The UOJ Bais Din Is Now In Session - Rosh Bais Din - Dayan UOJ Presiding!
There have been many requests that I crack open the culture of corruption that exists in today's batei din. It's not one or two batei din that are impossibly corrupt, there are only a handful that perhaps you can trust. The vast majority of batei din are run by crooks and hooligans. If I went after all of them, I would not have time to eat, never mind tend to my personal life.
So...I decided to open my own online bais din. Hazmanas are free, and there is no charge for a psak din. The criteria for "UOJ - House Of True Din" to accept a case, is that the case has to be unusual.
If you want to know if your neighbor has a right to open a ladies clothing store in his basement, where he or she would be selling tube socks that you have in your basement mens store (an ugly case of hasagat g'vul), ask your local posek.
But if you want to know if your kid should be sent to a boot camp because he wears a kipa sruga, that's where the "UOJ - House Of True Din" will render a psak without consulting with the former SS guard Aaron Schachter from Coney Island Avenue.
So, I hope you get the drift of what the UOJ bais din will focus on.
Having said that, I'm certain that there will be cases that I will need to consult with "real ppposkim -- gggggedoiiilei Torah", and I will. (I always stutter when I say those words, I wonder why?) I have no ego issues; if you wanted to know, for example, if you should invest your last dime with Leib Pinter's mortgage company, I would be certain to call Shmuel Kaminetzky, and if for some strange reason he refuses to come to the phone, I would rely on his precedent ppppsak as applied to the Pinter case..."If Pinter did not scam someone in the last three months, one would have to assume Pinter did teshuva"... so by all means invest your last dime with him.
Another case that the UOJ bais din could consider even though it enters into the realm of medicine. If you had the fear of flying in an airplane, and you had a heart condition where you could drop dead if your plane had to land safely in a body of water, but the pilot was Captain Sully, there's a better than even chance I would try to get Avi Shafran on the phone. (As long as I had him on the phone I'll check on your investments with Madoff - no charge)
Now the next one is a tough one, but we will NOT shirk from our responsibility to Klal Yisroel. Your wife gets pregnant, but you DID NOT have relations with her for 9 years; after consultation with the ppppposkim in Los Angeles, Monsey and Baltimore, the UOJ psak would be -- wait until the kid is born, if it looks like Sholom, Mordecai or Aron Tendler -- the UOJ - House Of True Din would pasken that the collective Tendler families would be liable for that kid's tuition, bar/bat mitzvah, wedding, and a lifetime in kollel.
One final example, just to make certain that you understand the depth and breadth of the UOJ bais din and the diverse range of topics we're willing to tackle. You want to know if you are permitted to picket your child's school, because the principal and 4 rebbes were gang-banging your son in the back of the bais midrash after mishmar -- I would certainly consult with the Novominsker Rebbe, although he and I may not see eye to eye on this one.

The House ethics committee has started investigating 15 new cases of alleged misconduct so far this year while probing 11 cases held over from last year, according to a new semi-annual report the panel released Friday.
Only two of the new cases are publicly known, an investigation into two trips to the Caribbean taken by several members of the Congressional Black Caucus
Multiple ethics charges against Rep. Charlie Rangel (D-N.Y.) are among the 11 cases in progress. Rangel requested an ethics committee probe after media reports that he failed to pay taxes on villa he owns in the Dominican Republic, used congressional letterhead to solicit donations to a private education center bearing his name and violated N.Y. rental laws by occupying four rent-stabilized apartments in Harlem.

