"Chassid"ism" is not Judaism"
THE UOJ ARCHIVES - FEBRUARY 2007:
Chassidic movements today, regardless of the value it may or may not
have had at the time of the Besht, are for the most part today,
meaningless to Jews of intellect. The Rebbe today is a fraud
capitalizing on the very essence of human weakness. Look around, save
some good chesed organizations, the rest of it is like rotten stinking
meat. The smartest of the chassidic kids are leaving physically, and
much of the rest are trapped, and have left emotionally. But the
chassidim are Jews, certainly not ones that we should be proud of.
I want to thank Rabbi Eidensohn once again for taking the time to attempt to correct my views on the meaning of Torah-true Judaism.
I do assume dear Rabbi, that the reason I have not heard from you in the past two years since I began my career as a Blogger, is because you do agree with everything else I have written since March 2005. That's quite flattering.
Now that we got that out of the way, I will proceed in a serious manner. For the sake of some of my detractors, I want to be able to demonstrate that I am capable of respecting rabbinic figures in positions of authority, when indeed those rabbis have earned my respect.
Dear Rabbi,
It would be foolhardy of me to attempt to match my Torah knowledge with someone of your stature, although I'm confident I am capable of holding my own. I can , however, match Gedolim stories with you, and perhaps tell you a few that you are not aware of. Perhaps.
I have a very diverse audience. There are clergy-people of every faith, a sitting U.S. Supreme Court Justice, Superior Court judges, yeshiva-leit, attorneys, bankers, doctors, journalists, an adviser to President Bush, college professors, roshei yeshiva...not to forget leitzonim (clowns), and everyone else, that I am expected to entertain at no charge. They do not come to UOJ for Gedolim stories, they come here for an unorthodox presentation of the ugly, in your face, rude & crude truth! So here goes! (With respect!)
The crux of my post on "Chassid"ism" is not Judaism", is entirely different than your well-intended interpretation of those words. I did not certainly mean to imply, as you seem to infer, that Chassidim are not Jews. I certainly did not say that Kabbalists are not Jews. As, I would never say or even think for a second, that a Reform Jew is not a Jew, or that our totally secular brothers and sisters are not Jews. Our Halacha clearly states that "anyone born to a Jewish mother is a Jew". That includes "Jews For Jesus", members of the "Kabbalah Center", and even members of the "Moon" sect, that were born to a Jewish mother.
But the facts actually speak for themselves. The "Zohar" was not an evolutionary work that began with Rabbi Shimon Bar Yochai as the "Ari" claimed it was. Of course there are references in the Talmud to kaballah, spirituality, mystical happenings, and aggadata, or stories that were passed down through the ages, I have not said otherwise.
But I am looking for Mesorah, actual references to "Kaballah /Zohar" as a body of work that was incorporated into Judaism at the time of Rabbi Shimon Bar Yochai, and there are none.
What we call today Chassidim, are by definition followers of the Besht or Baal Shem Tov. His teachings, perhaps, had purpose at the time. It was able to bring into his sphere of influence a simplified, watered-down Judaism, for "simple" Jews, that were incapable of grasping the learnings of the Talmud. That, I'm certain, was a good thing, supposing that it did not conflict with true Torah values. Serving God by singing was in fact something new to Judaism at that time. I do not have a problem with that form of prayer, provided it also included the traditional prayers of the Jews that were formulated after the destruction of our Bais Hamikdash, by Chazal.
I have no doubt that the great Rav Ahron Kotler embraced many Chassidic Rebbes. Are you therefore implying that because of an embrace out of ahavas Yisroel, his love for a fellow Jew, that implied he endorsed their philosophies? How would you respond to a photo of Rav Ahron Kotler embracing the great gaon Rabbi Joseph B. Soloveitchik? Would you therefore claim he endorsed his great thoughts, philosophies and writings?
After giving a shiur in Tanya, the writings of the Lubavitch Rebbe referred to as the Baal Hatanya, the saintly Rav Shraga Feivel Mendlowitz, the founder of Yeshiva Torah Vodaath and Torah Umesorah, was asked by a student; "Rebbe, are you a Lubavitch Chasid?" (a follower of the Lubavitch movement), his answer was clear and precise , "I am a chasid of the Ribono Shel Olam". (a follower of Hashem)
We need to remember that once we start including additional works of rabbis into our Canon, or the original Torah that was given to us at Sinai, where and when does it end? Would you then claim the works and the writings of the Rambam as significant as the Prophets? How then would you explain that many of the Rambam's writings were burned, and he was excommunicated by many contemporary rabbis for being a heretic?
Would you also then claim dear Rabbi, that the works of the great gaon Rabbi Moshe Feinstein to be as significant in terms of being able to dispute them, as the Shulchan Aruch? ( The body of law written by R' Yosef Caro accepted by Orthodox Jews as the embodiment of the Torah law)
So there is a huge difference in what is "authentic, original Sinai Judaism" and the add-ons that came later for whatever certain rabbis may have deemed worthwhile at the time.
That leads me to another favorite saying of mine. "There are happenings, doings/actions, successes by people that are timely, and than there are the ones that are timeless!
What the great Rabbi Kotler did for Judaism after the war was "timely", what the saintly Rabbi Mendlowitz did for American Judaism was "timeless".
The era of recruiting every single male into a lifetime of Torah study is over. It was perhaps desperately needed post-war for twenty years or so, perhaps, but certainly that is an idea that is now devastating Jews. Time to bury it quickly before the damage becomes irreparable! Entire families are being destroyed!
The original intent of kollel was for the select precious few that were able to carry forth the Torah to our next generation with the utmost integrity. Kollel is for our select few mitzuyonim or excellent students. Excellence in mind, in middos, and character, with purity of heart and soul. Those people only deserve our communal support, not the other 95% with average, at best, abilities, or for most, just a place to hang out after the wedding.
What Rabbi Mendlowitz did for American Judaism is "timeless"! A day school in every major American city was his dream that was fullfilled under the leadership of one very great man, the college educated, Dr. Joseph Kaminetsky. When Elya Svei and Shea Fishman took over, Torah Umesorah died for all intents and purposes! In its present form, he would have shut it down.
The great visionary Rabbi Mendlowitz strongly felt that Judaism in America can not survive without ample parnassah; was as "timeless" when he lived , as it is today, and will be until the end of time. Make no mistake about it, had he lived longer, there would have been a full-fledged state chartered yeshiva college and a trade school under the auspices of Yeshiva Torah Vodaath. Prior to his untimely death, Rav Hutner, at his behest, had handled the application and approval process. This is not story, this is verifiable fact.
DON'T BELIEVE ANYONE THAT SAYS OTHERWISE!
http://theunorthodoxjew.blogspot.com/2014/02/american-hebrew-theological-university.html
Each child would have been educated and put on a learning path for their individual needs and abilities. There would not have been mass herding of children into educational programs that were unsuited for them. He worked for God, his business was owned by God, and every breathing second of his short life was dedicated to benefit Klal Yisroel and Hashem. He did NOT leave Torah Vodaath to his progeny; there were more qualified people to lead the yeshiva. THIS WAS HASHEM'S YESHIVA, and he was only God's clerk!
What is very telling is what you chose not to disagree with. The Christian concepts of the Rebbe as an intermediary between Jews and God; and Gedolim infallibilty as an integral part of our Mesorah, is something I would want to hear your opinion on.
The evidence however is clear. The Rebbes and "infallible" Rabbis are comitting crimes under the guise of Mesorah. According to them, "one must never question their behavior or decisions, period, leave your brains at the door"! That is something that must never be tolerated under any circumstances. We do not live under the Czars, the Romans, and other hostile governing powers that we must be concerned that ALL of our affairs, whether we know what we're doing or not, must be totally controlled by rabbis. This is what killed hundreds of thousands of Jews, perhaps millions, since we became a People, and came really close to destroying all of Judaism.
I clearly, unequivocally, and respectfully disagree with Rav Hershel Schachter's opinion that "where" a criminal perpertrator is incarcerated, is a consideration that must be addressed before one goes to the police. A crime such as child molestation, that destroys our childrens' well-being, physical as well as emotional, must be reported to the police promptly without any other consideration, certainly without asking a rabbi that probably has an inherent conflict of interest.
The huge philosophical problem that I'm having is the inverse relationship that is taking place in the Torah world. What one must expect and demand; that the more Torah in our society, the more piety and Torah values should be increasing as well. The exact opposite is what's happening! The more Torah being learned, the more Torah centers going up, the more crime in one form or another, is transpiring in these very centers. The Torah is NOT being internalized, it became a subject to study, the very antithesis of what R' Ahron and R' Shraga Feivel had in mind!
Dear Rabbi Eidensohn, you are a very brave man for coming here. The Agudah really thought that I expected them to invite me to speak at their Convention. They are afraid of their own shadows. Yes, I asked for an invitation, challenging them to do the very thing that they did. They devoted the theme of their Convention to this dangerous phenomena called blogging/Internet. Not the avlas/crimes going on with their tacit approval, but a "maaseh Satan" who uncovered them for the criminals/incompetents/ impotent fools that they are. Then, of course, comes the coverup and tortuous twisting of the English language.
So we have a difference of opinion on this and that, Rabbi. You value certain channels of information, stories, that I gave up on a long time ago, when they consistently did not hold up under scrutiny. You use the Internet to communicate your thoughts, kol-hakovod. I would much rather focus on what we do agree on.
The Jewish people are a great People, but we are floundering and destroying ourselves with criminal and frivolous behavior. The "Kabballah Movement" is a fraud, the works of the Zohar are not the learnings of Rabbi Shimon Bar Yochai, and have perhaps as much value to Jews as the Tanya, the Mesilas Yeshorim and the Michtav M'Eliyahu. They are works that tantalize the mind, and challenge, if studied correctly, the intelligent minds. Mesorah? I don't think so.
Chassidic movements today, regardless of the value it may or may not have had at the time of the Besht, are for the most part today, meaningless to Jews of intellect. The Rebbe today is a fraud capitalizing on the very essence of human weakness. Look around, save some good chesed organizations, the rest of it is like rotten stinking meat. The smartest of the chassidic kids are leaving physically, and much of the rest are trapped, and have left emotionally. But the chassidim are Jews, certainly not ones that we should be proud of.
If this is what the Besht had in mind for his followers, he should be considered as very much the danger that Shabbtai Tzvi was in his reign of ignorance and confusion. I could care less about certain groups that find comfort in ancient myths created by charismatic storytellers. As long as they do not violate the basic tenets of Judaism perhaps there is a value ; I frankly am concerned about people spending their precious time on frivolous acts in the name of Torah.
I do not really have much to add about the behavior of the present-day Rebbes and their chassidim. I have mocked the movement to the point of painting them as ignorant, vile, obscene cartoon characters, except that Mickey Mouse did not claim to be an intermediary to God for his Mouseketeers. That's when people start killing /maiming other people in the name of God and Halacha. Certainly not part of my Mesorah!
Hopefully, other concerned and honest rabbis like yourself, will join together and give us hope that there is a future for Jews that crave for honest rabbis and authentic, Torah-true Judaism.
May you be blessed with kol-tuv; the strength and wisdom of our previous Torah giants, and the desire to continue where they left off . We want to be delivered back to the time when we were surrounded by ehrliche rabbonim and true yirei Hashem that deserve our respect.
Your successes would then be "timeless".

