The school Toras Eliyahu has re-employed the alleged child molester to teach their Grade Three kids.
In response to the questions/criticism about why they chose to put a child molester back into their classroom, Toras Eliyahu's menahel is now claiming:
1. They knew all about the allegations (came out in the summer) against Akiva Kagan before they employed him this semester.
2. They have thoroughly investigated the charges against him, and found him innocent of all charges and worthy of being entrusted with more kids.
They are clearly in a bind.
If they say they DIDN'T know about the allegations, then this raises serious questions about their screening process.
Once they say they DID know about it, they have to explain why they've put a pervert to guard over 30 kids?
The allegations have been investigated by the Tahor Mishpacha (Tznius Patrol) of Geula, Meah Shearim - who found Kagan "uncooperative" and therefore recommended taking it to the police. (Kagan refused to take a polygraph examination)
The police are now in the early stages of investigating it.
The school is clearly lying about their 'investigation'. They have no knowledge or experience of dealing with such matters - and simply swept the allegations under the carpet, following the lead of local rabbonim headed by Rabbi Chaim Malinowitz of Art Scroll.
I am amazed that parents entrust their children to these people - who clearly don't care a damn about the safety of kids.
Where is the outrage? Why aren't parents making a stink?
Don't they care about their own children either?
The rabbonim don't care; the schools (now Ishrei Lev and Toras Eliahu) don't care; the parents don't care.
Aside from UOJ - does ANYBODY take a stand to protect frum children???!!

Following a meeting that lasted much of the day, the National Fraud Investigations Unit of the Police Department announced Sunday evening that they have decided to recommend that Prime Minister Ehud Olmert be indicted on multiple charges of bribery, fraud, breach of trust and other offenses. The recommendations were delivered to Attorney General Menachem Mazuz, who will have the final say as to whether or not to file charges against the Prime Minister.

ReplyDeleteI've never written a letter like this before, preferring to stay quiet, but after reading your excellent blog, I feel compelled to write to you to ask how to further an investigation against a potentially dangerous individual in our neighborhood.
After speaking to several mothers whose daughters have suffered at the hands of this woman, but refuse to go to the police since she has VERY powerful friends, a few like-minded people did some investigating.
This woman originally comes from England, where we found she was "slipped out the back door" from her post as teacher in a Beis yaakov following "inappropraite behaviour".No charges were filed, but she was asked to leave the country and not come back.I have confirmed this with several of the staff members of the school who have all signed a contract not to disclose any more information. She has since risen to a high position in Ramat bet shemesh as someone who works one on one with young and teenage girls, doing drama.
She has sleepovers and pool parties to which parents are not allowed to attend. During rehearsals for the shows she now puts on, parents must drop their girls at the door, but are not allowed in. The parents are so desparate for their daughters to be 'stars' that all but a few are willing to talk about the threats, both physical and psychological that she uses to control and manipulate the girls who want to work with her.
One mother told of this woman's ability to befriend girls in tricky family situations. In the middle of a divorce, she would take her daughter for long walks, turning up at the door after midnight to discuss her daughters role in the show. B"H, this mother pulled her daughter out, but received threats afterwards. Other mothers have confessed to their daughters being shaken by the shoulders if they are not performing correctly. She also has a group of "thugs" at her disposal, friends of her millionaire benefactor, who personally silence those families who attempt to spaek out. People are terrified.
I myself have witnessed the intimidation first hand, when several emails and visits asked me and my family to leave the neighborhood for attempting to stand up to her. One woman and her family left Israel for good when the intimidation and tide of rumor became too much. Everyone here knows there is something strange going on, but are so overawed by this person's forceful personality and charisma and so terrified of the benefactor ( you would not even begin to believe which multi-millionaire philanthropical family they represent) that they stay quiet.
So, where do we go from now? We know that there are several girls she has singled out as her "personal friends" that sleep over at her house and get to use her rich friend's pool for parties. Mothers have noted the change in personality as these girls bow to her will but simply don't know what to do.What advice can you give us, as mothers in Israel against a woman like this? At one point the Rabbonim three years gao actually came out against her and her shows, banning them, but a year later she was back on her feet and with endorsemant from our old friends at Hamodia!
Something really stinks here, since she is actually doing Broadway shows, so one asks how much her "friends" gave to pay off Hamodia for their approval?
So far, sexual abuse has not been mentioned, although many have suggested that her own sexuality is questionable and the fact that the girls are touched and manipulated during private rehearsals has been enough to start several rumors.
However, we do not want this to be a witch hunt. The simple fact that he was removed from one school should have been enough to prevent her from being hired in Israel. The American prinipal at the beis yaakov high school here did fire her from a teaching role, but she still haunts the school corridors to visit her "groupies".

Superstar money manager Mario Gabelli says the U.S. consumer sector is dead in the water, with ominous implications for the economy and stock market.
Real personal consumption expenditures dropped 0.4 percent in July, the biggest drop in four years. July represented the fifth month out of the last 10 that real consumption fell.
Many analysts have said that growth abroad, particularly in emerging markets, will be strong enough to counteract the downturn in consumer spending. But Gabelli, who oversees $28 billion as chief executive of Gamco Investors, disagrees.
"The U.S. consumer is greater than China, Russia, India and Brazil in terms of the impact," he told Bloomberg TV.
"As we're slowing down, we're slowing down the world. The consumer has been in a recession since November of 2007."
U.S. GDP expanded at a 3.3 percent annual rate in the second quarter. But most economists attribute that rise to consumers spending their tax rebates. Like Gabelli, they expect the economy to slow rapidly.
The consumer weakness spells trouble for the stock market, Gabelli points out. "The concern over the earnings outlook for 2009 is well founded," he says.
Many experts also share Gabelli's dismal view of the outlook for U.S. consumers.
"Consumers are very focused on value, stretching their dollars, and anything deemed not absolutely of need, they are forgoing those purchases," Ken Perkins, president of Retail Metrics, tells Reuters.

