Turner's hashgocho is owned by Rabbi Spivak in Monsey who uses Turner when clients are wary of Spivak's bad reputation and standards. Spivak is giving hashgocho to all kinds of goyish owned places that are open & cooking on Shabbos, and mistam doing anything else they want, without a mashgiach ever checking on them. Spivak is also rosh yeshiva of a strange yeshiva in Monsey where the Jewish Press's Yaakov Klass is a magid shiur as are a bunch of characters who also run not very serious hashgocho agencies. Spivak is a very modenna guy. A rov once called to inform him that everyone walking by a restaurant of his in Manhattan could see them cooking on Shabbos. Spivak started shouting oy vay and gasping for air like he was shocked. But nothing changes.

The Kotler family could maybe count as the "sixth family" the way they run not just the Lakewood yeshiva they totally own, but the entire town, surrounding counties reaching into the state of New Jersey with an array of economic, political and social levers and pullies to get their way. This is not just about learning Gemora or Torah Lishma, rather, this has become about raw POWER and accumulation of big time money, all so American.
This is all very removed from the old-time yeshivas of Lita (Lithuania) that were mired in abject poverty because in the days when the yeshivas grew in Lithuania the Jews were VERY poor there, yet they became great as Torah scholars. Not so now in America, where American materialistic values rule and Lakewood is rightly called FAKEWOOD (similar to HollyWOOD) where the emphasis is on guys roping in father's-in-law to support them for life and live in the laps of luxury forevermore, or for as long as possible at any rate.
So Rabbi Matisyahu Salmon is a nice "fig leaf" for what's really going on, as he provides a nice (artificial) patina of "respectability" -- an "appearance" and a "sound" of the old fashioned "ye olde European world" so that people in Fakewood can delude themselves that they are "in the olden days" of Torah with the quaint Rabbi Salomon to speak for them when there is absolutely no connection between who and what Rabbi Salomon is and the people he hangs out with and who trot him out to talk for them are. Even Charles Dickens could not make this stuff up.
Cut it out already. The profiteering in Lakewood took off when CEO showed up on the scene from Fallsburg. And you know it. Stop attacking the whole extended family. MONTICELLO – A couple of hundred emergency responders and volunteers Sunday evening searched the greater Monticello area looking for a 12-year-old boy who was reported missing early Saturday afternoon. He was found safe and sound late Sunday night.
Binyamin Simantov-Linkov, was last seen at the Monticello Synagogue on Landfield Avenue at 1 p.m. He was found around 10:30 p.m. hiding under a porch, said Rabbi Joel Gold, the chaplain for the state forest rangers.
Some 200 volunteers came up to Monticello from Brooklyn to aid in the search and hand out fliers with the boy’s picture at the stores in the area in hopes that someone might have seen him. Fliers were also handed out in Brooklyn.
Emergency personnel from Monticello Fire and Police departments, the Sullivan County Sheriff’s Office, Catskills Hatzolah and Misaskim were searching for the boy, who is a resident of Crown Heights.

