It is highly hypocritical of Rabbi Yaakov Horowitz to be advising adults who were sexually abused as children!

In response to the Motty Borger tragedy, Rabbi Horowitz, together with Dr. Twerski, wrote an article about the importance of sexual abuse victims to seek help and not to keep their pain inside. It is highly hypocritical of Rabbi Horowitz to be advising adults who were sexually abused as children. Rabbi Horowitz was a vocal opponent of the Child Victims Act, even going on public radio to voice his opinion. The Child Victims Act would be the only recourse for these past victims. Nobody will believe these victims years after the abuse if not for the possibility of them seeking legal action. Rabbi Horowitz along with Vito Lopez, David Niederman, the Agudah and the Catholic Church have worked to insure that these victims are forever muzzled.

You want these poor victims to seek professional help? What kind of closure are you offering them? Their molesters will be protected indefinitely thanks to your lobbying. The community continues to shun these victims and label them as "damaged goods". What incentive do they have to come forward and risk being exposed, thereby ruining shidduchim prospects for themselves and their families. Until the stigma is removed from sexual abuse victims and until we stop protecting the molesters, there is no reason for these victims to speak out. Without any sense of closure and without the community's love, understanding and acceptance, there is no psychotherapist that can help these victims. The first step to healing is passing the Child Victims Act, over Rabbi Horowitz' objections and over the rest of the axis of evil's objections. Let's make it happen!

CHILD SEX ABUSE AND TEMPEST IN THE TEMPLE: THE REAL STORY BEHIND THE STORY!

I’ve always said that the truth about abused children in Orthodox communities is going to come out.

I mean the WHOLE truth – not just about the children being used by molester rabbis and rebbeim, but the cover-ups by rabbis, politicians, Agudah, OU, Shafran, Schick, Rosenblum, etc., etc., etc…. The whole nasty, mind-blowing, covered-up truth.

And, my friends, it IS coming out – a little at a time. There’s already more out there than meets the eye. You just have to know where to look.

The first place you might want to look is the new book Tempest in the Temple: Jewish Communities & Child Sex Scandals (Brandeis University Press, 2009), edited by Dr. Amy Neustein.

For instance, did you notice that the Jewish Week’s FRONT PAGE story on charedi child abuse this week mentions Tempest in the Temple? . . . But I’ll bet writer Steve Lipman wasn’t allowed to tell you what the book shows about child-abuse cover-ups… and Brooklyn D.A. Charles “Joe” Hynes.

Or, did you notice this week’s Jewish Press? Most of you are probably so sick of that paper you may not have noticed that Tempest in the Temple got reviewed this week on page F2, and by none other than David Morris of Lema’an Achai (a truth-teller about child sex abuse in Ramat Beit Shemesh).

But here’s what I mean about the truth coming out – even in the charedi media! Here’s what Jewish Press/David Morris has to say about Tempest in its review this week:

[One] powerful narrative is “The Fugitive and the Forgotten” by Michael Lesher . . . in which he describes his role in the case of alleged multiple child attacker, Rabbi Avrohom Mondrowitz. . . . In spite of some 25 years of stalling by various authorities in the US and Israel . . . Mondrowitz was finally arrested in Israel in 2007 and is now in custody pending extradition to the US.

Neustein and Lesher’s “Justice Interrupted” reviews the case of Rabbi Solomon Hafner who was “cleared” of abuse charges by the Bobov Bet Din (religious court) while the alleged victim was chased out of town. They also explore the Mondrowitz case and that of Rabbi Yehuda Kolko. In all three cases, the DA, Charles “Joe” Hynes seems to have participated in whitewashing, or obfuscating, due apparently to political considerations.

Yes, it’s all true… And that’s only the rough outline!

Read the book and see how bad it really is.

Michael Lesher’s role in these cases is not news, but in these chapters, he (with Amy Neustein in “Justice Interrupted”) lays out in detail the way rabbis, the “gedolim” and the criminal authorities are trying to fool us into believing they really care about child abuse. (Just think “Kol Tzedek” – and keep a straight face if you can.)

Here are a few points to be learned from just those two chapters in Tempest:

· D.A. Hynes’ office deliberately buried the Mondrowitz case in September 1993 by telling federal authorities to stop attempts to bring him back from Israel.

· Lesher has mounting evidence that Ohel Children’s Home (home of “Kol Tzedek”) sent foster children to Mondrowitz and covered up the abuse they suffered.

· The D.A.’s office, with help from federal officials, tried to “disappear” a copy of Mondrowitz’s hard drive, obtained by Lesher, that appeared to show Mondrowitz had illegally downloaded hard-core child porn in Israel.

· Rabbis with important information about Mondrowitz have refused to share it, despite Lesher’s requests.

· Member of the D.A.’s Jewish Advisory Council told Amy Neustein that Mondrowitz should not be prosecuted at all.

· The D.A. – who has said he doesn’t allow rabbis to interfere with his child sex abuse cases – took orders from a rabbinic court (headed by Rabbi Dovid Feinstein) to drop the case against the Bobov rabbi Shlomo Hafner.

· There is evidence he has done similar things in other child sex abuse cases.

There’s more – and more important information in other chapters – but this will give you some idea why it’s important to read this book – AND SEE WHAT THE JEWISH MEDIA ISN’T TELLING YOU. YET.

There’s a reason this information isn’t blaring at you from the Jewish Week, or from the Post or the Times, for that matter. The real news is too hot for the media to handle. After all, they get hoo-ha crime stories from Joe Hynes… and they don’t want to lose that connection.

But we need to know the truth. And repeat it. And repeat it. And repeat it.

Hynes, the rabbis, Ohel, the Agudah, etc., etc., are playing us for suckers, folks. We can’t let them get away with it. This is our revolution and we’re gonna have to work to keep them from stealing it.

TORMENT & DEATH!





A Brooklyn newlywed who jumped to his death from a hotel balcony the night after his wedding was tormented by memories of being sexually molested as a Jewish student, sources say.

After joyfully singing and dancing at their lavish celebration in Williamsburg on Nov. 3, Motty Borger, 24, bared his secret anguish to his bride, Mali Gutman, the next day -- and the revelation caused a strain, a source close to the family told The Post.

"That entire day he discussed it with her. He told her the story of his life, how he felt so awful and he couldn't go near her," the source said. The couple had met just last July, after a matchmaker set them up.

TORMENT: A suicidal Motty Borger "felt he couldn't go near" Mali Gutman the day after their Brooklyn wedding. "When he got married, he realized he couldn't face up to it, and he told his wife that he needed help."

The stunned bride responded, "So, why did you marry me?"

Borger reportedly answered, "You are absolutely right. It was not right of me to get married."

At 6:45 a.m., while Mali slept, Borger climbed a railing outside their seventh-floor room at Avenue Plaza Hotel and leaped, police say. He died hours later at a hospital.

Friends insist that Borger -- described as fun-loving, smiling and cheerful -- wouldn't take his own life.

"I know Motty, and I know he didn't jump. It was an accident," one said. The rabbi who spoke at his funeral called reports of suicide "wickedness."

A security video at the hotel shows him looking "agitated" in an elevator with his wife, cops said.

The city Medical Examiner ruled his death a suicide. The NYPD is investigating the sex-abuse allegations, said a police official.

A source familiar with the tragedy said Borger had confided in close relatives that he was molested while a teen attending a yeshiva, possibly by a rabbi, but they never went to the police.

An Open Letter To Rabbi Matisyahu Salomon, Mashgiach, Bais Medrash Govoha, Lakewood, New Jersey

You put them there and you can and should take them down! They are the primary reason your communities and your children are traumatized and having kids "falling" out of windows to their deaths.

Dear Rabbi Salomon:

I heard your speech at the Agudah Convention and have a few comments and questions I would like to share with you. I am writing this letter in an open forum as I believe the issues herein are of vital importance to our people and warrant the same circulation as your much publicized speech.