While some will say that this is 2008 and one can not compare this era to any other, they are mistaken. The systems that made America great were uniquely our own. These systems of free market capitalism, tempered only with a rational amount of regualtion, were "The goose that lay the golden egg." In just a few short years, we have seen fit to kill the goose. Now we have aligned ourselves with European systems that ensure a priviledged class and a sea of mindless drones sucking down episodes of American Idol and NFL Sunday, all the while unawares their lost liberty and opportunity to succeed. What's next? The Obama/Pelosi "Gulag Archipelago"
ReplyDeleteInstead of buying insolvent companies, Treasury should have bought the CDO's to minimize overall exposure. Now the taxpayer is stuck with the risk while the banks get off the hook. The Fed will be pumping out more paper that will devalue the Dollar, cause more inflation and make the national debt for this buyout bigger than our GDP. I don't buy their estimates of how much this will cost because the final pricetag is ALWAYS exponentially higher. It's simply another favor Paulson is giving to his Wall St. buddies so they can keep their bonuses, while get stuck with the bill. This is cronyism at it's best and will only deteriorate the economy in the long run.
ReplyDeleteFannie and Freddie are government subsidized mortgage institutions that our Congress is responsible for. It's another democrat-initiated financial fiasco started by Franklin Roosevelt who also initiated our mismanaged social security system, and TVA -- another government pork-laden dinosaur. Freddie and Fannie became too big to allow failure. So who allowed them to get that big? The democrats. Now comes the bail-out. At the end of the day the democratic party is a bunch of socialists. What's our governement doing in the mortgage business anyway? What's next -- government assisted used car sales? And who is accountable for this mess? Isn't it nice that nobody gets blamed? Everybody knows who pays the tab, but nobody is accountable. The free-fall will continue until mortage-lending is based on accountability, which nobody wants to own up too. That's too bad for the tax payer.

Each Decade it gets worse and worse, it won't be long before you work and the Feds send you a check each month of what they think you should have. Thousands of jobs were lost when the EPA mandated stricter rules for deisel trucks, now the price of deisel has soared because they try and make it "clean". Think of the Billions wasted on Ethanol, and we all know that it takes more energy to create it than it gives back, plus you take a food crop to produce it. Lastly, now the Big 3 are hurting because the CAFE standards are being raised to levels that just don't make sense. You'll have to accept small, lightweight cars which don't do well in crashes just because of group of wackos put the fear into everyone that humans are causing global warming. Politicians should never decide how you live your life...that's been tried, it's called Communism.
ReplyDeleteOnce again those at the top of the financial food chain are getting a pass at the expense of the general taxpayer. We need a changed mind set in the laws and general population that failure should be observed by all and paid for by those at fault and not the general population. We carried out a refinance a few years ago so that we are no longer obliged to pay a bank, but a family member that had enough assets to carry our remaining loan. We live below our means in order to stay more financially secure. The federal government has no money with which to take over a financial block. All of the federal government’s “money” is either printed on demand which causes devaluation and inflation, or taxes which eat away at the earnings of again the individual. The current mortgage problems are the result of a few individuals that need to be held accountable in the harshest of terms. Unfortunately they are so highly connected in the CORRUPT political circles their names will never be revealed and they will not be harmed by this in the least. Once again the change we need is political accountability, and bailing out failing financial systems is NOT promoting the general welfare. It seems more like the goal today is to put the general population on welfare. Bring back the gold standard so we can put an end to socialism and cronyism.

The nationalization of Fannie Mae and Freddie Mac shows that the U.S. is "more communist than China right now" but its brand of socialism is meant only for the rich, investor Jim Rogers, CEO of Rogers Holdings, told CNBC Europe on Monday.
"America is more communist than China is right now. You can see that this is welfare of the rich, it is socialism for the rich... it's just bailing out financial institutions," Rogers said.
Stock markets jumped after the U.S. government's decision to launch what could be its biggest federal bailout ever, in a bid to support the housing market and ward off more global financial market turbulence.
But Rogers said in the long term the move spelled trouble.
"This is madness, this is insanity, they have more than doubled the American national debt in one weekend for a bunch of crooks and incompetents. I'm not quite sure why I or anybody else should be paying for this," Rogers told "Squawk Box Europe."
European stocks soared on Monday, led by banks. UBS was up 11 percent, BNP Paribas up 8 percent, Credit Agricole up 11.1 percent and HBOS up 13.8 percent.
"You certainly gonna see a huge jump in any financial institutions which owned a lot of Fannie (NYSE: fnm) or Freddie (NYSE: fre) ... because they don't have to worry about going bankrupt all of a sudden," Rogers said. (Watch the video on the left for the full interview)
"Bank stocks around the world are going through the roof, that's 'cause they've all been bailed out. You don't see the homeowners in Kansas going through the roof 'cause they're not being bailed out," he added.
"A Huge Mess"
However, despite the rally in Asian and European markets, the decision to take over Fannie and Freddie is likely to cause more volatility and needs careful consideration by investors, according to Rogers.
It's rarely good to jump in a moving bus and right now you got a lot of buses moving. I might short some more investment banks in the US, depending on how they rally over the next week, but other than that, I'll just sit and watch," he said.
Rogers, who is short on U.S. bonds, said these are likely to fall while commodities may rally. The two government-sponsored enterprises don't have good loans on their books, because "everybody else took the good stuff and dumped the bad stuff onto Fannie and Freddie," he said.
From 2010, Fannie and Freddie will have to shrink their portfolios by 10 percent a year until they reach $250 billion, to reduce the risk to the taxpayer, according to the Treasury plan. But this may put additional pressure on the housing market, Rogers said.
"That's going to also ensure that house prices continue to go down. It's going to be harder and harder to get a mortgage."
Investors should not pin their hopes on this year's presidential election for a solution to the problems, as none of the candidates is likely to find one, Rogers said.
"This is a big huge mess and neither one of them has a clue what to do next year. It's going to be a mess."