MELBOURNE'S orthodox Jewish Yeshivah community has been rocked by another alleged child sex abuse scandal with a youth worker arrested on indecency charges. Former Chabad Youth leader Aron Ezriel Kestecher, 26, of East St Kilda, has been charged with four counts of indecent acts on a child under the age of 16. Kestecher, known as ''Ezzy'', is also understood to have recently worked as a substitute teacher at Yeshivah College, the East St Kilda boys' school at the centre of a police investigation into paedophilia. The arrest comes a month after Yeshivah College security guard David Samuel Cyprys was charged with multiple counts of indecent assault and gross indecency after he allegedly repeatedly molested boys from the school between 1984 and 1991. When Cyprys appeared in the Melbourne Magistrates Court last month, Detective Senior Constable Lisa Metcher accused members of the Yeshivah community of lying to police and trying to cover up sex abuse claims. ''They failed to act in any way to protect children,'' she said in court. Police wrote to former Yeshivah College students earlier this year, urging them to contact Crime Stoppers if they were assaulted or witnessed an assault between 1989 and 1993. The investigation was prompted by claims that former Yeshivah College teacher David Kramer had fled Australia in the early 1990s after parents complained he had sexually abused their children. The school did not report the claims to police at the time. The Age understands Victoria Police hope to extradite Kramer from the United States when he is released from prison, where he is serving a seven-year sentence for molesting a 12-year-old boy at a synagogue in St Louis. Earlier this year Yeshivah College principal Rabbi Yehoshua Smukler wrote a letter encouraging anyone who was aware of or suspected abuse to contact child protection services or police. ''If you have any concerns about abuse … please contact me directly … and I will immediately contact the relevant authorities,'' Mr Smukler wrote. Dovid Grynstzajn is a Lubavitcher whose name came up in a Senate investigation of Munkatcher Pell grant fraud. He was lav davka a willing accomplice as Munkatch was known to use peoples' names without their knowledge too.
Leo Teitelbaum is identified by Shmarya as going by his Yiddishe name Lipa Teitelbaum. The only person I can find who goes by both those names is the son in law of alleged molester Chazan Potchie Lipschutz from Frankel's shul and Monsey. He is in cherem along with his father in law due to involvement in some kind of real estate scandal in Suffern. He is best known as the Satmar street bum from the Amnon's pizza scene who is the kid brother of Aaron Teitelbaum from the orchestra. He is also the former owner of Deli 52 on 13th Ave. Hashgocho was Amram Roth. Pretty much anyone who shook Lipschutz's hand in the diamond district ended up with at least one gem stolen by him.
I was there when someone very snidely made a comment about the new house for a newlywed nephew of R' Shlomo Feivel Schustal that was purchased for him with BMG's money. A supporter of Margo who was standing there just snickered away.
Where does the fine line begin and end for families like the Kotlers who own yeshivos. Are they really required to take a vow of poverty as if they were old order monks? It is very admirable of Rav Olshin to refrain from dipping in the cookie jar but are the others mechuyev to follow suit?
It's certainly a good idea to appoint a board and it is a chiyuv when the rosh yeshiva's family does not actually own the place. But the Kotlers do own the place. Where do we see in halacha that such a chiyuv extends to them. Is there anything in nosei kelim to Choshen Mishpot or the teshuva seforim?
They got rid of Barnetzky not because he is a Lubav but because there wasn't room for another executive salary when Aaron decided to jump into the picture as CEO.
It's quite a coincidence by the way that a Rabbi Borenstein was forced out of Yeshivas Yesodei Hatorah when he refused the new board demand to hand over the books. He ended up in South Fallsburg which is where Aaron came from.
An early example of libel would be the case of John Peter Zenger. Zenger was hired to publish New York Weekly Journal. When he printed another man’s article that criticized William Cosby, the governor of New York at the time, Zenger was accused of seditious libel.[15] The verdict in the 1735 case was returned as "not guilty" on the charge of seditious libel, having proved that all the statements Zenger had published about Cosby had been true, so there was not an issue of defamation. Another example of libel would be the case of New York Times Co. v. Sullivan (1964) which involved a newspaper publication. The Supreme Court overruled a state court in Alabama that had found the New York Times guilty of libel for printing an advertisement that criticized Alabama officials for mistreating student civil rights activists. Even though some of what the New York Times printed was false, the Supreme Court ruled in favor of the Times, saying that libel of a public official requires proof of actual malice, which was defined as a knowing or reckless disregard for the truth.
How to prove libel
There are several ways a person must go about proving that libel has taken place. For example, in the United States, the person first must prove that the statement was false. Second, that person must prove that the statement caused harm. And, third, they must prove that the statement was made without adequate research into the truthfulness of the statement. These steps are for an ordinary citizen. In the case of a celebrity or public official trying to prove libel, they must prove the first three steps, and must (in the United States) prove the statement was made with the intent to do harm, or with reckless disregard for the truth. Usually specifically referred to as "proving malice".
How is that libelous? Do you know how many Kotlers and Schustals had their houses and vehicles bought for them by the yeshiva? Do the math, genius.
I wonder if even R' Aron owned the yeshiva because he was invited to join BMG by R' Nosson Wachtfogel who started the yeshiva a year before R' Aron came to America.
That comment about Rabbi Boring-stein makes me laugh. A psycho kid in Yesodei Hatorah once tried to burn the yeshiva down with a pack of matches. Borenstein called an adam gadol in Israel in a big panic but he sounded crazy so the gadol didn't believe him. Borenstein started shouting at the gadol: Ich hub eidim! while he tried to corral some yeshiva ketana age kids to get on the phone to vouch for his story.
There's a son of a Conservative rabbi who thinks he's a big Brisker who made himself a rosh yeshiva at a new place he opened up. I couldn't believe it when I heard he became rosh yeshiva because he is such a big putz. His wife is a tzebissen and nasty Boro Park girl who likes to scream. He would always pretend to everyone that his father is some big rov in a small out of town place to hide that he is Conservative. One day someone from yeshiva was in that town so he called the son's house to find out where the shul is so he can daven there. The wife screamed and yelled at the guy and refused to tell him where the shul is. Because her behavior made no sense, the sharp screaming victim knew something was wrong so he investigated and found out it's Conservative. I can see that the son is ashamed of his father's shteller but then before he had his own yeshiva he was evidently so proud of it that he used the Conservative temple tax exempt form to buy every personal item down to a pencil. He also pulled some kind of scam to live in one of the biggest houses in town with a HUD voucher. He might know how to learn but he was a big batlan in yeshiva who was always involved in dinei Torah. He was tovayeh many of his neighbors and threatened more still he would be mazmin them. At one point he was in so many dinei Torah at the same time that he didn't come to bais medrash for two weeks. You could see him running in and out of his house with two cordless phones pushed against his cheeks, carrying on two hectic conversations at the same time. It was neurotic with his head bobbing between phones while he squabbled like a chicken. Almost no one knows the truth about this putz.
On the afternoon of 10/15 a Stratton Road resident found a 4 year-old child roaming the street alone. She brought the child to her front step and her husband called the police. Police contacted the boy’s father, a rabbi, who said that the boy had tried to follow his mother to synagogue. The next day police received a second call about the same child from another neighbor at 11:35 am. An Old Lyme Road woman found the boy walking on Stratton Road by himself again. When Police arrived, the rabbi came to the house and said that his son had learned how to unlock the front door. Police advised the man to change the locks and also warned that if the child continued to get out alone they would be forced to call Child Protective Services.

