted that he had been previously rejected for parole under a Pataki administration policy against releasing violent felons. Two of the three commissioners who ruled yesterday were appointed by Mr. Pataki’s successor, Gov. Eliot Spitzer.
One of Dr. Friedgood’s lawyers in a separate court appeal challenging the parole process, his daughter Esther A. Zaretski, had no immediate comment on yesterday’s decision, which said that Dr. Friedgood had killed his wife using his “skills as a physician to cause her death and did so in a premeditated manner motivated by greed and lust.”
In the Times interview, Dr. Friedgood insisted that he had intended only to sedate her at her request, that he had given her an overdose but “figured with her tolerance, it wouldn’t be lethal.” Why, then, did he tell an earlier Parole Board that he was “guilty”? He later clarified he was admitting guilt only to administering the painkiller.
“The only way you can get out,” he said, “is, you have to admit you’re guilty and show remorse and repent, and then they’ll — they might release you.”

Rabbi L. J. Bernstein, 67, Orthodox Jewish Leader

Rabbi Louis J. Bernstein, president of the 1,000-member Rabbinical Council of America and a major spokesman for modern Orthodox Jewry for three decades, died on Sunday at his home in Bayside, Queens. He was 67.
The cause was brain cancer, according to family members.
Rabbi Bernstein was serving his third term as president of the Orthodox rabbinical group, the only person to be elected to the post that many times. He had been president from 1972 to 1974 and 1984 to 1986.
Rabbi Bernstein also held educational and synagogue positions within Orthodox institutions for more than 40 years. He was rabbi of the Young Israel of Windsor Park, Queens, since 1953, and a professor of Jewish studies at Yeshiva University since 1954.
He also reached out to the non-Orthodox, although, he maintained, without diluting or compromising the Orthodox principle that Jewish law is not subject to change by the norms of modern society.
In his second term as president of the council, for example, Rabbi Bernstein was caught up in a controversy when he accepted an invitation to speak at a hotel in Miami Beach before a convention of the Rabbinical Assembly, the main group of Conservative rabbis. Many right-wing Orthodox leaders criticized the appearance, saying it signaled an endorsement of Conservative innovations like the ordination of women as rabbis.
Rabbi Bernstein proceeded with the speech, explaining that he was not there to endorse but to warn the Conservatives against further changes in Jewish law like those adopted by more liberal Reform groups.
He added that he would not be pressured into silence by the right wing within Orthodoxy. "For us," he said, "the only guidelines must be what is right, and not what the right says."
Rabbi Bernstein was also active in Zionist causes and supported Orthodoxy in Israel. He was president of the Religious Zionists of America, a member of the executive committee of the World Zionist Organization and a member of the Board of Governors of the Jewish Agency.
Surviving are his wife, the former Pearl Moshel; four children, Sara Peretz of Jerusalem, David, of Manhattan, Sima Kern of Teaneck, N.J., and Avi, of Bayside, and five grandchildren.