Sholam Weiss was indicted for his role in the insolvency of National Heritage Life Insurance Company (NHLIC). Lifeco Investment Group (Lifeco) was the sole shareholder of NHLIC. Through a series of real estate transactions, the assets of NHLIC were diverted to the officers of the company and to their associates in NY, IL and TX. Weiss was considered an organizer of the scheme to defraud. The charges against the group included racketeering, wire fraud, mail fraud and conspiracy. Weiss was an Orthodox New York rabbi who took over $450 million from National Heritage. He was convicted on 78 counts, but jumped bail and fled the country with many of the stolen assets. Weiss disappeared from the courtroom during the last day of jury deliberations. He was sentenced in absentia to 845 years' incarceration. He was arrested in Austria, but the Austrian government declined extradition. Co-defendant Keith Pound was sentenced to 740 years and restitution of $133.9 million. Michael D. Blutrich pleaded guilty in federal court for the Middle District of Florida to 18 felony counts of racketeering, wire fraud and money laundering. For over seven years, Blutrich concealed and laundered tens of millions of dollars that he and his co-defendants had stolen from LifeCo Investment and National Heritage Life. Blutrich was convicted on 22 counts and sentenced to 25 years' incarceration, subject to a reduction for testifying against others in the scheme. Lyle Pfeffer and Patrick Smythe were offered similar deals. Blutrich and Pfeffer then testified, had their sentences reduced to three years' probation and $82 million restitution. They entered the witness protection program in August, 2001. While they were under investigation for the National Heritage fraud, Blutrich and Pfeffer were also under investigation in Manhattan for racketeering charges related to the operation of two well-known strip clubs, Scores Entertainment, Inc. and Gold Club. Scores was visited by NBA celebrities and was often promoted by radio celebrity Howard Stern. Blutrich and Pfeffer used National Heritage to purchase an interest in Scores Entertainment, Inc. Blutrich was allegedly extorted by Steve Kaplan, the owner of Gold Club, a rival club, and Michael DiLeonardo, an alleged captain of the Gambino crime family. Blutrich testified that DiLeonardo demanded protection money, allegedly telling Blutrich that the garbage at the club would not be picked up, liquor would not be delivered, the club could be firebombed and that mobsters knew where his family lived. In addition to the National Heritage sentence, Blutrich was sentenced to 25 years' incarceration for racketeering, fraud and child pornography possession. Other individuals and corporations associated with the NHLIC insolvency in New York include Jan R. Schneiderman, a New York attorney who acted as general counsel for Weiss; Yaakov Starr, a/k/a Jan Starr, an officer in several of the Weiss companies; Isack Rosenberg, a co-owner of several of the New York companies involved in the scheme, Harry Gutman, a lawyer who was Weiss' partner in several companies, Frenkel & Hershowitz, a New York law firm which represented Weiss; David Schick and Bernard Shafron, attorneys at Frenkel & Hershowitz who handled many of the Weiss transactions; Lyle K. Pfeffer, a member of the investment and audit committee of LifeCo who owned and controlled National Mortgage Corporation, partially owned Nulenda and Future Diversified and FPDI Holding; and Richard B. Herman, an attorney who represented Weiss, Blutrich and Pfeffer in transactions involving NHLIC. Weiss controlled the following companies and involved them in the insolvency of NHLIC: South Star Management, Inc. (FL); National Housing Exchange, Inc. (NC); IWUB Corp. Obama Admits He’s a Muslim; ABC Covers For Him