I take no issue with your well reasoned argument calling for civility in expression of disagreement. B'nei Torah should be able to agree to disagree. While I join you in condemning the deplorable language used by the few, I respectfully suggest that dissenters need not be placed in the category of “rasha,” or “maskil” for you to make your point. Likewise, suggestions of “hakei es shinov” (knock out their teeth) and proclamations that children of select members of our community whose views you may disagree with have no place in our schools, do little to further civilized discourse.

In your speech you made a point of declaring your lack of cowardice in dealing with the issue of sexual abuse by rabbeim in yeshivas and insisted that keeping your efforts discreet or as you put it to “sweep under the carpet”, is a choice you make to protect human dignity. Whose dignity are you referring to? The dignity of those few victims courageous enough to step forward and confront these powerful monsters or the dignity of these monsters and their poor families? I respectfully suggest that by concerning yourself with the dignity of the pedophile and sweeping his heinous acts under the carpet, you subject his victims to another round of abuse at the hands of the community while enabling the predator to continue his reign of terror on unsuspecting victims.

We are taught that “chochmah b’Goyim, taamin.” Medical statistics tell us that a treated pedophile has a sixty percent rate of recidivism. This places the pedophile squarely in the category of a rodeph and as such we have a duty to our community to expose him so that potential victims are aware of this clear and present danger. Sex Offender Registries exist for a reason. Namely, the law and medical science recognize that these people are incapable of controlling themselves. You may be impressed by a heartfelt and tearful confession coupled with a commitment to never again succumb to temptation, (“teshuva”.) However, you will not be present when this pedophile succumbs to his overwhelming urges and destroys another poor innocent life. Respectfully, you do not have the right to ignore universally accepted medical knowledge and take innocent children’s lives into your hands for the sake of a pedophile’s “dignity.”

Indeed, your strategy of not acting until the pedophile has been proved 100 percent guilty and using the Torah as your guide to protect our mosdos is not new. As will be shown below this very same strategy was followed by many other rabbonim with disastrous results. Rabbi Shalom Yosef Elyashiv puts it best while writing about this very issue. Rabbi Elyashiv quotes the Rashba who writes in his Responsa, III no. 393, “… Because if you will adjudicate based only on the laws established by the Torah, society will be destroyed …” (emphasis added.)

Yes, we do need to stop “the terrible assault” and “immunize against a plague” of “insidious poison seeping in.” It is our duty to teach our children to “rise in their defense” and of course we must “give them the ammunition to fight back when they are attacked.” You and I differ only in our opinion of where the threat lies. You maintain with an impressive fervor that the threat lies with disrespectful bloggers. I respectfully disagree and see the threat to be that deadly minority of rabbeim who are morally corrupt and are destroying our children.

In your speech you alluded to the case of Rabbi Yehuda Kolko, a rebbe in Yeshiva Torah Temimah for over thirty-eight years. You express indignation that this one example of a pedophile that “slips through the fingers” is being used as an illustration of how Klal Yisroel behaves. Rabbi Salomon; unfortunately one is as one does. As such, this is who we are as a community today. Tragically, the story as depicted by the secular media in all its gory detail is but the tip of the proverbial iceberg.

The below bullet point history is general and merely touches upon events of the past forty years. If you want more details, I suggest you confer with Rabbi Ephraim Wachsman, who was employed by Kolko in Camp Ma-Na-Vu and will surely share his knowledge of events with you. Remind Rabbi Wachsman of his expression of remorse to his friends for not having informed his uncle, Rabbi Shloime Klein, of Kolko’s predilection for young boys when Rabbi Klein was embroiled in a difficult din Torah with Kolko and Rabbi Lipa Geldwirth in or around 1990.

A Partial Biography of Rabbi Yehuda Kolko & Rabbi Lipa Margulies

· 1967 – While working as dormitory counselor at Yeshivas Mir, Rabbi Yehuda Kolko calls David R. out of his dormitory room and begins discussing matters of a sexual nature with him while rubbing up against him in an aroused state. This abuse continues for the remainder of the school year and into the summer season at Camp Agudah. Mr. R. is now a Manhattan attorney living with his partner in New York City and insists that his lifestyle choice has absolutely nothing to do with his abuse by Kolko.

· 1969 thru 1971 - Rabbi Yehuda Kolko begins abusing Dovid Framowitz in Yeshiva Torah Vodaas of Flatbush (now known as Yeshiva Torah Temimah) and Camp Agudah, the details of which abuse are now public knowledge. Mr. Framowitz, a grandfather living in Eretz Yisroel, has not gone a day since being abused without reliving the unspeakable agony he suffered at Kolko’s hands.

· 1972 - Rabbi Yehuda Kolko sexually abuses two young campers (names withheld at the request of the victims) in Camp Agudah who complain to their counselor. Their counselor reports the complaint to Rabbi Simcha Kaufman. The abuse of these two boys cease for the remainder of that summer. Rabbi Simcha Kaufman is a co-worker of Kolko in Yeshiva Torah Temimah (more on Kaufman below) and was a co-worker of Kolko in Camp Agudah until 1976 when Kolko voluntarily left Camp Agudah after he co-founded Camp Ma-Na-Vu with Rabbi Lipa Geldwerth, another co-worker of his at Yeshiva Torah Temimah.

· 1977 – Rabbi Yehuda Kolko, employed as a rebbe in Yeshiva Torah Temimah in the morning, is employed in the afternoons by Yeshiva Karlin Stolin as secular studies principal. During the course of his short tenure in Yeshiva Karlin Stolin numerous complaints are lodged by both students and parents (names withheld at the request of the victims) accusing Kolko of sexually abusing boys in the Yeshiva. Rabbi Shmuel Dishon asks Kolko to leave the employ of the yeshiva.

· 1977 on – Eyewitness testimony and accusations of sexual abuse by Rabbi Yehuda Kolko of students at Yeshiva Torah Temimah and Camp Ma-Na-Vu reach a crescendo which culminates in several businessmen approaching Rabbi Lipa Margulies in 1984 and offering to fund a retirement package for Rabbi Yehuda Kolko provided he seeks employment away from children. Rabbi Lipa Margulies steadfastly refuses to accept the offer and suggests that those parents who disagree with his decision remove their children from his Yeshiva Torah Temimah.

· 1981 – Rabbi Yehuda Kolko sexually abuses a twelve year old student of Yeshiva Torah Temimah (name withheld at the request of the victim.) This victim publicizes the abuse and acts out, vandalizing Kolko’s home and car. Rabbi Lipa Margulies calls this victims father and warns him that if this activity does not stop his other children would be expelled from Yeshiva and the safety of his family could not be guaranteed. This victim is subsequently referred to Avrohom Mondrowitz for counseling.

· 1984 – As instructed by Rabbi Avigdor Miller, an askan calls for a meeting which takes place at the home of Rabbi Yakov Perlow (the Novominsker) and is attended by Rabbi Avrohom Pam, Rabbi Elya Svei, Rabbi Chaim Dov Keller, Rabbi Aharon Schechter, Rabbi Moshe Scheinerman, Rabbi Shea Fishman and Rabbi Yankel Bender. At this meeting, chaired by Rabbi Perlow, the askan discusses what is transpiring to innocent boys at the hands of rabbi pedophiles and requests that Torah Umesorah and the rabbonim issue a statement calling for their removal from chinuch. Rabbi Svei informs this askan that Torah Umesorah has consulted their attorneys who advised that for Torah Umesorah to admit knowledge of such abuse would subject Torah Umesorah, its staff, all its member schools and their staff to liability for not having reported their knowledge to the authorities earlier. Accordingly, Rabbi Elya Svei informs the askan, neither he nor Torah Umesorah will do anything about this problem.