The LA Times reports on the circumstances of Berg's debilitating stroke, revealing details no one was aware of. Berg and his wife were such big gamblers at Las Vegas casinos (which the IRS is very interested in), that they were given free rooms, limousine rides and MEALS. The LA Times confirms rumors that Berg's 2nd wife (who he chased while still married to the niece of the mekubal Rav Brandwein) was not frum when they got married. She is now 68 years old and still does not dress according to halacha. People have also seen her at the hotel swimming pool on Shabbos. When they questioned her she claimed it has a din mikva.
This other article says Berg is accused of stealing the kesovim on kabbala from R' Isaac Levi Krakovsky that he plagiarized as his own. Rav Krakovsky was a talmid of Rav Ashlag who followed his rebbe from the heim to Eretz Yisroel in 1922. He later moved to Brooklyn where he was niftar in 1966 after getting to know Berg.
A web of lawsuits have been woven around an allegedly crooked rabbi accused of forging paperwork to steal a whole building.According to court records and knowledgeable sources, Benjamin Herbst and cohorts have been the focus of a number of real estate lawsuits similar to the one Real Estate Weekly reported last week he is involved in at the midtown office building 315 West 35th Street.
The court cases and lawyers involved in them accuse Herbst and his associates of taking part in a number of schemes in which they have forged documents and signatures in order to gain title to properties they do not own and also leverage money against them.
“It’s like the Leonardo DiCaprio movie Catch Me If You Can, but instead of just forging checks this guy forges deeds,” said attorney Stephen Meister, who is involved in one of the lawsuits.Last week, Real Estate Weekly reported that 315 West 35th Street, an office building in Manhattan, had fallen victim to such a scam.
In that situation, the real estate investor Isaac Chetrit had purchased the distressed debt on the asset for $10.75 million in the summer of 2010. But when Chetrit tried to proceed with a foreclosure against the owner of the property, a man named Aaron Chitrik, he found that the title to the mortgage had been recorded to an imposter company with a similarly spelled name to the corporation Chetrit has used to buy the note.
According to Stephen Meister, who is Chetrit’s attorney and is a well-known real estate lawyer in Manhattan who has handled several prominent lawsuits, Chitrik along with Herbst and two lawyers who are involved with Herbst, Jon Lefkowitz and Stuart Davis, masterminded a plan in which they forged a new mortgage title in the name of their imposter company and then recorded it, fraudulently seizing control of the debt. Their actions have stalled Chetrit’s ability to proceed with the foreclosure on the property.
In a conversation with Real Estate Weekly last week, Herbst vehemently denied the allegations, stating that he had transferred the mortgage into the similarly named venture but that it was a voluntary partnership between Chitrik and Chetrit that he had helped arrange to resolve the property’s financial problems. Herbst, however, could not demonstrate proof that Chetrit and Chitrik had agreed to work together.
“What they are saying is an outright lie,” Meister countered.
This isn’t the 1st time Herbst has been involved in these types of activities, records show. In 1999, Herbst committed similar misconduct at a property where he was living in Boro Park, Brooklyn that his wife, Rhoda Herbst, had defaulted on.
A NJ company called Providence Properties purchased the building, which had been owned by Rhoda, in 1999 for $400,000.
According to court records, Herbst created an imposter company also named Providence but based in Boro Park & proceeded to transfer the property, 5001 17th Ave, to his son Richard’s control.
As was allegedly done at 315 W 35th, Herbst appeared to print out the deed, alter the document to reflect Providence was the company he created in Boro Park, not the Providence in NJ, and then filed it with the state authorities. Stuart Davis, acting as Herbst’s attorney in the case, then made formal requests with the Sheriff of Kings Country, who had been called to evict Herbst, to cease such actions, claiming the issues had been ameliorated.
Herbst then structured a complicated transaction in which he drew $600,000 of loans against the home using a company he created called Ay One.
In the end, the court ordered Herbst to hand back the property. Herbst wound up keeping 5001 17th Ave in return for paying off Providence.
In another incident in 2006, Herbst helped a Barry Chaimovitz set up a 1031 exchange for properties owned by Chaimovitz’s family.
Herbst appeared to arrange a deal in which the funds would be directed to a building in Detroit being sold by a Mayer Goldberger. The transaction was never completed.
According to court documents & Roy Martin, a lawyer who represented Chaimovitz in a subsequent lawsuit, Herbst transferred $1.8 million in proceeds from Chaimovitz to his own entity, Ay One. From there, he & Goldberger took the funds.
In a conversation with REW, Herbst insisted that nothing unordinary happened & he had taken control of the money only because the 1031 had been cancelled.
Herbst’s explanation didn’t correlate with court testimony & records, which show the funds were destined for Madison Exchange, a recognized intermediary. The money had only been allowed to pass to Ay One because Herbst had improperly altered the check.
During the Chaimovitz case, Herbst was reluctant to release financial information relating to the deal & was jailed for 15 days on 2 separate occasions for contempt of court.
Eventually, he & Goldberger returned the money to Chaimovitz & the case was settled.
Last year, Goldberger was indicted for an unrelated multimillion dollar mortgage fraud on Long Island.
In yet another recent case, Herbst improperly transferred ownership of a vacant home next to his house in Brooklyn to his possession. He then began construction to integrate the structures without city approval.
The neighboring property was severely damaged & Martin is representing the owner of the home in a suit against Herbst for over a million dollars.
It is at least the 3rd case where Martin has represented plaintiffs against Herbst.
Herbst again denied he had committed wrongdoing.
“I stand up for the downtrodden,” Herbst said. “I save people’s lives & businesses.”
Herbst said accusations of misconduct were inevitable because he's involved in distressed real estate where negotiations can turn acrimonious & lead to false charges against him.
“I’m a rabbi & I've taken a vow of poverty,” Herbst said, insisting he had no desire for profit & no motive to commit fraud.
For Roy Martin & Steve Meister however, the facts are clear.
“The court cases speak for themselves,” Martin told REW. “What I don’t understand is why the authorities have not moved to do something about this.”
As was told to Rabbi Nuchim Rosenberg by someone that was there two weeks ago: Someone tried to sodomize a yungerman in the Satmar mikveh on 53rd St. bet 13 & 14th Avenues in Boro Park. The perpetrator was caught and Shomrim were called and the perp begged not to embarrass him for he has a family and kids, so Shomrim led him out with a garbage bag over his face, and people were told that he stole a wallet - Police were never called.
Reb Nuchim is begging that the yungerman and a Rabbi Leitner who were in the mikva come forward to reveal everything they know so that the perp can be apprehended by police.
Does UOJ know anything about Yaakov Bryski who runs Chanoch Lenaar, the Lubav BT yeshiva in Crown Heights? He is accused of molesting students but his defenders say his yeshiva took in a lot of disturbed bochurim who make up stories so no one should pay attention.
Don't forget that many of Mordechai Tendler's accusers were crazy which is why it took so long for them to be believed.