Over the weekend, Barrack Hussein Obama went on the television show of former Clinton press secretary George Stephanopoulos. And in doing so, he revealed himself in a way that the liberal media has refused to do since he started running for president. In a supposed “slip of the tongue,” Obama referred to his “Muslim faith,” once and for exposing the truth about his Muslim past. A truth that all the party apparatchiks and all the liberal talking heads in all American haven’t been able to cover up. Some say it was a Freudian Slip. I say it was a Mohammedan Slip.
Perhaps the most disgusting part of this entire incident is the fact that as soon as Obama had said the words “Muslim faith,” the Democrat lackey George Stephanopoulos stepped in to help him. The words “Muslim faith” came so naturally to him that Obama didn’t bother to correct himself. Stephanopoulos immediately jumped in said, “Christian faith.” The left protects its own.
The question is this: How did he get this far? How did a Muslim stealth candidate manage to become the anointed candidate of one of the two major parties in the United States of America? The answer is the collusion of the Communist media. The media covered up this inconvenient truth about Barrack Hussein Obama because it did not fit into their storyline of the heroic black presidential candidate who would save America from its evil racist past. The media used his race as an excuse to support him and refused to look any deeper than that.
Even today, when this is the only story worth talking about, the media refuses to give it any attention. CNN talks about the weather. FOX talks about O.J. And MSNBC talks about itself. But I will talk about this story. I will play the clip of this Mohammedan Slip again and again and again until America realizes that it is too dangerous to vote for Barrack Hussein Obama. I will play this clip until America realizes that it’s a choice between an ex-Navy pilot and a community activist. The Nation -- Sarah Palin took the biblical Queen Esther as her role model when she became governor, according to her former pastor--a report that suggests her ties to Jewish history are stronger than you might have expected.
ReplyDeleteWhen Palin took office as governor in 2006, according to the New York Times, she asked her former pastor in the Assembly of God church in Wasilla for "a biblical example of people who were great leaders and what was the secret of their leadership"--that's what Paul E. Riley, the pastor, told Kirk Johnson and Kim Severson of the Times. He recommended the Old Testament story of Esther, the beautiful Jewish queen who persuaded the Persian king to save the Jews from annihilation and instead let them kill their enemies. The story is celebrated by Jews annually in the Feast of Purim.
The parallels are clear. Esther was selected queen in a beauty contest; Palin was runner-up in the Miss Alaska pageant.
So Queen Esther apparently provided the role model for the former beauty queen who went to our own king and asked for earmarks for her people.
The Palin/Queen Esther report has sparked a flood of commentary from fundamentalist Christian web sites. One reports that "Sarah Palin, like Esther, was an unlikely choice. Sarah Palin, like Esther, is bold and courageous in the face of fear. Sarah Palin, like Esther, proves you can be loyal and devoted to your family while having a high position. But perhaps, more than anything, . . . we are seeing someone right before our eyes who is capturing the hearts of the American people in a way that defies description" - just like the Bible says, "And Esther won the favor of everyone who saw her."
Another says "Every once in a while a woman comes along who is made for the times. Sarah Palin is such a woman. . . . Another woman, Esther, was brought on the scene by God at just the right time. God's timing was perfect for he used Esther to save the Jews"--and now he is using Palin to save the Republicans.
One problem with this view -that God sent Palin the way He sent Esther -- is that the Book of Esther never mentions God. It never says God sent Esther to save His people, or even that Esther's belief in God gave her the power to defeat her enemies. Somebody should point this out to the fundamentalists.
If you follow the logic in the story - as another fundamentalist Christian website did - you find a "major, and creepily precise" parallel between the threats to Jews then and now. In Esther's day the threat came from Persia - and what country is the modern successor to Persia? Iran, of course -- "the same Iran that has vowed to wipe Israel off the map and is well on their way to acquiring the nuclear weaponry to do so . . . . And along comes tough, clear-eyed, plain-speaking Sarah Palin."
The implications for Palin's Iran policy are clear. In the Bible, after the Jews are saved from annihilation, and after the first day of Jewish revenge against their enemies, the King tells Esther the Jews have killed 500 people, and asks what she wants to do next. Esther says she wants permission for a second day of killing - so the king grants the Jews the right "to destroy, to slay, and to cause to perish the entire host of every people and province that oppress them, small children and women, and to take their spoils for plunder."
The Bible says the Jews then killed 75,000 more of their enemies. It doesn't say anything about Jewish casualties, which makes it seem like a one-sided slaughter. (This part usually doesn't get mentioned at the Purim carnival.)

I don't think anyone can fill Boog's shoes. Besides, I don't think you've heard the last of him. Regarding Dov Hikind's radio show, I felt like puking at midnight this past motzaei shabbos, and it wasn't from my wife's cholent. To think that this store owner, who's molested g-d knows how many children over at least a fifteen year period, can walk around freely with immunity, makes me wonder if we're making any progress at all. How can Dov be so sure that this guy is no longer a danger to society. Because he claims that he's in therapy? Because he said "I'm sorry", fifteen years later, when the statute of limitations had expired? As an elected official and a public servant, doesn't Dov have the obligation to publicize the criminal's name? Not once in the program did Dov ask "David" whether he ever considered going to the police. He asked him a bunch of other questions, and not once did the issue of the police come up. The same thing when he interviewed the mother of the Williamsburg victim. As an elected official, shouldn't he be advocating following the law of the land? When there's a robbery, a mugging, a stabbing, or a rape, do we think twice about going to the police? Why is it still considered taboo to go to the police when a child has been molested???? Can someone please give me an answer??? Why are there hundreds of child molesters (that we know about) roaming freely and being given the biggest respect, while their victims are not allowed to get any sense of closure?
Somehow, we are supposed to feel a sense of relief and accomplishment that Dov Hikind has finally taken on the "issue" of child molestation. In the words of Bruce Springsteen, I wonder if we have taken "one step forward and two steps back".