Buffeted by foreign competition, Mr. Bartlett recently closed his printed circuit board factory, founded 57 years ago by his father, and laid off the remaining 87 workers. Last week, he auctioned off the machinery, and soon he will raze the factory itself in Cary, Ill.
“The property taxes are no longer affordable,” Mr. Bartlett said glumly, “so I am going to tear down the building and sit on the land, and hopefully sell it after the recession when land prices hopefully rise.”
Though manufacturing has long been in decline, the loss of factory jobs has been especially brutal of late, with nearly two million disappearing since the recession began in December 2007. Even a few chief executives, heading companies that have shifted plenty of production abroad, are beginning to express alarm.
“We must make a serious commitment to manufacturing and exports. This is a national imperative,” Jeffrey R. Immelt, chairman and chief executive of General Electric, said in a speech last month, while acknowledging that G.E. was enriched by its overseas operations too.
The United States ranks behind every industrial nation except France in the percentage of overall economic activity devoted to manufacturing — 13.9 percent, the World Bank reports, down 4 percentage points in a decade. The 19-month-old recession has contributed noticeably to this decline. Industrial production has fallen 17.3 percent, the sharpest drop during a recession since the 1930s.
CAMBRIDGE, Mass. — Colleagues of Henry Louis Gates Jr., Harvard’s most prominent scholar of African-American history, are accusing the police here of racism after he was arrested at his home last week by an officer investigating a report of a robbery in progress.
ReplyDeleteProfessor Gates, who has taught at Harvard for nearly two decades, arrived home on Thursday from a trip to China to find his front door jammed, said Charles J. Ogletree, a law professor at Harvard who is representing him.
He forced the door open with the help of his cab driver, Professor Ogletree said, and had been inside for a few minutes when Sgt. James Crowley of the Cambridge Police Department appeared at his door and asked him to step outside.
Professor Gates, 58, refused to do so, Professor Ogletree said. From that point, the account of the professor and the police began to differ.
According to his lawyer, Professor Gates told the sergeant that he lived there and showed his Massachusetts driver’s license and his Harvard identification card, but Sergeant Crowley still did not seem to believe that Professor Gates lived in the home, a few blocks from Harvard Square. At that point, his lawyer said, Professor Gates grew frustrated and asked for the officer’s name and badge number.
According to the police report, Professor Gates initially refused to show identification.
In the report, Sergeant Crowley said a white female caller had notified the police around 12:45 p.m. of seeing two black men on the porch of the home, at 17 Ware Street. The caller was suspicious after seeing one of the men “wedging his shoulder into the door as if he was trying to force entry,” according to the report.
A spokesman for the Police Department did not return a call seeking comment. But in the report, Sergeant Crowley said that as he told Professor Gates he was investigating a possible break-in, Professor Gates exclaimed, “Why, because I’m a black man in America?” and accused the sergeant of racism.
“While I was led to believe that Gates was lawfully in the residence,” Sergeant Crowley wrote in the report, “I was quite surprised and confused with the behavior he exhibited toward me.”
Professor Gates ultimately followed him outside, the report said, and kept yelling at him despite the sergeant’s warning “that he was becoming disorderly.” Sergeant Crowley then arrested and handcuffed him. Professor Gates was held at police headquarters for several hours before being released on his own recognizance.
“He is cooperating now with the city to resolve this matter as soon as possible,” Professor Ogletree said, adding that Professor Gates wanted the charges against him dismissed.
Professor Ogletree said that Professor Gates had “never touched” Sergeant Crowley, but did “express his frustration at being subjected to the threat of arrest in his own home.”
He would not say whether Professor Gates believed he had been the victim of racial profiling. But Dr. S. Allen Counter, a black professor at Harvard Medical School, said he and a number of his university colleagues were “deeply disturbed about the actions of the Cambridge police.”
“My colleagues and I have asked the question of whether this kind of egregious act would have happened had Professor Gates been a white professor,” said Dr. Counter, who said he had talked to Professor Gates since the arrest. “We think that it has to be investigated.”

The very idea that any behavior that might in the remotest of ways be seen as a Chilul HaShem was anathema to them. The very thought of Chilul HaShem singed them like fire.

ReplyDeleteThe lawyer for a prominent rabbi arrested today in a federal money laundering and corruption probe said he "remains confident that the truth will come out and he will be cleared."
Robert G. Stahl, representing Saul Kassin, 87, of Brooklyn, N.Y. said his client has been a rabbi for more than 60 years and is a well-respected member of the community.
Kassin, who officials called the leader of the Syrian Jewish community in the United States, appeared before U.S. Magistrate Judge Mark Falk this afternoon, along with others charged with money laundering. His bail was set at $200,000, which he plans to secure with his Brooklyn residence where he lives most of the year with his wife.
Eliahu Ben Haim, 58, of Long Branch, principal rabbi of Congregation Ohel Yaacob in Deal, had his bail set by Falk at $1.5 million, and was ordered to be placed on electronic monitoring.
Falk set bail at $700,000 for Edmund Nahum, 56, of Deal, principal rabbi of the Deal Synagogue.
There is a poshutta kal vachomer here. Rosenbaum is considered really bad for transporting a single human organ.