· 1984 thru 1985 – At directed by Rabbi Avrohom Pam an askan approaches Rabbi Moshe Scheinerman and the two meet with Rabbi Shea (Joshua) Fishman in the office of Torah Umesorah. Both Scheinerman and Fishman neglect to inform this askan that Fishman had been instructed by Torah Umesorah’s lawyer to do nothing about this issue. Rabbi Fishman requests the names of Kolko’s victims and promises absolute confidentiality. Names are provided to Rabbi Fishman who begins his own investigation of the allegations. He meets with and speaks with several victims who pour their hearts out to him after he guarantees them confidentiality. Rabbi Shea Fishman promptly discloses all he has learned to Rabbi Lipa Margulies who in turn publicly disparages and discredits each and every one of those boys who were brave enough to step forward.

· 1985 – A follow up meeting takes place at the home of Rabbi Simcha Kaufman and includes Rabbi Kaufman, Rabbi Lipa Margulies, Rabbi Shea Fishman, an askan and an eyewitness. The eyewitness recounts his personal knowledge of Rabbi Kolko’s sexual abuse of boys and discusses the information he had gleaned from others. Rabbi Lipa Margulies insists that the charges are all fabrications and attacks the reputations of everyone involved in seeking the removal of Kolko from his Yeshiva Torah Temimah. Rabbi Shea Fishman subsequently informs anyone who asks that he can not deal with this issue as he is old (50 at the time) and will lose his job if he pursues this matter.

· 1985 – Rabbi Moshe Scheinerman is offered a lucrative and prestigious position as rav of a shul (a position he holds to this day) and is told that he must cease and desist from his actions against Yeshiva Torah Temimah rabbeim (his own words) which he promptly does. Scheinerman abandons ship explaining that it is not appropriate for a rabbi of his stature to deal with these matters. Rabbi Yehoshua Leiman takes over.

· 1985 - Rabbi Yehoshua Leiman and others continue their quest for a solution and convene a bais din for this purpose. This bais din, consisting of Rabbi Menashe Klein, Rabbi Yechezkel Roth, Rabbi Aharon Stein, Rabbi Moshe Stern and Rabbi Chaim Yankel Tauber, is scheduled to hear testimony for two days after which they will rule on how to proceed. This panel meets and hears testimony for one day. Shortly thereafter, Rabbi Moshe Stern states that he is unable to participate in any more sessions and this bais din is disbanded without further explanation. In a private conversation with one of the askanim, Rabbi Stern disclosed that he had been approached by Rabbi Lipa Margulies which resulted in the discontinuance of the din Torah.

· 1985 – Upon the dissolution of the above bais din, Rabbi Lipa Margulies retains Rabbi Pinchus Scheinberg to convene a second bais din for the purpose of clearing Rabbi Yehuda Kolko’s name. Rabbi Lipa Margulies then drafts Rabbi Friedman (the Tenka Rav) and Rabbi Shlomo Zalman Brown to serve on Rabbi Scheinberg’s bais din. Prior to convening the bais din, Rabbi Pinchus Scheinberg speaks with several of Kolko’s victims and asks them to describe what Kolko has done to them. Upon hearing the allegations Rabbi Scheinberg informs the boys that in the eyes of Halacha they had not been molested. Rabbi Scheinberg also calls the askanim and tells them to cease and desist in their attempts to remove Kolko from chinuch. Rabbi Avigdor Miller disagrees and instructs the askanim in no uncertain terms to do whatever must be done to protect children from Kolko.

. 1985 - Rabbi Pinchus Scheinberg convenes the bais din and takes the position that Rabbi Kolko has a chezkas kashrus absent any testimony by two adult witnesses to any single event. Rabbi Friedman takes the position that in light of the persistent rumors Rabbi Kolko must be kept away from children. Rabbi Brown ultimately concedes that there is no halachic evidence against Kolko and the din Torah is concluded. Rabbi Lipa Margulies insists that he has a psak from this bais din but to this day has refused to produce it. Regardless, it is of note that no victims testified before this bais din.

· 1987 – Rabbi Yehuda Kolko, having groomed a former first grade student of his for years, begins systematically sexually abusing this boy (name withheld at the request of the victim) both in and out of the Yeshiva Torah Temimah building. When this boy complains to Rabbi Lipa Margulies that his grades are slipping because Kolko is removing him from class almost daily, Margulies responds by slapping the boy across the face and throwing him out of his office. This young man is now living down south after obtaining a leave of absence from the U.S. Army.

· 2001 – Rabbi Yehuda Kolko, takes a young Yeshiva Torah Temimah student under his wing (name withheld at the request of the victim) and begins removing him from class for “special projects.” These special projects include the boy being sexually molested by Kolko in the basement of the yeshiva, in Rabbi Kolko’s car and in Rabbi Kolko’s private office, which Rabbi Lipa Margulies has conveniently equipped with its own private bathroom. This young man is currently in therapy and hopes to be able to recover enough to be able to get married and start a family.

· 2005 – Dovid Framowitz, after years of searching on the Internet, chances upon a post written by a blogger calling himself “ UOJ - the Un-Orthodox Jew” which makes reference to Rabbi Lipa Margulies harboring Rabbi Yehuda Kolko, a known pedophile, in his Yeshiva Torah Temimah. Dovid begins communicating with this blogger via e-mail who in turn posts Dovid’s story on his blog. Over the course of several months other victims of Kolko begin to step forward with their stories.

· January 2006 – Several askonim decide that this four decade long chillul Hashem must stop and approach both Rabbi Yehuda Kolko and Rabbi Lipa Margulies with a demand that Kolko be removed from Yeshiva Torah Temimah and Camp Silver Lake and further commit to spending the rest of his life in treatment and away from children. Both Kolko and Margulies refuse.

· February 2006 – A letter is drafted informing the public that Rabbi Yehuda Kolko is a dangerous pedophile and that Rabbi Lipa Margulies continues to employ him despite his knowledge of this fact. Copies of this draft letter are delivered to Kolko and Margulies. Both Kolko and Margulies are offered the opportunity to deal quietly with the issue and are informed that if they continue to refuse, the letter would be mass mailed to the entire community. Kolko responds by stating that “the matter has been taken care of” and Margulies responds by asking if anyone “thinks Kolko is still a threat” and declares “if anyone does not like the way I run my yeshiva let them not send their children to my yeshiva.” They refuse to comply and the letter is sent out in a mass mailing.

· February 2006 – Eli Greenwald, a graduate of Yeshiva and Mesivta Torah Temimah, son of one of the founders of the yeshiva and a parent in the yeshiva receives the letter and spends a few days investigating the matter. He calls Rabbi Yaakov Applegrad, the yeshiva’s administrator, and requests a meeting of the Vaad HaHorim in order to address this serious issue. Rabbi Applegrad informs him that there will be no meeting as the allegations are false and that he and Rabbi Margulies have the matter under control. Mr. Greenwald called Rabbi Lipa Margulies and makes the same request of him. Rabbi Margulies responds by shouting at him.

· February 17, 2006 – Eli Greenwald is served with a hazmana issued by Rabbi Yisroel Belsky calling him to a din Torah to answer the charge of hotzoas shem rah (a form of lashon hara) allegedly committed against Rabbi Yehuda Kolko. Mr. Greenwald responds on February 21, 2006, that he will appear for a din Torah before the Bais Din of America. To this day there has been no reply to Mr. Greenwald’s response by either Kolko or Rabbi Yisroel Belsky.

· February 2006 – An askan meets with Rabbi Yaakov Perlow and pleads with him to get involved in this matter. Rabbi Perlow refuses on the basis of his being a yachid and this being a tzibur matter. After being pressed further Rabbi Perlow takes his final stand that this is a Flatbush matter and as he is a Borough Park rabbi it would be unseemly for him to get involved in this matter.