He is one the most prominent Rabbis in RBSA.
He got himself involved in the begining of this mess by trying to force parents to use "his" therapist. He wanted it to be "contained" within the Charedi community.
Where is he now? One word from him and Torat Eliyah wouldn't have touched this guy.
When it comes to unimportant matters in our city his name is everywhere but when nefoshos are involved he is no where to be found (or heard).

Malinowitz who has no connection with Toras Eliyahu and probably isn't held in high regard by them due to his support for Slifkin, the fact that his kehilla is moderate, and the fact that his kehilla generally doesn't send to that school. Therefore, he has no control over who works there. I don't know what R. Malinowitz did or didn't say or do regarding the issue in the previous school (where perhaps he was asked by some of his congregants who were sending to the school), but if you do know then that would be a more appropriate topic to discuss in you emails to him, instead of asking him to fire someone else's employee.

Malinowitz is and I dont care who he is, I will write, call and even harass any one that had any contact with this story, now I dont know the exact details of this story, only that there is a yeshiva that hired an employee knowing of the accusations against him, and the more people who are pressured to do something about it the better.
btw I sent e-mails to all the people mentioned above, I got their e-mail address through the yeshivas web site www.TorasEliyahu.org.

Shareholders in Fannie Mae and Freddie Mac saw the value of their stock nearly disappear Monday after the mortgage giants had been taken over by the federal government, but the companies' chief executives will leave after banking millions and taking millions more on the way out the door.
Fannie Mae's Daniel Mudd and Freddie Mac's Richard Syron stepped down but are helping with the transition of their companies into federal conservatorship under the Federal Housing Finance Agency. The agency has not said how much they will earn in their new roles.
By conservative estimates, Mudd, 49, and Syron, 64, will leave with an additional $7.3 million and $6.3 million, respectively, as part of a severance package, according to an analysis by Paul Hodgson at the Corporate Library.

Child Labor Law Charges Filed Naming Agriprocessors Officials and Plant in Postville
Statement of the Iowa Attorney General’s Office:
The Iowa Attorney General’s Office filed a criminal Complaint and Affidavit Tuesday in Allamakee County District Court in Waukon, alleging more than 9,000 violations of Iowa Child Labor law at the Agriprocessors, Inc., plant in Postville.
Defendants named in the Complaint and Affidavit are Agriprocessors, Inc.; Abraham Aaron Rubashkin, principal owner and president of Agriprocessors; Sholom Rubashkin, manager of the slaughtering and meat packing plant at Postville and an officer; Elizabeth Billmeyer, human resources manager of Agriprocessors, Inc.; and Laura Althouse and Karina Freund, management employees in the human resources division of Agriprocessors, Inc.
The Complaint alleges a total of 9,311 child labor violations, involving 32 youths under the age of 18. (Seven of the 32 also were under age 16.) The alleged violations date back to Sept. 9, 2007, for some of the children, and to as recently as May 12, 2008, when Federal officials raided the Postville plant. The violations all are simple misdemeanors, each punishable by up to 30 days in jail and/or a fine of $65 to $625.
Iowa District Court Judge John Bauercamper scheduled an initial appearance for all defendants in Allamakee County Magistrate Court for 2 p.m. Wednesday, September 17, 2008.
The Complaint alleges violations of five sections of the Iowa Child Labor law, Iowa Code Ch. 92: employing a child under age 18 in a meat packing plant; employing a child under age 18 in an occupation that exposes the child to dangerous or poisonous chemicals; employing a child under age 16 who operated power machinery; employing a child under age 16 who worked during prohibited hours or more hours in a day than permitted by law; and employing a child under 16 who worked more days in a week than permitted by law. (See breakdown of alleged violations, below.)
The Affidavit said: “During the period of September 9, 2007, through May 12, 2008, the persons listed as employee-victims in the attached Complaint were employed and permitted to work at Agriprocessors’ slaughtering and meat packing establishment. All were under eighteen years of age on each of the dates listed. Throughout their employment these children were exposed to dangerous and/or poisonous chemicals, including, but not limited to, dry ice and chlorine solutions. Several of these employee-victims were also under sixteen years of age during the dates for which they are identified as such in the Complaint. Throughout their employment, these children, while under sixteen years of age, were employed in the operation of or tending of power-driven machinery, including, but not limited to, conveyor belts, meat grinders, circular saws, power washers, and power shears.”
The Complaint and Affidavit also enumerates more than 1500 violations relating to hours worked, including employee-victims under age 16 who worked more than eight hours on specified days, and more than forty hours in specified weeks. The Complaint also alleges records show instances of children under age sixteen working before 7 a.m. and after 7 p.m., and, while school was in session, working more than four hours in a day and more than 28 hours in a week. “The records of Agriprocessors, Inc., also confirm, as alleged by each of the employee-victims, that each of these employee-victims worked more hours of overtime each week than that for which they were compensated,” the Complaint said.
According to the Affidavit: “All of the named individual Defendants possessed shared knowledge that Agriprocessors employed undocumented aliens. It was likewise shared knowledge among the Defendants that many of those workers were minors. The company’s hiring practices encouraged job applicants to submit identification documents which were forgeries, and known to contain false information as to resident alien status, age and identity.”
The Affidavit said: “Each defendant, either as principal or as aider and abettor, hired children, retained the employment of children observed working throughout the plant, and/or participated in efforts to conceal children when federal and state labor department officials inspected that plant.”
Criminal charges are only allegations, and defendants are presumed innocent until and unless they are proven guilty.
The Iowa Attorney General’s Office is serving in the role of prosecutor at the request of the Allamakee County Attorney. The matter was investigated by the Iowa Division of Criminal Investigation and the Labor Services Division of the Iowa Dept. of Workforce Development.
Alleged violations:
The Child Labor statute, Iowa Code Ch. 92, specifies that “every day during which any violation of this chapter continues shall constitute a separate and distinct offense,” and that “the employment of any person in violation of this chapter shall. . . constitute a separate and distinct offense.” Violations are simple misdemeanors. (Iowa Code sec. 92.20.)
The Complaint alleged 9,311 counts of child labor violations, as follows:
Iowa Code sec. 92.8 (9) -- prohibited occupations under age 18, meat packing plant: 3,857 violations. (“No person under eighteen years of age shall be employed or permitted to work with or without compensation at any of the following occupations or business establishments: . . . (9.) Occupations in or about slaughtering and meat packing establishments and rendering plants.”)
Iowa Code sec. 92.8 (19) -- prohibited occupations under age 18, exposure to dangerous chemicals: 3,857 violations. (“No person under eighteen years of age shall be employed or permitted to work with or without compensation at any of the following occupations or business establishments: . . . (19.) Occupations involving exposure to lead fumes or its compounds, or to dangerous or poisonous dyes or chemicals.”)
Iowa Code sec. 92.7 -- hours permitted for persons under age 16: 677 violations of hours-per-day limits or working during prohibited hours, and 130 violations of hours-per-week limits. (“A person under sixteen years of age shall not be employed with or without compensation, except as provided in sections 92.2 and 92.3, before the hour of seven a.m. or after seven p.m., except during the period from June 1 through Labor Day when the hours may be extended to nine p.m. If such person is employed for a period of five hours or more each day, an intermission of not less than thirty minutes shall be given. Such a person shall not be employed for more than eight hours in one day, exclusive of intermission, and shall not be employed for more than forty hours in one week. The hours of work of persons under sixteen years of age employed outside school hours shall not exceed four in one day or twenty‑eight in one week while school is in session.”)
Iowa Code sec. 92.6 (6) -- occupations not permitted for persons under age 16, operating power machinery: 790 violations. (“Persons fourteen and fifteen years of age may not be employed in: . . .(6.) Operation or tending of hoisting apparatus or of any power‑driven machinery, other than office machines and machines in retail, food service, and gasoline service establishments which are specified in section 92.)

