Germany: Change to Abuse Statute - By THE ASSOCIATED PRESS

Under legislation approved by the cabinet on Wednesday, Germans who were sexually abused as children are expected to have as long as 30 years after they turn 21 to bring accusations in court. The previous statute of limitations on civil abuse cases was three years. Criminal cases have a statute of limitations of 3 to 30 years, depending on the charges. Justice Minister Sabine Leutheusser-Schnarrenberger praised the legislation as strengthening victims’ rights. Parliament is expected to pass the legislation this year.

ReplyDeleteI don't think 'Gedolim' work on the basis of the statute of limitations. The statute shouldn't apply in cases of molestation; its very hard to come forth, and victims may only find the courage years later.
ReplyDeleteReminds me of an old UOJ classic where he called up Kamenetzky and asked him if his grandson could be in Kolko's class, to which K said he has a Chezkas Kashrus, since we havn't heard anything recent. Bullshit. When asked if K would let his grandson be alone with Kolko, K asked for his phone number (Aharon Shechter-Chaim Berlin/Mordechai Tendler tactic).

The London Beis Din released the following statement this past Thursday regarding the [Tropper] Eternal Jewish Family:
In conjunction with the decision of made by the standing committee of the Conference of European Rabbis (CER) that met in Moscow in the month of Kislev we strongly object to involvement of the organization known as the [Tropper] Eternal Jewish Family (EJF) in matters of conversion in Europe.
By virtue of the fact that the abovementioned organization (EJF) involves itself in matters of conversion to actively influence gentiles to convert which is against the traditions of our community from previous times, and there is a concern for a breach of the walls of our faith in Europe, and by virtue of the fact that the leaders of this aforementioned organization caused a desecration of the Divine Name and a disgrace to the name of the Orthodox Rabbinate throughout the world in recent weeks, we the leaders of the Kehilos HaKodesh in Europe call upon the organization called the [Tropper] Eternal Jewish Family to cancel their planned seminar in Munich.
If they do not heed our request we call upon the Rabbis that were invited to the seminar not to participate with them and to guard themselves from entering there.

It is long established pattern of the hired cheer-leaders of the [Tropper] ejf to attempt to blacken the name of anyone who criticizes their activities in
any way - the pot of gold that the [Tropper] ejf has found is worth $25 million and counting and who wants to lose out on that? but it is clear who the real ganef is in this sad story - it is anyone who associates themselves with this organization whose sole function is to leech as much money as possible out of Mr. Kaplan.
The feeble attempts to publish fact sheets in the Jewish media demonstrates what and who they are - no serious or well meaning organization finds it necessary to print fact sheets stating that they are not low-lives, not ganovim, etc etc. this is usually a
given in any moisad - and if they have to publish something of this
nature it can only be that they are and always have been goineiv daas habri'os on a giant scale.
Some real facts:
[Tropper] EJF is an organization entirely funded by a (well meaning) secular Jew whose interests are the preservation of wild cats which are endangered
by encroaching civilization and the preservation of Jewry which is
endangered by intermarriage. His solution for the latter is to encourage the non Jewish partner to convert - the same approach taken by the reform and more recently, the conservatives.
The [Tropper] EJF has a rolodex
containing botei din across the USA to which it refers potential
converts which it claims to have selected and vetted. Many of those
botei din have expressed surprise that potential geirim were being
referred to them - small and relatively inexperienced, instead of being sent to the big established botei din in the major centers of yiddishkeit.
The reason is simply that the [Tropper] ejf refers cases which it
claims are ready for giur to a small beis din that will accept their recommendation when a larger more established beis din would not
consider the case in any way suitable. (Additionally the [Tropper] ejf besmirches
the name of botei din with track records measured in decades and whose credentials are impeccable but who have the temerity to question their judgement and qualifications). Rabbonim from small towns across the USA
were continually surprised over the last few years that intermarried couples who they reckoned were unready for giur - even though they might qualify with a year or two of work - were leaving town and returning a
month or two later having been converted through an [Tropper] ejf recommendation and officially having been mentored successfully by the [Tropper] ejf.
In many of these instances the levels of observance were insufficient to start with
and diminished subsequently with many ending up only nominally
practicing Jews."