· March 2006 – Rabbi Lipa Margulies reaches a standstill agreement with the askonim by committing to appear before a panel consisting of two rabbis and one frum lawyer, all three of whom had been chosen by him. Rabbi Lipa Margulies reneges on his promise to appear before this panel.

· March 23, 2006 – A hazmana to a din Torah is sent to Rabbi Yehuda Kolko, Rabbi Lipa Margulies and Yeshiva Torah Temimah summoning them to a din Torah before the Bais Din of Mechon L’Hoyroa or a bais din of ZBLA. The hazmana is ignored by all the defendants.

· March 30, 2006 – A second hazmana to a din Torah is sent to Rabbi Yehuda Kolko, Rabbi Lipa Margulies and Yeshiva Torah Temimah summoning them to a din Torah before the Bais Din of Mechon L’Hoyroa or a bais din of ZBLA. By fax sent on April 5, 2006, Rabbi Lipa Margulies responds to this hazmana stating he will not appear for a din Torah “without a prior determination of the charges against Rabbi Kolko.” Rabbi Kolko continues to ignore the hazmanas.

· April 6, 2006 – A third hazmana to a din Torah is sent to Rabbi Yehuda Kolko, Rabbi Lipa Margulies and Yeshiva Torah Temimah summoning them to a din Torah before the Bais Din of Mechon L’Hoyroa or a bais din of ZBLA. By fax sent on April 10, 2006, Rabbi Lipa Margulies responds to this hazmana by stating “the hazmonah that you sent to us was not a valid hazmonah.” Rabbi Kolko does not respond at all. It is of note that Rabbi Yehuda Kolko is still teaching in Yeshiva Torah Temimah while these exchange are taking place.

· May 4, 2006 – A lawsuit is filed in United States District Court: Eastern District of New York, naming Rabbi Yehuda Kolko; Yeshiva & Mesivta Torah Temimah, Inc. and Camp Agudah as defendants. Rabbi Yehuda Kolko remains in the classrooms of Yeshiva Torah Temimah.

· May 5, 2006 – Rabbi Simcha Kaufman approaches Dovid Framowitz and with tears in his eyes tells him that if only he had known what Rabbi Kolko was doing to him he would have put a stop to it. Of interest was Rabbi Simcha Kaufman’s complete denial of any prior knowledge of any accusation before Dovid Framowitz brought his lawsuit. Rabbi Simcha Kaufman pleads with Dovid to withdraw his lawsuit lest he hurt Rabbi Lipa Margulies and the yeshiva.

· May 10, 2006 – After being approached for comment on several occasions by Robert Kolker, a reporter for New York Magazine, and with a 5:00 p.m. printing deadline looming, Rabbi Lipa Margulies issues a statement through his attorney at 4:30 p.m. Beginning with a proclamation that Yeshiva Torah Temimah is the preeminent yeshiva in the world followed by an absolute denial of all the allegations, the statement concludes with an announcement that Rabbi Kolko has agreed to a “leave of absence” pending the resolution of this matter. Despite this claim, Rabbi Yehuda Kolko remains in the classrooms of Yeshiva Torah Temimah.

· May 12, 2006 – A second lawsuit is filed in United States District Court: Eastern District of New York naming Rabbi Yehuda Kolko; Yeshiva & Mesivta Torah Temimah, Inc. as defendants. Still, Rabbi Yehuda Kolko remains in the classrooms of Yeshiva Torah Temimah.

· May 15, 2006 – “On the Rabbi’s Knee – Do the Orthodox Jews Have a Catholic Priest Problem” a feature article in New York Magazine {nymag.com}, a publication with a circulation of three million, is published. Within days of the publication of the article and after thirty-eight years of committing unspeakable acts of perversion in Yeshiva Torah Temimah, Kolko leaves the classrooms of Yeshiva Torah Temimah. It was only after the magazine hit the newsstands that Margulies succumbed to pressure and removed Kolko from the classrooms of Yeshiva Torah Temimah.

· July 2006 – Over the vocal protest of many residents and with the help of his friend Rabbi Yaakov Applegrad, Rabbi Yehuda Kolko takes up summer residence at a home in Regency Estates in the Catskills. Despite the claim that Kolko was on a leave of absence from Yeshiva Torah Temimah, he continues working for Camp Silver Lake, Yeshiva Torah Temimah’s summer home. In addition, Kolko initiates and organizes a multi-camp excursion to Lake Compounce, a water park located in Connecticut, where he is seen frolicking with young boys in bathing suits. A media outcry ensues resulting in Kolko being banned from the park by its non-Jewish management. Astonishingly, in August Kolko organizes a second trip to Lake Compounce, which is attended by the same frum boys camps who participated in the July trip.

The above is but a sampling of the cases I am aware of. One need not be a great lamden to realize that I am aware of only a small percentage of Kolko’s abuse victims. As rachmonim b'nei rachmonim, it is unbearable to grasp the stunning extent of this catastrophe.

To all who decry the “chillul Hashem” the New York Magazine article resulted in, I say, embarrassing, yes, chillul Hashem, absolutely not! Indeed, it is ironic that this very article which has been condemned by many rabbis is what got you and them to belatedly acknowledge Kolko’s guilt. Apparently a mere forty years of kola d’lo posuk was not enough. Were the lawsuits and the magazine article the chillul Hashem?

No!

The decades long chillul Hashem is that of Margulies and Kolko’s actions coupled with the many decades of improper action and inaction by our rabbis and organizations. This was somewhat offset by the recent kiddush Hashem of the action taken by a few askonim. They who had the courage to do what had to be done to protect our children from the acts of monsters and the cowardice of our rabbis. All this I say with respect and reverence.

I lay no blame at your doorstep for the above; you come from another part of the world, did not participate in and have no first hand knowledge of these events. I merely ask you to understand the world of pain that Rabbi Yehuda Kolko and his enablers, with a special note of distinction going to Rabbi Lipa Margulies, have left in their wake. I respectfully question your judgment in showing respect and support for Rabbi Lipa Margulies without having done a thorough investigation of his history. Surely, l’maan yishmeu v’yirahu, a man such as Lipa Margulies must be publicly vilified; not chalila publicly honored by someone of your esteem.

I submit that despite the focus of your speech, this issue has nothing to do with a blogger or kavod ha'Torah. That he fell into this issue and “b’makom sheain ish” he chose to “hishtadail lehios ish” and participate in pushing it forward, is a sad commentary on the egregious failures of our leadership.

Rather, the issue is the still unanswered question of where our leaders were all these decades while Rabbi Yehuda Kolko and Rabbi Lipa Margulies were savaging our children?

I ask with humility; how can you stand in front of us in good faith and turn this into an issue of kavod ha'Torah? I ask that you hear the constant cries of anguish laden souls destroyed by chronic inaction coupled with a misguided concern for the “dignity” of rabbis who molest children.

This is not a tale of something that somehow “slips through the fingers” but rather only one of many glaring examples of what occurs in a community whose leaders are unwilling to deal with an issue that sits under a spotlight for four decades and engulfs the souls of countless innocent children. Hashem yerachaim.

As parents we have every right to expect that accusations of sexual abuse by a rebbe be first verified post haste and then publicized so that we may protect our children from this predator and make informed decisions about where to send our children to yeshiva. In the face of pikuach nefesh; cries of kavod ha'Torah, chillul Hashem and loshon harah have no relevance. To resort to such cries is simply am ha'aretzes and violates the precept not to be a merachaim al ha'achzor. The issue all of us need to address, lay people and rabbis alike, is why nothing was done for so many decades and what lessons we can learn from our past mistakes to prevent future catastrophes of this nature.