They could have and should have prevented this man from entering a classroom again.
The problem is that they both represent a segment of our community that must be stifled before they cause more mayhem and havoc.

One of them was for the purpose of opening a domestic violence center. In order to justify the money they receive Ohel must ensnare woman to come for counseling under the pretense that they are being abused. Ohel hires social workers and counselors and makes a nice fee off this. Once they sink their claws into the woman they don't let go very easy because this is a major profit center for them. It can evolve into profit from divorce counseling, children counseling and the list goes on.
Here are the signs to look for if you suspect that your wife is getting involved with Ohel.
Modus operendi: The counselor will first try to get the woman to get her own cell phone so she can contact her discreetly. The counselor has the woman call Ohel at 718 851 6300 and leave a message for the counselor. The counselor will then call back with the appointment time probably when the husband is at work so he wont find out that they are sucking in his wife. Ohel will not come up on the caller id. The caller id will come up as 646718. If you see that your wife has called 718 851 6300 and then has a call back of 646718 you will know that she is in touch with Ohel and you better take action before its to late. Ohel will give her articles, books and lists of items to convince her that she is being abused. You will then hear her use words and talk in ways that she was not familiar with before. Watch out for these signs.
This is being published for the benefit of the Jewish Community by Ohel Insider. I hope to post more information about Ohel and names of its counselors in the future. Anyone else that has information should also share it for the benefit of the community. This is a major scandal ready to break open. The Rabanim are unfortunately all quit about this. Some are paid fat salaries by Ohel. Call Ohel to protest this behavior.

ReplyDeleteAgents with Immigration and Customs Enforcement arrested two more employees at Agriprocessors this morning. Although names of the employees have not yet been released, it has been confirmed that they were employed in the human resources department.
The two are expected to have their initial federal court appearance this afternoon in Cedar Rapids.
Authorities continue to search for a third supervisor, Hosam Amara. The indictment listing specific charges against Amara remains sealed.

Charges Spark O.U. Threat
Following the filing of criminal charges against owners of the kosher meat producer Agriprocessors, the Orthodox Union says it will withdraw its kosher certification of the company within two weeks unless new management is hired.
"Within the coming days, or lets say a week or two, we will suspend our supervision unless there's new management in place," said Rabbi Menachem Genack, the O.U.'s head of kosher supervision.
Genack's comments came just hours after Iowa's attorney general filed criminal charges against Agriprocessors and its owner, Aaron Rubashkin, for child-labor violations.

ReplyDeleteTeitelbaum was put in cherem along with Lipschutz after they ignored 5 hazmonos and threw a family out of the house by force. Lipschutz may or may have not been correct in the argument but his contempt for people really "shined" in the way he dealt with it.
The cherem was handed out all over Monsey, on 13th Ave in Boro Park where Lipschutz was the former owner of Deli 52 (Guttman's) and in Flatbush.
Mind you, people have asked rabbonim including Cohen to put Lipschutz in cherem before for things that he was highly guilty of. They declined.

