I'm 7. "Do you want to go with me?" asks my uncle. I wanted to go. I remember that. I remember feeling excitement and shame simultaneously. In that moment, all I knew was that for some reason I wanted to be alone ... with him. We'd be driving to pick up my cousin. We'd pull over in some abandoned parking lot. He'd turn off the engine and suddenly that space in the car with the seats that go all the way across would become the scary and haunting locale of the most defining and damaging event in my life.
I tell you this story with trepidation. But my fear is far outweighed by what I know is my obligation to help other victims of sexual abuse to not feel alone. To inspire other victims to realize that their lives do not have to be paralyzed by guilt and shame; they do not have to be defined by victimhood. And to convey to each and every damaged girl or woman that it is not her fault. Unfortunately, many, many girls are victims of sexual abuse. So even as we fight evil abroad, the evil of this abuse lives on in our neighborhoods.
Rarely does an adult get to revisit and bring justice to a crime that happened more than 30 years ago. But that is exactly what I was able to do. It began when my parents were getting set to move from the Bay Area to southern California. Of course, in my middle-class family this involved a garage sale. I was sitting on the lawn trying to negotiate a quarter for all my dad's old T shirts when my mom handed me a local newspaper she'd been saving. It seems that in January 2002, a 14-year-old girl named Sarah had wrapped her head in a towel and shot herself. Her suicide note implicated one Richard Stone.
My uncle. What?!, I thought. And then so many things rushed through my mind. You mean he's been doing this all these years? It wasn't just me? Oh my God, that poor girl. I know everything she was feeling. I sat there in tears on my parents' lawn, numb. Then I got angry—that my mother didn't show the paper to me earlier; that I didn't put my uncle away when I was 7 years old. But, of course, no one did back then. "Back then." It makes me sound like an old person. But seriously, just 30 years ago, no one did. No one talked about any of that, and by the time I was conscious enough to know how wronged I'd been and how damaged I was as a result, well, the statute of limitations had flown by and my healing was only as close as $150 an hour for years of sessions that luckily I could afford.
I went back to Los Angeles and spent a few restless nights dreaming of Sarah. And then I decided to call the D.A. in Santa Clara County who was working on the case. His name was Chuck Gillingham. I wasn't sure I even wanted to come forward with my story. I wasn't sure it would help or matter. But I called. When Chuck and I finally spoke, I didn't tell him who I was at first. I knew I had a lot to lose if this hit the tabloids: Teri Hatcher, screaming out for attention. It's pretty much ingrained in any victim of abuse that no one will believe them, and even if they do, you feel you'll still somehow get blamed. And thus the cycle of pain.
The D.A. and a police officer flew to Los Angeles to take my statement. I began to reveal the details I could never forget. I could picture the car and recall the feelings I had. I remember the clothes I was wearing, because he had me take them off. He touched me and asked if it felt good. I said no and he said, "well, someday it will." Who would ever think four simple words could do so much harm: "Well, someday it will." Damned if I do, damned if I don't. Maybe that's where all my adult guilt came from. Maybe that's why when I ate caramel coated with chocolate or had pleasurable sex or won an award or got a great job, just moments after the elation, I'd be slammed with an overwhelming urge to punish myself. Because at the core, I felt I was bad. I felt that I caused it. That it was my fault. Ah, Sarah, I knew that pain.
So that was it. They took my statement and they flew away. I had no idea what to expect next, but what I got was a phone call. I wouldn't have to appear in court. No one would ever hear my story because the judge and my uncle's lawyer had read my statement, and the corroborating evidence was enough to make him plead guilty in October 2002 (not to me, but to Sarah's case). He got 14 years. He's old. I hope it's his final resting place.
For me, this opportunity, this turning point, gave me a chance to face a very old but still raging fear. I can't say that a victim of abuse is ever completely healed. But this experience allowed me the space to feel validated, vindicated and, frankly, not crazy. It was not my fault. In order to justify the money they receive Ohel must ensnare woman to come for counseling under the pretense that they are being abused. Ohel hires social workers and counselors and makes a nice fee off this. Once they sink their claws into the woman they don’t let go very easy because this is a major profit center for them. It can evolve into profit from divorce counseling, children counseling and the list goes on.
Here are the signs to look for if you suspect that your wife is getting involved with Ohel.
Modus operendi: The counselor will first try to get the woman to get her own cell phone so she can contact her discreetly. The counselor has the woman call Ohel at 718 851 6300 and leave a message for the counselor. The counselor will then call back with the appointment time probably when the husband is at work so he wont find out that they are sucking in his wife. Ohel will not come up on the caller id. The caller id will come up as 646718. If you see that your wife has called 718 851 6300 and then has a call back of 718646 you will know that she is in touch with Ohel and you better take action before its to late. Ohel will give her articles, books and lists of items to convince her that she is being abused. You will then hear her use words and talk in ways that she was not familiar with before. Watch out for these signs. Warning your wife could be involved with Joan Hertz of Ohel Domestic Violence.
This is being published for the benefit of the Jewish Community by Ohel Insider. I hope to post more information about Ohel and names of its counselors in the future. Anyone else that has information should also share it for the benefit of the community. This is a major scandal ready to break open. The Rabanim are unfortunately all quit about this. Some are paid fat salaries by Ohel to condone what they do.

The convicted felon, on probation from Fort Dix Federal prison, has struck again at our community by publicly assaulting the Rosh Hayeshiva of Tomchey Tmimim in 770, Rabbi Labkowsky, On Top of the Rebbe’s Bima, during Hakofos in 770.
Thousands, who gathered at the Hakofos in 770, were in shock, as they witnessed the Elected Rosh Hakohol, Head of the Board of Directors of the government funded Crown Heights Jewish Community Council and of the Vaad Hakohol, violently attack Rabbi Labkowsky, in front of thousands of Chassidim and in front of the Rebbe, MH”M, during Hakofos in 770.
Rubashkin, a repeat offender, with a very long criminal record of violently attacking fellow Lubavitchers, dating back to his attack on Rabbi Sklar, the then, head, of the Chevra Kadishe of C.H., (during his grandfather’s Levaya) and more recently, his violent attack on the head of the Netzigim, Reb Yisroel Best, and his violent attack on the most respected and most senior worker of the C.H. Jewish Community Council, Rabbi Shmuel Light, and his current attack on the Rosh Yeshiva, Rabbi Zalman Labkowsky, has never yet been punished, sanctioned, nor removed from office, by his Rav, Rabbi Osdoba, whom Rubashkin claims to respect, adhere too and whom he he follows.

