Naked short selling, or naked shorting, is the practice of selling a stock short, without first borrowing the shares or ensuring that the shares can be borrowed as is done in a conventional short sale. When the seller does not obtain the shares within the required time frame, the result is known as a "fail to deliver". However, the transaction generally remains open until the shares are acquired by the seller or the seller's broker, allowing a trade to occur when the order is filled.[1]
In the United States, naked short selling is covered by various SEC regulations which, as of September 2008, prohibit the practice.[2] In 2005, "Regulation SHO" was enacted to curb the practice, requiring that broker-dealers have grounds to believe that shares will be available for a given stock transaction, and requiring that delivery take place within a limited time period.[3][4] As part of its response to the crisis in the North American markets in 2008, the SEC issued a temporary order restricting fails to deliver in the shares of 19 financial firms deemed systemically important.[5] Effective September 18, 2008, amid claims that aggressive short selling had played a role in the failure of financial giant Lehman Brothers, the SEC made permanent and expanded the rules to remove exceptions and to cover all companies.[6][7]
Some commentators have contended that despite regulations, naked shorting is widespread and that the SEC regulations are poorly enforced, although the SEC has denied these claims. However, the SEC and others have also defended the practice in limited form as beneficial for market liquidity. Its critics have contended that the practice is susceptible to abuse, can be damaging to targeted companies struggling to raise capital, and has led to numerous bankruptcies.[6][2] Other commentators contend that naked shorting is more of a potential than a real problem, and have criticized the SEC for dealing with an issue that is tangential at best.

Scheinberg allegedly told the families that, if Rabbi Kolko did not penetrate your son, it is not abuse according to the Torah, and pulicly exposing Rabbi Kolko violates the laws of lashon hara, and you must not do it.
2. Abuse is so widespread that Hella Winston, author of the Unchosen, met dozens of haredi men who were abused or who knew someone who was.
3. Gedolim, including Rabbi Scheinberg, have allegedly been covering up this abuse for years.
4. Both Agudath Yisroel and Torah U'Mesora are alleged to be part of the coverup.
5. The Brooklyn Attorney General defers to local beit dins, and fails to prosecute haredi abusers.
6.The beit dins themselves are corrupt.
7. Chabad advocates for sexual abuse victims have been prevented from making presentations in Chabad yeshivot.
8. A Chabad man-on-boy abuse victim is quoted in the article.
9. The laws of mesira (informing), lashon hara (talebearing) and hillul Hashem (desecration of God's name) are frequently cited by rabbis, including gedolim, to silence accusers and victims.
10. The community does not protect its children from predatory rabbis.
I ask readers in Jerusalem to do the right thing. Go to Rabbi Scheinberg's yeshiva in Mattersdorf and demand an answer. Anything less than a complete apology, spit in the senile bastard's face.

A rabbi friend called me the other day to wish me a Happy New Year.
He then told me that he thought that I was being too critical of the Orthodox rabbis.
“They did sign that document,” he said, referring to the April 11, 2007 condemnation of child molestation.
I told him that since April 11, 2007, little or nothing has changed.
There are still children facing the dangers of life-changing acts of molestation. The use of drugs and alcohol seems to be on the rise, and the connection between molestation survivors and the need to abuse drugs is becoming more and more linked.
And here they are on the threshold of a new year, just saying words out of a Makzor. They are Millie Vanillie in black hats, just lip-synching their prayers, nothing more.
Why is that a rabbi can still live at our area yeshiva even though the college “leadership” knows that he is a concern? And they even know who his victims were.
Happy New Year.
And why is that a young woman in Israel continues to speak publicly and urgently about the abuses of her father back here in Baltimore.
Yet to discount her, they call her “crazy?” Who is crazy, the molester or the survivor?
Two women I know molested by a rabbi in this town are too afraid to use their names. This rabbi hires legal counsel for protection.

Last year, we finally had a case come to trial involving a child molester. And all that Israel Shapiro could do to stay out of jail was to resort to an Alford plea. He was given five years of supervised probation. An Alford plea allows the defendant to circumvent a guilty plea, but accept the consequences of a guilty verdict.