Three New Jersey residents plan to file a lawsuit today that could put the staple of the great American backyard cookout -- the hot dog -- on the same path as the once romanticized puff on a cigarette.
Pointing to "landmark" research showing a heightened risk of colon cancer in people who consume processed meat, the class-action lawsuit in state Superior Court in Newark will target the makers of Nathan's, Oscar Mayer, Ball Park, Hebrew National and Sabrett franks as if they were Big Tobacco.
The plaintiffs want labels on hot dogs to read, "WARNING: CONSUMING HOT DOGS AND OTHER PROCESSED MEATS INCREASES THE RISK OF CANCER."
"We view this just like the tobacco litigation," said Dan Kinburn, the plaintiff's lead attorney and general counsel for the Physicians Committee for Responsible Medicine. "There is now a scientific consensus that processed meats are a significant cause of colorectal and other forms of cancer."

It just shows the complete overreaching by the Obama administration to lay huge pitfalls for the average citizen. It could cost up to $50,000 to properly account and report on Mickey Mouse bank accounts in some cases to be in compliance with that ridiculous new law.

Title-Insurer Fees Draw Scrutiny

The U.S. title-insurance industry faces increasing pressure from regulators to justify the fees charged to consumers for ensuring they have clear ownership of their homes.
For most people, title insurance is just another mysterious fee they must pay when they buy a home or refinance a mortgage. Unlike some of those fees, though, title charges aren’t negligible. They range from several hundred to several thousand dollars—and last year totaled more than $10 billion for the title industry.
Federal and state laws bar title insurers from giving kickbacks to real-estate agents, mortgage firms or others for funneling business toward a particular title company, but enforcement is spotty. In recent years, regulators have fined title companies for various alleged violations of laws against inducements to steer business toward a title agent. The inducements have included entertainment, trips and help with marketing.
Typically, 80% or more of the premium goes to the title-insurance agent, with the rest going to the insurer. Agents often handle the task of searching through and analyzing public documents, sometimes going back many decades. But in many states, consumers pay separate fees to the agents for that research, on top of the premiums.
The industry so far has fended off a class-action lawsuit, filed in early 2008, charging title insurers with illegally fixing prices at unreasonably high levels in New York state. A U.S. District Court judge for the eastern district of New York dismissed that suit last month. It has been appealed to the U.S. Court of Appeals for the Second Circuit.
The big title insurers may face more price competition. Entitle Direct Group Inc., of Stamford, Conn., last year began selling title policies online. Timothy Dwyer, chief executive officer and founder of the company, says Entitle aims to undercut other insurers by at least 35%.
The Rambam Nizakin 8:10 states: “It is permissible to murder one who is deemed an informant anywhere even today that we don’t judge capital cases, and it is even permitted to murder him before he informs by just hearing him say, “I will inform on said individual with regard to his physical body or his money”. This even applies for an insignificant amount of money. He thereby has doomed himself to be killed, and we warn him and we tell him “do not inform”, if he is defiant and he says,”No, I will still inform” it is a Mitzvah to kill him and whoever seizes the opportunity first to kill him will be rewarded.”
ReplyDeleteThe Rambam Tshuva 3:12, and chovil U’mazik 8:9 writes: “there are two kinds of informers, one who delivers his friend to gentiles to kill or injure him, or one who conveys his friend’s money to the gentiles… neither of these (informers), have a portion in the world to come”.
Spira did something really bad once that some rabbonim know about. I don't know all the details except they were planning on taking drastic action against him but then because of some complicated cheshbon didn't act on it. I do know there were serious meetings about it with askonim.