UOJ is right as always. Two female first cousins of the Tendlers, in an infamous interview in a pornographic magazine, said they were sexually abused as children, by a male member of their family.
ReplyDeleteAron Tendler told me he was molested as a child by his uncle. There is a good reason Shalom Tendler was thrown out of his Shul and YULA. I brought my claim to the RCC in the 1980's and they ridiculed me. I am now married and left the organized Jewish community, but I live with the horrors of my experiences every day of my life. First as a victim of the Tendlers, then as a crazy person in the bet din. The RCC has never apologized to me and they know who I am and where to find me.

ReplyDeleteThe Israel police fraud squad questioned Israeli Prime Minister Ehud Olmert for five hours on Tuesday over an alleged influence-peddling deal involving the sale of an Israeli bank two years ago.
The investigation, part of a larger probe into the privatization of Bank Leumi, comes as Olmert is preparing for a U.S.-backed meeting with Palestinian Authority Chairman Mahmoud Abbas intended to help put the Israeli-Palestinian negotiating process back on track after years of violence and stalemate.
If Olmert is convicted of wrongdoing in the bank affair, he could be forced to resign, although that is not expected to happen any time soon.
But an Israeli non-governmental organization that monitors the performance of the government said Olmert should not wait to resign if the investigations are distracting him from his duties.
"There is a great dissonance here between the lofty ideals of making peace and what people expect of leadership and an investigation for very petty minor crimes involved in material gain," said Michael Partem, vice chairman of the Movement for Quality Government in Israel.
Partem told Cybercast News Service he had no complaint about Olmert's involvement in the peace process, since as prime minister he should be dealing with matters of state.
Partem said the question is whether Olmert's personal business is taking up too much of his time and wasting taxpayers' money. If it becomes a distraction, then he should step aside, he said.
The current investigation focuses on suspicions that Olmert, while serving as acting finance minister in 2005, tried to steer the sale of Bank Leumi to a friend.
Press reports suggest it will be difficult for police to prove wrongdoing. Nevertheless, Olmert, the last suspect to be questioned, will be forced to meet again with investigators later this week, reports said.
According to Partem, Israeli law demands the resignation of a government minister only if he is convicted of a crime that leaves a "moral stain." A court would decide that, he said.
This is not the only investigation that Olmert faces. Two weeks ago, Israel's attorney general called for an investigation into suspicions that Olmert took a bribe when he purchased his Jerusalem home in 2004 for $300,000 below the market price.

The company’s enormous success seems to defy its critics. With over 1,000 titles in print, Mesorah/FartScroll dominates the Jewish publishing marketplace.
Well Funded
The company’s non-profit arm, the Mesorah Heritage Foundation, raised more than $8.2 million in 2005, the most recent year for which tax filings are public. That includes $407,000 in government grants, according to tax records, so the Washington lobbying firm the foundation hired for $66,000 earned its keep.
The foundation’s income has grown from $5.9 million in 2004 and $4.5 million in 2003. All told, between 2001 and 2005, the foundation raised nearly $29 million.
The men who founded and run both the foundation and Mesorah Publications Ltd. are Rabbis Scherman and Zlotowitz, who are well compensated. Between roles as foundation directors and principals of the publishing house, in 2005 Rabbi Scherman earned $303,000, and Rabbi Zlotowitz earned $377,700.

The fundraising is necessary to publish religious books, says Rabbi Scherman. “One volume of our Talmud costs between $250,000 and $350,000 to put out, and the marketplace can’t cover that,” he said, when each lists for under $50.
“Fundraising is never easy, but one very good thing is that there’s a product to show. You’re not giving for some amorphous cause. You’re seeing the product of your generosity,” he said. The cost to dedicate a prayerbook or volume of holy text ranges from $150,000 to $250,000, he said.
FartScroll farms out its printing but does its own binding in Brooklyn, and has a staff of about 50, Rabbi Scherman said.

On Cardinal Lustiger
The millennium has arrived. We are now invited to celebrate Rosh HaShanah with two Catholic heroes: the late Cardinal Jean Marie Lustiger and Mother Teresa (“Spending Rosh Hashanah With a Saint and a Cardinal,” Opinion, Sept. 14).
The piece correctly notes that Cardinal Lustiger was born a Jew, that he was saved by a Catholic couple in Orleans, France, and that he converted to Catholicism, “its truth and beauty having been demonstrated to him by that brave [Catholic] couple” that saved him.
To be sure, Lustiger was not the only Jewish child saved from death by non-Jews during World War II. But Cardinal Lustiger is unique in that even after being elevated to be a prince of the Catholic Church, he never denied his Jewishness. Indeed, as the article points out “Cardinal Lustiger declared until his dying day that while he was a proud and faithful Catholic, he also remained a Jew.”
With all respect to the author of the opinion piece, Cardinal Lustiger’s insistence that one can remain a Jew despite having converted to Catholicism reflects the greatest danger facing the future of the Jewish people (other than the licentiousness and depravity of the modern culture).
Every year, Jews for Jesus launches a multimillion-dollar campaign, supported by Hebrew Christian groups throughout the world, with the aim of convincing individual Jews — by the thousands — that a Jew need not convert to accept Jesus. As a past chairman of the Task Force on Missionaries and Cults, I personally witnessed the massive campaign that is launched yearly by Jews for Jesus.
It has always been the Jewish position — at least until now — that a Jew believing in Jesus is an oxymoron and, consequently, to adopt Jesus as one’s god is a gross act of apostasy.
If the author wanted to spend Rosh HaShanah with Cardinal Lustiger, that’s his call; I, for one, spent Rosh HaShanah davening with my fellow Jews.