MISRATA, Libya — Moammar Gadhafi was buried early Tuesday morning in an unmarked grave in a modest Islamic ceremony, closing the book on his nearly 42-year rule of Libya and the eight-month civil war to oust him.
A Gadhafi nephew read a prayer for the dead before Gadhafi’s body — along with those of his son Muatassim and former defense minister Abu Bakr Younis — were handed over for burial, said Ibrahim Beitalmal, a spokesman for the military council in the port city of Misrata.
The bodies had been kept in cold storage in Misrata for four days before being taken under cover of darkness to the burial site, which Beitalmal said was “not far” from the city. As part of the ceremony, the bodies were washed in line with Islamic tradition. A Muslim cleric, a nephew of Gadhafi and sons of Abu Bakr then recited prayers before handing the bodies over for burial, which took place at 5 a.m.
Libya’s new leaders have said they would not reveal the location of the grave, fearing it could be vandalized or turned into a shrine for the former dictator’s die-hard supporters.
Gadhafi was captured alive on Thursday as he tried to flee his hometown of Sirte, where he had been hiding since revolutionary forces swept into the capital, Tripoli, two months earlier.
He died later that day in unclear circumstances, and Libyan leaders have promised an investigation in response to international pressure to look into Gadhafi’s death. Video has emerged showing Gadhafi being beaten and abused by a mob after his capture, and researchers for the New York-based Human Rights Watch have said there are strong indications he was killed in custody...many Libyans appeared relieved that Gadhafi is dead, saying a long trial for the former dictator would have been disruptive and made it harder on the country to get a fresh start. Earlier this week, interim leader Mustafa Abdul-Jalil formally declared an end to the civil war, starting the clock on what is to be a two-year transition to democracy.
The bodies of Gadhafi, Muatassim and Younis had been kept in a refrigerated produce locker in a warehouse area of Misrata for the past four days. Hundreds lined up every day to view the corpses, some coming from hundreds of miles away. Visitors donned surgical masks, and at times guards arranged separate lines for men and women.
Misrata suffered immensely during the war. It was besieged for nearly two month this spring by Gadhafi forces, who shelled the city indiscriminately before being pushed out in fierce street fighting. Gadhafi was captured by fighters from Misrata, who brought him back to the city as a trophy.

The Libyan uprising that began in mid-February and quickly turned into civil war has decimated the Gadhafi family.