There’s an emerging group of women in town referred to as “buttoned down and shut tight.” They are frum women who dress modestly, were educated in girls’ only schools, but were molested. Some can’t even date men they are so frightened. Some resort to eating disorders to deal with their pain. Look around you, they’re here.

At a conference recently in Brooklyn, two issues stuck in my head. One, hearing a state legislator, a frum man, call molestation within the frum community an “epidemic.” The other was hearing a formerly frum young man talk about how molestation is now a “rite of passage” in some yeshivas.
You know what I think?
And people here in this community are concerned about the shidduchim of the relatives of these men, the innocent family members who aren’t at fault.
They then turn the accusers into the reasons for their misery, not the perpetrators. They turn the reporters of this information into ones at risk. Rabbi Ben Zion Twersky was named to head an anti- molestation task force in Brooklyn. Soon people wouldn’t acknowledge his existence. His children felt their future shidduchim threatened.
So here’s the idea.
Why don’t these family members buy billboard signs or advertisements apologizing for the acts of their relatives? Wouldn’t it make for an even greater shidduch possibility if one knew that your family was publicly and absolutely sorry for their family member’s transgressions. Wouldn’t it take a sheer act of uncommon bravery to do such a thing?
Is there anyone brave enough in Baltimore’s Orthodox community who could stand up and apologize for all of this.
What about you Vaad HaRabbanim? Is the word “brave” in your lexicon of chumrahs?
I think not.
But I do know that on Thursday late afternoon when that Book of Life is getting ready to be sealed, you better be sorry.
And you better be genuine about your sorrow.
If not, even the brave won’t be able to help you. So, yeah, I’m critical of the rabbis.
But next time don’t produce a letter if you don’t mean anything by it, or if it’s the work of the younger rabbis in town, not the real consensus.
Better yet, why doesn’t the Vaad rent a billboard apologizing and seeking forgiveness? Place it on Reisterstown Road in Pikesville so that we can all take a look.
That would beat a meaningless letter any day.

A Charedi man has pleaded not guilty to raping a 12-year-old boy in a synagogue lavatory.
Moshe Reichman, 24, from Golders Green, North-West London, appeared at Snaresbrook Crown Court on Monday and will face trial in January 2009, accused of four offences.
He has been charged with raping a child under the age of 13, sexual activity with a child, and two charges of causing or inciting a child to engage in sexual activity. The charges all relate to one incident alleged to have taken place between 2004 and 2005. Mr Reichman denies all four charges. The victim cannot be named because of his age.
Mr Reichman's barrister, Gary Grant, persuaded Judge David Radford to change his bail conditions which prohibited him from entering any synagogue. Judge Radford agreed that he can now attend the Biala Synagogue in Clapton as long as he is with one of eight chaperones, all rabbis and members of the Charedi community.

Weingarten's children who were living with him spent all of last night and this morning soliciting the wealthy Monsey baalei batim to raise 2 million to for the defense of this animal who raped and sodomized his daughter repeatedly over many years. Hamatchil B'Mitzvah Omrim Lo G'mor- one who starts doing a "mitzvah", we tell him to finish the job. Maybe Lipa Margulies will also come to the aid of his former employee while he's still collecting for his other notorious employee. These days pidyon shvuyim is all the rage in the frum community: Chabad is busy collecting for Weiss in Albany, Satmar has its hands full defending Reichman, and now Monsey is setting up for Weingarten. All this, mind you, in today's depressed economy. Chas v'shalom that a penny should be raised for the countless victims of these reshaim. Instead, they are all labeled as cunning, greedy fabricators and conspirators.
Nothing will change until the truth comes out in court and these bastards are locked up for a very long time. I'm waiting anxiously for the day that Mondrowitz is finally extradited and is brought to justice. Same for all the predators currently awaiting trial. Employment agency sues cheese plant for $30,000

CANTON — An Ogdensburg employment agency has filed suit against the owner of the kosher cheese plant seeking money owed it for providing payroll services and temporary workers.
The lawsuit was brought by Maxsys USA Inc., seeking $30,537 plus interest against St. Lawrence Food Corp. of Ogdensburg.
The lawsuit alleges St. Lawrence Food signed a contract April 10, 2006, with Maxsys to provide staffing and payroll services for temporary workers at the plant. Maxsys provided its services from Sept. 25 to Oct. 29, 2006, alleging St. Lawrence Food paid it only $3,786. The balance owed was $30,537 plus interest for late payments, according to the contract.
The lawsuit was filed Thursday in the St. Lawrence County clerk's office by J. Eric Charlton of the Hiscock & Barclay law firm in Syracuse.