Ok, I'm forwarding this to everyone so they don't make the same mistake. These burns were caused by a Magic Eraser sponge. The mom in this case let her kids erase their crayon marks off the walls and never even thought the sponges would have this kind of chemical in them that would cause this kind of burn or even hurt them. Learn from her mistake. Pass this along to anyone who has kids or grandchildren.
The photo is of Kolby - 24 hours after being burned by a Magic Eraser sponge. It was much worse the day before.
Here is the email we received -
One of my five year old's favorite chores around the house is cleaning scuff marks off the walls, doors, and baseboards with either an Easy Eraser pad, or the real deal, a Mr. Clean Magic Eraser. I remember reading the box, wondering what the "Magic" component was that cleaned crayon off my walls with ease. No ingredients were listed and absolutely no warnings were on the box, other than "Do not ingest."
My package of the Scotchbrite Easy Erasers didn't have a warning either; and since my child knew not to eat the sponges and keep them out of reach of his little brother and sister, it was a chore I happily let him do.
If I had known that both brands (and others like them) contain a harmful alkaline or "base" chemical (opposite of acid on the pH scale) that can burn your skin, I never would have let my little boy handle them. As you can see from the picture, when the Scotchbrite Easy Eraser was rubbed against his face and chin, he received severe chemical burns.
At first, I thought he was being dramatic. I picked him up, put him on the counter top and washed his face with soap and water. He was screaming in pain. I put some lotion on his face - more agony. I had used a Magic Eraser to remove magic marker from my own knuckles a while back and I couldn't understand why he was suddenly in pain. Then, almost immediately, the large, shiny, blistering red marks started to spread across his cheeks and chin.
I quickly searched Google.com for "Magic Eraser Burn" and turned up several results. I was shocked. These completely innocent looking white foam sponges can burn you?
I called our pediatrician, and of course got sent to voice mail. I hung up and called the hospital and spoke to an emergency room nurse. She told me to call Poison Control. The woman at Poison Control said she was surprised nobody had sued these companies yet and walked me through the process of neutralizing the alkaline to stop my son's face from continually burning more every second.
I had already, during my frantic phone calling, tried patting some numbing antibiotic cream on his cheeks, and later some Aloe Vera gel - both resulted in screams of pain. The Poison Control tech had me fill a bathtub with warm water, lay my son into it, cover him with a towel to keep him warm and then use a soft washcloth to rinse his face and chin with cool water for a continuous 20 minutes. My son calmed down immediately. He told me how good it felt. I gave him a dose of Tylenol and after the twenty minutes was up, he got dressed in his Emergency Room doctor Halloween costume and off we went to the hospital. They needed to make sure the chemical burn had stopped burning, and examine his face to determine if the burn would need to be debrided (from my fuzzy recollection of hospital work, this means removing loose tissue from a burn location). My son was pretty happy at the hospital, they were very nice and called him "Doctor" and let him examine some of their equipment. The water had successfully stopped the burning and helped soothe a lot of the pain. I'm sure Tylenol was helping too.
They sent us home with more Aloe Vera gel, Polysporin antibiotic cream, and some other numbing creams. By the time we got home, my son was crying again. I tried applying some of the creams but he cried out in pain. Water seemed to be what worked the best.
After a rough night, I took the above photo in the morning. He was swollen and wouldn't move his lips very much. The skin on his cheeks was taut.
Today he is doing much better. The burns have started to scab over, and in place of red, raw, angry, skin we have a deeper red, rough healing layer. I can touch his skin now, without it stinging.

He describes attending the Yeshiva of Spring Valley with its competitive blessing bees. When the father of a classmate dies, the teacher advises the students to pray to God for forgiveness so that He wouldn’t decide to kill their fathers, too. (The Putz is probably making this up).
The reader learns that his mother is the sister of Rabbis Maurice and Norman Lamm, one a best-selling author and the other the chancellor and former president of Yeshiva University. While growing up, she had wanted to be a doctor, but her father used the money saved for her tuition to pay for her brother’s rabbinical education. Soon after she married, her husband’s father died, leaving his fortune, thought to be millions, entirely to charity. Early in their marriage, Shalom’s parents lost a baby son.
As a young boy, Auslander began sneaking out of the house on Shabbat afternoon; a first transgression was to ride his bike to a local store, but then he couldn’t get himself to step on the electronic pad to open the door, another transgression. But soon after, he was taking taxis to the mall, shoplifting small items and sneaking non-kosher foods. By the time he was in high school at MTA, the Manhattan Talmudic Academy, he was shoplifting the kinds of expensive clothing his classmates wore, smoking dope and skipping classes to go to museums, bookstores and porn shops.
When he was caught with more than $500 of stolen clothing and some marijuana in his pocket at Macy’s, he was sentenced to community service and a heavy fine. He worked at a local hospital, doing filing on Sundays, until he learned that he could also fulfill his service at a religious institution. He then went off to study at a yeshiva in Israel, pasting a poster of a bikini-clad Cindy Crawford above his bed.
Most of the rebbes there had stories of their own — they had been on drugs or in street gangs and then found God. While their tales were meant to be inspiring, for Auslander they were cautionary. He mostly skipped class and prayer services, and occasionally showed up stoned. But even he experienced the phenomenon of return. After accepting invitations to a rebbe’s home, he felt loved and accepted — as he had never felt before — as long as he agreed to live as they did. He returned to New York still wearing his black hat, and while studying in a Queens yeshiva, worked nights as a shomer, watcher, in a funeral home. Not the most traditional of watchers, he’d get high and fall asleep on the gurney.
Six months after he was introduced to his London-born wife, who had been through her own traumas, they married and moved to the East Village, shifting further from religion and their families. Auslander didn’t go to college and took a job as an advertising copywriter. Later, he began writing journalism, including articles for Esquire. He found the personal voice that he now uses a few years later, when writing a letter to his mother about halting communication.
“I cried as I read the letter to my wife. Then I thought, this is wrong — this is sad for my mother but freedom for me. I rewrote the letter funny — as funny as a don’t-call-me-ever-again letter could be. That was the first time I wrote something for myself.
“I laughed and kept writing,” he says, adding, “You can choose. There’s you and a hundred other voices in your head. It’s about not letting yourself live in someone else’s movie.”
Does he worry about writing things that will upset his family?
“My basic feeling is that I’m entitled to my story and I’m entitled to talk about it.”
He’s no longer in touch with any of his family members, including his well-known uncles. He last saw his parents when his son was born. For his son’s first birthday, the inscription on the cake read, “Happy Birthday, Paix. From Mommy, Daddy, Harley, Duke [their dogs], and no one else in our families because they are bitter miseries who’d rather drag us into the morass of their bleak, tragic lives that share for a moment in our joy. And many more.”