I take back what I said about Rabbi Shain. I didn't know that he tried to stop Finkel eight years ago. That's why its important to be clear in our communications.
Now, if you have good evidence, please, tell us, What is the name of the rabbi who is giving out untrustworthy hechsherim?
3:19
Now that you believe that Rabbi Shain is for real, read more about the "mashgiach" of Finkel's "kosher" butcher store. Bear in mind the putz mashgiach is an employee of YSV where Finkel was the Chairman of the Board.

I mentioned this on the blog a while ago. It is well known that in the early days of the "youth-at-risk" when Mitnick hung around Playboy Billiard's on Coney Island Ave, that he did have a contest with some of the kids that went something like this, "Don't masturbate for a month or so and you'll get a prize." (I think it was a trip to Israel - which prob meant they would be shipped off to a place like Nivei, if even that was true)
Totally inappropriate, but like I said before, the "at-risk" scene exploded and parents were brainwashed, desperate and ignorant. I'm not sure much has changed.

WOW! Imagine, an Honest Rabbi! Rod Serling where are you?
Or as the late great Mel Allen would say; "How 'bout THAT!"
Alas, Gross, Playboy Billiards is no more. Where have you gone, Joe Dimaggio?
Reb Av Schorr is known to have a pair of "quick" hands and an even quicker temper; one of the reasons he's bounced around from yeshiva to yeshiva before landing his present gig on E 15th in Flatbush.
Is this R schorr from E 15 and M, the shaloshudees rebbe?
When I was in 9th grade in TT, they used to charge $0.75 for breakfast. I used to duck out of shacharis and get to breakfast early, so very often I didn't pay. When the City inspectors were present breakfast was FREE, obviously because the breakfasts were subsidized by the gvm't and it was illegal to charge for it. I was pulled out during the regents exam, and Fat Margo called my father saying that if he didn't promise to pay $200 to the yeshiva for the breakfasts I didn't pay for then I would not be let back in to take the regents. Nice guy, huh?
Check the next thread, where more people will see it, for a very revealing post on Brooklyn kashrus scams.
Depending on when I have time, it will bli neder be tonight or tomorrow.
Very important and appropriate article. However the comment about R.H.Shachter is not correct. He for many years has stated that the issue of 'moser' is not applicable in abuse cases. In fact he stated that all means (I suspect including blogs can be used to disseminate this knowledge)going to governmental authorities and police should be used.
The Eidensohn article stated:
"People are aroused and angry if a woman is pained in any way. But why are people not aroused and angry, and why are the women completely silent, when in the modern Orthodox world women must delay marriage so long, and men delay marriage so long, that inevitably, men use women the wrong way? Why are we silent at the Tephilin Dates? Is it not abuse when women must dishonor themselves?"

Is this rabbi really suggesting that the Jewish outrage as a result of the consensual sex that takes place between two adults should be on par with the outrage when we find out that our leaders have been defending, covering up, and allowing a sex predator to roam our streets for 30 plus years?!?
If he does, no wonder the Jewish community is in such shambles. Let's examine our priorities and our leaders.

No one in the Modern Orthodox world must delay marriage. People marry when they want. Just go to Stern and you'll find plenty of married undergrads. Then go look at the daughters of some of the yeshivish rabbonim and you'll see older singles.
check some os the elementary Rebbes in Torah Temimah. You will find one who has hidden his own son's sexual abuse at the hand of family members and this has caused him to have a mental depression, and a host of other severe problems. Torah Temimah knows who this rebbe is and doesn't care that supposedly "this upstanding man who is really a "little man with a big ego" is teaching and giving comfort to young children. This man alienated his own son while his son was going through his trauma and is not fit to teach young children. He is a fake.

I'm looking for the person who posted this comment on VIN a while back. You obviously know about this "Rebbe". We are seeking other victims of Abramson . PLEASE call Dov Hikinds office with any info that you have. Talk to Eli. His # is 718-853-9616. If there is anyone else out there who has any info on this animal please call as well. Tizku L'mitzvot.
I don't recall reading this previously - it might have been posted the first time before I found your webpage. But I do want to say that this is amazingly good and spot on. You're living proof that Judaism can survive - if enough people are willing to open their eyes and choose life instead of being blindly led down dead end alleys.
Hang in there! If we go down, and real Judaism is mortally wounded, at least we'll have gone down fighting.
Shalom!
Is this from YSV????????

A few comments suggest that the information that has reached Dov’s office should be turned over to police for investigation. No. No. No.
While Dov is launching a project to develop a system to enable the frum community to address cases of abuse and molestation, he is not becoming the investigator, prosecutor, judge, or jury. Those cases that have been brought to the attention of Dov’s office are just anecdotal reports, many of which are credible. However, there are also some that may not be. Every case needs to be properly investigated to determine whether it is real, or it may be fiction or exaggeration. All of these scenarios have happened. So don’t expect prosecution based on info reaching Dov’s office, and certainly not automatic handing of reports to police.
Shomron, Israel - A charedi Principle of a Yeshiva in one the settlements in Shomron was arrested today by Israeli police on accusations that he molested in the last 2 years more than a dozen boys under the age of 13.
The man in his high 40's who is said to be a principle at a yeshiva in Shomron is being held in Kefar Saba courthouse until future investigation.
According to 'Yedioth Ahronoth' police sergeant Merak Amiel said that in the next few days it will be made public the details of the allegation, in which the sergeant said is extremely troubling and disgusting.

NORFOLK
The former rabbi of B'nai Israel synagogue in Ghent went to work a few years ago in Tennessee for WexTrust Capital, the investment firm now charged, along with one of the synagogue's members, with a massive investment fraud that targeted Orthodox Jews.
Norfolk resident Joseph Shereshevsky, the former chief operating officer of WexTrust and head of its Norfolk office, lavished the community with his generosity, building trust and raising money for the firm's investments.
But on Monday, the Securities and Exchange Commission charged Chicago-based WexTrust, Shereshevsky and the firm's chairman, Steven Byers of Oak Brook, Ill., with bilking investors out of $100 million in what it called a large-scale affinity fraud.
Shereshevsky is being held without bond after a hearing Wednesday in which a federal magistrate in Norfolk deemed him a flight risk.
B'nai Israel's current rabbi reacted Friday to a Wall Street Journal story about the charges against Shereshevsky and his ties to the community by firing a letter off to the newspaper saying his comments had been misconstrued. The story gave the impression that Rabbi Chaim Silver assured members of the synagogue that Shereshevsky was trustworthy.
In Silver's letter to The Journal, posted on vosizneias.com, a Web site that gathers news of interest to the Orthodox community, he said that he told Shereshevsky and potential investors on many occasions that he didn't give business advice because he has little expertise in that area.
"Our community is devastated by the charges against Mr. Shereshevsky and the unwanted publicity it has brought on our synagogue," Silver said in the letter. "We hope all persons of faith will pray for us as we deal with the damage this matter has caused, both for our congregation and for those who lost money."
The scrutiny of Shereshevsky and concerns about his alleged victims come amid emerging evidence that the former WexTrust officer may have repeatedly disregarded securities laws.
In a bitter exchange of e-mails, another WexTrust officer accused Shereshevsky of raising $9 million for one of the firm's real-estate offerings by distributing phony documents to prospective investors.
"Guys from enron got 20 years for doing that," wrote Amnon Cohen, the fellow WexTrust officer, referring to fraudulent practices that came to light at the defunct energy-trading company Enron Corp. in Houston.
"Think of all your investors all the guys from Norfolk that invested with u, all the wealth that you accumulated all down the drain," Cohen wrote in a Nov. 16, 2007, e-mail, which the SEC has submitted as part of its case against WexTrust in federal court in New York City. "What will your investors think when they know you played with their money while you took home $3,000,000 a year in salary and spend $1,000 a night in hotel suites?"
In an exchange of e-mails the previous day, Shereshevsky told Cohen that he was "rich enough today that I can do what I want."
"I have invested my money very well the last 3 years," he said. "I accumulated several million dollars. I don't need wextrust any more... "
During Shereshevsky's bond hearing in Norfolk's federal court, his attorney Andrew Sacks said that the bearded 52-year-old Shereshevsky lacked a business background and wasn't aware of any fraudulent activity at WexTrust.
"He was the fundraiser," Sacks said. "He was not the accountant. He was not the one who kept the books."
Herbert Zukerman, a member of the B'nai Israel congregation and president of Zukerman & Associates, the Virginia Beach accounting firm that prepared Shereshevsky's personal tax returns, said he found the SEC's allegations unsettling.
"If you find out that someone has not been honest with you, it is disturbing," he said.
Zukerman said he invested in two WexTrust offerings, an income fund and a mixed-use building near Chicago with apartments and office space. Both, he said, appeared to be performing as the investment documents described.
The roster of WexTrust investors extended well beyond the Orthodox community. A handful of Hampton Roads residents said last week that they were referred to the firm by the host of a weekly radio talk show on real estate investing.
Paul Clemmons, a former mortgage lender in Chesapeake who goes by the nickname "Crunchman," estimated Saturday that 62 listeners who came to him ended up investing with WexTrust.
Clemmons said he began referring people to WexTrust after the Chicago-based firm contacted him in October 2004. WexTrust later sponsored his radio show for four months, he said, but he didn't collect any fees or commissions from WexTrust for his referrals.
He did put some of his own money into the firm's investments after talking with Shereshevsky and others. One involved a hotel and another a diamond mine. Clemmons, who declined to say how much he invested with WexTrust, said the company stopped sending him dividend checks in February. The firm, he said, initially blamed accounting problems and later attributed the lapse in payments to a slower national economy.
"We were all surprised and in a way embarrassed," he said of WexTrust's difficulties, "but we did our due diligence, and there was so sign of trouble."

My mother, who's a life-time member of B'nai Israel, was approached to invest 100k with him, by his secretary who continuallly called her to invite her for the Friday Evening Shabbath dinner to discuss investing. Luckily, my mother sensed that he wasn't honest and didn't invest with him. He should be sentenced to prison along with all of those employees and Board Members/Officers who knew , or should have known, about the fraud being committed, and even the former Rabbi of B'nai Israel should be imprisoned if he's involved in the scam.

Accused hedge fund fraudster Joseph Shereshevsky will remain in jail to await his arraignment on fraud charges, a federal judge has ruled.
Despite pleas from friends and family, who turned out in droves to Wednesday’s hearing in Norfolk, Va., U.S. Magistrate Judge Tommy Miller denied Shereshevsky’s bid for bond. Calling the WexTrust Capital founder “a thief and a thug”—and noting that Shereshevsky had a one-way plane ticket to Israel and then England when he was arrested Monday, and a 2003 conviction for bank fraud— the judge ruled that Shereshevsky is a flight risk.
Shereshevsky and his partner, Steven Byers, were charged Monday with defrauding investors of $255 million, misappropriating at least $100 million of it. They and WexTrust were also charged by the Securities and Exchange Commission, which won an emergency asset freeze and the appointment of a receiver on Monday.
Most of the victims were Orthodox Jews, a community in which Shereshevsky is reportedly well-known.
Both men face up to five years in prison if convicted on the fraud charges, although additional charges could lead to a much longer sentence, federal prosecutors said.
If you think I look fat in the WSJ picture, check this out.