Shooter --- Major Malik Nadal Hasan - [Unlikely To Be Amish]


FORT HOOD, Texas – An Army officer opened fire Thursday with two handguns at the Fort Hood military base in an attack that left 12 people dead and 31 wounded. Authorities captured the gunman and apprehended two other soldiers in what appears to be the worst mass shooting at a U.S. military base.

There was no immediate word on a motive. The shooting began around 1:30 p.m., said Lt. Gen. Bob Cone at Fort Hood. He said all the casualties took place at the base's Soldier Readiness Center, where soldiers who are about to be deployed or who are returning undergo medical screening.

"It's a terrible tragedy. It's stunning," Cone said.

A law enforcement official identified the shooting suspect as Army Maj. Malik Nadal Hasan. The official said Hasan, believed to be in his late 30s, was captured after opening fire at the base. The official spoke on condition of anonymity because he was not authorized to discuss the case publicly.

A defense official, also speaking on condition of anonymity, said Hasan was a mental health professional — an Army psychologist or psychiatrist. Officials say it was not clear what Hasan's religion was, but investigators are trying to determine if Hasan was his birth name or if he may have changed his name and converted to Islam at some point.

Defections, court fights test Scientology

The Church of Scientology is going through a difficult season.

Over the course of two days last week, a French court convicted the church of fraud and Oscar-winning filmmaker Paul Haggis' resignation from the church over a litany of concerns was aired publicly. On one hand, it was just another bad press week for the embattled institution founded in 1953 by the late science fiction writer L. Ron Hubbard.

But for former Scientologists and scholars of the movement, the setbacks pose a greater challenge coming on the heels of defections of top-level Scientologists who lifted a veil of secrecy on the organization and alleged a culture of violence and control under Hubbard's successor, David Miscavige.

"With any organization, the loss of a substantial number of your most experienced people and chaos at the upper levels is problematic," said David Bromley, a Virginia Commonwealth University professor who studies new religious movements and has written on Scientology. "There are PR implications, the possibility of legal actions ... That dwarfs the other things."

The church has strenuously denied the allegations against Miscavige, portraying the accusers as lying disgruntled ex-employees.

Church spokesman Tommy Davis said Scientology is flourishing, with more than 8,000 Scientology churches, missions and groups in 160-plus nations. He said assets and property holdings have doubled over the past five years, including a new church in Rome and another opening this weekend in Washington, D.C.

"From our perspective, things are going pretty great," Davis said. "In fact, that's downplaying it. Actually, what's happening with the church right now is frankly spectacular. To the degree there are these various things happening, it really is a lot of noise."

One major survey of American religion shows Scientology declining in the U.S., however. The estimated number of Americans who identify as Scientologists rose from 45,000 in 1990 to 55,000 in 2001, then plummeted to 25,000 in 2008, according to the American Religion Identification Survey.

Davis said that while the church avoids membership estimates, it's "absolutely in the millions" globally and growing in the U.S.

Scientology has long been controversial. The Internal Revenue Service granted the church tax exemption in 1993 after a nearly four-decade battle over whether it should be considered a religion. Critics say Scientology is a business, preying on people by charging exorbitant sums for services.

The church continues to fascinate, fueled by interest in celebrity adherents such as Tom Cruise, John Travolta and Kirstie Alley, as well as beliefs that don't fit into typical American religious boxes.

Hubbard taught that the "thetan," the equivalent of a spirit, can be cleared of negative energy from this and previous lives through a process called auditing. With the aid of auditors, Scientologists seek a state called "Clear" and then advance through various levels of "Operating Thetan."

The allegations of violence were leveled by four former high-ranking Scientology executives who told their stories to the St. Petersburg Times last summer. The executives said they witnessed Miscavige, chairman of the board that oversees the church, hit staff members dozens of times and urged others to do the same.

Davis called the allegations "absolutely, unquestionably false" and "sickening and outrageous." ABC's "Nightline" aired a report this month covering much of the same ground.

To critics of Scientology and ex-members who have grown increasingly vocal in recent years, it's a breakthrough — critical voices from former members of the inner circle, not the media or outsiders.

"When you have dozens of people speaking out, it's no longer too credible to say they're all malcontents and criminals," said Jeff Hawkins, a former Scientology marketing guru who defected in 2005. "(The church) is either going to reform or collapse, and I think it's going to be the latter because they're incapable of reform or admitting any wrongdoing."

One defector, Marty Rathbun, who served on the church's board and was a top lieutenant of Miscavige's, said a growing movement of people hold to the tenets of Scientology, but reject the institutional church.

"I don't foresee another church," Rathbun said. "That was the first attack on me — that this was a coup, that I'm trying to tap a schism or start another church ... That's not an objective of mine or a positive way to go."

Haggis, the Oscar-winning director of "Crash," was not a high-ranking Scientologist. But his defection is significant, said actor Jason Beghe, who left the church in 2007 and has become a critic.

"He was somebody the Scientology community was proud of, and therefore I'm sure he helped hold some of their base in place," said Beghe, who appeared in the film "G.I. Jane" and TV's "Everwood" and is cast in Haggis' next film, now shooting in Pittsburgh. "Anybody who is a Scientologist is harboring doubts."

It was Rathbun who obtained a copy of Haggis' critical letter to Davis and posted it on his blog. Haggis complained that Davis didn't do enough to distance Scientology from proponents of California's gay marriage ban. He criticized the church's "smearing" of the high-level defectors.

The filmmaker also wrote about the church's practice of "disconnection," in which members cut off contact with loved ones who leave or advocate against the religion — something Davis said is not mandated.

A day after Haggis' letter went public, a Paris court convicted the Church of Scientology of fraud and fined it more than $900,000, but stopped short of banning the group's activities in France. The organization's French branch likened it to a modern-day Inquisition and said it would appeal.

Davis questioned the attention paid to the French verdict, saying that little notice was given when the church won court victories in Italy and Russia that cemented the church's presence in those countries. He said the top-level defections are not troubling, but rather a gain for the church.

Some scholars of Scientology believe the recent setbacks are momentary.

Defectors are overly optimistic about doing any real damage, said J. Gordon Melton, director of the Institute for the Study of American Religion in Santa Barbara, Calif., and editor of a book on Scientology.

"If five cardinals walked out of the Roman Catholic Church and turned on it and said there are bad things happening, it'd be a storm, but the church would weather the storm," Melton said. "I think Scientology is big enough to where it can and will weather the storm."

Most religions, Scientology included, experience disagreement and leadership turmoil after a founder's death and survive, said Susan Palmer, a religious studies professor at Dawson College in Montreal.

"I think they'll end up like the Mormon church or Jehovah's Witnesses, that were very controversial in our time but now are largely accepted," Palmer said.

Others think the Church of Scientology is in trouble. Along with the defections and French court setback, Scientology has been unable to stop Internet leaks of confidential material that members must pay a premium for, said Hugh Urban, a professor in the department of comparative studies at Ohio State University.

"They're really losing what has been the bread and butter," Urban said.

Meanwhile, an online betting parlor is taking wagers on the next celebrity Scientologist to leave.

On Abuse, the Catholic Church’s Progress

Archbishop Silvano Tomasi, the Vatican’s representative to United Nations organizations in Geneva, noted that the Catholic Church has been “cleaning its own house” and that other institutions “could do the same” (“Vatican’s New Defense on Child Molestation Charges: Finger-pointing,” October 16).

There is validity to his statement.

While the Catholic Church was dragged kicking and screaming — and the architects of change were the media and Catholic laypeople — there’s no denying that today’s church is different.

The U.S. Conference of Catholic Bishops issued a Charter for the Protection of Children that requires counseling for child sex-abuse victims; mandatory reporting to “public authorities” of all child sex-abuse complaints; permanent removal from ministry of any priest or deacon found guilty of even one act of sex abuse, no matter when committed; a mandatory “safe environment” for all youth programs, and mandatory background checks for church personnel.