Can anyone imagine the leading rabbi of the Conservative movement giving the keynote address at the Rabbinical Council of America's annual convention? Well, that is exactly what happened in 1985. That year, the head of the RCA, Rabbi Louis Bernstein invited Conservative Rabbinical Assembly leader Rabbi Alexander Shapiro to address their annual convention at the Homowack in upstate New York. Not only that, earlier that year, Rabbi Bernstein spoke at the RA's convention in Miami.
Predictably, the Mo'etzes Gedolei Hatorah objected (see page 24-25 here), and according to the New York Times, "letters were sent to the wives of several rabbis imploring them not to let their husbands attend the convention."
In response, Rabbi Bernstein made a surprising claim:
Before agreeing to the convention exchange, Rabbi Bernstein said, he cleared the matter with Rabbi Joseph B. Soloveitchik, the 82-year-old Torah sage at Yeshiva University, one of the most widely respected Orthodox leaders.
The reason it is surprising is that Rav Soloveitchik was opposed to interdenominational dialogue and cooperation with respect halakhic matters (as opposed to matters relating to issues of Jewish survival and defense), and the topic of Rabbi Shapiro's address was "recognition of Conservative ritual procedures" and a "call for a joint beth din, or rabbinical court, in the United States." These are the precisely the kinds of topic Rav Soloveitchik held should not be the subject of interdenominational cooperation.
It could be that Rav Soloveitchik was not made fully aware of the situation. By 1985, Rav Soloveitchik was very ill and was no longer actively giving shiurim. It is also possible that while Rav Soloveitchik opposed cooperation with other denominations -- such as the creation of joint religious courts -- he had no problem with giving a Conservative rabbi a time at the podium.
My admittedly armchair analysis is that this represented some sort of watershed in Orthodox politics. These events are unimaginable today. While left-wing Modern Orthodox institutions like YCT might interact with Conservative rabbis and scholars, the mainstream Modern Orthodox represented by the RCA would not. But it's not just a matter of substance, it’s a matter of conviction and self-confidence. Just check out the stridency of Rabbi Bernstein's defense of his invitation to Rabbi Shapiro:

ReplyDeleteWilli Foods is owned by Willi Investments, a publicly traded company. Gaydamak owns most of the shares of the parent company and the Willigers who founded the company currently own very little. So this is a Gaydamak show from start to finish. The putz is "merging" with himself.
Gaydamak is pulling a stunt here that Kobi Alexander is doing in Namibia. They are both very rich criminals who are trying to throw around their largesse to various charities in the hope their host country won't extradite them. Gaydamak has not only shelled out many millions to send Sderot residents on vacations and to shelter Galil residents from terrorist rocket attacks, but he also started his own political party that has 8 seats in the Knesset. The putz is also now gearing up to run for mayor of Jerusalem. Let's see if this is enough to stave off the hot water he's facing for money laundering in Israel itself.

ReplyDeleteThe two child rapists were brought to the yeshiva by the English principal Patrick Meloy and assistant principal Michael Berk. They were both gay Irishmen who brough all their fellow faygs from Bishop DuBourg including one shikker who was always stoned on his 5th bottle of whiskey.
Robben would ask the kids their opinion of homosexuality. Whoever spoke negatively of it would be in the bad graces of the entire staff and started getting penalized with bad marks for no good reason. Robben was the only fayg there who seemed "straight" and was able to take the kids in. It was also apparent that Robben and Berk were having an affair.
After the two rapists were arrested, someone drew a sketch of their mug shots and hung it up. The faygs went beserk and ran to Rabbi Kleiman to demand he do something about it. The faygs conducted a witch hunt to figure out who drew it. They decided it was Feldheim, the nephew of the publisher, and really messed him up. It happens to not have been Feldheim.
The police never investigated to see if any of the yeshiva boys were abused, and i am sure that at least one or two were, because the rosh yeshiva never informed them about the job on the side and neither did the menahel Rabbi Storch who I hear now his own yeshiva in Lakewood.
I don't understand Rabbi Bomzer. I've spoken to him in learning and he is no slouch for a Young Israel rabbi. He knows Shas and at least Rishonim too at his fingertips.

Herbie Bomzer was the founding rabbi of Young Israel of Ocean Pkwy and stayed in that post for over 50 years. When the Americans were replaced by Russians, he retired and has been rabbi emeritus for at least 10 more years.

Remember that Rubashkins meats contribute the majority of the income to the CHK.
The Vast Majority of Rubashkins CHK_Money is emptied indirectly (or directly) into all the Osdoba Pockets.
It is transfered directly (or indirectly) into the 4 Osdoba Salaries.
What this means is simple:
Suppose anyone would want to be honest and expose major kashrus concerns at Rubashkin’s, which would remove the CHK Hechser from Rubashkins.
The result would be that 4 Osdoba would instantly become unemployed.