Rabbi Moisha Turner turns up giving hashgocho to a caterer or two. Turner's hashgocho is owned by Rabbi Spivak in Monsey who uses Turner when clients are wary of Spivak's bad reputation and standards. Spivak is giving hashgocho to all kinds of goyish owned places that are open & cooking on Shabbos, and mistam doing anything else they want, without a mashgiach ever checking on them. Spivak is also rosh yeshiva of a strange yeshiva in Monsey where the Jewish Press's Yaakov Klass is a magid shiur as are a bunch of characters who also run not very serious hashgocho agencies. Spivak is a very modenna guy. A rov once called to inform him that everyone walking by a restaurant of his in Manhattan could see them cooking on Shabbos. ReplyDeleteThe Kotler family could maybe count as the "sixth family" the way they run not just the Lakewood yeshiva they totally own, but the entire town, surrounding counties reaching into the state of New Jersey with an array of economic, political and social levers and pullies to get their way. This is not just about learning Gemora or Torah Lishma, rather, this has become about raw POWER and accumulation of big time money, all so American.
This is all very removed from the old-time yeshivas of Lita (Lithuania) that were mired in abject poverty because in the days when the yeshivas grew in Lithuania the Jews were VERY poor there, yet they became great as Torah scholars. Not so now in America, where American materialistic values rule and Lakewood is rightly called FAKEWOOD (similar to HollyWOOD) where the emphasis is on guys roping in father's-in-law to support them for life and live in the laps of luxury forevermore, or for as long as possible at any rate.
So Rabbi Matisyahu Salmon is a nice "fig leaf" for what's really going on, as he provides a nice (artificial) patina of "respectability" -- an "appearance" and a "sound" of the old fashioned "ye olde European world" so that people in Fakewood can delude themselves that they are "in the olden days" of Torah with the quaint Rabbi Salomon to speak for them when there is absolutely no connection between who and what Rabbi Salomon is and the people he hangs out with and who trot him out to talk for them are. Even Charles Dickens could not make this stuff up.
Cut it out already. The profiteering in Lakewood took off when CEO showed up on the scene from Fallsburg. And you know it. Stop attacking the whole extended family. Even with the petty stuff in the old days, the Olshins did not cash in by having the yeshiva pay for a grand house. R' Yeruchim said he will move out of yeshiva apts when all the yungerleit are paid on time.
ReplyDeleteMONTICELLO – A couple of hundred emergency responders and volunteers Sunday evening searched the greater Monticello area looking for a 12-year-old boy who was reported missing early Saturday afternoon. He was found safe and sound late Sunday night.
ReplyDeleteBinyamin Simantov-Linkov, was last seen at the Monticello Synagogue on Landfield Avenue at 1 p.m. He was found around 10:30 p.m. hiding under a porch, said Rabbi Joel Gold, the chaplain for the state forest rangers.
Some 200 volunteers came up to Monticello from Brooklyn to aid in the search and hand out fliers with the boy’s picture at the stores in the area in hopes that someone might have seen him. Fliers were also handed out in Brooklyn.
Emergency personnel from Monticello Fire and Police departments, the Sullivan County Sheriff’s Office, Catskills Hatzolah and Misaskim were searching for the boy, who is a resident of Crown Heights.
You can't bring a R'aya from R' Yeruchem. R' Yeruchem is a genuine tzaddik, completely removed from all of the crap that goes on there. Whether or not it was a Kotler ploy to put him there for this reason, as it would benefit them and Schustal - all arguable.

ReplyDeleteMELBOURNE'S orthodox Jewish Yeshivah community has been rocked by another alleged child sex abuse scandal with a youth worker arrested on indecency charges.
Former Chabad Youth leader Aron Ezriel Kestecher, 26, of East St Kilda, has been charged with four counts of indecent acts on a child under the age of 16.
Kestecher, known as ''Ezzy'', is also understood to have recently worked as a substitute teacher at Yeshivah College, the East St Kilda boys' school at the centre of a police investigation into paedophilia.
The arrest comes a month after Yeshivah College security guard David Samuel Cyprys was charged with multiple counts of indecent assault and gross indecency after he allegedly repeatedly molested boys from the school between 1984 and 1991. When Cyprys appeared in the Melbourne Magistrates Court last month, Detective Senior Constable Lisa Metcher accused members of the Yeshivah community of lying to police and trying to cover up sex abuse claims. ''They failed to act in any way to protect children,'' she said in court.
Police wrote to former Yeshivah College students earlier this year, urging them to contact Crime Stoppers if they were assaulted or witnessed an assault between 1989 and 1993. The investigation was prompted by claims that former Yeshivah College teacher David Kramer had fled Australia in the early 1990s after parents complained he had sexually abused their children.
The school did not report the claims to police at the time.
The Age understands Victoria Police hope to extradite Kramer from the United States when he is released from prison, where he is serving a seven-year sentence for molesting a 12-year-old boy at a synagogue in St Louis.
Earlier this year Yeshivah College principal Rabbi Yehoshua Smukler wrote a letter encouraging anyone who was aware of or suspected abuse to contact child protection services or police.
''If you have any concerns about abuse … please contact me directly … and I will immediately contact the relevant authorities,'' Mr Smukler wrote.
Meanwhile, Kestecher has been released on bail and will appear in the Moorabbin Magistrates Court on November 29.

ReplyDeleteIt's quite a coincidence by the way that a Rabbi Borenstein was forced out of Yeshivas Yesodei Hatorah when he refused the new board demand to hand over the books. He ended up in South Fallsburg which is where Aaron came from.