Outstanding lay groups like Survivors’ Network of those Abused by Priests and Voice of the Faithful make sure these policies are implemented.

The sad and even ugly truth is that after all the recent headlines, arrests and convictions resulting from abuse scandals, no comparable system exists for American yeshivas. Our ancient rabbis teach, “We should believe there is wisdom among the nations of the world.” This lesson needs to be applied to present-day circumstances.

I suppose nobody likes criticism from outside their own religious or cultural milieu, but facts are facts, and truth is essential if genuine and constructive change is going to occur in the Jewish world.

Here's a truly heartwarming story about the bond formed between a little 5-year-old girl and some construction workers that will make you believe that we all can make a difference when we give a child the gift of our time.

A young family moved into a house, next to a vacant lot. One day, a construction crew turned up to start building a house on the empty lot.

The young family's 5-year-old daughter naturally took an interest in all the activity going on next door and spent much of each day observing the workers.

Eventually the construction crew, all of them "gems-in-the-rough," more or less, adopted her as a kind of project mascot. They chatted with her, let her sit with them while they had coffee and lunch breaks, and gave her little jobs to do here and there to make her feel important.

At the end of the first week, they even presented her with a pay envelope containing ten dollars. The little girl took this home to her mother who suggested that she take her ten dollars "pay" she'd received to the bank the next day to start a savings account.

When the girl and her mom got to the bank, the teller was equally impressed and asked the little girl how she had come by her very own pay check at such a young age. The little girl proudly replied, "I worked last week with a real construction crew building the new house next door to us."

"Oh my goodness gracious," said the teller, "and will you be working on the house again this week, too?"

The little girl replied, "I will, if those a**holes at Home Depot ever deliver the damn sheet rock...."

Kind of brings a tear to the eye - doesn't it?

Kosher craze sweeping U.S.

Major food manufacturers, grocery chains compete for 9 billion dollar kosher market; analysts say market for kosher products growing at 15 percent per year

When U.S. supermarket giant Albertsons hired Yaakov Yarmove more than three years ago, the company found a point man to navigate what might seem like an unlikely market for a grocery chain with stores in places like Cheyenne, Wyo., and Evanston, Ill.: kosher food.

Albertsons, one of America's largest grocery chains, has since dramatically expanded kosher aisles at hundreds of its supermarkets across the country.

The company has also launched more than two dozen kosher destination stores that include everything from bakeries to delis.

"There's a kosher awakening," said Yarmove, an observant Jew who is Albertson's corporate kosher, marketing and operations manager.

"Kosher was perceived as scary and foreign. Now it's perceived as chic. I think everybody is realizing that there is an opportunity," he added.

Bringing matzah to church

The Idaho-based Albertsons is just one of many companies around the country competing to get a lucrative slice of an approximately USD9 billion kosher industry that is growing at a rate of 15 percent a year.

Experts say the boom is being fueled by several factors, including vegetarians and younger customers looking for healthier and safer food – the same demographic that has helped the organic market take off. Plenty of these customers are not Jewish.

"When I take the matzahs to the church, they love it," said Ursula Torres, of Manhattan, who was buying 100 percent wheat matzos recently at Streit's, a Jewish landmark on New York's Lower East Side.

Marcia Mogelonsky, a senior research analyst with Mintel International Group, a Chicago-based consulting firm, recently completed a nationwide study in April that produced some surprising results about the kosher craze.

She found 55 percent of the people who buy kosher products believed the food was better for them – almost double the number in a similar study Mogelonsky conducted in 2003.

"They trust the kosher symbol like they'd trust the Good Housekeeping seal," she said.

Part of the trust, Mogelonsky said, is derived from how the animals are raised. There is a popularly-held myth that Jewish law forbids the use of antibiotics, additives, hormones or feeding animal byproducts to animals raised for kosher slaughter. But Jewish law has no such regulations.

Jewish for 'good food'

Manischewitz, one of the best-known kosher food companies in the world, is developing an advertising campaign that says their name is "Jewish for good food."

Hebrew National, a division of ConAgra Foods, has always touted that famous tagline found on its packages: "We answer to a higher authority." But over the summer, the company decided to move the "Finest Kosher Quality" seal to a more prominent spot on certain product packaging.

Lou Nieto, president of packaged meats at ConAgra, said two things are driving the double-digit growth at Hebrew National, which recently opened a new state-of-the-art kosher facility in Michigan.

"First and foremost is taste but number two is that it's 100 percent kosher beef – nothing artificial," said Nieto, who oversees the Hebrew National brand.

He added that sales were being bolstered by non-Jewish customers, who devour the company's popular hot dogs at hundreds of venues across the United States.

To meet demand, the industry has undergone radical changes, recognizing that kosher food is more than matzo, gefilte fish and borscht.

The transformation was on display last month in New York at Kosherfest 2005, a convention that drew more than 6,100 retail and foodservice buyers, manufacturers and distributors from 36 countries.

"Anything that can be made kosher, is being made kosher," said Menachem Lubinsky, who founded Kosherfest. "Even the Chinese are going kosher."

Kosher dumpling wrappers – no problem. Asian sesame ginger noodle and Thai chili sauce? They got it. Italian kosher. It's in abundance. Penne rigate, lasagna, angel hair, and all enriched with soy protein. There is also a kosher energy drink called "Kabbalah."

And it seemed like almost everyone was selling humous, creating a war of the chick pea. If any one food is leading the kosher charge, it might be humous.

One of the biggest humous makers is Sabra Go Mediterranean, produced by Blue & White Food Products in New York.

"Today, all the hippies buy this stuff," said Nissim Ohana, who distributes Sabra products and has been selling kosher food for 20 years in the United States. "Humous has become a very hot item.

At Streit's, the venerable New York company is adapting to the changing environment, producing Mediterranean, Spelt and five-grain matzos, along with spreads like sundried tomato morsels.

"Chains carry it," said Alan Adler, director of operations at Streit's, which has been making matzos since 1925. "Our products are on the shelf year round. We are having trouble baking enough matzos."

In two decades, Ohana, an Israeli, has seen the number of Brooklyn stores purchasing his kosher food rise from 16 to more than 200.

"Five years ago, it wouldn't have sold," said Frank Widdi of Met Foodmarkets in Brooklyn. Widdi, a Palestinian, now has two separate refrigerators with humous, including one for Sabra which he gets from Ohana.

Rabbis Rule Romaine Lettuce Off Limits to Kosher Consumers

A cross-section of Orthodox rabbis ruled last week that “it is forbidden” to eat romaine lettuce and several other packaged vegetables, including Spring Mix and Baby Spinach, because of insect infestation. The 30 rabbis, however, noted that “this prohibition does not apply to iceberg lettuce, cabbage or greenhouse vegetables provided they are under a reliable, expert hashgacha.” According to several rabbis reached by Kosher Today, a key target of the edict published in many Jewish newspapers was Fresh Express, whose certifying rabbis have since withdrawn their certification. A spokesman for the Orthodox Union said that while the US grown romaine lettuce was off limits, it approved the romaine lettuce grown in hothouses by Alei Katif, which after having being evicted from the Gaza Strip was said to have resumed production in Israel’s Negev Desert. The letter by the rabbis singled out pre-washed romaine lettuce, romaine hearts, romaine mixes (European, Italian, Greener Selection) and Fresh Leafy Salads (such as Spring Mix and Baby Spinach).

The letter noted: “It is unfortunately our duty to inform you that insect infestation was found in most packages, regardless of the company or the supervising authority…Caterers, restaurants and stores that offer these products are guilty of offering food that is forbidden by Torah law.”

The OU lead by Yisroel Belsky was on the attack. The Star-K, Moshe Heinneman's organization was permitting it. As we can see from the numbers, "Kosher" is a multi-billion dollar business.