That is money which according to the bylaws belongs to the THREE elected Rabbonim, (Rabbi Schwei, Rabbi Heller and Rabbi Osdoba) yet ends up in Rabbi Osdoba’s pocket ONLY.
2) and 3) Rabbi Osdobo’s 2 children, working at the CHK / “Badataz ? “, (One Rav alone can’t be called “Badataz”) or whatever you want to call this fiasco. These 2 Osdoba children, also get paid from the CHK money by Rubashkin (while the real Rabbonim, Rabbi Heller and Rabbi Schwei do NOT !)
4) One more Osdoba, got a job in Iowa, also on Rubashkin’s Payroll.
Think about all of that the next time you think of the Integrity of the CHK and how comfortable you are with * T R U S T I N G * such a “Hechsher”.

Russia's strongman Vladimir Putin came to power with the backing of Chabad-linked oligarchs opposed to the oligarchs that backed the Russian Jewish Congress. Shorty after Putin's election, Putin recognized Chabad rabbi Berel Lazar as "chief rabbi' and ostracized the rabbis and leaders linked to the Russian Jewish Congress. On the day he recognized Lazar as "chief rabbi," Putin's police arrested the RJC's leading oligarch, Vladimir Gusinsky. Putin harassed, arrested or exiled pro-democracy oligarchs. He curtailed press freedoms and squashed democracy. He persecuted religious minorities. And all the while, Chabad's Berel Lazar stood by Putin's side, praising Putin.
ReplyDeleteLazar led a campaign to de-link US-Russia trade status from Human Rights. He gave Putin a medal while standing on the bone and ash of Auschwitz. He began the process of whitewashing the Soviet Union's murder of Raul Wallenberg.
But it was not enough.
Lazar did not succeed in changing Putin's thuggish image, either in the US Congress or in American public opinion. Now it seems Vladimir Putin has a theory about why Lazar has failed, and Putin is acting on it.
Putin now believes only a rabbi that represents all the varied Jewish communities of Russia can do the job. Lazar, despite his claims to be representative of all Judaism in Russia, is clearly a nothing more than Chabad's political leader. That is how Lazar is viewed in the West, and it is how Lazar is viewed in Israel, as well.
So, yesterday Putin invited the once exiled Chief Rabbi of Moscow Pinchas Goldschmidt to a private meeting in the Kremlin, the first time a non-Chabad, non-Lazar rabbi has been so honored.
The move has sent shockwaves through the Russian Jewish community. And those shockwaves may be felt as far away as Israel. According to Ha'aretz, which broke the story:
The sudden turn of events in Moscow may also have an effect on Israeli politics. In contrast to Lazar, Goldschmidt is a Lithuanian ultra-Orthodox rabbi and is very close to Rabbi Elyashiv, a powerful political figure in Jerusalem. Goldschmidt's improved standing in Russia could help [Russian-Israeli oligarch Arkady] Gaydamak in his plans to run for mayor of Jerusalem.
Ha'aretz notes that Gaydamak is the patron of the RJC and has been in a feud with fellow oligarch, Chabad's Lev Leviev. The move by Putin is seen as a snub to Leviev as well as a rejection of Lazar.

According to documents recently obtained by the UFCW through Freedom of Information Act requests, over 250 Noncompliance Records (NRs) were issued to Agriprocessors by USDA’s Food Safety and Inspection Service (FSIS) between January 1, 2006 and January 24, 2007. In addition, FSIS records show two Class I meat recalls in 2007 attributed to Agriprocessors. FSIS documents also cite numerous food safety violations committed by Agriprocessors that may have increased the risk of food-borne illnesses to consumers.
Specific findings include:
At least five citations for faulty monitoring relating to Bovine Spongiform Encephalopathy or "Mad Cow" disease.
Over a dozen NRs issued for fecal and bile contamination of beef and poultry.
Four NRs issued for foreign objects, plastic and metallic, found during sausage and poultry production.
Three NRs issued in relation to rodent problems, including live rodents and feces.
"A serious mislabeling noncompliance" involving a shipment of beef.
“Mad Cow” Disease and Agriprocessors
In the space of less than eight months, Agriprocessors was cited by the FSIS for violations involving processes for screening for Bovine Spongiform Encephalopathy (BSE), or "Mad Cow" disease, on at least five different occasions. A sixth violation dated April 2, 2006, concerning spinal cords may also be related, although this is not clear due to the redacted state of the document.