Geico has now revised their car insurance policy to exclude the following Lakewood chapp: If they get into a bad accident that is their fault, the kollel guy sues his wife who was driving to help recoup the cost of the rate hike. Geico spells out no more spousal suits in these cases.
The first yungerman I remember who figured this out about 15 years ago, is the kind of putz who Pinny Lipschitz would label in the Yated as a "noted askan" if he gets the chance.

ReplyDeleteI for one remember, when R' Elya Svei had a fit about "translating" the Talmud in English. I firmly am of the belief that Artscroll has done a great service to the Jewish community with their shas and many other works.
The problem is they let their success go to their head, and Zlotowitz and Scherman get to decide what's fit to print. Now, these are smart guys; yet like every one in public life and using public funds, they need to be monitored very carefully.
Scherman is very guilty of many mistakes in judgment, and Zlotowitz shleps along.
They have no problem with white lies as in their Gedolim series, and publishing books from the likes of Pinter. This is where you have to question their ability to decide for the Jewish community, what is "fit to print"---or print and print, raise money and raise money...and what else don't we know about regarding - what influences their decisions.

ReplyDeleteWASHINGTON (Reuters) - Starbucks Corp (SBUX.O), the world's biggest coffee shop chain, recalled 250,000 children's plastic cups made in China after receiving reports of the cups breaking and posing a choking hazard.
The U.S. Consumer Product Safety Commission (CPSC) said Starbucks received seven reports of the cups breaking, including two reports in which a child began to choke on a piece of the cup.
No injuries were reported, the CPSC said in a statement.
The recall covers four styles of plastic 10-ounce cups with lids shaped like a red ladybug, green turtle, pink bunny and yellow chick, the CPSC said. The children's cups were sold for about $6 each at Starbucks stores from May 2006 to August 2007.
If the cup is dropped, the face on the cup can break off and leave small parts or sharp exposed edges that can pose a choking or laceration hazard to young children, the CPSC said.
Consumers should take the recalled cups away from children and contact Starbucks for a refund. The company is also offering a complimentary beverage as an incentive to return the recalled cups, the CPSC said.

Dear Friends,
I am still on a medical leave and not sure when I'll be returning to work. I am told that my healing process from the car accident will take much longer then I expected. We have a few volunteers who are stepping in to help, yet we are far behind. Please be patient with us.
Today a friend dropped off a copy of David Mandel's article "Child Molestation in the Jewish community - Overblown or Understated?", which was published in the Jewish Journal. I haven't had a chance to read the entire article, yet I glanced at the first paragraph and found several errors (see below). David Mandel is the CEO of Ohel, which is an ultra-orthodox, mental health center in New York City.
I'm sure Mr. Mandel's goal is to make a difference in hopes of protecting our children. The problem is that his expertise is not in child molestation. It's obvious that Mandel and those at Ohel are lacking the specialized training and education in the field of sexual victimization and working with offenders.
David Mandel is correct "we need a more open dialogue on the issue of child molestation", that the majority of cases do not involve strangers and that as a people we need to remove the shame, blame and stigma associated with sexual victimization from those who have been violated and place it on the offender(s) and those who cover up these criminal offenses. The goal is not only to teach prevention, yet also to help those who have already been victimized.
It is also vitally important for all parents, schools and youth groups to teach children about "good touch, bad touch." The reason why I also say schools and youth groups is due to the fact that majority of cases of child molestation occurs in the home.
46 percent of cases of child molestation are committed in the home -- most often by a parent, stepparent and or sibling. One cannot expect a parent who molests to teach their own child about prevention.
When one suspects a child is at risk of being abused or neglected we are all mandated reporters. This does not mean reporting our fears to our rabbonim. It means picking up the telephone and calling the secular authorities (child protection services) in your community. The responsibility of investigating suspicions is that of the professional agency. They have the education and training. It's important to remember their goal is not to break up families or remove children from the home. The goal is to offer services to families in need and most importantly to help children to grow up in safe, healthy environments.
David Mandel also made a mistake by stating that "Perpetrators (sex offenders) may be less likely to offend children, knowing their community will not tolerate their behavior."
The problem is that as of now there is no known treatment that works for sex offenders. Many look at sex offenders as being mentally ill, unable to control their criminal behavior. They are a time bomb waiting to go off. It's sad and scary to say that we need to look at sex offender's as having an incurable disease. Only 16.3 percent of known sex offenders will end up in prison. We also have to remember the fact that 61 percent of sex crimes are never reported to law enforcement. Meaning, the majority of those who sexually victimized children are unknown. Their names are kept secret by those who are or have been victimized.
We all have to know that times that a sex offender's disease may go Into remission, yet according to the US Dept. of Justice, over a 25 year period 52% of convicted sex offenders will re-offend. A typical child sex offender molests an average of 117 children (National Institute of Mental Health)
Given this information and the article that was written, I want to suggest that everyone call Mr. David Mandel. Let him know of the errors I pointed out, suggest to him that he and his entire clinical staff go through The Awareness Center's certification program. Our goal is not to attack, our goal is to educate. To make sure all care providers have the basic information that they are lacking and also learn how to work with survivors, family members and offenders. I think it's time we all work together to end sex crimes in Jewish communities.