To burnish their credentials as the only chareidi purveyors of geirus, the game plan was to present themselves as the most chareidi organization out there by buying their way into the chotzer of the Gedolim by giving kickbacks to the various individuals who attempt to surround the Gedolim. By steady
drip feeding of a few thou here and there to help with a chasuna or pay off some choivos or support a pet project, tropper managed to buy his way in and then parade his ability to get photo ops as if that made him a ne'emon of the Gedolim. The story that he was telling was that all botei din and mekarvim in the USA were not to be trusted with the future of klal yisroel and only someone with his dikduk bemitzvos particularly
in the areas of kiruv was in the position to handle it properly.
This from [Tropper] a man whose personal habits until this time had been a matter of concern to all who knew the facts and whose yeshiva had not managed more
than a minyan of balei tshuva at any given time. In the kiruv world he was not regarded as even a side-show, particularly because of his habit of telling anyone who would listen that only he knew about kiruv and that everyone else attempting it is a charlatan.
The [Tropper] ejf then went about organizing conventions of Rabbonim and Roshei yeshivos in the USA again trumpeting the terrible standards of giyur and their qualifications to solve the problem. Many attendees enjoyed being flown to Washington or the Davids Citadel or Kibbutz Lavi all expenses paid but were surprised to be invited seeing as they were largely not involved in giur. Very few of the participants were top ranking poskim with expertise in the subject and while they were often high level talmidei chachomim and Roshei Yeshivos, they would not necessarily be
consulted on this topic. However, given that the names of the worlds
preeminent Gedolim were being thrown around as if they had personally checked and verified the activites of the [Tropper] ejf and because so many other
prominent Roshei Yeshivos were present, most relied on it all being real.
Meanwhile in the field the real agenda was Mr Kaplan's which is to get the largest number possible to become Jewish and therefore botei din were encouraged to convert people shipped half way across the country and cleared by the [Tropper] ejf. To find the customers, the [Tropper] ejf offered money to local rabbonim and mekarvim to find them intermarried couples to attend
their seminars - not couples where the Jewish half was moving towards
yiddishkeit: any intermarried couples would do. They were also hiring field workers to go and find intermarried couples - a sort of giur bounty hunt - and were offering organizations money,which to their credit many refused, to allocate staff to this very dubious purpose which it is unlikely they were telling the gedolim!
Additionally, they were trying to break into the European market where stringent standards were already in place through the efforts of the CER over the previous ten years. If they could buy their way in there, they would be able to add the number of geirim being processed around Europe to their bottom line and justify the millions that they were milking from Mr Kaplan."

The problem was that tropper's personality is so obnoxious, that when he showed up to address a European Rabbinic convention, he yelled at the assembled (very bemused) rabonim that they were all frauds and charlatans and that only he knew the real path to kiruv. He had a hissy fit and stormed out of the room when one of the (by now very amused) rabbonim had the cheek to ask him a question.
To keep this happening while diverting attention away from the real activities and towards the chareidi image being projected, Lubicom PR agency headed by Mr Menachem Lubinsky was running a big-time campaign to keep the operation going. The seminars and the venues, the speakers and
the message were all coordinated by Lubicom - who apparently billed
around $500,000 last year for their efforts.
When has a serious klal organization had its image and message manufactured by a PR company?
Yiddishkeit isn't a detergent or automobile which needs hard sell and message management and when something claiming to be yiddishkeit does, it should be immediately a cause for suspicion. It must be noted however that they do a great job as they have successfully managed to position [Tropper] ejf as a mainstream and serious organization and create an image in the mind of unsuspecting Gedolim and public.
They have also done a wonderful job post-tropper-fiasco of fighting a rearguard action with limited weaponry and under very adverse conditions. They produced some gloriously meaningless press releases designed to say nothing at all while the damage assessment was underway.
They were all over the blogs with whole-hearted defenses of the defenseless which could not be attributed to them. The Rabbi Wachtfogel press release was clearly not cleared by him and his subsequent disavowal of it shows that they are happy to cheerfully publish letters in other people's names without consent. They spread the usual quarter-truths and innuendos mixed in with a good dosage of plain old-fashioned sheker - the prime example of
which is the mealy-mouthed puff-piece mentioned above that most frum news outlets were paid kesef molei to run. (Some were honest enough and brave enough not to run it and were subjected to a barrage of abuse by [Tropper] lubicom/ejf)."