Salmonella Contamination
In July 2006, Food and Water Watch, a nonprofit consumer organization, released a report on Salmonella issues at USDA-inspected broiler chicken establishments. According to the report, Agriprocessors failed to comply with USDA Salmonella standards on two separate occasions in 2000 and 2005. Contamination rates for the failed test periods at Agriprocessors equaled 25.5 percent in 2000 between the time period 5/9/00 to 11/29/00 and 29.4 percent in 2005 between 8/1/05 to 12/1/05.

WINNESHIEK One of two Postville men accused in the robbery and shooting of a Decorah convenience store clerk will be sentenced March 10 after pleading guilty to charges of attempted murder and first-degree robbery. Phillip Stillman, 22, entered the guilty pleas last week in Winneshiek County District Court. His trial was scheduled to begin Wednesday. Stillman and Pinchas Lew, also 22, were arrested in connection with the robbery of the Petro N Provisions store Sept. 27. During the robbery, clerk Marion Bakken was shot and wounded. She recovered from her injuries. The men are also charged with holding up a popcorn vendor in Ossian earlier that eve ning. Lew has pleaded innocent to attempted murder and first-degree robbery.
Stillman was later sentenced to 55 years.

Lew, a rabbinical student working at Agriprocessors in Postville, wore a baseball cap over his Jewish skull cap, apparently to conceal his identity.

Bakken, who has a .38-caliber slug near her spine, said Monday she did not have to testify. She testified at Stillman's sentencing.
Though she was satisfied with Stillman's sentence, she is not happy with the fact that he'll be eligible for parole in five years.

DECORAH. Lew sentenced to 10 years Pinchas Lew, 23, one of two Postville men accused of robbing a Decorah convenience store and shooting the store clerk on Sept. 27, 1991, was sentenced to 10 years in prison Wednesday by Judge James Bauch.
Lew remains free on $100,000 bond, which was posted by an acquaintance shortly after Lew's arrest. Lew has already filed an intent to appeal.

Pinchas Lew and Phillip Stillman, both then 22, came to Postville to work at the kosher meat plant. Lew is a tall, thin former rabbinical student and son of a respected Brooklyn rabbi. Stillman is the Colombian-born adopted son of an Orthodox Jewish couple in Queens.
On the night of Sept. 27, 1991, the two went on a holdup spree. Stillman, who had been drinking, was the gunman. Lew, wearing a baseball cap over his yarmulke, was the getaway driver-unwittingly, contends his lawyer. He drove a car that had a temporary spare tire on one front wheel, and its license plates had been removed.
The first victim was an elderly popcorn vendor in the town of Ossian.
Stillman flashed the butt of his .357 magnum revolver and made off with $70.
The second victim, a 50 year-old grandmother clerking at a convenience store in Decorah, rang the silent alarm when he demanded money. Stillman shot her and fled. The woman, critically injured, recovered.
The two, easily spotted by the lopsided, licenseless car, were captured without resistance a short time later.