Did the Appellate Division, First, Department, condone a religious leader's sexual misconduct in Marmelstein v. Kehillat New Hempstead?
In 1994, Adina Marmelstein met Mordecai Tendler, the founder and spiritual leader of The Rav Aron Jofen Community Synagogue, and a man known within the Orthodox Jewish community as a "scholar, educator, and community leader."
Marmelstein alleged that Tendler counseled her regarding her “personal, legal, and financial problems," particularly focused on her goals of marriage and procreation. As part of that "therapy," Tendler supposedly induced Marmelstein to have a sexual relationship with him, lasting from November 2000 until May 2005.
Tendler allegedly advised Marmelstein that she was "closed to the possibility of finding a husband," and that she needed to “permit him to have sexual intercourse with her so that her life will open up and men will come to her.” He reportedly was so close to God, that was her "only hope."
Unfortunately, Tendler’s “treatments” were unsuccessful, and Marmelstein remained unmarried. Furthermore, she alleged that Tendler warned her against exposing their relationship, threatening to have her "placed in a straitjacket,” “put in a penitentiary,” and “turn the community against her.”
In New York County Supreme Court, Marmelstein asserted four causes of action against Tendler. When the court dismissed only two of them (“fraud” and “negligent infliction of emotional distress”), Tendler appealed to the Appellate Division, First Department, which struck the remaining claims (intentional infliction of emotional distress and breach of fiduciary duty).
At common law, a woman could sue for “seduction,” defined as “conduct on the part of a man, without the use of force, in wrongfully inducing a woman to surrender to his sexual desires.” In 1935, the New York State Legislature abolished "seduction" as a means of recovery. (See section 80-a of the Civil Rights Law.)
According to the AD1, the remaining causes of action warranted dismissal because Marmelstein’s allegations, “[d]istilled to its essence,” comprised a seduction claim barred by law.
Although he advised her on “personal, legal, and financial” problems, neither a fiduciary nor “professional” relationship was alleged. And, while recent caselaw holds open the possibility of a “cleric-parishioner” fiduciary relationship, Marmelstein did not assert that Tendler served as her religious counselor. (The AD1 speculated that plaintiff intentionally omitted that claim for fear of dismissal on First Amendment grounds.)
Such a shonda, wouldn’t you agree?

Fallsburg, NY - Last night a large fire swept through the Krula Bungalow Colony on Route 42 in South Fallsburg.

ReplyDeleteFor years, the state Public Service Commission has been after Con Ed to replace its 10,000-volt paper-insulated cables, some of which failed during the 1999 Washington Heights blackout and last year's nine-day Astoria and Long Island City outage.
Con Ed concedes that the underground cables have a higher failure rate than newer ones, but it has no plan to replace them all before 2024.
"The company has imprudently dragged its feet," the union wrote in a PSC filing.
As of last year, paper-insulated cable made up 27 percent of its distribution system, Con Ed said. In its request for a 17 percent residential electric-rate hike, it proposes spending $39 million a year to speed up replacement of the old cables by 2020.

According to unofficial results from the city Board of Elections (they're certifying the votes later this week), Noach Dear got 3,776 votes to beat Karen Yellen, who got 2,554.

Four Orthodox Israelis who attempted to smuggle 65,000 cigarettes into Britain, were fined, after which they returned to Israel.

They were each fined £400 and ordered to pay £100 costs, and an order was given for the cigarettes to be destroyed. They paid up less than an hour after being sentenced and returned to Israel.

ReplyDeleteMiami, FL - A little girl on life support left the hospital after nearly a month and returned home, where her family will now care for her.
A wish has come true for a devout Jewish family of brain dead 4-year-old Aliza Schwab. "It's unbelievable," said Esther Schwab. "I have no words to describe it. It's happiness. I'm speechless."
Doctors say Schwab has been on life support at Jackson Memorial Hospital for six weeks since a near drowning in her family's pool. Several doctors declared Schwab brain dead, and claim that by Florida law the girl had to be taken off life support. Schwab's family refused to abide by that law and believed that for as long as her heart is beating, they still had hope.
Schwab will be on a ventilator, feeding tube and will undergo rigorous physical and occupational therapy.
She has shown this by increasing the movements of her head, neck, hands, legs and feet in a more exaggerated motion and showing more response when her family members are nest to her depending on the side she will only move on the side they are on. Alizah also continues to maintain her bodily functions i.e. tempurature, blood pressure, heart rate etc on her own. Also after an examination from her pediatrician the pupil of her left eye has began reducing in size when exposed to light, this is a breakthrough as it further indicates there is upper brain activity. However, Alizah is still in a critical state. The tefilos, tehillim, mitzvos and ahavas/achdus Yisroel need to continue and even increase the efforts.

Hillel, who is lovingly known by anyone who has ever set foot in Shomer Shabbos, was in the midst of emptying the pushkas in the Shul as he does every day, when he came upon the Boneh Olam pushka which was literally overflowing with money. The source says, "Hillel lost it. He grabbed a cell phone and called Boneh Olam, yelling and screaming at them at the top of his lungs for leaving the pushka with hundreds of dollars in it, putting it at risk of being broken into." The source says further, "He told them that they were behaving completely irresponsible with other peoples' money that they had donated to them. He told them that they should either empty the pushka immediately or it would be taken down."