Rabbi Blum who apparently heads the organization (after the tropper
scandal and Rabbi Wachtfogel refusal) is a nice young man who until now was an office manager on a regular secretary/PA salary. He has suddenly been promoted to the top of the organization; apparently tropper's replacement, on the basis of this paltry experience. He is the man who
is now going to be the recognized scourge of bad geirus and mouthpiece of the gedolim. He is however, nothing more than a straw man for lubinsky, etc who wish to steer clear of the limelight.
Interestingly enough, in the weeks preceding the eruption of the scandal, Lubinsky and
Yisrael Freedman were attempting to ease tropper out of the driver's
seat into a more nominal role. Did they know something was wrong? Did

There are two cases on Friday march 25 2011 in Brooklyn Supreme Court 320 JAY STREET (FREE TRANSPORTATION)
1- Nechemya Weberman who allegedly sexually assaulted a twelve-year-old girl and continued doing it till she was fifteen and
2- Meir Dascalowitz who allegedly raped a disabled boy in a mikvah (ritual bath) over a dozen times.
The victims and their families are subjected to all sorts of pressures to drop their cases.
Both defendants are out on bail facing serious jail-time of decades in prison.
It is now ten months since Dascalowitz was arraigned on ten Felony D charges of criminal sexual activity-2nd degree with a victim under fifteen years of age (PL 130.45 01). There are many additional felony and misdemeanor charges. Approximately once a month he goes in for a court appearance. For almost a half a year his lawyer, Israel Fried has successfully gotten postponements by dickering with the District Attorney about how to determine if Dascalowitz is mentally competent to assist in his defense.
As of a month ago, Dascalowitz had still not gone in for an inpatient evaluation of his mental status.
Weberman was arrested on February 23, 2010, on a small set of charges, which only included one D Felony. On March 8 a Grand Jury indictment was entered into the court record. He was charged with 150 felonies all involving sexual crimes with a child including one B felony in the first degree, 145 D felonies and 4 E felonies.
Among other things he was specifically charged with the B felony in the 1st degree, of “a course of sexual conduct” with his victim Trials and sentencing sessions are dramatic. The court appearances preceding a trial are short and quick. A morning in court can include many defendants and very little time for each. The usual outcome is some very small development followed by the scheduling of the next date and the continuation of bail and the order of protection.
Phone calls and letters, jeers on the street, and scurrilous rumors about the parents and the kids including charges of promiscuity, other irreligious behavior, theft, and child abuse.
They suffer social death in a world where community is everything.
The point of going to court for the sporadic appearances is to show support for the victims, to let the miscreants know that we are fighting them, and to publicize the case during the doldrums between arrests and convictions.

In case he censors my comment on his blog, I am posting it by you - someone who isn't deluding himself into thinking the Moetzes is protecting our children.

HARRY Maryles, Your perception regarding the attitude of the Moetzes regarding reporting molesters is obviously faulty. Actions prove more than words. Attempts to report molesters in the yeshivishe community have been frustrated by Rosh Yeshivas. An outstanding Rav in the Lakewood community was chased out of town because he reported his sons Rebbe who molested his son. This is not the exception - this is the rule.
The Moetzes does not consider it beneath themselves to meet and declare books such as the "Making if a Gadol" and " My Uncle the Netziv" as prohibitted to be read. Yet, when it comes to molestation, they do not come out personally. Is banning books written by the Torah Temima and the son of HaGoan Reb Yaakov Kaminetzky more important than the issue of molestaton in our community? Why hasn't the Moetzes come out, with heir own signatutes, proclaiming that which you claim is their real position? Don't turn a nightmare into a dream. Recognize the truth. At the very least, even if what you said was true (which it clearly is not), the Moetzes certainly has a warped sense of priorities.