Shereshevsky was known for his philanthropy. At a September 2007 golf tournament in Westchester, N.Y., for the U.S. Friends of Ezer Mizion, the Israel Health Support Organization, when hearing about the plight of two children with cancer, Shereshevsky said he would double his donation.
“What could be more important than saving Jewish lives?” he said.
“I am happy to have a partner who has a heart,” said Byers at the tournament.
Byers and Shereshevsky sponsored the tournament.
But before moving to Norfolk, Shereshevsky, according to court documents, had been severely censured by the religious Orthodox Jewish community. Documents didn’t specifically say why.
While in the process of divorce from a previous marriage, Shereshevsky attempted to unilaterally arrange the marriage of his minor daughter, the religious consequences of which would have prevented the child from ever marrying, court records show.
Shereshevsky then left the United States, according to court documents.
Eventually, he moved to Norfolk with the help of his friend Amnon Cohen and called himself Joseph Heller. Heller is his mother’s maiden name.
He married, started using his real name Shereshevsky and called Stanley and Nancy Peck, Uncle Stanley and Aunt Nancy, court records show.
In 2001, Shereshevsky convinced the Pecks to invest $200,000 in Arbor Village, an apartment complex in Indianapolis, a project developed by Nizan Ran and Amnon Cohen, court records show. The shares the Pecks bought gave them a 16 percent ownership of Arbor Village, documents show.
The project eventually failed and the Pecks wanted their money back. In the meantime, Shereshevsky had stopped managing Arbor Village and begn working for WexTrust.
In 2004, Peck threatened to report the matter to the SEC and took legal action against Ran, court records show.
Byers offered to help salvage the Arbor Village deal, court documents contend. Byers also offered the Pecks other deals so they could get their principal investment back.
Byers and Shereshevsky asked Peck not to contact the SEC, court records show.
On Nov. 23, 2007, the Pecks filed a $1.5 million lawsuit against WexTrust Capital LLC, Wexford Equity Partners LLC, Byers and Cohen.
Shereshevsky was also named in the suit as a WexTrust employee.
In a brief filed July 21, Byers asked that the lawsuit be dismissed. The brief contended that WexTrust and Byers promised to replace the Peck’s failed investment in Arbor Village with new and different securities worth $200,000 in return for Peck’s promise that they would not report the matter to the SEC, conduct further investigations or take action against Nizan, Arbor Village or Shereshevsky.
WexTrust wasn’t an investor or a partner in the Arbor Village deal, court records show.
The suit is pending.
On Nov. 6, Shereshevsky and his wife, Elka, filed suit against Ran for $200,000.
Nizan asked that the suit be dismissed July 14. The suit is pending.
On Oct. 15, G&H Partners of New York City bought a suit against WexTrust Capital and its subsidiaries, Idex Mines and Minerals and Idex Mining Managers.
The complaint alleged that WexTrust and Idex made a variety of fraudulent and negligent statements to induce G&H to invest $8 million.
On Jan. 4, the U.S. District Court of Southern New York awarded G&H attorney’s fees of $5,416 and $437 in costs and remanded the case to the New York Supreme Court.
The case was dismissed in May because a settlement was reached in April.
Samuel Gross of G&H Partners was one of four directors elected to the board of directors of Pure Africa Holdings Limited, which is WexTrust Capital’s holding company for its operations in South Africa, according to a press release dated July 17, 2007.
Other members of the board included Byers, Shereshevsky and Elka Shereshevsky, who was listed as connected to Thunder Energy, which has an ownership stake in WexTrust’s IDEX Mines and Minerals subsidiary.
In the SEC complaint filed last week, charges were also filed against four affiliated Wextrust entities: Wextrust Equity Partners LLC, a Chicago-based purchaser of real estate; Wextrust Development Group LLC, a Chicago-based real estate development firm; Wextrust Securities LLC, a Norfolk-based securities broker and dealer; and Axela Hospitality LLC of Bethesda, Md., which operates Wextrust’s hotel properties.
In one offering, conducted in 2005, the SEC alleges that Byers and Shereshevsky falsely represented to investors that the more than $9 million raised would be used to purchase seven real estate properties that were to be leased by federal government agencies, such as the General Services Administration.
According to the complaint, the defendants never purchased the seven properties.

WASHINGTON -- Alan Greenspan usually surrounds his opinions with caveats and convoluted clauses. But ask his view of the government's response to problems confronting mortgage giants Fannie Mae and Freddie Mac, and he offers one word: "Bad."
Quote Of The Day
"My 14-year-old son could buy a block of Detroit property." - Ann Laciura, senior servicing specialist for the Bearing Group, referring to Detroit homes selling for $1. Banks are so desperate to unload them, that they’ll often pay fees of $10,000 just to convince buyers to take them. (Detroit News, Aug. 13)
The Zohar's authenticity has been accepted by virtualy all poskim throughout the ages across 'political' lines - the GR"A, the BESH"T, the Mechaber all quote it as a source. HUndreds of times. So does the Chofetz CHaim.
Please see the beginning of the 2nd Perek of CHagiga. Where certain parts of our Mesorah are indeed NOT public knowledge. This does not make them 'ois mesora' cholila, just not a part that was expounded in public.
Your ga'ava that Chazal say is found in great doses in grubbe am horataim shines forth when you are claiming that only knowledge that me, the holy and all knowing UOJ is aware of is 'part of our mesorah'.
The Zohar was accepted by all who had access to this part of the mesora as authentic.
The same for the Kisvei Ari. ALthough, it is true that the ARI's is mechudash and not 'msorah' meaning he recieved things not from his Rebbeim but from outlets only he had acces to.
You can dismiss the ARI if you want to but you would be quite arrogant to do so. If the ARI was not accepted by the community of Torah Giants you would be b'seder. But that ARI is unanimously accepted by Torah Scholars. Have you ever learned the ARI's writings?
DO you know more than the Mogen Avrohom about Mesorah? He quotes the ARI all of the time.
The same could be said for much of the Chasidic Tzadikim you brazenly disparage (see Shulchan Aruch YD 246 for what happens to one who ridicules a Talmid CHochom). While you do not accept the Chassidim (which is more am ho-arutzus on your part) - i.e. the Maggid, the CHozeh, The Berditchever, Rebbe Nachman, of Breslov, the Ba'al haTanya, the Sfas Emes and many many more giant scholars are Holy people all accepted the ARIZAL as a starting point. Rebbe Nachman includes ZOhar and Kisvei ARI in the list of things one should learn in it's entirety each year - the others include - TNCH, Shas, Rif, Rosh, All Midrroshim and Shulchan Aruch with the major commentaries like TZ and MA and Pri CHodosh. , I do think you accept the Mogen Avrhom and the GR"A. And the CHofetz Chaim. THey and many many more all accept the ARI.
It is a very foolish thing to dismiss something you knwo nothing about.
DOn't Despar UOJ, Rebbe Nachman has already said that right before Moshiach comes we will see a flood of 'mefursomim shel sheker'.
SO Moshiach is coming soon.

They booed and taunted Sen. Arlen Specter (D., Pa.), calling him a tyrant, as anger at the Democrats' proposed overhaul of the health-care system boiled over yesterday at a pair of town-hall meetings.
"This country is turning into Russia," one man said in a common refrain, standing toe to toe with Specter in a hall at the Harrisburg Area Community College campus here. Chants broke out - "You work for us!" and "Read the bill!" - as the senator tried to answer questions.
Later in the day, Specter faced similar frustrations from skeptical voters in Lewisburg in an auditorium at Bucknell University. In both places, most of the questioners stayed civil but accused President Obama, Specter, and other congressional Democrats of trying to force a government takeover of health care that would violate their constitutional rights as well as the character of the nation.
Specter, 79, is traversing the state this week during the Senate recess, an August ritual but his first trip as a Democrat. He is running for reelection in 2010, facing a primary challenge from the left in his new party from Rep. Joe Sestak.
"I'm getting an earful, and I'll take the message back," Specter deadpanned at Bucknell, where he and attendees who expressed opinions in favor of the health-care legislation were booed and peppered with catcalls.
Obama's hope to overhaul the health-care system, reducing costs and expanding coverage to the uninsured, has entered a rough patch that was underscored Aug. 2 when crowds disrupted a town-hall meeting Specter hosted in Philadelphia with Health and Human Services Secretary Kathleen Sebelius.
Since then, some members of Congress have been shouted down, one was hanged in effigy, fistfights have broken out at some town halls around the nation, and Rep. Brad Miller (D., N.C.) reported a death threat. Protesters at a few events have displayed swastikas, seeking to compare the Obama administration to the Nazis, and a swastika was spray-painted on a sign outside a district office of Rep. David Scott (D., Ga.).
While mainstream conservatives denounce such rhetoric, polls have shown growing concerns about the health-care overhaul plans as conservative resistance has ramped up. Republican-leaning groups, including Americans for Prosperity and FreedomWorks, have organized some of the protests - saying in widely circulated memos that the purpose is to damage Obama's political standing. The White House and its allies called for labor unions to send their own supporters to town halls, and the president is traveling to stump for the effort.
Specter, accompanied at both town halls by several plainclothes Capitol Police and state troopers, said it had been difficult to explain the Democrats' plans without a specific bill to defend. The House has a version pending, but the Senate does not yet have specific legislation.
"The objectors have gotten ahead of the curve, and a rumor is hard to dispel," Specter said after the Lebanon event. "It's a lot easier to knock down a house than it is to build one. So it's a struggle. And August is going to be a critical month whether there is going to be legislation. . . . I'd say the jury is assembling. It's not out yet."
As a sign of the escalating level of noise around the issue, CNN, MSNBC, and Fox News Channel carried most of Specter's Lebanon meeting live.
About 300 people packed the hall, with several hundred outside, demonstrating for or against health-care changes. The line to get in began forming before 7 a.m. and stretched about four blocks around the community-college building in downtown Lebanon.
A woman who unfurled a banner in Lebanon told Specter, a cancer survivor, that the senator might be dead already under Obama's plan because of government boards that she said would ration care for people in their 70s and give it to those who are productive.
After yesterday's meetings, Specter said he did not remember seeing this much public anger before.
Mr. Specter and his staff controlled the microphones. And he stood face to face with his questioners, a move, he said later in an interview, that he had hoped might make it harder for people to scream at him.
But for all his efforts, tempers boiled over 15 minutes into the meeting. Standing two feet from the senator, Craig Anthony Miller, 59, shouted, “You are trampling on our Constitution!” A half-dozen security people quickly swarmed but refrained from touching him as Mr. Specter, raising his voice, said sternly, “Wait a minute! Wait a minute!” He said the man had the right to leave.
Mr. Miller, shaking, stood his ground. He said he was furious that the senator’s staff had limited the questioning. “One day,” he said to loud applause, “God is going to stand before you, and he’s going to judge you!”
Mr. Specter shouted into his microphone that demonstrators disrupting the proceedings would be thrown out.
A New Jersey bank executive was killed Friday night in a freak accident on the Rancocas Country Club Golf Course in Burlington County, police disclosed yesterday.

Willingboro Township police Lt. Joseph Dey said Papotto, 46, of Moorestown, was a passenger in the cart.
He was airlifted to Cooper University Hospital, where he was later pronounced dead.
Dey declined to disclose further details, but said the case remained under investigation.