Moshe Heinneman was relying on a p'sak "he said" was told to him by Rabbi Aron Kotler z"l. UOJ called the Kotler & Schwartzman families and none of them knew of this psak by RAK, which would permit eating lettuce that normally had bug infestation in excess of ten percent of the time checked; providing that a particular batch of lettuce was checked and found bug free.

In other words, Heinnemann claims RAK told him you can go by a particular batch; if there is less than ten percent of bugs found, you may eat them. The OU and gang, say you go by the type of vegetable, if generally there are bugs, you must clean them all or throw them out.

I called Heinneman and asked him the following.

1-When did RAK tell you about this p'sak?
2-How old were you at the time of the p'sak?
3-Why would you have asked this shaila, if the shaila of bugs in Romaine lettuce was on no one's radar screen in the early sixties?(thinking he had asked him in the sixties)

Moshe Heinneman is 67 years old, RAK was niftar in 1962. Assuming Heinemann asked him the shaila that "no one knows about" in 1962, that would put Heinemann at 24 years old. The problem is Heinemann said he asked RAK this shaila the year he came to Lakewood, when he was 18 years old. Counting backwards, this would be circa 1956.

Who in the world was thinking about bugs in lettuce in 1956?????

The whole bug "epidemic" is maybe ten years old!!!

The OU is losing market share to Heinemann, they seem way to eager to do him in. Heinemann's p'sak from RAK sounds really questionable to me at best, and a lie at worst.

The unrelenting torrent of criticism of our failure to reformulate our approach is taking its toll. We are putting a brave face on it and we could probably continue in this way for a while. But if it persists long enough the damage will intensify and it may be too late to recover.

Accordingly I am writing this memo to you as a first step toward revising our approach before it is too late. Knowing how sensitive this issue is I used a typewriter and there are a limited number of copies in existence. Please burn yours after you finish reading it.

At the core of our problems is the Internet, especially the blogs such UOJ and FM as well as Polin’s Awareness Center. For a long time it was a “he said, he said” kind of situation. But now some of the old charges have been substantiated. As you and I know, more of those charges will be substantiated. Alas, Charles Hynes, Brookly DA, will be much less willing to take our word on dropping charges. Now some of the victimized girls are also talking. And some of them like little sheffele have stories that are so heartbreaking and yet so full of emunah. That sort of thing may be even more dangerous than UOJ which we try to discredit because of nivul peh.

Blogs (many anonymous) keep on opening. More of them are by individuals who are careful to make it appear like they are definitely frum. It is very hard to discredit them unless we have verifiable dirt on them. If we accuse them falsely they can choose to throw off their cloak of anonymity and then we are really up the creek. Moreover the anonymous one are less likely to be OTD. We know Shmarya is OTD but I suspect UOJ is not. Stripping UOJ of his anonymity it would be risky. Then he will be a real face and name, and that would be even worse for us because he clearly knows where many of the bodies are buried and I am afraid he has more dirt than he has dished out.

This is hurting us with contributors. Of course publicly, we are blaming the recession. Publicly I blame the drop in contributions on the economy. But serveral big givers have told me why they have stopped giving to us. I have confirmed that some of these people are giving the same or more to other groups. One fellow has dropped us and instead gives the money to SFJ.

Survivors for Justice is out there and it is hard to find any dirt on them. I am still looking. I wont give up, but I have to tell you I am pessimistic. Between you and me, we are just stuck with too many ehrliche yidn.

As if Rabbi Blau at YU was not bad enough now we are faced with Rabbi Eisenman at Ahavas Israel in Passaic. He got his smichah at YU but he is morphing into a hassid. If he has a specific Rebbe and we can identify him we might be able to pressure him. But he may be like Mr Mendlowitz, whose Rebbe was the Ribono shel olam. He clearly has a congregation which adores him and he commands great respect in his community.

Listen to the victims even if they are OTD because they didn’t leave us, we left them by ignoring their pleas.

Listen to complaints even if you can’t prove the truthfulness because it may be the truth. Usually when someone complains there is some real problem.

That al chet for giluy arayos applies to the community’s response to the problem and that ubiartem es harah mikirbechah (you shall eradicate the evil among us) applies to this problem in our community.

That the Gerer rebbe “isn’t God” and he is protecting a molester (Mondrowitz) and congregants should refuse to support them. (He was saying this before the latest Litzman scandal.

Eisenman has just gotten started and a few others like him may emerge. It is true that most congregational rabbis are clueless or easily intimidated. However, the frum world is one big network and as congregants in other shuls speak to his congregants they will start pressuring their rabbis to do more. This will only lead to uncovering more and more cases and stoking congregational anger. We will lose more ground with our olam once they start hearing these stories from kids in their own community.

I think we can anticipate what happens next by looking at the Catholic Church. It is like Watergate, at some point the question became, who knew and who was involved in the cover-up. Unfortunately for the catholics there is a large written trail. Whereas in our community it will be more complicated and ambiguous and people will start blaming each other for either misrepresenting the facts presented to rabbonim, or blaming rabbonim for forbidding mesirah, even when it should have been allow because of the danger to the children. Of course we will keep using the business of not knowing all this data about recividism among pedophiles. But this excuse is double edged, even as it dilutes responsibility it also reduces our credibility as competent leaders.

My ultimate fear is that several Moetzes leaders will break ranks and go public with some very serious charges and facts. It is just bound to happen once the Moetzes realizes that there are no more intermediate scapegoats left. It is the old sinking ship problem. Unfortunately that will probably be the end our influence. Because it is hard to argue for the clear demands of Daas Torah when there are seventy faces to Daas Torah.

I don’t see a solution, but I do see a way to buy time by serving up a few scapegoats from within the Moetzes. Ideally we will actually find a pedophile and find a way to claim he was our point person and he misled us. I know of no one who fits the bill, but it is quite possible we will discover someone with all the victims coming forward.

Unless we get lucky in finding our scapegoat our next best strategy is finding out which members of the Moetzes are most likely to come forward and find a way to scapegoat them and thus discredit them. The problem if figuring out who is most likely to suffer from a troubled conscience and who has the most dirt. Unfortunately we have a culture of conformity that makes it hard to know who on the inside is disgusted enough to come forward.

I have only one practical solution for the short term. It is similar to Mao’s thousand flowers shtick. He was one smart goy. Here is how he worked it. After a period where everyone was cowed into conformity, he announced, let a thousand flowers bloom. He encouraged all sorts of public expressions and practices. Then he stopped a thousand flowers but he knew who the troublemakers were and he pushed them out of power or and in many cases, out of the window.

I would suggest something along those lines called elef prachim, or pirchei for short in all of our future communications. B It borrows from what we did with the Spinka Rebbe over tax fraud. It was truly impressive. We had him saying chatassi for causing a big chillul hashem, without ever saying “I lied” His reference to lawyers and accountants was ambiguous enough so at sentencing he could imply that he was advocating compliance while others could read it as use lawyers and accountants so you don’t get caught. Finally the Yekkes could think, true it isn’t enough but it shows us that the Agudah is moving in the right direction.

For the problem we are talking about, we could arrange a big public event. Find someone to say chatassi, only admitting he should have gone to even more meetings. He could point out that we now have frum therapists at Ohel, and make some strong statements of sympathy for those who have been hurt. He might even announce a plan for an accelerated learning program to culminate in a siyum with a special kavannah for those who suffered. The beauty of this program is that we can canvass broadly for all sorts of support for this effort and seek advice on what to raise and how far to go. Those inside who have been fooling us by not showing their disloyalty will come out of the woodwork. We will give them just enough hope that we can change even if they don’t come forward. Then we can go to work on a gradual campaign to discredit them. They will try to complain that rumors are spread about them because of their concerns about child abuse. But if they havent yet come out strongly on the issue, no one will believe that argument. Naturally, the rabbonim themselves will never explicitly know about the true pirchei project and agenda. But quite a few of them are very smart. If my past experience is any guide that will give me free hand and stay above it all. Like the goy detective said during the Watergate hearings. “I knew something wasn’t kosher.” Our rabbonim can see an aphid on a broccoli from 2000 ammos so of course they will suspect something. But if they were the kind of people who insisted on acting on their suspicions we wouldn’t be in this matzav.