ReplyDeleteThe former pastor of Oswegatchie First Baptist Church was charged Thursday with possessing child pornography.
Merton E. Parks, 60, of 469 Oswegatchie Trail Road, was charged with possessing a sexual performance of a child, a felony. He was arraigned in Canton Town Court and released to probation supervision. The case will be presented shortly to a St. Lawrence County grand jury. Parks is represented by attorney Gary W. Miles.
The Fine resident is accused of downloading child pornography onto a computer. The U.S. Immigration and Customs Enforcement Cyber Crimes Unit, part of Operation Flicker, reportedly tracked him using his credit card to buy child pornography from several Web sites onto a computer inside the church.
"The reason I would go to these sites was because of my erectile dysfunction," the Rev. Mr. Parks wrote in an Oct. 6 statement to St. Lawrence County sheriff's investigators. "I would search for sites with girls who were nude and were of ages between 12 and 18."

ReplyDeleteMany post-high-school yeshiva boys return from a year or two of learning in Israel on a spiritual high. Unfortunately, quite often their sense of accomplishment and joy dissipates precipitously soon thereafter. These aspiring students can’t find suitable yeshivos in America that match the scholarship and nurture they experienced in Israel.
Another grievance expressed by yeshiva boys attending college is that while college study appears structured, offering quantifiable successes, yeshiva learning seems otherwise.
Enter into the scene Yeshiva Atarah Lamelech–The Moreinu Rabbi Avraham Pam Institute for Talmudic Studies, a new yeshiva founded in memory of Rav Pam, zt’l, that offers the warmth, support, and commitment comparable to a yeshiva in Israel, with a strong emphasis on measurable achievement and personal enrichment.

Yeshiva Atarah LaMelech was formed to perpetuate the vision of Rav Pam. Kosher chicken plant coming to Tulare
The plant would process up to 100,000 birds a day in what would be the first West Coast kosher poultry plant.

May 9, 2008 — An L.A. based start-up firm is planning a kosher chicken production plant in Tulare, California. The facility is a new 50,000-square-foot “Leed certified” building on Walnut just south of Bardsley in the Tulare Business Park. The plant would process up to 100,000 birds a day in what would be the first West Coast kosher poultry plant.
The new company will be called House of David Poultry.
The project is headed by former Israeli chicken businessman Hillel Shamam, an orthodox Jew who will bring the kosher style of raising and slaughtering chickens for the U.S. market to Tulare.
According to Shamam, the company could open as soon as October and employ 70. “God willing, we could grow to 250.”
Shamam said they have already contracted with a number of local ranches to raise the birds and expects all the birds to be raised nearby.
The site will include space for several rabbinical personnel who are key to the operation and will actually have residential units onsite.
“They'd like to be operational by the end of the year,” said Kyle Rhinebeck, the company's Tulare real estate broker. “The plant is a first operation and will even invite tours in the future to visit the plant.”
The Central Valley is the largest chicken raising area in the state. Nearby Sanger and Porterville each have chicken packaging facilities.

A 50,000-square-foot House of David chicken-processing plant is coming to Tulare.
Earlier this week the Tulare City Council approved a zoning amendment change that clears the way for the plant, which will employ up to 67 people and process 43,000 birds a day.
As proposed, live chickens will be delivered by up to four trucks a day; three refrigerated trucks will transport the processed, packed chicken to the Los Angeles area.
The plant will use environment-conserving technology, including solar panels, officials said.