For Lawmakers, Health-Plan Anger Keeps Coming
By DAVID STOUT
WASHINGTON — Lawmakers ran into fresh anger and skepticism on Wednesday as they fielded questions from constituents worried about changes in the health care system, and about a lot of other things having to do with government.
The queries hurled at legislators from the Atlantic Seaboard to the nation’s midsection reflected deep-seated fears, a general suspicion of government and, in some cases, a lack of knowledge on the part of the questioners.
“Why does the government want to rush into this bill when many don’t want it?” Senator Ben Cardin, Democrat of Maryland, was asked at a “town meeting” in Hagerstown. “Why are you rushing this?”
Many hundreds of miles away on Wednesday, in Iowa, Senator Charles E. Grassley, perhaps the state’s most popular Republican, found it necessary to tell an audience at the Winterset Public Library that he is against any plan that “determines when you’re going to pull the plug on grandma,” against any plan that would provide government-funded care to people in the country illegally, and against end-of-life counseling when death is near.
At the White House, President Obama’s chief spokesman, Robert Gibbs, was asked again on Wednesday if, perhaps, the administration had not done a good enough job explaining and selling the proposed health care overhaul. Mr. Gibbs suggested that the media bore some of the blame, for doing too many “X said this, Y said this” stories, without rooting out, and pointing out, unambiguous "falsehoods".

Westchester County entered into a landmark desegregation agreement on Monday that would compel it to create hundreds of houses and apartments for moderate-income people in overwhelmingly white communities and aggressively market them to nonwhites in Westchester and New York City.
The agreement, if ratified by the county’s Board of Legislators, would settle a lawsuit filed by an antidiscrimination group and could become a template for increased scrutiny of local governments’ housing policies by the Obama administration.
“This is consistent with the president’s desire to see a fully integrated society,” said Ron Sims, the deputy secretary of housing and urban development, which helped broker the settlement along with the Justice Department. “Until now, we tended to lay dormant. This is historic, because we are going to hold people’s feet to the fire.”
The agreement calls for the county to spend more than $50 million of its own money, in addition to other funds, to build or acquire 750 homes or apartments, 630 of which must be provided in towns and villages where black residents constitute 3 percent or less of the population and Hispanic residents make up less than 7 percent. The 120 other spaces must meet different criteria for cost and ethnic concentration.
The county, one of the nation’s wealthiest suburbs, has seven years to complete the construction or acquisition of the affordable housing.
Affordable housing is defined by a complex formula, but generally it is meant to help working families keep from spending more than a third of their gross income on housing. A family of four could make up to $53,000 as a tenant and up to $75,000 as an owner and still qualify.
There is no minimum income level, “but it’s not going to be no-income,” said Craig Gurian, executive director of the Anti-Discrimination Center, which filed the lawsuit. “This agreement is not focused on facilitating housing for the poorest of the poor.” The center is a nonprofit anti-bias advocacy and litigation group based in New York City.
Mr. Gurian said that while black and Hispanic residents have a disproportionate need for affordable housing, “this is an opportunity-creating agreement, not a guarantee” that the homes would go to minority members.
“Residential segregation underlies virtually every racial disparity in America, from education to jobs to the delivery of health care,” said Mr. Gurian.
No communities have been chosen to receive the homes, officials said. But according to the Anti-Discrimination Center, more than two dozen predominantly white towns or villages are eligible, including Bedford, Bronxville, Eastchester, Hastings-on-Hudson, Harrison, Larchmont, Mamaroneck, New Castle, Pelham Manor, Rye and Scarsdale.
A federal monitor, James E. Johnson, has been appointed to ensure that the county abides by the settlement. Given that 120,000 acres in the county meet the criteria, the monitor “should have no difficulty making sure that Westchester ends its policy of allowing affordable housing to be off-limits in the most highly white neighborhoods in the county,” Mr. Gurian said.
The lawsuit, filed under the federal False Claims Act, argued that when Westchester applied for federal Community Development Block Grants for affordable housing and other projects, county officials treated part of the application as boilerplate — lying when they claimed to have complied with mandates to encourage fair housing.
"Black is Beautiful" continued:
A Westchester official originally dismissed the suit as “garbage.” But the county was largely repudiated in February when Judge Denise L. Cote ruled in Federal District Court that between 2000 and 2006 it had misrepresented its efforts to desegregate overwhelmingly white communities when it applied for the federal housing funds.
Judge Cote concluded that Westchester had made little or no effort to find out where low-income housing was being placed, or to finance homes and apartments in communities that opposed affordable housing.
As part of Monday’s agreement, the county admitted that it has the authority to challenge zoning rules in villages and towns that in many cases implicitly discourage affordable housing by setting minimum lot sizes, discouraging higher-density developments or appropriating vacant property for other purposes. Westchester agreed to “take legal action to compel compliance if municipalities hinder or impede the county” in complying with the agreement.
It was unclear Monday to what extent localities could thwart the agreement, if any chose to do so. Mary Beth Murphy, the town supervisor of Somers, which is among the possible locales for new housing, said that while she was unaware of the agreement, “we certainly are committed to affordable housing and have amended our zoning legislation in recent years to create more opportunities.”
The agreement could spark challenges to suburban county governments across the country that have resisted pressure to undo decades of residential segregation.
Andrew J. Spano, the Westchester County executive, attributed the settlement to “a historic shift of philosophy” by federal housing officials. He said he had signed the agreement to avoid further litigation and possible penalties.
The county admitted no wrongdoing, attributed the judge’s ruling to a technicality and argued that since it had previously invested in affordable housing, “what is different is the locations where the housing must be built.”
“We are settling the lawsuit because we have no choice,” Mr. Spano said.
The suit by the Anti-Discrimination Center applied to towns and villages in Westchester. The federal government deals directly with the county’s larger cities, among them Yonkers, which nearly went bankrupt before capitulating in a housing segregation case that began in 1980 and dragged on for years. That city, which had concentrated public housing in its southwest, was forced to build on the east side, where more whites lived.
The agreement is subject to approval within 45 days by the county’s Board of Legislators, which is also required to approve a $32.9 million bond sale to help finance the housing. Without legislative approval, the litigation would resume and the county would be faced with having to prove at trial that it did not knowingly file false claims.
Most of the homes would be new construction, although some existing houses and apartments could qualify if the county made them permanently affordable.
The case was litigated by Mr. Gurian and the center’s lawyer, John Relman, and supported by testimony from Andrew A. Beveridge, a sociologist at Queens College of the City University of New York.
Dr. Beveridge found that “racial isolation is increasing for blacks, falling slightly for whites” and that “income level has very little impact on the degree of residential racial segregation experienced by African-Americans.”
Mr. Gurian said that the 750 homes called for by the agreement “represents only a small percentage of need"

New Square fugitive back in U.S. jail
BY JAMES WALSH • JAWALSH@LOHUD.COM • AUGUST 11, 2009
A former New Square village clerk was ordered jailed yesterday, a dozen years after fleeing federal charges of bilking education and anti-poverty programs of tens of millions of dollars.
Avrum David Friesel, 57, was extradited Friday from London, where he was arrested last year after eluding authorities since 1997.
http://www.forward.com/articles/112034/
On a recent Monday afternoon in the Boro Park section of Brooklyn, eight women and two men sat patiently in the back room of Neuman’s Optical, tapping their feet, chatting in Russian, reading psalms and occasionally letting out an aggravated sigh. Appropriately, a broken clock hung over the windowless waiting area, where some said they had been sitting for as long as six hours.
These customers were not in line to have their eyes examined. They were looking forward to improved vision of a very different sort, with an Israeli psychic named Rabbi Chaim Yosef Sharabi. Lately, Sharabi has been giving his readings in a space at the back of the store. His unpredictable schedule, changing venues and sometimes hazy advice keep patrons on their toes and returning for his unusual services.
One of several Israelis said to work in Brooklyn as a clairvoyant, Rabbi Chaim, as his patrons affectionately call him, claims to be the scion of a famous Yemeni family of Jewish mystics. But even as a steady stream of business flows through his door, experts in Jewish law continue to debate the religious status of clairvoyants. And some Brooklyn Jewish community leaders staunchly oppose the practice.
My visit in early August was to follow up on a prediction that Rabbi Chaim made for a Brooklyn relative at a consultation on which I was allowed to sit in a few months ago. We went out of curiosity. I had heard about the rabbi from an acquaintance whose husband’s family — Georgian Jews — visits Rabbi Chaim regularly.
The earlier meeting was conducted in a small office in the rabbi’s own home, an unassuming two-family house in the sleepy southeast Brooklyn neighborhood of Georgetown, a far corner of the borough, unvisited by subways. Framed pictures of North African and Middle Eastern rabbis covered the walls.
Seated behind an outdated schoolroom desk, with a stack of books to his right and an open suitcase full of paper amulets to his left, Rabbi Chaim copied my relative’s birthday and the Hebrew names of her parents onto a yellow writing tablet. Through his wife, who interprets for him from Hebrew, the rabbi asked if she was seeing someone, and she answered that she had just broken off a relationship. Rabbi Chaim said, “Was he born in the third month?” My relative nodded.
Rabbi Chaim then set a laptop-sized book spine-down on the desk and instructed my relative to open the book at random — a clairvoyant methodology known as bibliomancy. After staring at the opened page, full of symbols and dense Aramaic script, Rabbi Chaim announced that my relative would meet her future husband in three to eight months; that he would be born in the third, seventh or 11th month, and that possible names for him would be Avraham, Mayer, Michael and Shmuel. He added this information to the yellow piece of paper and gave it to my friend along with an amulet. The paper was folded to the size of a postage stamp and held with Scotch tape. Though we had been told to have money ready for him, he charged no fee—perhaps because we were younger than his other clients, or because it was our first visit; we don’t know. But we overheard the customer who saw him before us paying for multiple amulets at $180 apiece.
On a recent trip to his Boro Park office I could see Rabbi Chaim moving from room to room at the end of a hall. Occasionally he saw a client. I had come to ask why my relative, who was out of town, had not yet met her future husband in the prescribed time, but he left abruptly in the early evening with no explanation, and without seeing me.
Rabbi Chaim traces his ancestry to Rabbi Shalom Sharabi, an 18th-century mystic from Yemen. Rabbi Chaim said he was trained in Kabbalah by a great-uncle who ran a seminary in Jerusalem. His family had always told him he would become a mystic, the rabbi recalled. “I was born circumcised on Yom Kippur,” he said when asked about his credentials, indicating that this was an early sign of his calling.
The rabbi told me that the book he uses for bibliomancy is 800 years old and was passed down to him by family members. “It doesn’t have a name,” he said, lifting the red facsimile of the manuscript, whose original he says is hidden in a secret location in Israel. “Not everyone can touch a book like that,” his wife added. “This is not fortune telling. It’s between him and God.”
Barukh Berek, an Israeli who counts himself as one of the rabbi’s many helpers, added that Rabbi Chaim once made a mute child speak and has the ability to disappear mysteriously. “He is a malakh,” Berek said, using the Hebrew word for “angel.” “He always comes back. Angels are here to help people.”
But not everyone is ready to attribute supernatural powers to rabbis. Shelomo Alfassa, a Sephardic community activist in Brooklyn, has been outspoken against local rabbis who practice fortune telling. “Judaism expressly prohibits palm readers, fortune tellers and other soothsayers,” Alfassa wrote in an e-mail. “A person calling himself a rabbi, whether he is an actual rabbi or not — does not entitle him to act in any fashion which will allow him to fool people into making donations — all the while providing the eager recipient with junk information about their future.”
Alfassa cited a line from Deuteronomy 18 — “For these nations which you inherit, they listen to fortune tellers and diviners; but as for you, not so has Hashem your God given” — that, he said, made divination a violation of Jewish law, or Halacha. It is also, as it happens, against New York State law, a Class B misdemeanor punishable by up to six months in prison. But the presence of fortune tellers in almost every neighborhood of this diverse city testifies to the unenforceability of this statute.
An expert on Jewish law, Rabbi Mordechai Frankel, was not dismissive of fortune telling. “Halachically, there are ways in which it is permitted,” he said by phone from his Baltimore office, where he serves as director of the Institute of Halakha for STAR-K, a major kosher certification company. “There are methods considered sorcery, and there are methods which have been used extensively over the ages by many great rabbis.
“The question is where is the line between what is acceptable and what is not. There have been many cases of fraud, which has nothing to do with Halacha, and this is another reason for hesitancy.”
Professional magician James Randi, who runs a foundation devoted to debunking paranormal activity, said in an interview: “We hear about this sort of thing just about every day. It’s common to all religions. They all say they have contact with God.”
After hearing about Rabbi Chaim’s practices, Randi concluded: “He’s an opportunist. He sees people will believe it, and takes their money.”
Randi, who authored a book accusing Uri Geller, the Israeli-born self-described paranormal, of fraud, emphasized that there’s no evidence that supernatural practices work. Randi’s foundation offers a $1,000,000 prize to anyone who can demonstrate any supernatural power under controlled circumstances. According to Randi, several rabbis are among those who have attempted to win the prize, and it has remained unclaimed for a decade.
Rabbi Avrohom Holtzberg, who runs a Chabad house out of a trailer in his backyard near Rabbi Chaim’s home, said the two rabbis first met six or seven years ago at an area synagogue. “But I didn’t know his profession yet,” he recalled with a smile.
At first, Holtzberg said, he was skeptical. Then one day, he was present when Rabbi Chaim, provoked by a crowd, correctly guessed the birthdays of 10 strangers at a party. “It’s not that I believe or that I don’t believe,” Holtzberg explained soberly. “A lot of people put on tefillin because of him; a lot of couples live better. What can be more positive than this?”