State police arrested a Kiryas Joel man yesterday accused of threatening a Hasidic couple whose cars were vandalized because the wife was deemed to dress too immodestly.
Troopers charged Herman Ezriel, 33, with aggravated harassment, a misdemeanor. He allegedly harassed the couple by phone after reading a newspaper article detailing the attack on their cars. Sgt. Warner Hein said police have no evidence linking Ezriel to the vandalism, though the search for suspects continues.
Kiryas Joel — They came in the night, a group that claimed to consist of 25 men who deemed that the dress of a Hasidic woman violated the village's standards of modesty.
The men deflated the tires of one car belonging to the woman's husband and threw white oil-based paint on another vehicle. The message in Hebrew, slathered in white paint on the couple's black car: "Get out defiled person!"
But residents of this village of more than 20,000 devout orthodox Hasidic Jews say they are just as concerned about who last week's attackers claimed not to be as they are about who the men said they were.
According to the couple, the attackers sent them a letter claiming they were not Vaad Hatznius, the rabbinically sanctioned arm of religious enforcement in the village.
In the letter, the attackers said they acted against the wife for wearing fancy wigs, brand-name clothing and denim skirts.
Bloggers and Times Herald-Record readers who identified themselves as being from Kiryas Joel said in online posts that the wife's choice in clothing disrespects their community, but they also feared that the vandalism would trigger more acts of violence by unsanctioned groups purporting to represent the interests of their religion.
"Now there is a new face of terror, and they are trying to target people who they feel are not behaving in a manner that they think they should," said one villager, who asked his name be withheld for fear of retaliation.
The incident shines a spotlight on the ambiguous acceptance of strict behavioral controls in the religiously orthodox community. Various Hasidic communities acknowledge the need for such controls to preserve their traditions, but also remain suspicious of those who enforce such rules, said Samuel Heilman, a City University of New York sociology professor.
"It's a little bit like the cops, who are on the side of the good guys, but don't always get looked upon as paragons of virtue," Heilman said.
Vaad Hatznius acts as the sanctioned arm of the grand rabbi, Aaron Teitelbaum in Kiryas Joel, or his brother Zalman, in Williamsburg, Brooklyn. Such groups are a common feature of orthodox Hasidic life, regulating all forms of modesty including public displays of affection, clothing and even Internet use.
"They're not at all different from religious groups in strict Muslim countries that go around making sure women keep their hijabs on," Heilman said.
But such groups are usually checked by the spiritual leader of the community, as well as by Jewish Talmudic law, which forbids violence in dealing with others. Allan Nadler, professor of religious studies at Drew University in New Jersey, said Vaad Hatznius usually uses persuasion, humiliation or threats of expulsion, addressing mostly the husbands of women thought to lack virtue — not the women themselves. "Frankly, (the attack) doesn't sound like something that they would do," Nadler said.
However, vigilante enforcement of religious customs is not uncommon in Satmar communities, especially in Brooklyn, where the acts are usually condemned immediately afterward by the head rabbi, Nadler said.
Aaron Teitelbaum has so far failed to publicly condemn the attack on the couple, but state police said the village religious authority, as well as the government, is cooperating fully in efforts to find the culprits.
"The success of previous rebbes have been their ability to put the lid on this kind of violence," Nadler said. "Otherwise, it can get out of control."
Keeping customs in check
The Satmar Hasidim trace their roots to Rabbi Joel Teitelbaum, a Holocaust survivor who moved to New York City from Romania after World War II to establish a Hasidic community in Williamsburg, Brooklyn. Teitelbaum was succeeded as the grand rabbi by his nephew, Moshe Teitelbaum, whose death on April 24, 2006, left a fight for power between his two sons: Aaron Teitelbaum, who heads Kiryas Joel, and Zalman Teitelbaum, who heads the main Williamsburg congregation.
The Hasidic group adheres to the most theologically conservative form of Orthodox Judaism, believing that they are the direct descendants of Moses' people. As such, the group adheres to a strict codes of dress and behavior and opposes any secularization or modernization of their customs.
Groups called Vaad Hatznius, or "committee on modesty," regulate the public behavior of community members, especially women. Public displays of affection such as holding hands, even by married couples, could be cause for admonishment. So too would be clothing that appears fashionable or flattering to the female form. At least one Web site, Hasidicnews.com, claims that Vaad Hatznius caused its operations to be shut down, apparently because the site allowed liberal discussion boards about Hasidic life.

The homeowner spotted the slithering serpent about 10:30 a.m., as it creeped along the Avenue M driveway.
The family, observing the Simchat Torah holiday, asked their housekeeper to call 911, and the NYPD responded with a pair of Emergency Services officers. One of them quickly corraled the rat-hungry reptile as a small crowd watched.

An anonymous person e-mailed me photographs of what "appears" to be an authentic reproduction of "that" magazine's photographs of the Tendler twin cousins. It is a very sad day for me. I truly am of the belief that this "illness" runs in families. If authentic, the photographs are shocking! Only seriously disturbed people would be able to permit themselves to be photographed in that manner.

ReplyDeleteI have a friend who is on the clinical staff at Ohel. Her starting salary was around 30k. This is someone who is a licensed mental health professional. She left due to how poorly trained most of the staff members were. She took the position because she wanted to work for an all frum agency.

I have names to investigate and this could jeopardize the licenses of Ohels social workers if they are being used. There is an unlicensed MSW running an illegal counseling clinic in Lakewood. He loves telling everyone that he is the last musmach of R' Shneur. He has counseled a large number of sexual abuse victims over the years, many of whom where abused by a relative.
ReplyDeleteHe was involved in at least one cover up in which a rosh yeshiva in NY tells me the primary perp is a personal friend of his and that the lowlife fed lies to Rav Salomon to protect the friend. Instead, someone who was nominally responsible for the abuse without actually laying a finger on the kids was driven out of town and had his own and his family's life essentially destroyed.
He otherwise has an incentive to cover up ANY abuse case because if it goes to the authorities or courts, he will be exposed as practicing illegally.
I happen to have learned the ID of 2 abuse victims in Lakewood. One was a young kollel veib who was abused by her sicko Hungarian parents who think they are big shots in Flatbush. There is also the case of a kollel yungerman who was beating his kids. The yeshiva got involved and placed his kids in other homes.

Trader Joe's sells meat that is claimed by Rubashkin to be "organic". Considering the way they are said to switch around labels between glatt and non (& possibly even treif to kosher), I suggest that Trader Joe's conduct a lab analysis.