Cases involving libel
ReplyDeleteAn early example of libel would be the case of John Peter Zenger. Zenger was hired to publish New York Weekly Journal. When he printed another man’s article that criticized William Cosby, the governor of New York at the time, Zenger was accused of seditious libel.[15] The verdict in the 1735 case was returned as "not guilty" on the charge of seditious libel, having proved that all the statements Zenger had published about Cosby had been true, so there was not an issue of defamation. Another example of libel would be the case of New York Times Co. v. Sullivan (1964) which involved a newspaper publication. The Supreme Court overruled a state court in Alabama that had found the New York Times guilty of libel for printing an advertisement that criticized Alabama officials for mistreating student civil rights activists. Even though some of what the New York Times printed was false, the Supreme Court ruled in favor of the Times, saying that libel of a public official requires proof of actual malice, which was defined as a knowing or reckless disregard for the truth.
How to prove libel
There are several ways a person must go about proving that libel has taken place. For example, in the United States, the person first must prove that the statement was false. Second, that person must prove that the statement caused harm. And, third, they must prove that the statement was made without adequate research into the truthfulness of the statement. These steps are for an ordinary citizen. In the case of a celebrity or public official trying to prove libel, they must prove the first three steps, and must (in the United States) prove the statement was made with the intent to do harm, or with reckless disregard for the truth. Usually specifically referred to as "proving malice".
How is that libelous? Do you know how many Kotlers and Schustals had their houses and vehicles bought for them by the yeshiva? Do the math, genius.

That comment about Rabbi Boring-stein makes me laugh. A psycho kid in Yesodei Hatorah once tried to burn the yeshiva down with a pack of matches. Borenstein called an adam gadol in Israel in a big panic but he sounded crazy so the gadol didn't believe him. Borenstein started shouting at the gadol: Ich hub eidim! while he tried to corral some yeshiva ketana age kids to get on the phone to vouch for his story.

There's a son of a Conservative rabbi who thinks he's a big Brisker who made himself a rosh yeshiva at a new place he opened up. I couldn't believe it when I heard he became rosh yeshiva because he is such a big putz. His wife is a tzebissen and nasty Boro Park girl who likes to scream. He would always pretend to everyone that his father is some big rov in a small out of town place to hide that he is Conservative. One day someone from yeshiva was in that town so he called the son's house to find out where the shul is so he can daven there. The wife screamed and yelled at the guy and refused to tell him where the shul is. Because her behavior made no sense, the sharp screaming victim knew something was wrong so he investigated and found out it's Conservative. I can see that the son is ashamed of his father's shteller but then before he had his own yeshiva he was evidently so proud of it that he used the Conservative temple tax exempt form to buy every personal item down to a pencil. He also pulled some kind of scam to live in one of the biggest houses in town with a HUD voucher. He might know how to learn but he was a big batlan in yeshiva who was always involved in dinei Torah. He was tovayeh many of his neighbors and threatened more still he would be mazmin them. At one point he was in so many dinei Torah at the same time that he didn't come to bais medrash for two weeks. You could see him running in and out of his house with two cordless phones pushed against his cheeks, carrying on two hectic conversations at the same time. It was neurotic with his head bobbing between phones while he squabbled like a chicken. Almost no one knows the truth about this putz.
ReplyDeleteOn the afternoon of 10/15 a Stratton Road resident found a 4 year-old child roaming the street alone. She brought the child to her front step and her husband called the police. Police contacted the boy’s father, a rabbi, who said that the boy had tried to follow his mother to synagogue. The next day police received a second call about the same child from another neighbor at 11:35 am. An Old Lyme Road woman found the boy walking on Stratton Road by himself again. When Police arrived, the rabbi came to the house and said that his son had learned how to unlock the front door. Police advised the man to change the locks and also warned that if the child continued to get out alone they would be forced to call Child Protective Services.