SYRACUSE, NY — United States Attorney, Andrew T. Baxter, today announced that Jerome Howard Feldman entered a plea of guilty today before United States District Court Judge David N. Hurd in Utica to a five count Indictment charging him with wire fraud.
On February 11, 2009, Feldman was indicted by a federal grand jury in Syracuse, New York for carrying out a scheme to defraud desperately-ill victims who paid large sums of money to Feldman and traveled to the Philippines based on false promises from Feldman that they would receive organ transplants there. In fact, Feldman had not arranged for organ transplants and kept the money from the victims, one of whom died while in the Philippines awaiting the promised liver transplant.
As a result of his plea of guilty to the Indictment, Feldman faces imprisonment for up to 20 years and a fine of up to $250,000 on each of the five counts. Feldman also pleaded guilty today before Judge Hurd to a federal health care fraud charge from the Middle District of Florida that occurred between 1996 and 1999.

Stamford Marriott claims woman was negligent in her own rape
By Monica Potts
Staff Writer
08/12/2009
STAMFORD -- A downtown hotel being sued by a woman raped at gunpoint in its parking garage is claiming she was careless, negligent and "failed to exercise due care for her own safety and the safety of her children and proper use of her senses and facilities," according to court documents.
The victim's attorneys also argue the hotel has inadvertently identified her to acquaintances by asking them to testify.
The Stamford Marriott Hotel & Spa, along with the firms in charge of managing the hotel and its parking garage, made the claim as part of a list of special defenses filed in state Superior Court in Stamford last month. Such defenses allow defendants in civil suits to argue they are not responsible for damages even if the plaintiff's story is true.
The special defenses, and the plaintiff's argument against them, are a few of the documents filed in a series of arguments and counterarguments as the case heads for trial, scheduled for April.
The woman filed the lawsuit in May 2008, six months after Danbury native Gary Fricker, 56, was sentenced to 20 years in prison after a plea deal in the case.
On Oct. 10, 2006, Fricker stuck a handgun in the back of the then 40-year-old woman and forced her and her children, then 3 and 5, into their minivan as they left the hotel, according to court documents.
She let him go through her wallet and told him he could take it, but Fricker demanded she take off her clothes. Fricker sexually assaulted the woman for several minutes, pointing the gun at her and her children and threatening to sexually assault one of her children.
When another car pulled up, the woman screamed, and Fricker fled. Police arrested Fricker near White Plains, N.Y., three days later, and he immediately confessed, police have said.
Fricker, a transient carpenter, had been arrested 20 times before and was wanted in Florida on an arson case, police have said.
The woman, identified in court papers only as Jane Doe, claims in the suit that Fricker had been in the hotel and garage acting suspiciously days before the attack, as well as the afternoon of the attack, and the hotel failed to notice him, apprehend him or make him leave. During the attack, security personnel did not see or stop him, the suit claims.
The hotel also claims as a special defense that the acts were unforeseen and beyond their control, that the woman and her children failed to properly "mitigate their damages," and that the hotel had not been notified about Fricker.
The hotel also subpoenaed several people involved with the family, including a Pilates instructor, friends, tennis partners and the children's baby sitter. The woman's attorneys argue the individuals subpoenaed do not know anything about the attack, that the subpoenas inadvertently identified her to those people and that it was merely an effort by the hotel's attorneys to intimidate her.
A general manager reached at the hotel declined to comment. An attorney for the hotel, Stephen Brown, did not return a call seeking comment.

"We're looking at the protection of a group of people who can, again, not protect themselves from those who have already demonstrated a behavior that may be harmful to children," First Selectman Peter Tesei said.
A Riverside man convicted of possessing child pornography, one of four town residents on the sex offender registry, is planning to speak against the ordinance during the board's 10 a.m. meeting at Town Hall.
"Some people say that we haven't paid our price until we're dead. Is that what the justice system is all about?" Ernest Drupals said in an interview Wednesday with the newspaper.
Drupals, 38, argued that the proposed restrictions violate the constitutional rights of convicted sex offenders and make it difficult for them to re-assimilate into the community.
"Wow. Imagine this town passes this ordinance. What's left for a registered sex offender? The street?" asked Drupals, who was arrested in June 2000 after he was caught filming boys in the swimming pool at Greenwich High School.
During a search of Drupals' home, police said they found 2,500 pornographic images on his computer and videotapes of boys changing their clothes in locker rooms at YMCAs in New Canaan, Wilton and West Haven.
I agree. R' Ernest Drupals deserves to be treated mit kovod and human dignity!

The Manhattan ear, nose and throat doctor who declared Michael Jackson healthy enough to go on a grueling concert tour has been thrust into an investigation of possible insurance fraud, The Post has learned.
Dr. David Slavit, a Park Avenue voice specialist with privileges at Lenox Hill Hospital, gave Jacko a four-hour exam last February for concert insurer Lloyd's of London.
According to Slavit, Jackson was fit to perform, but needed medical monitoring.
"He passed with flying colors," said a source familiar with a subsequent insurance policy.
LA detectives looking into Jackson's death previously issued a search warrant for any communication between Jackson's personal physician, Conrad Murray, who administered IV injections of an anesthetic to Jackson the day he died, and Slavit and other health professionals.
Sources said Lloyd's contacted cops, who now want to learn whether the insurer was misled into issuing a $17.5 million policy covering non-appearances by the pop star in the event of an "accidental death."
The policy, issued in the name "Mark Jones" to protect Jackson's privacy, did not cover illegal drug use, the LA Times reported.
The Jackson family estate is entitled to "100 percent of the proceeds" of any insurance payout, under a business partnership with concert producer AEG Live, a source close to the deal told The Post.
With millions of dollars at stake, Slavit has been pulled into the investigation. He did not return calls for comment.
A source close to AEG said the company did not get a copy of Slavit's medical report on Jackson, but insisted the exam was thorough and included "blood work."
But a Jackson relative said the family is furious that Slavit gave Jackson a clean bill of health, and wants to sue him and other doctors.
"Slavit will pay just like . . . the rest -- AEG too," fumed a family member. "[Jackson] wasn't physically able to do 50 shows. Period."
Slavit, 48, who has examined other ailing singers for insurance companies, treats opera stars from the Met and classical vocalists.
"There's nobody I would trust more with my voice," said Grammy-nominated mezzo soprano Margaret Lattimore. "He's a fabulous doctor. Very discreet, incredibly professional, and the gentlest, sweetest man you can imagine."
But Slavit wasn't beloved by a plastic surgeon, Dr. Howard Bellin, who rented office space in his Upper East Side townhouse to the vocal doctor. Bellin said Slavit moved out one weekend in 1999, leaving $41,000 of the lease unpaid and $12,000 in damage.
"I found him to be completely dishonest or I wouldn't have had to sue him to get the money he owed me. I eventually got it," Bellin said. Court records show a settlement.
Slavit's father, lawyer Leonard Slavit, represented his son in the suit. The doctor's brother, Ira Slavit, who practices with their dad, would not comment.

HARRY Markopolos -- the whistleblower on Bernie Madoff who proved to be much smarter than the SEC -- says there are evildoers out there who will make the Ponzi scum "look like small-time." Markopolos predicted major scandals will soon be revealed about the unregulated, $600 trillion, credit-default swap market. "To put it in simple terms, it is like buying fire insurance policies from five different insurance companies on your neighbor's house and then burning down the house," he said.

More than 200,000 schoolchildren are paddled, spanked or subjected to other physical punishment each year, and disabled students get a disproportionate share of the treatment, according to a new study.
Mayor Michael R. Bloomberg said on Monday that he planned to make it harder this year for Shvartzer fourth and sixth graders who score poorly on standardized tests to move on to the next grade, extending a policy that his re-election team hopes will help him curry favor with voters.
Under the requirements, which are already in place for grades three, five, seven and eight, students who perform at the lowest level on state tests in English and math will have to repeat the grade unless they can master the material in summer school.
Previously, under a policy known as social promotion, school officials gave a pass to low-performing students under the belief that they would be more likely to drop out if they were held back and separated from children their own age.
Mr. Bloomberg won approval for the stricter requirements in 2004, beginning with the third grade, after a bruising battle that involved the firing of three members of an education oversight board and criticism from elected officials, educators and good-government groups.