Bob Gittleman, who has run Bob's Butcher Block & Deli in Carmichael for nearly 17 years, is closing his business next month and moving his family to New York.
The reason? Too much competition from Trader Joe's and not enough growth in the Orthodox Jewish community, he says.
"I've been losing money for the past couple of years," says the 51-year-old deli owner. When offered a job as general manager of a kosher food chain in Queens, he took it.
Gittleman says his sales started slipping when Trader Joe's began selling kosher-certified chicken and beef -- at prices he couldn't match. Other mainstream grocery stores also started offering kosher goods.
"It's good for the (Jewish) community that more products are available with kosher certification," he says. But it hasn't been good for him.
The reaction from customers? Some are "shocked," he says, adding he feels bad for the longtime customers and business travelers who frequented his shop.
"It's just a shame the community couldn't support a store like ours," he says. Gittleman's last day for business will be in mid-October.

LAS VEGAS - Two hot dog eating champs faced an upset — not of the stomach variety — when a Chicago culinary arts student trounced them in eating chicken wings.
Patrick "Deep Dish" Bertoletti skinned champion Joey Chestnut and staved off a comeback by Takeru Kobayashi to win the chicken wing "Chowdown" for Spike TV.
Wriggling his body and gnashing his teeth, the 22-year-old downed 4.1 pounds of chicken meat in eight minutes flat in front of a cheering crowd in downtown Las Vegas Tuesday to win the $25,000 top prize.
Chestnut wolfed 4.05 pounds for second while Kobayashi came in third, inhaling 3.12 pounds.
Bertoletti, who came into the event ranked 3rd by the International Federation of Competitive Eating, said he used his thumb to squish meat off the bone for speedy ingestion, using the "umbrella technique." He credited the Buffalo Wild Wings staff for preparing a tasty meal.
"They were warm enough and they were soft enough. They had the perfect amount of sauce on them," he said. "It was perfect."
Top-ranked Chestnut, 23, was in his first cheek-to-jowl matchup against No. 2 Kobayashi since wresting Nathan's Fourth of July hot dog eating crown from the Japanese eating machine three months ago. He said Tuesday's loss left a bad taste in his mouth.
"It's bittersweet," said Chestnut, of San Jose, Calif. "I beat Kobayashi, but I didn't win."
Kobayashi was the six-time Nathan's champ from 2001 to 2006 and came into the contest nursing a sore jaw. While he downed wings like a cartoon character eating corn on the cob, the 29-year-old from Nagano, Japan, said he was more tentative than usual.

ReplyDeleteThis article doesn't identify him by name but the Wall St Journal in the summer did and really gave him a pummelling. There was then a big argument on Luke Ford's site between readers taking opposite sides about who is at fault.
The only way to put pressure on Ohel is to stop their funding. Take away all the grants they get from the city and state and educate their donors about how they run the place.

A few years back I wanted to move to Boro Park and work in an orthodox organization. I have years of clinical experience in working with the DV population. I was offered a position at Ohel as the clinical director of the program. I didn't take the position for the following reasons.
1. Living in NYC is extremely expensive. I would need to earn enough to support myself.
2. I had over 10 years of clinical experience. I needed to earn at least what I was already making.
3. The final offer Ohel made was $28,500 a year to be the full time clinical director. That was after I tried to negotiate with them from $27,000.
I became extremely disenchanted with the organization. If they want to provide quality services to their clients, they need to have qualified professionals working for them. They need to be paying their supervisory staff close to double of what they were willing to offer. the average salary for someone straight out of grad school is at least $35,000 to $40,000 for a low budget agency. Someone with my experience wouldn't take anything under $60,000.00.

The editorial page is the best part of the WSJ, but that piece in Aug. on Ariel Hacohen was very odd. The author though was not a regular staff writer, it was Bari Weiss, some young chick who was interning in the summer. She's best known for making a ruckuss as an activist at Columbia U.

ReplyDeleteI've been following the issue of child molestation on Jewish blogs for several years. I've watched The Awareness Center grow, the old Protocol's blog, the development of the Canonist. I even remember when Jewish Whistleblower (JWB) started his blog and then suddenly stopped.
Then came UOJ (Unorthodox Jew). At first I thought UOJ might be JWB, Rabbi Blau, Rabbi Dratch or even maybe Gary Rosenblatt taking on a new persona.
I think at first UOJ had integrity, yet as time has gone by it just seems as if his postings are really nothing more then a huge ego trip.
I also wonder why UOJ is working in this area? Is he a survivor? Was someone he knows and loves victimized? You see I don't think he has any more education in the field then David Mandel or Ohel.
It really bothers me that he doesn't disclose his true identity. As a survivor I don't trust UOJ.

UOJ, whoever he is, has saved more potential victims than all survivor advocates and trained professionals combined by removing predators from circulation.
It's very suspicious that another post then directs the readers to 2 attack blogs dedicated to smearing Feivy Mendlowitz / Paul Manilow & Ben Hirsch who are named there as being UOJ.
Tuvya's Blog is authored by Dr. Chaim Neuhoff, a friend of Gil Student, who had to resign from Kolko's yeshiva when HE was unmasked. He put up the blog at the urging of the thug Rabbi Belsky who tried to harass & silence both Kolko's victims and the victim advocate Eli Greenwald. The UOJ critic has the nerve to demand a professional standard when Neuhoff is a so called professional who abused his position to hurt victims. Neuhoff is a fraud, who Gil Student refuses to condemn, and who participated in the Kolko cover up by posing as Margo's "school psychologist". Neuhoff is currently working for SAFE even though he is mentally unfit in the opinion of many to work in this field.
Rosh Yeshiva is another attack blog written by a Margulies employee from inside the Torah Temimah building.

How dare you post that I am not a survivor. You small piece of feces. You have no idea what my childhood was like. My bet that you are UOJ especially with the way you go on and on about how great UOJ is.
I have a difficult time trusting anyone,yet someone who keeps their identity secret sends chills up and down my spine. I don't know what I would do with out the rape crisis center that I was referred to. They are professionals, they also tell me who they are and have connections with law enforcement. I don't play this secrecy spy game that you are into. You're no better then those who cover up cases.