ReplyDelete"Syrian Troops Open Fire on Protesters in Several Cities

CAIRO — Military troops opened fire on protesters in the southern part of Syria on Friday, according to news reports quoting witnesses, hurtling this strategically important nation along the same trajectory that has altered the landscape of power across the Middle East and North Africa.
Tens of thousands of demonstrators in the southern city of Dara’a, on the border with Jordan, and in some other cities and towns around the nation took to the streets in protest, defying a state that has once again demonstrated its willingness to use lethal force. It was the most serious challenge to 40 years of repressive rule by the Assad family since 1982, when the president at the time, Hafez al-Assad, massacred at least 10,000 protesters in the northern Syrian city of Hama.
Human rights groups said that since protests began seven days ago in the south, 38 people had been killed by government forces — and it appeared that many more were killed on Friday. Precise details were difficult to obtain Friday because the government sealed off the area to reporters and denied access to the country to foreign news media.
“Syria’s security forces are showing the same cruel disregard for protesters’ lives as their counterparts in Libya, Tunisia, Egypt, Yemen, and Bahrain,” said Sarah Leah Whitson, Middle East and North Africa director at Human Rights Watch.
The new round of protests and bloodshed came one day after the Syrian government tried to appease an increasingly angry popular revolt with talk of improved political freedoms and promises of restraint. Instead, it unleashed its forces, firing on peaceful demonstrators trying to march into Dara’a, according to The Associated Press and videos posted on YouTube. There were reports of security forces firing on civilians in cities around the country, as well.
In Sanamayn, a city of 27,000 people about 80 miles north of Dara’a, a video posted on YouTube showed at least seven bodies lying on stretchers, bloodied, at least three clearly with gunshot wounds. Residents speaking to The A.P. said as many as 20 people had been killed, figures that could not be independently confirmed.
In the capital, Damascus, several hundred opposition protesters tried to rally, too, but were quickly dispersed by security forces as pro-government supporters took to the streets honking car horns and waving photographs of the president, Bashar al-Assad. It did not appear that the growing wave of anger and protest had yet taken hold in the capital as it had in the south and east, though there were reports of troops opening fire on demonstrators in the suburbs of Damascus.
On Thursday, a longtime minister and adviser to the president, Bouthaina Shaaban, appeared to edge close to an apology for the deaths, insisting that the president had ordered security forces not to fire. Ms. Shaaban then laid out what she framed as concessions, saying that the government promised to consider lifting a state of emergency in place for decades and would consider more political freedoms — offerings dismissed out of hand by the public because they had been put forth before, in 2005, and never carried out.
“President al-Assad doesn’t want the bloodshed at all, and I witnessed his directives on not using live bullets whatever the circumstances as he is keen on every citizen,” Ms. Shaaban said. “This doesn’t mean that there are no mistakes or practices which were not unsatisfactory and not up to the required level.”
Less than 24 hours later, witnesses reported that live fire was again turned on unarmed protestors."
“This is exactly what has been happening around the Arab world,” said Ayman Abdel Nour, a Syrian opposition activist who is living in self-imposed exiled in the United Arab Emirates. “Sixty percent of Syrian society is less than 24 years old, and they want to be part of drawing and designing their future.”
ReplyDeleteSyria has few resources, but a strategic location bordering Iraq, Israel, Turkey, Lebanon and Jordan that its leaders have often tried to leverage. It has rankled the West and its Arab neighbors by forging close ties to Iran and by helping to sponsor Hezbollah in Lebanon and Hamas, the militant group controlling the Gaza Strip.
The cascading events in Syria bear a remarkable resemblance to the course taken in other Middle East nations, where a relatively small incident — in this case the arrest of children who scrawled graffiti, “The people want the fall of the regime” in Dara’a — led to protests and a lethal government response. That in turn sparked wider rage, prompting government talk of concessions that were too little, too late.
“They tried to use the classic Baathist method: You wave a few carrots with one hand, while the other one is holding a huge stick,” said Karim Émile Bitar, a researcher at the Institute for International and Strategic Relations in Paris. “But the massacres in Dara’a are only going to strengthen the protest movements.”...
The killings in Hama, when the Muslim Brotherhood, a conservative Sunni organization, moved against the government, resonate to this day — both for a resentful populace and for a government that fears revenge for its past actions.
“These minority regimes are galvanized against defections and splitting,” said Andrew J. Tabler, a Syria expert at the Washington Institute for Near East Policy. “They believe if the regime comes down, they fear being slaughtered by the Sunni majority after what happened in the past. It makes it likely if these protests get bigger, it will be very bloody.”
Sectarian tensions did not motivate this conflict, not initially. But they have begun to emerge. Mr. Tabler and Joshua M. Landis, director of the Center for Middle East Studies at the University of Oklahoma, said the demonstrators had started chanting: “No to Iran, to Hezbollah. We want a leader who fears God.”
That, they said, is a direct reference to the Alawite faith of the leadership.
“In the minds of the religious minorities, this evokes the specter of sectarian battle,” Mr. Landis said.
Dara’a, a drought-stricken section of Syria’s farm belt, is an unlikely place for Syria to face its own version of the uprisings that have rocked the region. Dara’a is in a region is known as loyal to the Assad family, Mr. Tabler said. The area tends to be more tribal and is not fond of the more religious conservative Sunnis in the north, he said.
“What makes this all surprising at this point is this is an area of Syria that is traditionally pro regime,” Mr. Tabler said. “So what the regime has been doing is suppressing a major Sunni base, all because a group of kids wrote graffiti on the wall.”
The government had initially insisted that the protests and deaths were the work of criminals brought across the border from Jordan. A vice president and former foreign minister, Farouk al-Sharaa, who is from the Dara’a region, said Thursday, “We are not opposed to the Islamic currents that are rational and broad-minded which understand their true roots, but as for Al Qaeda and the Taliban which take their instructions from America, and pretend that they are against it, they are condemnable.”
And while such logic may sound contrived in the West, perhaps fantastic, Mr. Landis said, it plays differently in Syria, where people are deeply distrustful of the United States.
“That sounds Qaddafi-esque to an American, but it’s not so weird in Syria,” he said."