I live in the town that VanPelt is from....it has gone from one traffic light to more than I can count in the last 15 years. The county records for the land deals are there for all to see...I knew he was a crook and took it to the NJ's State Atorney General...NO ONE WANTED TO KNOW. All of the records in this town should be looked at. The connections from the tax office and people sitting on the land use board are a joke. Some of the players haven't paid the property taxes in years but the tax liens are held by the town. When the land is needed for a development project. The activity begins to pay off the debts. If you try to use the NJ ELEC system to look at the campaign contributions you will find the data is very hard to access. Then try to use the State Buisness site to figure out who is behind the corporations...it gets even more opaque.

The community apparently tolerated this, and they do not seem to have asked whether Rabbi Dweck senior, his son's constant partner in community and educational endeavours, is at all invoved?
ReplyDeleteThen in an attempt to mitigate his guilt in the eyes of the authorities, he helps the FBI incriminate the most senior rabbi of the sefardic syrian community and a senior rabbi in the Deal community. Nobody asks, could this have happened if Rabbi Dweck senior didn't consent to his sons actions? they are not just father and son, they are actively partners in institutions!

ReplyDeleteI spoke to one of the askonim involved in that D. Spira case. While he can't divulge the whole story without permission from the rabonim and victims, this is what he can say.
ReplyDeleteLucky for him, the rabonim involved are not Spira's rabbis. But it would be interesting to know if his rabbis would still sing his praises if they knew about his dirty deeds. Spira did 3 actions during the incident in question. The first was weird and the sign of a goniff. The rabonim involved said that so far it was only case of declining to do a shiduch with him if someone red it to them. The second was ganeva mamash. The third was probably a ganeva by him and because of the first two actions, the halacha dictates that you blame him. Big poskim were consulted who said he is a rameye and a goniff.
Moishe Finkel (ca. 1850–June 7, 1904) (also known as Morris[1] or Maurice Finkel) was a prominent figure in the early years of Yiddish theater. He was business partner first of Abraham Goldfaden and later of Sigmund Mogulesko (the greatest Yiddish star of the generation)[2] and, for a time, was married to prima donna Annetta Schwartz. Together, they dominated Yiddish theatre in Bucharest in the early 1880s and in New York City in the late 1880s and into the 1890s, with a repertoire based mainly in the works of Joseph Lateiner and Moses Horowitz.[2][3]
ReplyDeleteAfter divorcing Schwartz, who returned to Europe, Finkel, then in his 40s, married 16-year-old Emma Thomashefksy, sister of one of the most powerful figures in Yiddish theatre, Boris Thomashefsky. They had two children, but their relationship was always troubled and eventually Emma Finkel left her husband and began divorce proceedings. Her suit mentioned examples of spousal cruelty including violence. She began a relationship with another actor, David Levinson. At the same time, Moishe Finkel's business partnership with Jacob Adler, which entailed managing the Grand Theatre together, ended with a bitter dispute and a legal battle for control of the theatre eventually settled in Adler's favor. Emma Finkel and her lover had continued working for Adler.[1]
On June 7, 1904, while Emma, the children and Levinson were staying at a summer colony in New Jersey, Finkel turned up unexpectedly and shot his wife, Levinson, and himself. He killed himself and seriously injured his wife. Levinson was unhurt.[1]
Jacob Adler wrote of him that he "never smiled" [4] and other contemporaneous accounts concur that he had a difficult personality. Finkel's son from his first marriage, Abem Finkel, became a Hollywood scriptwriter. The children from his marriage to Emma, Bella and Lucy Finkel, became Yiddish actors. Bella married Paul Muni. Emma Thomashefsky Finkel lived partially paralyzed for a number of years, and continued to act in roles that could be played sitting down. She died of complications from her condition in 1929 at age 46.[1]

Keiji Fukuda, WHO's Assistant Director-General for Health Security and Environment, told The Associated Press that given the size of the world's population, the new H1N1 virus is likely to spread for some time.
WHO earlier estimated that as many as 2 billion people could become infected over the next two years.
''Even if we have hundreds of thousands of cases or a few millions of cases ... we're relatively early in the pandemic,'' Fukuda said in an interview at WHO's headquarters in Geneva.
The global health agency stopped asking governments to report new cases last week, saying the effort was too great now that the disease has become so widespread in some countries.
Authorities in Britain say there were over 100,000 infections in England alone last week, while U.S. health officials estimate the United States has passed the 1 million case mark.