As "Judge Judy" Scheindlin often says, "if something doesn't sound right, it's usually not true."
So yes, I still find it hard to believe that the UOJ critic is a survivor. Anyone in the frum community knows that if you identify yourself when helping victims, the "mafia" will do everything to destroy your life, including getting your kids thrown out of yeshiva. Rabbi Dovid Cohen even allegedly said that Margulies has a right to expel boys of any parent who complains about the handling of the Kolko affair. Rabbi Belsky went a step further with his threatening behavior and Margulies himself, along with shadow operatives acted in a completely criminal way by leveling all kinds of threats and blackmail.
So Margo's anonymous shadow operatives get to carry on with impunity but UOJ gets criticized for anonymously saving scores of children?
There are a number of rabbis who are too cowardly to publicly voice their support of UOJ's end results. Two of the only rabbis to go on record in support of UOJ are Rabbi Hershel Schechter from YU and Rabbi Yehuda Shain from Lakewood.
The critic equates UOJ's hatzalat nefashot with criminal cover ups and little pieces of feces.

It was to this question that I received his "Why shouldn't they exaggerate" reply.
To be honest, his question rang so strange in my ears that I had a hard time formulating an answer. And then a few minutes after the conversation's conclusion it came to me: Why shouldn't they exaggerate? Because doing so is false!
This point is obvious of course. But not apparently to this ostensibly religious Jew. To him, the question wasn't why someone should depart from the truth, but why one would ever tell the truth in the first place.
Unfortunately, this gentleman is not alone in placing a very low premium on the value of truth. Unfortunately, some Jews, including -- or perhaps especially -- Chassidic Jews, will make sure never to shake a woman's hand and to always faithfully wear a black hat but lie (stretching the truth is perhaps a more delicate term) with astonishing ease.
When one witnesses such behavior one wonders what makes these people so religious after all. One also wonders what kind of impression these Jews make on other people who may be unobservant or non-Jewish but whose inner religious core and rectitude are stronger and more Godly than these "truth stretchers." Surely this cavalier attitude towards truth does not inspire others to praise the God whom these Jews (especially those wearing black hats or beards)apparently represent.
The impulse among many to come closer to God by becoming better Jews is laudable. However, these Jews and all Jews should attach greater importance to basic Biblical values and laws, such as the value of truth, than they do to ensuring that their tzitzis are clearly visible to all.

ReplyDeleteRabbi Union is well known for his description of Luke Ford as the most evil person he has ever met. Luke has no problem with any criticisms and reminds readers of that and how he was tossed out of 3 or 4 shuls because of his penchant for porn.

A prominent Elizabeth surgeon, genealogist and published author has been arrested and charged with possession of child pornogra phy after federal agents found hundreds of pornographic movies and photos involving children on his home computer.
Neil Rosenstein, author of "The Unbroken Chain" and founder of the Jewish Genealogical Society of New York, was arrested by U.S. Im migration and Customs Enforcement on Tuesday and posted bail later that day after making an initial appearance in federal court in Newark.
The 62-year-old surgeon is one of 285 people who have been ar rested over the past year and a half through an ICE investigation known as "Operation Emissary," which identifies child pornography Web sites based overseas and tar gets their U.S. customers through online servers and credit card records.
According to the criminal complaint against him, Rosenstein's home computer was seized from an attic office on July 24 by ICE agents and searched for pornographic material. Among the files found were videos showing explicit sexual acts between adult men and prepubescent children.
ICE Deputy Special Agent in Charge Thomas Manifase said the videos described in the complaint are just a sampling of the "hundreds and hundreds of images" found on Rosenstein's computer. Manifase said the images were all downloaded from a Web site produced somewhere in Eastern Europe to which Rosenstein had purchased a membership using his credit card.
The site alerts would-be subscribers that subscribing is illegal, authorities said.
"There's no mistake this guy knew exactly what he was doing," Manifase said. "They're very disturbing images."
Manifase said Rosenstein's case was particularly important because of his work as a doctor and his prominent standing in the community.
"He had the trust of his patients," Manifase said. "Anytime we see someone in a position of trust -- a doctor, a schoolteacher -- we move quickly on those cases."
Rosenstein answered the door at his home yesterday morning, but declined to comment on the charges. His Westfield Avenue office appeared to be closed and had a "For Sale" sign on the front lawn.
His attorney, Leslie Stolbof Si nemus of South Orange, urged the public not to prejudge Rosenstein and to let all the facts come out in court.
"The public should remember that anybody charged with any crime has a right to be presumed innocent and is innocent until proven guilty beyond a reasonable doubt," Sinemus said. "This is a man who donates his time and effort to the poor of the community by way of surgical medical care ... and he shouldn't be judged prematurely."
In addition to the extensive two-volume work "The Unbroken Chain," Rosenstein has written several other books about Jewish genealogy and family research, including "Latter Day Leaders" and "Sages and Scholars."
If convicted of possessing child pornography, he could face up to five years in federal prison, Manifase said.

The arrests cap a two-month investigation in which a state police technology investigations unit combed the Internet for New Jerseyans who distributed such images. Forty-one people were arrested.
Officials said the photos and videos have been made available worldwide.
"They included graphic rape scenes against children,'' New Jersey Attorney General Anne Milgram said.
The investigation, dubbed Operation Silent Shield, encompassed 15 of New Jersey's 21 counties and numerous law enforcement agencies. The arrests began 10 days ago and continued through Thursday, state police said.
"The people that we have arrested so far are only the beginning,'' said State Police Maj. James Fallon. "We know of many more people out in this state and beyond the borders of this state that possess and distribute this material, and I can tell you we're coming for you.''
The 41 people, who range in age from 14 to 71, were charged with child pornography possession and distribution and face 18 months to 10 years in jail.
No one has been charged with creating the images and videos, though Milgram said the investigation into who created them is continuing. She said officials will scour thousands of DVDs and more than 80 videotapes confiscated during the arrests.
Milgram said the videos last up to 15 minutes and feature children estimated to range in age from 4 to 9 years.
She said officials have identified some children involved. She declined to discuss any details about the children, but said the images are disturbing.
"It is impossible to sleep at night when you view them,'' Milgram said. "They are a horrific thing.''