ReplyDeleteI realize that this is a huge contract, but it was very disappointing to see that the first response of the OU to the numerous Agriprocessors scandals, beginning with the PETA video, has been to circle the wagons and put out the spin. Any changes from the OU only came after public outrage, and if the hashgachah is eventually removed from Agriprocessors, it will once again be due to this outrage. To be sure, we no longer can imagine cases of meat producers locking the mashgiach in the freezer, but it does seem that the company was being given pretty free reign in areas where the hashgachah could have been using more of its influence. (Let's not forget that Agriprocessors needs the OU more than the reverse.) At the very least, we need some competition in the glatt kosher meat business. Agriprocessors has a near monopoly and as we all know, competition is what forces businesses to operate at a higher standard.
In fact, the entire glatt kosher "standard" should be done away with and turned into an option for those who wish to be stringent. This has recently been tried in Los Angeles, with the support of local rabbis, but I don't know how successful it has been. The only way this can happen on a large scale is if the OU once again starts certifying non-glatt. The masses have been so brainwashed in the last twenty years that they will not eat regular kosher unless it has an OU hashgachah. There is no good reason – there are reasons, but they aren't good – why the OU does not certify non-glatt. As is the case with the Chief Rabbinate in Israel, the OU should certify both mehadrin (glatt) and non-mehadrin.
It might be that people in Teaneck and the Five Towns don't feel the bad economic times. Yet there are many people who are having difficulty making ends meet. It is simply not fair to create a system where people are being forced to pay more money for meat than they should have to. The biggest problem Orthodoxy faces, and the factor that makes it an impossible lifestyle for many who would otherwise be drawn to it, is the enormous costs entailed. Anything we can do to lower this burden, even if it is only a couple of hundred dollars a year--obviously significantly more for communal institutions--should be done.
Returning to Agriprocessors, while the current issue focuses on the treatment of workers, the problem of a couple of years ago focused on the treatment of animals. Yet the two should not necessarily be seen as so far apart. According to R. Joseph Ibn Caspi (Mishneh Kesef [Pressburg, 1905], vol. 1, p. 36), the reason the Torah forbids inflicting pain on animals is "because we humans are very close to them and we both have one father"! This outlook is surprising enough (and very un-Maimonidean), but then he continues with the following incredible statement: "We and the vegetables, such as the cabbage and the horseradish, are brothers, with one father"! He ties this in with the command not to cut down a fruit tree (Deut. 20:19), which is followed by the words כי האדם עץ השדה. This is usually understood as a question: "for is the tree of the field man [that it should be besieged of thee?] Yet Caspi understands it as a statement, and adds the following, which together with what I have already quoted from him will make the Jewish eco-crowd very happy.

ReplyDeleteFinally, in Rabbi Shmuel Herzfeld's op-ed on Agriprocessors in the New York Times (see here) he wrote as follows: "Yisroel Salanter, the great 19th-century rabbi, is famously believed to have refused to certify a matzo factory as kosher on the grounds that the workers were being treated unfairly." Herzfeld was attacked by people who claimed that there is no historical source to justify this statement. While the story has been garbled a bit, the substance indeed has a source. I refer to Dov Katz, Tenuat ha-Mussar, vol. 1, p. 358. Here R. Yisrael Salanter is quoted as saying that when it comes to the production of matzah, one must not only be concerned with the halakhot of Pesah, but also with the halakhot of Hoshen Mishpat, i.e., that one must have concern for the well-being of the woman making the matzah.

The OU has consistently lied. The OU's "CEO of Kashrus" Rabbi Menachem Genack must be fired immediately, along with Rabbi Seth Mandel, its head of shechita, and Rabbi Moshe Elephant who went to postville and participated in the whitewash perpetrated by Rabbi Pesach Lerner and Rabbi David Eliezrie.
ReplyDeleteAs for Rabbi Lerner, his complete lack of credibility should now be clear to all. The National Council of Young Israel should take the proper and necessary actions to restore confidence in its leadership. There is a door. Rabbi Lerner should be forced to use it.
Chabad's sometime spokesperson Rabbi David Eliezrie has a long history of lies. Chabad likes those lies and will do nothing to sanction him for them.
But you can.
If you currently pray at a Chabad House, stay away this Shabbat and tell your rabbi why. If you can do it, turn this Shabbat into forever. And if you donate to Chabad, stop immediately. You may like your local rabbi. But he works for the same people who refuse to stop Eliezrie. Make them pay.
As for the USDA, it's corrupt. What happens on the video is a clear violation of Humane Slaughter law. This is a repeat violation, the third exposed in four years.
Congress should hold hearings on the the USDA, its repeated failures, and its clear desire to protect big agribusiness from penalty.
They don't have to do anything, Hank Paulson and the U.S. Govt. will bail em' out!

Lehman Takes Huge Loss, Does Nothing

Lehman Brothers released its critical Q3 earnings and strategic plan: a huge writedown and lots of options. The real news is that, after seven months of crisis management, Lehman is still evaluating half a dozen options...and consummating none of them.
The release does say that Lehman is now considering "all" strategic alternatives, which presumably means it is considering selling itself (which is new). Aside from that, there's little in the release that we didn't know already:
The firm plans to spin off $25-$30 billion of its crappy real-estate assets into a "bad bank." This begs the question where the equity financing will come from. The release doesn't answer this question.
The firm plans to sell a majority stake in its investment management business.
It's not clear whether Lehman's problem is denial, incompetence, or just an impossible situation, but reports do suggest senior management still doesn't fully appreciate what a pickle the firm is in.
The firm's current liquidity should pacify traders for a while. But unless Lehman does something soon, whatever confidence this instills will soon evaporate. The company's gross writedowns in the quarter were a shocking $7.8 billion, and there is presumably more where that came from. With the firm continuing to struggle, moreover, it is likely that clients will soon consider taking their business elsewhere.