Hunt on for man who sexually assaulted a woman with a baby on the EL

Police are reviewing surveillance videos and seeking witnesses in their hunt for a knife-wielding man who sexually assaulted a 22-year-old woman carrying a baby on a SEPTA Market-Frankford El train yesterday.
The assault began not long after the woman boarded an inbound train around 11 a.m. at the Frankford Transportation Center at Bridge and Pratt Streets.
After she took a seat, her attacker sat next to her, took out a knife, and placed it to her side, police said.
The man then groped her while she held her infant in her lap, said Lt. Frank Vanore, a police spokesman.
"He told her to be quiet. That's why other passengers weren't alerted," Vanore said.
When the train reached the station at Eighth and Market Streets, the man fled on foot, police said. The woman also got off the train at the station and called 911.
Shmarya is being a real idiot about this, as is expected. He is taking very seriously a quote from Crazy Eddy Antar's brother Sam, who is himself a criminal, that hundreds of Syrians will be implicated. While it is possible if they really went digging, Shmarya always embraces the most dubious sources when it suits him.

ReplyDeleteWhen we reported on organ trafficking late last year, my main source for the story, a medical anthropologist by the name of Nancy Scheper-Hughes, told me that a couple of rabbis and synagogues in Brooklyn, N.Y., had been repeatedly been cited by her informants as well-known organ brokers. Nancy has done an extraordinary amount of detective work in the past two decades mapping the organs trade across the globe. She's gone undercover in Turkish slums, tracked down leads in Argentinian mental hospitals, and interviewed potential sources in Israeli prisons. She has also routinely reached out to the FBI and analogous law-enforcement bodies in other countries─usually to no avail. Maybe because she is a mere medical anthropologist, maybe because she had nothing more than word-of-mouth reports (albeit hundreds of pages of them, often from admitted criminals), the FBI did not seem to take her calls seriously (organ-trafficking allegations in yesterday's bust were the byproduct of a larger investigation on money laundering).

ReplyDeleteThe Brooklyn man arrested Thursday for dealing in black-market kidneys was identified to the FBI seven years ago as a major figure in a global human organ ring.
Levy-Izhak Rosenbaum's name, address and even phone number were passed to an FBI agent in a meeting at the Roosevelt Hotel in Manhattan by a prominent anthropologist who has been studying and documenting organ trafficking for more than a decade.
Nancy Scheper-Hughes of the University of California, Berkeley, was and is very clear as to Rosenbaum's role in the ring.
"He is the main U.S. broker for an international trafficking network," she said.
Her sources include a man who started working with Rosenbaum imagining he was helping people in desperate need. The man then began to see the donors, or to be more accurate, sellers, who were flown in from impoverished countries such as Moldova.
"He said it was awful. These people would be brought in and they didn't even know what they were supposed to be doing and they would want to go home and they would cry," Scheper-Hughes said.
The man called Rosenbaum "a thug" who would pull out a pistol he was apparently licensed to carry and tell the sellers, "You're here. A deal is a deal. Now, you'll give us a kidney or you'll never go home.' "
Scheper-Hughes felt she had to stop Rosenbaum. She met with the FBI.
"I always thought of it as my Dick Tracy moment," she said Thursday.
She waited and waited for something to be done. The FBI may have been following the lead of the State Department, which dismissed organ trafficking as "urban legend."
"It would be impossible to conceal a clandestine organ trafficking ring," a 2004 State Department report stated.
Scheper-Hughes had better luck in Brazil and in South Africa, where law enforcement corroborated her findings and acted decisively.
But the ring kept operating elsewhere. Scheper-Hughes visited villages in Moldova where, "20% of the men were siphoned off to be kidney sellers in this same scheme."
Back in Brooklyn, Rosenbaum stayed busy. He was contacted by an FBI informant who introduced Rosenbaum to an undercover agent who supposedly wanted to buy a kidney for her uncle.
"I'm doing this a long time," Rosenbaum was recorded saying.
The undercover asked how many organs he had sold.
"Quite a lot," he answered.
On Wednesday, the FBI called Scheper-Hughes, who is putting her findings into the upcoming, "A World Cut in Two, The Global Traffic in Humans for Organs."
"Why are you calling me now?" she asked.
Thursday, seven years after her Dick Tracy moment with the FBI at the Roosevelt Hotel, Rosenbaum was finally arrested.