ReplyDeleteA web of lawsuits have been woven around an allegedly crooked rabbi accused of forging paperwork to steal a whole building.According to court records and knowledgeable sources, Benjamin Herbst and cohorts have been the focus of a number of real estate lawsuits similar to the one Real Estate Weekly reported last week he is involved in at the midtown office building 315 West 35th Street.
The court cases and lawyers involved in them accuse Herbst and his associates of taking part in a number of schemes in which they have forged documents and signatures in order to gain title to properties they do not own and also leverage money against them.
“It’s like the Leonardo DiCaprio movie Catch Me If You Can, but instead of just forging checks this guy forges deeds,” said attorney Stephen Meister, who is involved in one of the lawsuits.Last week, Real Estate Weekly reported that 315 West 35th Street, an office building in Manhattan, had fallen victim to such a scam.
In that situation, the real estate investor Isaac Chetrit had purchased the distressed debt on the asset for $10.75 million in the summer of 2010. But when Chetrit tried to proceed with a foreclosure against the owner of the property, a man named Aaron Chitrik, he found that the title to the mortgage had been recorded to an imposter company with a similarly spelled name to the corporation Chetrit has used to buy the note.
According to Stephen Meister, who is Chetrit’s attorney and is a well-known real estate lawyer in Manhattan who has handled several prominent lawsuits, Chitrik along with Herbst and two lawyers who are involved with Herbst, Jon Lefkowitz and Stuart Davis, masterminded a plan in which they forged a new mortgage title in the name of their imposter company and then recorded it, fraudulently seizing control of the debt. Their actions have stalled Chetrit’s ability to proceed with the foreclosure on the property.
In a conversation with Real Estate Weekly last week, Herbst vehemently denied the allegations, stating that he had transferred the mortgage into the similarly named venture but that it was a voluntary partnership between Chitrik and Chetrit that he had helped arrange to resolve the property’s financial problems. Herbst, however, could not demonstrate proof that Chetrit and Chitrik had agreed to work together.
“What they are saying is an outright lie,” Meister countered.
This isn’t the 1st time Herbst has been involved in these types of activities, records show. In 1999, Herbst committed similar misconduct at a property where he was living in Boro Park, Brooklyn that his wife, Rhoda Herbst, had defaulted on.
ReplyDeleteA NJ company called Providence Properties purchased the building, which had been owned by Rhoda, in 1999 for $400,000.
According to court records, Herbst created an imposter company also named Providence but based in Boro Park & proceeded to transfer the property, 5001 17th Ave, to his son Richard’s control.
As was allegedly done at 315 W 35th, Herbst appeared to print out the deed, alter the document to reflect Providence was the company he created in Boro Park, not the Providence in NJ, and then filed it with the state authorities. Stuart Davis, acting as Herbst’s attorney in the case, then made formal requests with the Sheriff of Kings Country, who had been called to evict Herbst, to cease such actions, claiming the issues had been ameliorated.
Herbst then structured a complicated transaction in which he drew $600,000 of loans against the home using a company he created called Ay One.
In the end, the court ordered Herbst to hand back the property. Herbst wound up keeping 5001 17th Ave in return for paying off Providence.
In another incident in 2006, Herbst helped a Barry Chaimovitz set up a 1031 exchange for properties owned by Chaimovitz’s family.
Herbst appeared to arrange a deal in which the funds would be directed to a building in Detroit being sold by a Mayer Goldberger. The transaction was never completed.
According to court documents & Roy Martin, a lawyer who represented Chaimovitz in a subsequent lawsuit, Herbst transferred $1.8 million in proceeds from Chaimovitz to his own entity, Ay One. From there, he & Goldberger took the funds.
In a conversation with REW, Herbst insisted that nothing unordinary happened & he had taken control of the money only because the 1031 had been cancelled.
Herbst’s explanation didn’t correlate with court testimony & records, which show the funds were destined for Madison Exchange, a recognized intermediary. The money had only been allowed to pass to Ay One because Herbst had improperly altered the check.
During the Chaimovitz case, Herbst was reluctant to release financial information relating to the deal & was jailed for 15 days on 2 separate occasions for contempt of court.
Eventually, he & Goldberger returned the money to Chaimovitz & the case was settled.
Last year, Goldberger was indicted for an unrelated multimillion dollar mortgage fraud on Long Island.
In yet another recent case, Herbst improperly transferred ownership of a vacant home next to his house in Brooklyn to his possession. He then began construction to integrate the structures without city approval.
The neighboring property was severely damaged & Martin is representing the owner of the home in a suit against Herbst for over a million dollars.
It is at least the 3rd case where Martin has represented plaintiffs against Herbst.
Herbst again denied he had committed wrongdoing.
“I stand up for the downtrodden,” Herbst said. “I save people’s lives & businesses.”
Herbst said accusations of misconduct were inevitable because he's involved in distressed real estate where negotiations can turn acrimonious & lead to false charges against him.
“I’m a rabbi & I've taken a vow of poverty,” Herbst said, insisting he had no desire for profit & no motive to commit fraud.
For Roy Martin & Steve Meister however, the facts are clear.
“The court cases speak for themselves,” Martin told REW. “What I don’t understand is why the authorities have not moved to do something about this.”
As was told to Rabbi Nuchim Rosenberg by someone that was there two weeks ago: Someone tried to sodomize a yungerman in the Satmar mikveh on 53rd St. bet 13 & 14th Avenues in Boro Park. The perpetrator was caught and Shomrim were called and the perp begged not to embarrass him for he has a family and kids, so Shomrim led him out with a garbage bag over his face, and people were told that he stole a wallet - Police were never called.

ReplyDeleteDoes UOJ know anything about Yaakov Bryski who runs Chanoch Lenaar, the Lubav BT yeshiva in Crown Heights? He is accused of molesting students but his defenders say his yeshiva took in a lot of disturbed bochurim who make up stories so no one should pay attention.
Don't forget that many of Mordechai Tendler's accusers were crazy which is why it took so long for them to be believed.

ReplyDeleteThere is a house on ritzy Park Lane South in Kew Gardens that was owned by Philip Berg or one of his inner circle. The house has severe defects like the innards of all the walls are waterlogged. I don't know how the heck that even happened. That slimy real estate agent, the Iranian Jewish lady Mitra Hakimi tries to cover it up and play it down when prospective buyers figure it out. Between all of Mitra's for-sale signs and mortgages by molester Ephraim Bryks, it's more than I can stomach.