Partners Hillel Shaman and Simon Sage told commissioners chickens will arrive at the plant at night in trucks that will drive into a high-tech sealed building that won't allow odors to escape.
There will be only one processing shift, from 10 p.m. to 6 a.m., because the chickens will arrive at night, when they are more relaxed and sleeping. This aids in the process which requires the birds not be stressed when they are handled.
Rabbis from Israel will participate in and oversee the process to make sure Jewish dietary law is observed and the chickens are treated humanely. One of the rabbis on the site has to be a veterinarian, Shaman said.
In an interview after the meeting, Shaman said the company will employ 14 rabbis from Israel, who will work in Tulare on rotating three-month shifts.
He also said House of David wants to open kosher fast-food restaurants in Tulare, Porterville and Bakersfield.

One former Dechert associate thinks so and has filed suit against the firm claiming it exaggerated the extent of its corporate work in order to woo him, did not provide the touted opportunities, and then fired him in part because he is an Orthodox Jew.
In his complaint - filed in New York trial court by attorney Neil Brickman - the ex-Dechert associate, Marc Lubin, says he has worked at four top 100 US law firms since graduating from Columbia Law School in 1994. Dechert was the last of those firms; Lubin jumped there from Skadden Arps Slate Meagher & Flom in October 2002 because, according to the complaint, he felt "he should be gaining greater experience in a wider variety of structured finance deals".
Lubin says Dechert, especially partner Malcolm Dorris, told him during interviews that he would participate in endless transactional work with major clients.
Lubin's suit says that when he decided to take the Dechert job, he spurned two other offers - including one from "an international bank" - and took a 20% pay cut from his $215,000 Skadden salary.
But once he started at Dechert, Lubin claims, the promised opportunities failed to materialise. The lone deal the law firm was involved in at the time - over how to split up proceeds from tobacco litigation - soon collapsed, leaving Lubin to do what the suit describes as "glorified paralegal work".
Then in January 2004, Lubin says, Dorris fired him. When Lubin asked why, the complaint states, Dorris answered, "People did not like his work." When Lubin pressed for written evidence of the firm's displeasure, Dorris said there was none and added that Lubin "was different".
The complaint states that Lubin "understood this categorisation to refer to his religious status as an Orthodox Jew, which required him to eat kosher food and precluded his attendance at various firm functions, including the then recent Christmas party".
Dechert declined to comment on the suit. Lubin, who is currently unemployed, is seeking nearly $6m in back pay, lost earnings and punitive damages. He could not be reached for comment; his lawyer, Brickman, did not return messages seeking comment.

Credit them for being frank. His middle name is Hussein, one woman pointed out. It was a lively discussion, and if you want to see the barbs that World War II-era Jews can throw, check out the clip.
“The Daily Show” had the chutzpah to gather the same Boca Raton bunch to watch the first Obama-McCain debate.
“I am deathly afraid of him,” one woman said of Obama.
The crowning moment came when one old woman commented that Michelle Obama is “a big horse.” The guy next to her whispered that a lot of black women have big tuchuses.

ReplyDeleteAfter the Chinese government announced it would carry out extra checks for the presence of melamine in animal feed, the Dutch Product Board for Animal Feed (PDV) also took extra measures to prevent melamine entering the Netherlands.
PDV will do extra checks on melamine among the GMP+ feed companies in the Netherlands. It will also check dairy products which are intended for animal feed.
The extra checks for melamine in animal feed came after melamine was found in baby milk powder in China. As of yet, over 50.000 children in Chine have been affected by melamine and many children are in a serious health condition.
The reason why it was mixed with milk and milk powders is that it enables you to "stretch" the milk with water. The addition of melamine would then indicate falsely high nitrogen content, which generally is a quality criterion for milk.

ReplyDeleteThe biggest problem with sexual abuse in the Jewish community is not with the abusers themselves, but with the rabbis - and others in positions of authority -- who tolerate, defend, and enable these monsters. If the petition had a clause that we will no longer accept such leaders, and that we will publicly excoriate them and expunge them from our midst, then I'd be a lot more impressed.

ReplyDeleteR' Moishe Green, prominent and perhaps preeminent chassidishe rosh yeshiva in Monsey is 100% behind Weingarten and endorses every effort on his behalf. Weingarten's boys learned or currently learn in his yeshiva. Someone should get a crack investigative journalist to do a story on this and why no one has attempted to reach out to the plaintiff/victim before passing judgment.