All failed, to their great surprise, and the professor told them that socialism would also ultimately fail because when the reward is great, the effort to succeed is great but when government takes all the reward away, no one will try or want to succeed.
Could not be any simpler than that.

ReplyDeleteRabbi Chaim Lobel of Young Israel of Aberdeen Congregation Bet Tefilah, a largely Orthodox synagogue, said every Jewish community was stricken by the news.
"We're all tightly knit; we consider ourselves family," Lobel said. "We're all Jews and we're all deeply ashamed. As a person and as a rabbi, I feel very embarrassed personally."
Lobel said it wasn't likely that any of the arrested rabbis would be punished within the religious community or lose their titles.

ReplyDeleteA torrid affair between the married head of surgery and a beautiful doctor has spilled into a nasty court fight featuring broken promises, a DUMBO love nest and sex harassment charges.
Dr. Petra Rietschel, a striking 38-year-old redhead from Germany who had a two-year affair with Dr. Patrick Borgen, 51, claims in court papers she was fired because she dumped him.
"We had a relationship," Rietschel told the Daily News yesterday. "He was married, but he said he was getting a divorce. He said they hadn't been intimate in 10 years, that they hadn't been a couple.
"He said I was the woman he had always dreamed of. We worked very close together. We built the breast cancer program together. He is the king of the place, and I was very impressed with him."
Rietschel, a single mom with a young son, said she met Borgen in 2006, when both began at Maimonides. They started the affair in 2007, she said.
He told her he would help her "build my career" and she believed the father of four with a home in Connecticut was filing for a divorce.
They went to the hospital galas together, medical conferences in Hawaii and even his native New Orleans, where he introduced her to his mother, Rietschel said.
She started becoming suspicious when he sometimes didn't return phone calls. They bickered. It came to a head in his DUMBO apartment on Dec. 19, 2008. That's when she spotted an incriminating e-mail, Rietschel said in her suit, filed last week in Brooklyn Supreme Court.
"He was sleeping and that's when I saw the e-mail," Rietschel told The News. "I was horrified."
The suit says he'd written to his wife and indicated he was going to end the affair by getting Rietschel a new job outside of Brooklyn "ASAP."
"When he woke up I showed it to him and he just denied it and said, 'I'm lying to my wife,' " Rietschel said. "I wouldn't hear of it. I walked out on him."
Borgen repeatedly text-messaged her to come back, Rietschel said. "He's a very charismatic man. I had come back before, but this time I didn't respond."
That, she said, led to big problems at work. She said he started yelling at her and putting her down verbally.
Then, on Feb. 24 of this year, Rietschel said she was called into a supervisor's office with the head of human resources and was told she had to go.
"They just said for both parties it would be better to leave right away," she said.
Only hours earlier, Robert Gibbs, the press secretary, said the president had made his final remarks about the issue. But advisers said the mounting criticism from police groups and others persuaded the president to address the matter in an attempt to move on.
ReplyDeleteMr. Obama, carefully measuring his words to avoid further criticism from either side, said, “Even when you’ve got a police officer who has a fine track record on racial sensitivity, interactions between police officers and the African-American community can sometimes be fraught with misunderstanding.”
Sgt. Dennis O’Connor, the president of the Cambridge Police Superior Officers Association, said he was offended by President Obama’s assertion that the police department had acted “stupidly,” and by his connecting those actions to a history of racial profiling in America.
“The facts of this case suggest that the president used the right adjective, but directed it to the wrong party,” Sergeant O’Connor said, suggesting that Professor Gates had introduced racial concerns. “His remarks were obviously misdirected, but made worse yet by a suggestion that somehow this case should remind us of a history of racial abuse by law enforcement.”
Professor Gates requested a personal apology from Sergeant Crowley. But on Thursday, the sergeant said he would not offer one.
President Obama fueled the story — and the polarizing national debate about race and law enforcement in America — on Wednesday night by commenting on the arrest at the end of a national news conference that was primarily about health care reform.
Sergeant O’Connor said at Friday’s news conference that the president went too far. When a person says up front they do not know the facts, as President Obama and Governor Patrick both said in their separate comments, Sergeant O’Connor said, “one would expect the next statement to be, ‘So I cannot comment.’ ”
Mr. McDonald, his group’s lawyer, said the president’s conclusion about the case “was dead wrong.”
“If he knew all the facts,” Mr. McDonald said, “he would have concluded that had Professor Gates simply cooperated with the investigation that Sergeant Crowley was undertaking, Sergeant Crowley could have cleared the matter.”
He added: “In our view there was nothing stupid about what happened. What happened to produce a different outcome was directly under the control of Professor Gates. That’s something the president didn’t fully appreciate.”