Yale Press Bans Images of Muhammad in New Book
By PATRICIA COHEN
It’s not all that surprising that Yale University Press would be wary of reprinting notoriously controversial cartoons of the Prophet Muhammad in a forthcoming book. After all, when the 12 caricatures were first published by a Danish newspaper a few years ago and reprinted by other European publications, Muslims all over the world angrily protested, calling the images — which included one in which Muhammad wore a turban in the shape of a bomb — blasphemous. In the Middle East and Africa some rioted, burning and vandalizing embassies; others demanded a boycott of Danish goods; a few nations recalled their ambassadors from Denmark. In the end at least 200 people were killed.
So Yale University and Yale University Press consulted two dozen authorities, including diplomats and experts on Islam and counterterrorism, and the recommendation was unanimous: The book, “The Cartoons That Shook the World,” should not include the 12 Danish drawings that originally appeared in September 2005. What’s more, they suggested that the Yale press also refrain from publishing any other illustrations of the prophet that were to be included, specifically, a drawing for a children’s book; an Ottoman print; and a sketch by the 19th-century artist Gustave Doré of Muhammad being tormented in Hell, an episode from Dante’s “Inferno” that has been depicted by Botticelli, Blake, Rodin and Dalí.
The book’s author, Jytte Klausen, a Danish-born professor of politics at Brandeis University, in Waltham, Mass., reluctantly accepted Yale University Press’s decision not to publish the cartoons. But she was disturbed by the withdrawal of the other representations of Muhammad. All of those images are widely available, Ms. Klausen said
Aside from the disagreement about the images, Ms. Klausen said she was also disturbed by Yale’s insistence that she could read a 14-page summary of the consultants’ recommendations only if she signed a confidentiality agreement that forbade her from talking about them. “I perceive it to be a gag order,” she said, after declining to sign. While she could understand why some of the individuals consulted might prefer to remain unidentified, she said, she did not see why she should be precluded from talking about their conclusions.
Ms. Klausen, who is also the author of “The Islamic Challenge: Politics and Religion in Western Europe,” argued that the cartoon protests were not spontaneous but rather orchestrated demonstrations by extremists in Denmark and Egypt who were trying to influence elections there and by others hoping to destabilize governments in Pakistan, Lebanon, Libya and Nigeria. The cartoons, she maintained, were a pretext, a way to mobilize dissent in the Muslim world.
Although many Muslims believe the Koran prohibits images of the prophet, Muhammad has been depicted through the centuries in both Islamic and Western art without inciting disturbances.
Other publishers, including The New York Times, chose not to print the cartoons or images of Muhammad when the controversy erupted worldwide in February 2006.

Law enforcement officials in Brooklyn said informers have told them that the Colombo crime family was operating a casino at the Jewish Center of Kings Highway four nights a week until a police raid closed it on March 30. The Colombo family, they said, was also involved in gambling at Temple Shaare Emeth at 6012 Farragut Road before it was shut down after a robbery last fall, and apparently still runs the gambling at Temple Hillel of Flatlands at 2164 Ralph Avenue.
"The elderly women gambling away their Social Security checks are sometimes sitting next to guys with Sergio Tacchini suits and 9-millimeter semiautomatics in their waistbands," Mr. Levine said, referring to an expensive brand of loose-fitting warm-up suits.
"The Farragut temple was a major Colombo spot," said a Brooklyn-based law enforcement officer, who spoke on the condition of anonymity. The officer said that an informer had told the police that the site was robbed last fall, possibly by members of a Russian or Israeli gang. "For the next two weeks they had seven or eight guys inside walking around with guns," he said.
Athough the robbery was not reported to the police, members of the Shaare Emeth temple confirmed that a robbery did occur and that the gambling operation closed about two weeks later because the hold-up apparently scared off patrons.
Police officers from the Brooklyn public morals squad and 61st Precinct arrested 28 workers, none of them armed, in the raid on the Kings Highway Jewish center, after complaints from neighbors and letters from the local congressman, Representative Charles E. Schumer, about noise and parking problems.
Before the raid, the police sent letters to the president of the Kings Highway Jewish center, Murray Blum, and the heads of a dozen other Jewish centers warning them to close down the casinos, police officers and other law-enforcement officials said, adding that some of the locations did shut down.
Asked in a phone interview if he had received any letter, Mr. Blum said: "I don't remember. It's possible."
He declined to say to whom he rented the facility or whether he had knowledge of any connection between the casino operation and the Colombo family.
"I couldn't honestly answer that," he said. "This was an opportunity that presented itself. It was a gamble."

ROCHESTER, N.Y. (AP) -- Two upstate New York police officers have been treated and released from a hospital after being exposed to ammonia fumes that leaked at a milk processing plant in Rochester.
Officials say a family of six living across the street from the plant were treated at the scene, and one was taken to a hospital. That person's condition was not immediately available.
None of the 25 to 30 employees inside the Upstate Farms Cooperative plant were injured.
Officials say a buildup of pressure caused the valve leak early Thursday.
After an initial warning to stay indoors, residents near the plant have been told it's safe to leave their homes, and the plant has reopened.
A message left with Upstate Farms wasn't immediately returned.

No way to hide for US tax cheats
August 13, 2009

"For US taxpayers it is going to be impossible to hide money in Switzerland and it is just a matter of time that this is the case also for Germans and Britons," Asher Rubinstein, a partner at law firm Rubinstein & Rubinstein, said.
"Switzerland will no longer be a tax haven." Tax lawyers say many of UBS's competitors are sending letters to US clients asking them to transfer their funds to a US tax-compliant entity.
However, some secret account holders, who range from well-travelled businessmen to Jewish families who had fled hostile countries, could not stomach transferring between 40 and 60% of their hidden fortunes to US tax authorities.
"For every three to four clients that come here, there are one or two who, when we do the numbers, say: I cannot write a cheque that big. I will take my chances," Rubinstein said.

If Barack Obama's primary concern were to help those uninsured who desired coverage but were without, he could propose specific legislation in behalf of them. If he wanted to improve upon the health care system, he could address Medicare and Medicaid fraud, doctor malpractice insurance rates, and multimillion-dollar settlements that line the pockets of lawyers. Instead, he has chosen a mammoth health care (work in progress) "reform" bill of 1,000 pages in length.
Many people oppose Obama Care explaining that the devil is in the details of the bill, and they are correct, for a 1,000-page bill provides wonderful camouflage when one wants to give coverage to those illegally here and set landmines that force real citizens no choice but to follow the road that eventually ends with "public option." More specifically, though, the devil is in the phrase reform bill because reform bill intimates change for the better, and nothing could be further from the truth.
Obama Care is not reform, it is nationalized health care, plain and simple. It will lead to the government calling the health care shots, which means the eventual death of the medical private sector, which means more general practitioners, less specialists, and the rationing of medical services. All this adds up to only one thing: inferior health care for the average American and more power to President Obama and the Democrats.

Postville's population since the raid has shrunk by 40 percent and its tax base has been destroyed. Fewer than 50 Latinos remain from a former population of more than 1,000, most of them formerly detained illegals ordered to testify in the Sept. 15 trial.
Approximately 250 Jews also remain, unable to sell their homes. About half are Lubavitchers, some of whom are worried, Goldsmith reports, that they will not be rehired by the plant’s new owners, SHF Industries, a company formed in May by Canadian plastics manufacturer Hershey Friedman. Lubavitch kosher slaughter, or shechita, is increasingly unpopular in many Orthodox circles because of concerns regarding Chabad Messianism.

Back in January, The Atlantic ran a story about AdultVest -- a hedge fund that claimed an improbable 50% return last year by investing in adult businesses.
We say improbable, because although there's the notion that sin sells in any economy, that storyline has been decidedly busted this time around. Gambling is down. Liquor is down. Porn is even down. Even online porn. So, we wondered, how did AdultVest manage a 50% return?
Here's what we said at the time:
We asked Koenig what, exactly, he's been investing in that's bucked the trend, but he was unwilling to go into much detail. He noted AdultVest bought some porn domain names, which have been appraised at higher values, but which haven't been sold. He also mentioned AdultVest's stake in a startup doing porn for the iPhone. But it hasn't launched yet so any value is going to be difficult to determine.
Until proven otherwise, we're taking this claim of 50% gains with a grain of salt. We've been trained by the last year to be deeply skeptical of notional, mark-to-model values, and when you're talking about valuing assets like iPhone porn startups and unsold domain names, our skepticism ticks up another notch.
But perhaps our skepticism didn't go far enough.
Sources speaking to hedge fund newsletter FinAlternatives accuse AdultVest of being a downright fraud:
Sources close to AdultVest Inc., which manages the Priapus Investment Fund, an adult entertainment hedge and private equity fund, say that it is spending investor money on more than just investments, and that what investments there are don’t account for the returns it claims.
A former investor says that founder Francis Koenig is looting the fund to pay for fine art, expensive wines, cars, personal trips and alimony. Meanwhile, a former employee tells FINalternatives “there was no capital being generated” during his time at the firm.
“There is almost no money left in the fund,” the investor, who said he was privy to some of AdultVest’s financials via a court order, alleges. “Koenig has an American Express black card through the company that he uses on partying, girls and high living. Most money is missing and iPhone app is not worth what he says it is.”
“It just seems to me the whole time I was there that there was no capital being generated,” says the former employee, who left the firm last year because he felt uncomfortable working in an office shrouded with mystery. “And it seemed like money was being spent for things that didn’t need to be bought like cars, clothes and trips,” he adds.
The fund's manager and founder Francis Koenig vociferously denies the accusation, calling it "slanderous." He chalks the rumors up to a single, unnamed investor who wants to take his money out of the fund.
FinAlternative's sources, meanwhile, claim the fraud has been reported to the FBI and the SEC, so we'll be on the watch for developments.
For those of you following the case of Barry Tannenbaum's ponzi scheme in South Africa. It looks like he's getting away with it. The Australian govt deems it politically incorrect to extradite anyone to South Africa because the prisons there are very harsh conditions where they actually treat criminals like criminals.

Will the Police Take Down Israel's Foreign Minister?
By TIM MCGIRK
So accustomed is Israel's Foreign Minister Avigdor Lieberman to being under police investigation that he is known to constantly switch phone numbers and to remove the battery from his cell phone during private meetings. After 13 years of on-and-off probes into his private and political affairs, Lieberman has had good reason to believe that Israel's police were bugging his calls. And it certainly came as no surprise to the leader of the right-wing Yisrael Beiteinu party when the police National Fraud Squad on Aug. 2 recommended that Lieberman be indicted for money-laundering, accepting bribes and obstruction of justice.
It is now up to Israel's crusading Attorney General, Menachem Mazuz, to decide whether to charge Lieberman. Justice sources told TIME that a decision may be reached before December. The focus of the police probe centers on Lieberman's alleged ties to a string of shell companies, one of which was run by his 20-year-old daughter, now a multimillionaire. The liberal daily Haaretz reported that the police are curious about an estimated $3 million that the company headed by Lieberman's daughter received between 2004 and 2007 for "business consulting" from anonymous sources overseas.
Lieberman is confident that the police recommendation lacks merit. The hawkish Foreign Minister has always dismissed the probe as politically motivated. And voters, at least in the last elections, appear to concur: the former Moldovan nightclub bouncer has a large following among the 1 million–plus Israelis who emigrated from the former Soviet Union, although his support could wane as more and more allegations of wrongdoing are leaked by the police.

Ezra Nawi, a 57-year old Israeli Jewish plumber who is openly gay, is facing up to 10 months in jail for non-violently resisting Israel’s demolition of Palestinian home in the occupied West Bank.
And today, human rights campaigner Peter Tatchell is urging people to join an email campaign to press for the dropping of all charges against Mr. Nawi.
“Ezra Nawi is a human rights defender of conscience and courage,” Mr. Tatchell said this afternoon. He added that Mr. Nawi will be sentenced by an Israeli court on August 16.
Several years ago, Mr. Nawi had a relationship with a gay Palestinian refugee, Fuad Mussa who fled the West Bank, fearing ‘honour killing’ because of his homosexuality.
Mr. Nawi was convicted on charges of allowing his partner to live illegally in Israel, while Mr. Mussa was jailed by the Israelis.
As a result of his human rights work, Israeli settlers, police and soldiers have subjected Mr. Nawi to a torrent of homophobic abuse.
“He is subject to almost round-the-clock surveillance and harassment by the Israeli military,” Mr. Tatchell continued.. “His plumbing business has been audited, and he was handed a huge tax bill that he disputes. He believes that his phone calls are monitored, and soldiers shadow his every move.
“Despite this intimidation, Ezra remains undeterred. His commitment to justice for the Palestinians is as strong as ever.