DECORAH (AP) - A Postville man serving a 10-year prison sentence in connection with a convenience store shooting was transferred to the Winneshiek County Jail after he complained he wasn't served kosher food.
Pinchas Lew, 23, was released from the Iowa Medical and Classification Center at Oakdale after serving one day.
Prison warden Rusty Rogerson said Lew's request for a special diet was impossible to meet.
"He was not ever going to receive it," Rogerson said. "We don't provide kosher diets. We prepare 600,000 meals per year here."
Rogerson said the Oakdale center serves specially prepared meals only on a doctor's order.
A court order issued last week said the transfer was for sentence reconsideration.
Lew was sentenced in December after he pleaded guilty to conspiracy to commit a forcible felony. He admitted driving a getaway car after Phillip Stillman shot a convenience store clerk during a robbery.
Stillman pleaded guilty last February to attempted murder and first-degree rob bery. He is serving a 55-year sentence.
Winneshiek County Sheriff Floyd Ashbacher said there's barely room in his jail, but he's required to hold Lew until a judge can determine where - or if - he should serve his sentence.
Rabbis bring specially prepared food to Lew's jail cell at their own expense.
Rogerson said Stillman also requested kosher food when he was brought into prison but was denied.
"I don't understand the difference between the two cases," Rogerson said. "I really don't."

DECORAH - After serving less than three months in jail, Pinchas Lew was placed on probation, with special provisions, for five years.
During Tuesday's hearing, Lew's attorney, Lawrence Scalise, questioned Rabbi Shalom Lipskar about the Aleph program that Lipskar started 12 years ago as an alternative to prison.
After an extensive background check, Aleph officials determined Lew could benefit from the program, Lipskar said.
The program involves intensive study, prayer and rehabilitative counseling.
Lipskar testified that Lew had acted irresponsibly but was not by nature "diabolical."
Bauch ordered Lew to take part in the Aleph program, which will include residing in Morristown, N.J., for at least six months.
Lew will then be placed under house arrest for six months at his father-in-law's residence in Brooklyn, N.Y.
During the year, Lew will be required to live as a monk, with no leisure activities, Bauch said.
There are no televisions or radios at the campus, and Lew will be allowed to read only designed texts. He will be required to remain in the program for four more years and to perform 750 hours of community service.

CHAPEL HILL -- A rabbi who was convicted of a felony 10 years ago said Thursday that he intends to stay in town and minister to students on the University of North Carolina campus.
Pinchas Lew, known as Pinny, has faced growing criticism this past month from the Jewish community after the discovery of his involvement in an attempted armed robbery.
Members of the Jewish community called him to a meeting Wednesday night in which they asked questions about his involvement in the incident. Many were interested to know whether Lew had paid the $1.6 million he owes the shooting victim in damages as part of a civil suit.
But the meeting did not accomplish its goal of healing. Several members of the Jewish community said they didn't feel Lew answered the question about restitution directly.
"That's a key issue that was not addressed," said Art Werner, the president of the Durham-Chapel Hill Federation. "People are frustrated that they're not getting an answer."
The Jewish community has no authority over the rabbi, who was chosen for the job by his New York-based Lubavitch group.

The Chabad-Lubavitch center in New York knew of the incident when it appointed Lew to the Chapel Hill position in 1997, said Rabbi Yoseph Groner of the Chabad Lubavitch of Charlotte.
Rabbi Steven Sager of Durham's Beth El Synagogue paid Lew a visit and urged him to come forward and answer the questions festering in people's hearts. Last week, Lew finally agreed.
He arrived at the Freeman Center for Jewish Life on the Duke University campus, wearing a suit and striped tie, with his wife, (Name removed), and their youngest child at his side. About 100 members of the Jewish community turned out to hear his story.
It was not an easy night.
Lew's wife took the platform first, her baby strapped in a pouch on her chest. She thanked the 100 people who had come out to the meeting, saying she had received many calls of support all week. Next came Rabbi Sager, who asked the group to listen with a compassionate ear and repeated some of the questions people wanted Lew to answer.
Starting out in a soft voice, Lew began reading his prepared text. But the microphone wasn't working and several people in the audience called out, "We can't hear you!" The sound was turned up, and he began again. Lew apologized for the incident and then invited questions. Few, however, were interested in the details of the crime.
For members of the Jewish community there were two main issues. Had Lew repented and sought "teshuva," which in Hebrew means a turning inward in self-examination? And had he paid restitution to Marion Bakken, the victim of the robbery?
"Have you apologized to the woman who was shot?" someone asked.
"Would 'sorry' have changed anything?" he responded.
The crowd pressed the issue, wanting to know if he had made an attempt to pay the $1.4 million awarded Marion Bakken in a civil suit. (Lew never attended the proceedings of the civil suit, filed on behalf of Bakken.)
Lew gave several answers.
"I never plan to make that kind of money."
"It's nobody's business."
And finally, "I'm in compliance with my responsibilities."
Sam Levine, a professor of chemistry at N.C. State, took it a step further. "Are you in compliance with the Jewish concept of repentance?
"You ought to know that we in the audience are hoping to hear some kind of concrete description of what you have done by way of teshuva," he said. "We don't have a feel for what you've done."
Lew repeated that he was in compliance. But many members of the audience were not convinced.
"What's so abhorrent to us is that he did not have any human reaction to anything in his history," Levine said later. "This is so upsetting to us. I have tears in my eyes when I say this, but we feel he is not a mensch (a truly good human being)."