THE health bills coming out of Congress would put the decisions about your care in the hands of presidential appointees. They'd decide what plans cover, how much leeway your doctor will have and what seniors get under Medicare.
Yet at least two of President Obama's top health advisers should never be trusted with that power.
Start with Dr. Ezekiel Emanuel, the brother of White House Chief of Staff Rahm Emanuel. He has already been appointed to two key positions: health-policy adviser at the Office of Management and Budget and a member of Federal Council on Comparative Effectiveness Research.
Emanuel bluntly admits that the cuts will not be pain-free. "Vague promises of savings from cutting waste, enhancing prevention and wellness, installing electronic medical records and improving quality are merely 'lipstick' cost control, more for show and public relations than for true change," he wrote last year (Health Affairs Feb. 27, 2008).
Savings, he writes, will require changing how doctors think about their patients: Doctors take the Hippocratic Oath too seriously, "as an imperative to do everything for the patient regardless of the cost or effects on others" (Journal of the American Medical Association, June 18, 2008).
Yes, that's what patients want their doctors to do. But Emanuel wants doctors to look beyond the needs of their patients and consider social justice, such as whether the money could be better spent on somebody else.
Many doctors are horrified by this notion; they'll tell you that a doctor's job is to achieve social justice one patient at a time.
Emanuel, however, believes that "communitarianism" should guide decisions on who gets care. He says medical care should be reserved for the non-disabled, not given to those "who are irreversibly prevented from being or becoming participating citizens . . . An obvious example is not guaranteeing health services to patients with dementia" (Hastings Center Report, Nov.-Dec. '96).
Translation: Don't give much care to a grandmother with Parkinson's or a child with cerebral palsy.
He explicitly defends discrimination against older patients: "Unlike allocation by sex or race, allocation by age is not invidious discrimination; every person lives through different life stages rather than being a single age. Even if 25-year-olds receive priority over 65-year-olds, everyone who is 65 years now was previously 25 years" (Lancet, Jan. 31).
Since Medicare was founded in 1965, seniors' lives have been transformed by new medical treatments such as angioplasty, bypass surgery and hip and knee replacements. These innovations allow the elderly to lead active lives. But Emanuel criticizes Americans for being too "enamored with technology" and is determined to reduce access to it.

You may have noticed the news story about motivational speaking consultant Jeffrey Locker from North Woodmere being murdered in Harlem.

He had a habit of going to a Black zoyna in a housing project after work. She knew he was rich and had 2 accomplices help her kill him in a robbery. Locker was a member of Temple Israel in Lawrence. How were the freye rabbis maspid him?
If Ungar and Goldwasser are the best the Yeshiva can come up with to host the Yeshiva's functions, the Yeshiva obviously thinks geneivah, zenus and kol davar assur is what they stand for.