The Obama administration's policy on Israel is misguided, puts too much emphasis on the issue of settlements and ignores the bigger threat of a nuclear-armed Iran, a U.S. delegation of Republican congressmen visiting Israel said Thursday.
Led by minority whip Eric Cantor from Virginia, the only Jewish Republican in Congress, the delegation of 25 Republicans say their weeklong mission to Israel is designed to show solidarity with the Jewish state and promote Mideast peace. A group of Democratic congressmen are expected to visit next week.
Cantor said that instead of focusing on issues such as Israeli settlement activity in the West Bank, Obama should concentrate on "the primary issue of import ... and that is the existential threat that Iran poses not only to the state of Israel but to the United States."
The congressman said he is "concerned about what the White House has been signaling of late."
Israel believes Iran is trying to develop nuclear weapons that could one day be used against the Jewish state. Iran says its nuclear program is meant only for energy production.
Cantor and others supported Israel's handling of the eviction of two Arab families from a house in east Jerusalem earlier this week, a move criticized by the European Union and U.S. Secretary of State Hillary Clinton.
"I don't think we, in America, would want another country telling us how to implement and execute our laws," Cantor said.

By MARCI A. HAMILTON
Thursday, July 29, 2009
Based on an unscientific survey of everyone with whom I have spoken in recent months, I have come to the conclusion that there is an untold story that would shock the vast majority of Americans. Pieces of it have appeared in various publications, but never the whole story. It is the story of the New York Catholic Conference's outrageous measures to stop the reform of New York's laws that govern child sex abuse.
The bottom line is that the Catholic bishops have committed both themselves and their copious resources to becoming the political enemies of all child sex abuse victims and thus the political allies of all child predators (whether they be priests, teachers, or uncles).
The ugliest confrontation to date, which was engineered by the bishops and pitted believers against survivors, occurred in front of Lopez's office. A handful of Jewish and Catholic survivors have been staging a protest there for weeks. DiMarzio organized a group of believers to march in support of Lopez's opposition to the Child Victims Act. Two busloads of people were taken to the neighborhood and told – contrary to the facts, as noted above -- that the CVA did not apply to public institutions and that it would bankrupt the dioceses, causing losses of services. About a dozen survivors, who had been raped as children by priests and rabbis, stood across the street holding signs in favor of the Child Victims Act. When the survivors confronted the sadly uninformed marchers with the truth about the bill and the misinformation from the bishops and Lopez, they told me directly, some of the marchers actually threw coins at the survivors.
If the Conference were not pouring hundreds of thousands of dollars into lobbying, and if it were not employing the tactics I have described above, the CVA would have been the law long ago. And today we would know the identities of hundreds of New York child predators who are now, instead, enjoying the anonymity – and protection – afforded them by existing state law. Fewer children would be subject to abuse right now. Instead, Agudah Fressers, the Conference and DiMarzio and Lopez have become the sworn enemies of New York's children and of the truth.

CHICAGO — Two Chicago men have been charged in a family-affair tax fraud scheme that allegedly involved using federal inmates' identities to file for $35 million in tax refunds.
Eric Berkowitz, 33, and his brother-in-law Yair Berkowitz, 26, pleaded not guilty Monday to conspiracy and wire fraud charges. If convicted, Eric Berkowitz faces a maximum of 65 years in prison; Yair Berkowitz faces a maximum of 45 years in prison.
Yair Berkowitz's father, Marvin Berkowitz, 62, is believed to be the scheme's mastermind, and was arrested Sunday in Jerusalem.
In all, ten people were charged in February in relation to the scheme. But the indictment remained sealed until Sunday night while authorities arranged the arrest in Israel. Authorities are still seeking one person related to the scheme.
Federal prosecutors say the suspects used 3,300 federal inmates' identities to file for the income tax refunds. According to the indictment, they netted $4 million, including $1.5 million from the Internal Revenue Service and $2.5 million from various states. Sham businesses and bank accounts were allegedly set up to receive the money.
The indictment said $800,000 was paid to or had benefited eight family members, including Yair Berkowitz, Eric Berkowitz and another son of Marvin Berkowitz. That son, David Berkowitz, 32, was arrested Sunday night in Hollywood, Calif.
According to the indictment, Eric Berkowitz received about $270,000 through the scheme that he used for himself and his business, B.B.'s Bagels on Chicago's North Side. The indictment says the IRS confronted Eric Berkowitz after he accepted seven checks worth $36,000 in May 2006 from an alleged co-conspirator. He said he didn't know the money's origins, but that it was from his father-in-law. He gave IRS the checks but, according to the indictment, he recouped the money within the next month.
Yair Berkowitz requested some of those checks from the co-conspirator, according to the indictment. Yair Berkowitz allegedly received $80,000 in the scheme.
Attorneys for both men said their clients have done nothing wrong.
Barry Sheppard, attorney for Eric Berkowitz, said Monday that his client is a victim of a ploy by the government to "punish the father-in-law." Assistant U.S. Attorney Maureen Merin told federal Judge Virginia Kendall on Monday that Marvin Berkowitz evaded tax-fraud charges in 2003 by fleeing to Jerusalem, where he allegedly had continued spearheading tax-fraud schemes.
"He received some support from his father-in-law," Sheppard said of his client. "He's not responsible for his father-in-law anymore than anyone else would be responsible for their in-laws."
Others arrested in the scheme are Fernando Benalcazar, 48, of Warrenville, Ill.; Christopher Moore, 44, of East Hazelcrest, Ill.; Kevin Murray, 54, of Berkeley, Ill.; Marvin Harris, 75, of Chicago; and Franklin Novak, 61, formerly of Charlotte, N.C. Novak was arrested in Israel, where he lived, and Harris was arrested in Michigan.
Federal authorities are looking for Yousef Lefkowitz, 26, of Brooklyn, N.Y., who was also indicted in connection with the scheme.
Prosecutors said Monday that Eric and Yair Berkowitz are flight risks and asked Kendall to keep them in jail until their trials. The judge will decide later this week.

HARTFORD, Conn. (AP) -- The former dean of an exclusive Connecticut boarding school has been charged with molesting three students.
Dean of Students Richard Reinhardt was fired from The Gunnery in June after allegations surfaced that he abused boys there.
The family of one former student sued this week over what it says were ''repeated'' abuses by the 44-year-old Reinhardt, of Telford, Pa.
He was arraigned last week on charges including sexual assault and risk of injury to minors.
Reinhardt's lawyer, William Dow III, says his client denies the allegations and will plead not guilty Sept. 1.
The school in Washington, Conn., was founded in 1850 by outdoorsman and abolitionist Frederick William Gunn. Tuition, room and board costs more than $42,000 per year.
Gov. David A. Paterson on Thursday proposed legislation that would make it a felony to drive while drunk or high on drugs when a passenger under 16 is in the car. The proposal comes in the aftermath of the deadly crash on the Taconic State Parkway, in which Diane Schuler killed herself and seven others while drunk and under the influence of marijuana.
“In 2007, more than 7,000 people were injured in accidents related to driver intoxication,” Mr. Paterson said in a statement. “Of the 344 who lost their lives, nearly 200 were under the age of 14.”
Marvin Berkowitz and his Klan are klainerkeiten. At least they never considered themselves SPECIAL ASSETS.

FAA Suspends Two Air Traffic Controllers In Wake Of Crash Over Hudson
August 13, 2009
The FAA has has suspended two air traffic controllers who were handling the plane involved in the crash last Saturday with a helicopter, which resulted in the death of 9 people. In a statement, the agency said “we learned that the controller handling the Piper flight was involved in apparently inappropriate conversations on the telephone at the time of the accident. We also learned that the supervisor was not present in the building as required.”
The Daily News reported that the controller was talking to his fiance as the disaster took place and that Rabbi Avi Shafran has appealed to the Federal Aviation Administration that there should be an exemption for shidduchim as long as the pilot did not do anything stupid such as crash land the plane and save everyone onboard.
Mordechai Berkowitz and his children might no be the brightest apples, but they are not arrogant fools. If they were arrogant or mean-spirited, the community would have sent them up the river ages ago. They have no rabbinic connections or backing in the city and don't seek the limelight.
However, SPECIAL ASSETS are two arrogant fools who try to pull rank with their delusions of wealth. There is no excuse at all to incite and assist criminal activity against Jewish people. At the same time SPECIAL ASSETS need the fawning of the rabbis to prop up their self worth.
SPECIAL ASSETS will have an even more SPECIAL ENDING.
I'm proud to be a neighbor of the Berkowitz family.

Hadassah, the Jewish volunteer organization, knew it had invested $40 million with Bernard L. Madoff by the late 1990s. It also knew it had taken more than $130 million from its Madoff accounts and still had millions on the books when the vast Ponzi scheme was revealed in December.
What the charity says it did not know, however, was that Sheryl Weinstein, its chief financial officer when it made those investments, was having an affair with Mr. Madoff.
Ms. Weinstein, who has been married for 37 years, discloses that relationship in “Madoff’s Other Secret: Love, Money, Bernie, and Me,” a memoir scheduled for publication by St. Martin’s Press at the end of August, a spokesman for the publisher confirmed.
Hadassah’s national president, Nancy Falchuk, told Hadassah’s national board in a letter on Thursday that the group was “shocked to hear the news reports of Mrs. Weinstein’s personal admission regarding this relationship. Indeed, we knew nothing of her relationship with Mr. Madoff until today.”
According to John Murphy, the publisher’s spokesman, Ms. Weinstein’s relationship with Mr. Madoff “spanned 20 years.” That would take it back to 1988, when Hadassah received a gift of about $7 million from a French donor, whom the organization has declined to name.
That money was already invested with Mr. Madoff, and the donor wanted it to remain in his hands, the organization reported in December. Thereafter, Hadassah invested an additional $33 million with Mr. Madoff, who was a well-known figure on Wall Street and a contributor to several other prominent charities — some of which were also victims of his fraud.
Indeed, the Madoff scandal raised questions in the nonprofit community about how well charities managed their investments and monitored their conflicts of interest, with some watchdog organizations saying that some groups left those decisions to small, clubby boards or influential insiders.
Hadassah has declined to identify the members of its investment advisory committee, other than to say they are “prominent and experienced financial and investment individuals” who serve without pay and are not members of its large governing board, whose membership rotates frequently.
But the organization did confirm that one member of that committee was Ms. Weinstein, who was on Hadassah’s staff for more than a dozen years.
Ms. Weinstein and her husband invested virtually everything they owned with Mr. Madoff, and lost it all.
At his sentencing hearing in June, Ms. Weinstein spoke about the emotional and financial devastation of her family.
“A deep, heavy depression would surround me and not lift,” she said. For months, she felt “unable to escape the reality of my personal devastation.” She and her husband were forced to sell their home “because four years ago we refinanced our mortgage and gave the excess cash to Bernie Madoff,” she continued.
Ms. Weinstein has not said publicly whether she actively participated in investment decisions involving Mr. Madoff. But William Josephson, a lawyer who was formerly the chief charity regulator for the New York attorney general’s office, said she should not have done so.
“In her position, she had a fiduciary duty to her employer that would require her to either disclose the relationship or recuse herself from making any decision related to investment with his firm,” Mr. Josephson said.
Ms. Weinstein’s headlines are not Hadassah’s biggest worry these days. Because it withdrew far more cash from its Madoff accounts than it contributed, it may be vulnerable to a lawsuit by the Madoff bankruptcy trustee, who is trying to recover money for those victims who put in more than they took out.