CHAPEL HILL, N.C. -- A Hasidic rabbi who recently acknowledged his role in an armed robbery in Iowa 10 years ago has been arrested and charged with exposing himself to a woman in his home.
Pinchas Lew, 31, was charged with misdemeanor assault on a female, said Police Chief Gregg Jarvies. Part of the Orthodox Jewish sect Lubavitch, Lew conducts services for University of North Carolina students at his home in Chapel Hill. He is married and has five young children.
On May 16, Lew allegedly exposed and touched his genitals repeatedly in front of an unrelated woman in his home, Jarvies said.
According to the woman, he locked all the doors to his house, then continued to move in front of her, causing her to fear imminent assault.

A man has been arrested for allegedly invading an elderly woman's home in Rutland Town Monday morning.
Police say 33-year-old Scott Beyor broke into the home, cut the phone line >>> and made breakfast. <<< He then woke the woman up, demanded her purse and took several items before fleeing.
The victim was not hurt.
Beyor was picked up a few hours later by troopers. He is charged with burglary and giving false information to police for allegedly giving them a false name during his arrest.

ReplyDeleteI remembered something about this but didn't want to comment until I found the article. Trader Joe's switched to Rubashkin in 2004 because of a genayvishe scandal with Empire. One California county banned the sale of Empire after they were caught overstating the weight on chicken packages by about 10%.

In a 5-4 vote, the Supreme Court decided against an orthodox Jew’s right to wear a yarmulke head covering in the U.S. military. In his dissent Justice William Brennan wrote: “I find it totally implausible the suggestion that the overarching group identity of the Air Force would be threatened if Orthodox Jews were allowed to wear yarmulkes with their uniforms,” Brennan wrote. In his conclusion, Brennan said the decision was devastating for “patriotic Orthodox Jews.” He wrote that “we must hope that Congress will correct this wrong.” [4]
Rabbi Balkany lobbied successfully on behalf of federal law, 10 U.S.C. § 774, which “provides for a general rule that "a member of the armed forces may wear an item of religious apparel while wearing the uniform of the member’s armed force.”

ReplyDeleteIn 1987 Balkany became embroiled in a scandal after a number of California legislators tried to have a grant that he had solicited on behalf of Yeshiva Rav Isacshon in Los Angeles overturned on the grounds that Balkany had acted improperly in soliciting politicians to approve the $2.3 million grant.[5]
Ultimately everything was found to be aboveboard. The grant was fully funded. The building was constructed, its classrooms filled.