People are furious, and for a good reason at what Dwek the Moser did. However, this should be a time for introspection. This should be a time for tshuva from the leadership down, not just for the Syrians, but for the entire Orthodox community. It is time to reexamine our ethics and morality and how we conduct our businesses in this medina shel chesed. Yes, in this wonderful country we live in. To blame all these arrests and problems on the FBI and on the moser is shortsighted. When the law is broken on such a grand scale, it is inevitable that the criminals will eventually be caught.
ReplyDeleteDo we attribute the destruction of the First Temple to the wickedness of Nevuchadnezzar and the Babylonians? Do we attribute the destruction of the Second Temple to the wickedness of Titus and the Romans? Perhaps that is the historical take. The religious take is that we were exiled and our Temples destroyed because of our sins and only because of our sins! Nevuchadnezzar, Nero, Hitler, et al, were only the tools that G-d used to vent his anger. These reshaim were more than willing to be these tools and therefore are culpable. The bottom line is when disasters occur, it is our own fault.
We need to look no further than ourselves and our leadership to realize that we need to change. With every arrest of an observant-looking Jew, with every case of sexaul molestation revealed, with every coverup and fraud case revealed, the chillul hashem gets worse and the shechina is further alienated. When will we wake up? Yes, this moser is evil and his actions were outrageous. His crimes that were revealed in 2006, with the accompanying chillul hashem, should have been enough to put him in cherem. Unfortunately he was allowed to stay in the community as if nothing happened. Now we are paying for this misplaced compassion. How many more of these criminals will be cutting deals to save their own skin at the Jewish community's expense? It is our failure to identify evil and to act immediately to weed it out, is what leads to such destruction. It is our failure to identify the perversion of the law of Dina D'malchuta Dina that has been taking place in our community, that leads to more arrests and chillul hashem. What do you expect when you have rabbis declaring that tax evasion is muttar? What do you expect when you have rabbis starting pidyon shvuyim funds for criminals like Rubashkin? What do you expect when the most vicious criminals amongst us, the child molesters, are defended and allowed to continue teaching in our yeshivos? How many times did we see the words "blood libel" on Matzav.com in the past year in response to reported crimes in the Orthodox community? Instead of calling every arrest and accusation a "blood libel", and blaming it on "anti-semitism", let us examine practically what we are doing wrong, and start working on fixing these problems, for G-ds sake! We need a totally new haskafa in regards to obeying the laws of this country. The change must start from the top.
It's my understanding that at least some of the perps in the Dweck sting were entrapped and may have never committed a crime before. Dweck has devolved into the Syrian version of Shmarya Rosenberg or worse. A Jewish anti-Semite who will do anything to bring about the downfall of frumma Yidden. Those entrapped include Rabbi Kassin. What happened to Charlie Ammon who was arrested in Lakewood is said to be even worse. According to what I am hearing, Ammon did not know the money he was asked to relay was in the commission of a crime.

This was after they had tortured him with knives to reveal his credit card pin number. ReplyDeleteUh, he didn't know that bribing a housing inspector is a crime? How old is he, 10 or thirtysomething? Even if he spent his entire life in kollel, something like that should be common knowledge. This doesn't excuse Dwek for setting him up (btw I hear that this Ammon fellow is somehow related to Dwek's agunah), but bribery is bribery.
There is no evidence that orthodox criminals turn into mosrim on rabbonim to save their own necks even though Shlomo Dweck and my nephew David Schick both did it.
ReplyDeleteI used to sometimes daven in Weinfeld's shul during the week. I was forced to leave many years ago due to Yossi Ungar being an extremely low individual. There was a terrible tragedy that befell me that only 5 people on the face of this Earth were sick enough to actually laugh at me in public about, including Ungar who burst out laughing whenever he glanced at me. It is a very special kind of perversion that someone would not only find such a thing geshmak but to go on to humiliate someone over it. Besides Ungar, one of the people has since died and the other three sick individuals are all named Pinter. One of them is that narcissist jailbird, Leib Pinter. People who picked up on the Pinter snickering told me they felt like vomiting.

I agree with you that the case against Rabbi Kassin is overreaching by the FBI. However, the others were involved in some serious junk. Bribing public officials and laundering hundreds of thousands of dollars are not petty crimes.