Then it was Greece that went belly-up (5/3/2010: Eurozone OKs $145 billion bailout for Greece).
Hungary had already gone bankrupt (Oct. 29, 2008: Hungary snares $25.1 billion bailout).
Now it's Portugal's turn (March 24, 2011: Portugal bailout could top $100 billion in new problem for European Union).
So while "the rich Uncle Sam' has been busy "bailing-out" bankrupt and crooked and looted banks, insurance companies, corporations, investment houses, and the 50 states in various ways bringing itself to the brink of collapse, in Europe it has been Germany and the European Union doing the same, and they can't go on much longer at this rate (December 8, 2010: Germany reluctant to expand European bailout fund).
Add all that to the collapse of Japan under its new nuclear Holocaust, the collapse of the Arab regimes and the impact on oil production, the sounds of unrest and teetering in China, and it can safely be said that right now, the world is skating on very, very thin ice, and no one knows where this will lead.
Perhaps what we see is the collapse of Capitalism by the Divine Hand, no less than the sudden collapse of the failed system of Communism, and both for the same reasons, human GREED and selfishness.
So much wealth was generated in the recent global boom yet the majority of workers and professionals reaped few benefits from it as food, housing, clothing and transportation prices sky-rocketed, job security evaporated, and tens of millions in all countries lost established jobs and secure income while a tiny minority enriched themselves.
Now everyone is suffering from uncertainty and unrest.

I live in Baltimore and NEED TO TALK TO SOMEBODY IN TOWN WHO IS OPENLY OPPOSED TO NIRC AND EISEMANN, AND TRULY KNOWS HOW TO KEEP A SECRET. Everyone in my sviva appears - at least publicly - to really worship these guys. There are some people who seem to be somewhat ehrlikh, but I know that they are more or less connected to NIRC and may not listen to me, or worse, may report me to those crooks. No, in my horrifying circumstances I am not afraid of death, but - if that were possible - would like to be around longer than NIRC and Eisemann assumed. And I know that if my identity is disclosed, I will be done with faster than one can eisemann.
ReplyDeleteAt first, I thought of speaking to Vicki Polin, but after I read about her appearance on Oprah Winfrey's show and how she went on sabbatical after receiving money from Baltimore rabbis to keep her mouth shut, I started having my reservations. The same holds true about Phil Jacobs. He published an extremely watered-down article about rabbi Moshe Eisemann, then reportedly passed the victim list to rabbi Beryl Weisbord, and also preferred to keep his mouth zipped after rabbis Shraga and Sheftel Neuberger arranged for a special "don't ask - don't tell" policy between NIRC and "Baltimore Jewish Times" (this last thing I know for a fact not from the Internet but another source).
I would appreciate if UOJ were to post my appeal as a separate topic. This would cause people to read it and, perhaps, encourage them to reply. Otherwise, it may simply go unnoticed like so many newspaper cut-and-paste posts here. I hope you will help me - I recognize that this is my only remaining chance...