Mason City, IA--Mason City police found themselves dealing with the great unknown on Saturday morning.
Police reports suggest officers were summoned to a man's home in the 300 block of 5th Street Northwest just before 7 a.m.
A caller at the address had informed a 911 dispatcher he had "aliens trapped in his closet and needed help getting them out."
At least 7 officers responded to aid in the effort.
An initial incident report does not offer any information about what they found.

Question: Secretary Chertoff, my name is Leslie Orlaf (phonetic). I work at legal momentum and have been involved in drafting, actually, the U and the T visas, and really want to -- first, to say thank you for all of the work that both people at ICE, CIS, and border patrol have done on this issue.
I wanted -- I just came back, actually, from Postville (phonetic) where we've been interviewing immigrant victims of rape, sexual assault, domestic violence. We found a 15 year-old girl who was raped by someone at the plant this weekend. And I brought a team of forensic psychologists out there to help the victims and to document the cases. But there is a major hurdle in the way of both T and U visa applicants that I wanted to make you aware of. And there is there -- the fees, the 192 fees, the inadmissibility waiver fees for the 192 -- I192 and the I601s are blocking access and putting victims in a situation that need these visas to be able to cooperate, and are cooperating in criminal prosecutions. In Postville, they're cooperating with the EEOC, the State Attorney Generals. There are a thousand -- over a thousand counts of criminal charges that the State of Iowa's going to be bringing against the plant, and we need those fees exempted or wavered.
Right now, immigrant victims -- the women in Postville that were humanitarian released that are wearing ankle bracelets have to come up with between $545 and over $3,000 per case before they can get legal work authorization and their new visas adjudicated. And it's a major, major roadblock for victims that are going to prevent victims from being able to really cooperate in these cases. It's also making them susceptible to prostitution, because men in Postville, Iowa, see these women with ankle bracelets and they're hitting on them, because they have no way to support their families because they can't file the U and get work authorization.
Secretary Chertoff: Well, that's a -- I'm glad you brought that to my attention. You know, generally, we do have an ability to waive fees for people who are indigent, so let me find out about that. Because I agree with you that if there are people who are victimized, we don't want to have -- you know, my definition, they're destitute. We don't want to have that be an obstacle to getting a visa that will enable them to make -- help us make cases against, you know, very serious criminals. So I'm going to find out about that. Thanks.

ReplyDeleteIt contains some useful petitioning information regarding the situation in Beit Shemesh. This whole thing about pressuring Rav Malinowitz to be more vocal and so forth is ineffective and useless. There are a lot of rabbis in Beit Shemesh, however very few of them have any authority whatsoever. Rav Malinowitz is not going to start any public initiative without the backing of this authority and he certainly will not go against this authority. You see in neighborhoods in Israel like RBS Aleph there are very strict protocols in community affairs. It does not matter whether they are called morei d'asras or chief rabbis, they make the final decision. So this whole business of taking this issue up with Artscroll is a dead in the water idea.
If Rav Malinowitz has already received emails and phone calls regarding the Kagen case he has probably contacted the sitting authority in order to discuss this issue. He probably already has even without these calls. More than likely he has been approached by his congregates over the issue.
Now because Torat Eliyahu's new campus building is situated on Nachal Arugot, the proper person with authority to contact is Rabbi Mordechai Goldstein. You have probably heard of him. He is formerly the rav of Telstone and originally hails from Boro Park. He is the mora d'asra for what is called the Mishkanot Yaakov Congregation in RBS Aleph. This geographical area in the northwestern side of RBS Aleph includes all of the offshoot streets of Nachal Sorek and the streets that intersect with the lower part of Nachal Kishon. Nachal Arugot is at the base of Nachal Sorek and is in Rav Goldstein's jurisdiction. The rest of RBS Aleph is under the jurisdiction of Rabbi Shlomo Zalman Perlstein.
I have here his phone number that he uses when he sits in the beit hora'ah. It is 02-992-2194. I forgot what his schedule is. Perhaps someone from RBS is reading this posting. May be he/she would be so kind to post the hours that he is there. There is not even an answering machine at this number. May be someone can also post the names and numbers of other rabbanim who sit in the beit hora'ah and their hours. If enough of them will be sufficiently irritated perhaps there will be some results. I have not been there for a couple of years and I do not have a proper directory.
Now if somebody actually does get through to Rav Goldstein do not let him sherk you of by claiming that he is just as mora d'asra he has no real power. He merely handles community arbitration between agreeing parties and so on. He has real powers. All of the Rabbanim in his area (aside from the Eidat Hachareidit), both Israeli and American alike are meshubad to him. He decides whether or not authorities should be called in cases of child abuse and so forth. Any community activism regarding his neighborhood has to be ok'd by him. He himself has personally been involved in activism. Three years ago he led a public protest that was covered by the media regarding the shopping center at the corner of Nachal Sorek and Nachal Kishon.