Italian government on brink of collapse

Silvio Berlusconi’s [Leib Tropper's] centre-right coalition government in Italy [Aguda] appears in danger of collapsing over European Union [UOJ] demands for a demonstration of concrete action on economic reform by Wednesday’s summit of eurozone leaders [bloggers].
The EU [UOJ] ultimatum delivered to Mr Berlusconi [Mr Tropper] in Brussels [whereabouts unknown] on Sunday risks breaking his coalition [chaverim] instead of giving it an external impetus to move ahead on measures to cut Italy’s [Aguda's] debt and promote economic growth [a nechtiken tog].
The ultimatum was delivered as part of efforts to resolve the eurozone [Aguda's] sovereign debt crisis, but the Italians’ [Frummers] failure to reach agreement on reform threatens EU [UOJ's] leaders’ stated goal of finalising at Wednesday’s summit a comprehensive solution to the crisis.
Talks on Tuesday morning between Mr Berlusconi [Mr Tropper] and his Northern League [MTJ] coalition partners failed to resolve the deadlock – centred on proposed pension reforms – after negotiations into Monday night made little progress.
“The government [moetzes] is at risk,” Umberto Bossi [Reuvo Feinsti], leader of the fiercely eurosceptic and federalist Northern League [MTJ], told reporters in Rome [Little Italy]. “The situation is difficult, very dangerous. This is a dramatic moment [azoy!],” he was quoted as saying.
Commentators said the crisis was the most serious facing Mr Berlusconi [Mr Tropper] since his election victory in 2008, recalling memories of 1994 when the Northern League [MTJ] brought down his first government after just a few months...
Mr Berlusconi [Mr Tropper] lashed out at his European critics in a statement on Monday evening, reacting to what was widely seen as humiliating treatment of his handling of the debt [orgies] crisis at a post-summit press conference held by France’s Nicolas Sarkozy [oichet a noe'ef] and Angela Merkel [a groise machasheifa] of Germany...

MISRATA, Libya — Moammar Gadhafi was buried early Tuesday morning in an unmarked grave in a modest Islamic ceremony, closing the book on his nearly 42-year rule of Libya and the eight-month civil war to oust him.
A Gadhafi nephew read a prayer for the dead before Gadhafi’s body — along with those of his son Muatassim and former defense minister Abu Bakr Younis — were handed over for burial, said Ibrahim Beitalmal, a spokesman for the military council in the port city of Misrata.
The bodies had been kept in cold storage in Misrata for four days before being taken under cover of darkness to the burial site, which Beitalmal said was “not far” from the city. As part of the ceremony, the bodies were washed in line with Islamic tradition. A Muslim cleric, a nephew of Gadhafi and sons of Abu Bakr then recited prayers before handing the bodies over for burial, which took place at 5 a.m.
Libya’s new leaders have said they would not reveal the location of the grave, fearing it could be vandalized or turned into a shrine for the former dictator’s die-hard supporters.
Gadhafi was captured alive on Thursday as he tried to flee his hometown of Sirte, where he had been hiding since revolutionary forces swept into the capital, Tripoli, two months earlier.
He died later that day in unclear circumstances, and Libyan leaders have promised an investigation in response to international pressure to look into Gadhafi’s death. Video has emerged showing Gadhafi being beaten and abused by a mob after his capture, and researchers for the New York-based Human Rights Watch have said there are strong indications he was killed in custody...many Libyans appeared relieved that Gadhafi is dead, saying a long trial for the former dictator would have been disruptive and made it harder on the country to get a fresh start. Earlier this week, interim leader Mustafa Abdul-Jalil formally declared an end to the civil war, starting the clock on what is to be a two-year transition to democracy.
The bodies of Gadhafi, Muatassim and Younis had been kept in a refrigerated produce locker in a warehouse area of Misrata for the past four days. Hundreds lined up every day to view the corpses, some coming from hundreds of miles away. Visitors donned surgical masks, and at times guards arranged separate lines for men and women.
Misrata suffered immensely during the war. It was besieged for nearly two month this spring by Gadhafi forces, who shelled the city indiscriminately before being pushed out in fierce street fighting. Gadhafi was captured by fighters from Misrata, who brought him back to the city as a trophy.
International organizations asking to see the burial site would be given access, Beitalmal said.
Over the weekend, Libya’s chief pathologist, Dr. Othman el-Zentani, performed autopsies on the three bodies and also took DNA samples to confirm their identities. El-Zentani has said Gadhafi died from a shot to the head, and said the full report would be released later this week, after he presents his findings to the attorney general...
The Libyan uprising that began in mid-February and quickly turned into civil war has decimated the Gadhafi family.
His wife, Safiya, fled to Algeria with their daughter and one son, while another son fled to Niger. At least other three sons — Muatassim, Seif al-Arab and Khamis — have been killed. Another son, former heir apparent Seif al-Islam, remains at large.
A high-ranking Tuareg official in Niger said Tuesday that Seif al-Islam, who is wanted by the International Criminal Court, is headed for Niger with the help of ethnic Tuaregs, a tribe that was among Gadhafi’s strongest supporters..."