FORT WORTH, Texas (AP) -- The Charles Manson follower convicted of trying to assassinate President Gerald Ford was released Friday from a Texas prison hospital after more than three decades behind bars, a prison official said.
Lynette ''Squeaky'' Fromme was just 26 years old when she pointed a semiautomatic .45- caliber pistol at Ford in September 1975 in Sacramento, Calif. Secret Service agents grabbed her and Ford was unhurt.
Fromme, now 60, left the Federal Medical Center Carswell in Fort Worth at about 8 a.m. Friday, spokeswoman Dr. Maria Douglas said in a statement.
Fromme, who got a life term, became the first person sentenced under a special federal law covering assaults on U.S. presidents, a statute enacted after the 1963 assassination of President John F. Kennedy.
Ford was walking to the California State Capitol from his hotel when Fromme pushed through the crowd, drew the pistol from a holster on her thigh and pointed it at the president as he shook hands with well-wishers. She was restrained by Secret Service agents who wrested the gun away from her and led the president to safety.
Fromme was granted parole in July 2008 and released ''via good conduct time'' after completing a 15-month sentence for unlawful escape from a federal correctional institution, according to the statement. That sentence was being served consecutively after a life sentence for threats against the president.
WELLINGTON (Reuters) – An extremely drunk, naked man lost his way at a New Zealand hotel and ended up sleeping in the wrong room, forcing its female occupant to hide in the bathroom, local media reported.
The 72 year-old Brooklyn rabbi had gone back the hotel in the resort town of Queenstown with a woman, but got up in the night and wandered into a bedroom where a couple were sleeping.
"He was a bit surprised that there were two people in his room and he was butt naked," Sergeant Steve Watt of Queenstown police told the Southland Times.
As the intruder slept, the startled woman took refuge in the bathroom as her husband summoned hotel staff.
The man, who could not remember whom he had been with nor what room he had been in, and had no clothes or wallet.
Police gave him a ride home clad in a hotel bathrobe, but let him off after the guests and hotel decided not to press charges.
"It was far too funny," said Watt.
Mordechai Yosef Leiner celebrated a double milestone this week in New York’s capital of Hassidic Jewry, Boro Park: He was named to succeed his father, the late Rabbi Yaakov Leiner, as Radzhiner Grand Rabbi, and became Bar Mitzvah – 13 years old and obligated in the Torah’s commandments – at the same time.
Rabbi Yaakov Leiner passed away suddenly three months ago, at the age of 47, leaving behind a wife and 11 children, the oldest not yet 13. The deceased represented the sixth consecutive generation of Leiners to serve as Grand Radzhiner Rabbi, beginning with Rabbi Mordechai Yosef Leiner of the early 19th century, who founded the dynasty. He was also the great-grandson of Rabbi Avrohom Yehoshua Heshel Leiner, whose brother, the late Rabbi Gershon Henoch Leiner, is considered the “rediscoverer” of the blue dye mandated by the Torah for tzitzit (ritual fringes).
After the sudden death of the Grand Rabbi, several leading Hassidic rabbis convened and decided that his eldest son, Mordechai Yosef, should be installed as the Rebbe, despite his young age, in order not to break the Radzhiner chain. The rabbis who made the decision were the Rebbes of Novominsk, Alexander, and Amshinov.
Among the guests at the double celebration in Boro Park were the new Rebbe’s uncle and aunt, siblings of the deceased, who are Rebbe of Radzhin-Jerusalem and the granddaughter-in-law of the late saintly Rabbi Moshe Feinstein, respectively.
Rabbi Leiner is the youngest new Rebbe to be installed in a Hassidic sect in the United States in at least the last 50 years.
Bank of America Corp. has filed a foreclosure action against the owner of the 239-unit Silver Blue Lake Apartments in northern Miami-Dade County, Fla.
BofA is the trustee for the holders of the commercial mortgage-backed security loan.
The Charlotte-based bank (NYSE:BAC) filed the action last week against 103 Silver Blue Lake Apartments and principals Hillel Bronstein and Zvi Shiff, according to Miami-Dade County Circuit Court records.
The complaint is based on an $11.8 million mortgage UBS Real Estate Investment gave the developer in 2005. The mortgage was later securitized.
In 2002, 103 Silver Blue Lake bought the apartment complex for $4.8 million. The three-story building was constructed in the 1960s.
John Edwards is expected to publicly admit he is the father of the daughter of his former mistress, Rielle Hunter, sources told North Carolina's WRAL News on Thursday.
Last week, Hunter was seen entering a courthouse in North Carolina and leaving nine hours later. She apparently testified before a federal grand jury, which is investigating whether Edwards broke campaign finance laws by allegedly paying off Hunter and aide Andrew Young, who claimed paternity of the child in 2007. Young reportedly testified last month to the same grand jury.
Edwards is expected to make the public admission about being the father before the end of the investigation, according to WRAL News. Hunter brought the baby with her to the courthouse. She appeared to be deliberately forcing her baby to turn her face toward the waiting TV cameras trying to publicly demonstrate her daughter's physical resemblance to Edwards for the media.
We can only feel sorry for little Frances.

Three men were arrested last week by Tel Aviv Police on suspicion of attempting to extort a well-known Bnei Brak rabbi, police sources said on Monday.
Two main suspects, whose names are barred from publication, are believed to have conspired to extort $150,000 from the rabbi, after mistakenly believing that he had pocketed more than half a million dollars from an American Jewish donor that was intended for charity.
The third suspect, an American millionaire and a resident of Brooklyn, New York, is believed to have taken part in extortion attempts, a police source told The Jerusalem Post.
“This affair began in August, when a rumor spread in a synagogue that the rabbi received $600,000 from a Jewish American donor based in New York, but didn’t pass it on to its intended recipient,” a police source told The Jerusalem Post.
After hearing the rumor, the source added, the main two suspects went to the rabbi’s office, pretending to represent the US donor, and began making threats and demands for a portion of the money.
The rabbi insisted he had never received the money.
“They told him, we will ruin your daughter’s wedding. We want $150,000,” the police source added. “The threats continued via phone calls.”
In a bizarre twist, the source said, the US donor himself is suspected of being a part of the extortion plot, after he allegedly told the rabbi that the two suspects were linked to underworld elements, and that it would be “in his best interest” to pay the amount they demanded. The rabbi facing the threats then contacted police.
On October 14, at a meeting in the lobby of the Carlton Hotel in Tel Aviv, the rabbi facing the extortion threats met with the two suspects and the American donor, and demands for the money were reiterated. Undercover detectives pretending to be waiters documented the meeting.
“The rabbi again said he didn’t receive any money, and the meeting ended without agreement,” the police source said. The “waiters” then immediately arrested the three suspects.
All three are suspected of conspiracy to commit a crime and extortion. The two main suspects are in custody, while the American national has been placed under house arrest for 15 days, the police source said.

U.S. Sen. David Vitter on Thursday repeatedly refused to say whether he broke the law in connection with a Washington prostitution ring to which he was linked by phone records in 2007.
The Louisiana Republican dug in during a Thursday night debate marking the first time that the senator has faced repeated, pointed questioning from reporters about the scandal.
The first-term senator and former House member has repeatedly turned away interview requests and has referred only to a "serious sin" in statements about his alleged involvement as a House member with the prostitution ring run by the so-called "D.C. Madam," the late Deborah Jeanne Palfrey.
WAFB television reporter Greg Meriwether asked Vitter to explain what the "serious sin" was. Vitter launched into a lengthy response, saying again that he has been forgiven by his wife, family and God, and that he believes voters have forgiven him and support him.
"Did you violate the law?" asked moderator Dennis Woltering of WWL.
Vitter: "Dennis you can look back, you can continue to write stories in the media about it. That's your decision. It's a free country. I looked the voters of Louisiana in the eye. I spoke to them sincerely. I think they heard me and I think they understood me. And now I'm looking forward, I'm not looking back."
Vitter ducked several other questions about whether he had broken the law, and then attacked his Democratic opponent, Rep. Charlie Melancon, for airing a two-minute tabloid TV-style commercial about the senator's alleged past involvement with prostitutes.
"Is that part of your Melancon family values, Charlie?" Vitter asked.

Rabbi Elchonan (Zohn) has no ne'emanos when it comes to cemeteries. In the late 1990s he sought to recover Mokom Shalom, the oldest free Hebrew burial site in New York, with six feet of earth and bury a second layer of dead even though it was clearly known that the cemetery was full. He continued to try after Rav Eliyashiv Shlit"a told him it was assur, that the matzaivos that were taken down are assur bihana'ah, and must be restored to their location if possible. Only because of the publicity brought to bear by Moshe Handler did Zohn and Jacobsen back off.
Recently Zohn's partner in crime, David Jacobson, manager (trustee?) for Mokom Shalom, signed an agreement with OmniPoint comminications, whereas Omnipoint would build a "flagpole style" communications antenna on the location of the old Mokom Shalom office building. Jacobsen receives almost $1600 a month rent for the antenna and equipment area. It would be nice if that money went back towards maintaining or restoring Mokom Shalom. As of the last I was there about two months ago, the place does not look like it's improving.

Since then the Queens Vaad doesn't admit to anything.

That one source for his grave story was actually murdered a few days after he talked to Handler. Now, that's reporting when someone feels they have to kill your source!
On his website, Handler put satellite photos of the cemetary decades apart and had substantial research posted including # of graves from records, photos of smashed headstones and original tshuvot with translations and way more.
Who's Lying Now?

As we were about to go to press with this issue of the Jewish Interest Magazine, we were flooded with phone calls telling us that both David Jacobson and the Vaad Harabonim of Queens had placed ads in the Jewish Press. Jacobson's ad suggests that this magazine published lies about him. The Vaad's ad took a somewhat more subdued approach. Since I am the one who wrote all the cemetery articles I feel that it is important to expose the open lies both these ads try to palm off on the Frum public.
The Vaad's ad is a classic exercise in damage control. They admit things they know I can prove so that they do not look so bad and then they go on with a song and dance. It's almost like a page out of the Clinton Handbook - "We were caught so now we'll say we were always for cemetery reform."
The Vaad would have you believe they listened to what the Poskim said. I'm not new to this story. They spent the first year insisting against all evidence that there were no burials in the cemetery. Only when the same evidence was presented through our people and supportive Rabbonim to Rav Elyoshuv and Rav Elyoshuv ruled against their plans did they admit the cemetery was full. They then changed tactics and tried to claim the cemetery was a mass burial ground and not subject to normal cemetery Halocha. That is the reason Rabbi Zohn flew to Israel and argued with Rav Elyoshuv for three days straight. Rav Elyoshuv found him not credible. Yet, when he came back from Israel Rabbi Zohn told everyone he got that heter. It's also interesting to note that I have witnesses telling me that as late as September 14, 1997, the Vaad was still discussing the issue of whether Rav Elyoshuv has the right to "Pasken" issues and overrule American Rabbonim.
The guilty parties here are the few rotten apples right at the top of the Vaad.
To those who begged me quietly to write these articles because you didn't want to be part of the problem but were afraid for Parnosso and or violence, in the course of this investigation there has been indications of tampering with papers and survey maps at high levels and even one cemetery trustee who was beaten to death days before he was supposed to speak to me. I don't make accusations but it was an interesting coincidence to say the least. His murder was never solved.