ReplyDeleteIn 1994 Balkany tried to bring David Luchins an Orthodox Jew and official of the Orthodox Union as well as a then aide aide to Senator Daniel Moynihan[7] before a rabbinical court after Luchins wrote memos complaining about Balkany's heavy-handed efforts to compel Israeli government officials to use U.S. aid money to fund projects Balkany favored in Israel. [8] Luchins - a self described liberal - claimed that this was part of a witch-hunt against him by right-wing lobbyists such as Balkany trying to silence him.[8]
Balkany told the press that "We have grave concern with a lot of things he is doing in the Jewish community under the auspices of being a senior staff member of Sen. Moynihan's, whenever an issue comes to his attention, he gets involved and does great harm. He's hurting individuals and hurting communities, he thinks he has a direct link to Sinai. I haven't accepted his word as God's word yet."[8]
Luchins responded that "Jewish tradition says that every Jewish soul was at Sinai, and I assume Rabbi Balkany's was there also. We may not have met because he might have been in the back, collecting money. He apparently feels a need to find a scapegoat for his own loss of influence in the new administration."[8]
Utimately Moynihan refused to allow Luchins to attend the hearing.[9]
In March of 1995 a rabbinic court met at Yeshiva University at Rabbi Ahron Soloveichik's suggestion to hear Rabbi Balkany's charges against David Luchins. The court, consisting of three revered Yeshiva University Roshei Yeshiva, cleared Dr. Luchins of all charges.

In 1996 a request for $2.3 million in federal funding for a charitable project was accepted after Bob Dole interceded on his behalf. Dole had been a beneficiary of Balkany's political fundraising and got involved after the proposal had first been rejected by the U.S. Agency for International Development.[10] The request was in relation to funding for a program to help Russian immigrants gain computer skills for the workplace that was initiated by an obscure Yeshiva in Jerusalem run by Rabbi Shlomo Riskin, Ohr Torah. Balkany subsequently sued Riskin in a Beit Din for $200,000 over non-payment of fees related to his activism on his behalf. Months later, in a quiet comeuppance, the president of Ohr Torah settled with Rabbi Balkany and paid the fee.[11] Riskin argued that he had never asked Balkany to intercede with Dole on his behalf and refused to attend the hearings[11]
Despite the fast-tracking of the payment following the AID meeting with Dole, both Dole and AID denied that was any exesive influence exacted on the organisation by the then Senate Majority Leader on Balkany's behalf.[11]

According to the Village Voice, several people who have dealt with him say that he has claimed the power to arrange favorable treatment in prison for individuals such as Leona Helmsley and Crazy Eddie Antar.[5] He was subsequently banned from making any contact with prison service officials. As part of the 2004 deal with prosecutors of the charity fund pilfering scandal he agreed not to lobby on "any matter involving a federal inmate or any other person charged or convicted of a federal crime." Prosecutors alleged that would ensure favourable conditions for Jewish prisoners in exchange for money of donations to his charities. After he arranged a brief prison release for Helmsley so that she could visit family members' graves before Yom Kippur, the billionaire made a contribution to his school.[6]
For it's reporting, a $40 million lawsuit has been brought against The Village Voice by Balkany.
He was actually acquitted of the sex assault because of a technicality. Since it was his own home where he exposed himself and masturbated that is within his rights. The judge further ruled that it is not illegal to hint to your cleaning that you'd love to have sex with her. I still don't understand the ruling because he also locked the doors which should be kidnapping / confinement.

Jason Bedrick (born June 5, 1983) is a member of the New Hampshire state legislature.[1] He is a Republican representing Windham, New Hampshire. He is also an Orthodox Jew.[2]
Bedrick is the first Orthodox Jew to hold elective office in New Hampshire, which has fewer than ten Orthodox Jewish families among its 1% Jewish population.[2] New Hampshire has had several prominent Jewish elected officials, such as Paul Hodes and Warren Rudman, but no others have been Orthodox.[2]

Bedrick works as a salesman part time, and intends to enroll in law school.[1] He also serves as gabbai of the Wellesley Weston Chabad-Lubavitch synagogue, in Wellesley, Massachusetts.[7]