I expect to be working on this project for a while. I will let you know how it progresses.

I think this approach may just buy us enough time to come up with something better for the long haul. But between us, I am hedging my bets and beginning to build a private lobbying and consulting practice.

Orthodox Jews Shielding Child Sex-Abusers!

A New York State Supreme Court judge has criticised the Orthodox community for shielding perpetrators of sexual abuse while persecuting victims.

Judge Gustin Reichbach lamented the community’s “circle-the-wagons attitude” as he sentenced Yona Weinberg, a barmitzvah tutor and social worker from Brooklyn, to 13 months in jail for molesting two boys.

At the sentencing earlier this month, the courtroom was filled with Weinberg’s supporters. Almost 100 members of the Orthodox community wrote letters to the judge defending him.

Judge Reichbach lamented that no letters displayed “any concern or even any acknowledgement for these young victims which, frankly, I find shameful”. Rather, the community “seeks to blame, indeed punish, victims who seek justice from... civil society”.

Sexual abuse has become a highly contentious issue in the US Orthodox community following a string of cases involving well-known teachers and rabbis. Over the past year, 26 strictly Orthodox men have been arrested in Brooklyn in child sexual abuse cases; eight have been convicted and 18 await trial.

The strictly Orthodox are statistically no more likely to experience sexual abuse than any other group. But the problem is often exacerbated because there is pressure on victims not to go to the police, due to a suspicion of secular society and a fear of bringing shame on the community. In some cases, parents worry that revealing abuse might harm chances of a shidduch. Meanwhile, some community leaders prefer to act solely through a beth din.

However, the timing of Judge Reichbach’s comments may be ironic, as some see signs that the taboo against reporting sexual abuse is beginning to fade. NY state Assemblyman Dov Hikind became involved in the issue 15 months ago. He says many people in the community have overcome the stigma associated with abuse and are openly discussing it.

“There has been an improvement, no question about it,” says Mr Hikind. “The fact that people are acting is a huge accomplishment, but we have an even longer way to go.”

This year, more than 40 minors have agreed to testify about abuse in court.

David Zwiebel, executive vice president of the Charedi group Agudath Israel of America, told the New York Times this week that “A broad consensus has emerged that many of these issues are beyond the ability of the community to handle internally.”

In the past, victims who have spoken out have faced ostracism, as well as verbal and physical threats.

One victim, Shua Finkelstein, died of an overdose at the beginning of this year. His parents later discovered a letter he had written criticising the community for not confronting abuse, which they published online. Soon afterwards, their New Jersey home was damaged in a suspected arson attack.

Yona Weinberg joins a list of recent high-profile court cases involving Orthodox Jews. Last year, Rabbi Yehuda Kolko, a teacher at Yeshiva Torah Temimah in Brooklyn, struck a plea deal with the Brooklyn district attorney. To campaigners’ dismay, Kolko pleaded guilty to two counts of child endangerment, ducking a jail sentence and avoiding registration as a sex offender.

Meanwhile, Rabbi Avrohom Reichman, a principal at the United Talmudic Academy in Williamsburg, is currently the subject of a civil lawsuit filed by Joel Engleman, who claims he was molested during the 1990s.

Rabbi Avrohom Mondrowitz, who fled to Israel from New York in 1984 to avoid prosecution for sexual abuse, continues to fight extradition.

Mark Weiss, who says he was abused by Mondrowitz in the late 1970s, blames community leaders for the support shown to Weinberg and others like him. Mr Weiss says that “otherwise good, warmhearted, caring people are suddenly reprogrammed to defy all logic”, when they are told that they must defend the community from a chilul hashem — disgracing god’s name — by standing up for the accused.

“It’s a disgrace that our community has to get chastised by someone like Judge Reichbach, but he’s 100 per cent right,” he added. “This is about the Orthodox leadership’s control over people.”

Child abuse: when family courts get it wrong!

San Rafael, Calif – When a parent harms his or her own child, family courts are supposed to step in and safeguard the victim.

Can you imagine what a tragedy it would be if courts awarded custody to the wrong parent – the abuser?

Actually, according to one conservative estimate, more than 58,000 children per year are ordered by family courts into unsupervised contact with physically or sexually abusive parents following divorce in the United States.

The fact that this type of scandal is taking place in the American justice system defies the imagination. Not since the Roman Catholic Church pedophile scandal has the US seen this level of institutional harm inflicted on innocent children.

Consider the case of Jonea Rogers, a hairstylist from Marin County, Calif. During her costly divorce, she sought help from numerous law enforcement, child protection, and family court authorities to protect her daughter from what medical evidence and reports by the child and her baby sitter suggested could be ongoing neglect or sexual abuse or both by the girl's father or grandfather.

None of the authorities she approached would effectively intervene to protect her daughter. So in 2000, Ms. Rogers eventually felt that she had no choice but to flee with her child to protect her.

More than three years later, this protective mother was caught and jailed for five months, while her daughter was immediately handed over to her alleged abusers. Rogers faced criminal charges for violating a court order by fleeing with her child. After considering the evidence in her case, a jury of her peers completely exonerated her of all wrongdoing.

The very same evidence that exonerated her in the criminal court had been called "frivolous" by the family court judge and disregarded. Despite her acquittal, Rogers was never granted custody of her daughter, who lives with her alleged abusers to this day. She is now forced to pay a fee to visit with her daughter a few times a month in a supervised visitation facility.

As we see in many cases across the country, even when physical or sexual abuse of children is alleged during a divorce, American family courts routinely award custody to the parent with an established record of domestic violence restraining orders, child abuse, neglect, alcoholism, addiction, dangerous mental illness, or a combination.

Meanwhile, the child's other parent, commonly referred to as the "protective parent," is typically demonized by court professionals as an "alienator" for bringing evidence of child abuse to the court's attention.

This happens because the reigning paradigm in family courts across the country is an unscientific, discredited theory known as "Parental Alienation Syndrome," or PAS.

PAS and its many derivatives suggest that the parent who asks the court to protect his or her child by limiting the alleged abuser's access to that child is "alienating" the child from the other parent.

The theory suggests that a parent "coaches" a son or daughter to fabricate false abuse allegations, and the court's attention immediately shifts away from investigating an alleged crime and instead focuses on the "uncooperative parent" who refuses to share custody of the child with the alleged abuser or molester.

PAS is tricky for the courts because parents in heated custody battles often badmouth each other and sometimes exaggerate claims of neglect, and children overhear their parents complaints about each other. Though rare, false allegations of abuse do occur. Research on child sexual abuse indicates that close to 98 percent of children who claim sexual abuse in the context of a high conflict divorce are telling the truth, yet family courts routinely proceed as if the opposite were true.

Protective parents not only lose custody of the children they are trying to protect, but they lose their life savings, too. Many cannot even afford a lawyer to represent their interests, but are saddled with hefty supervised visitation fees and often threatened with a loss of custody if they object to paying the bevy of court-appointed experts that the judge assigns to their case.

Fees quickly add up to tens or even hundreds of thousands of dollars. Many such parents go bankrupt, making court appeals impossible. The family law "machine" operates as Big Business, and a sophisticated cottage industry has sprung up that appears to be preying on desperate parents and children who are trying to escape family violence.

Four factors conspire against protective parents:

1. Family law judges are granted broad discretion in their decisionmaking;

2. Juries are nonexistent in most family law courtrooms;

3. Costly appeals are out of reach for most litigants; and

4. Children are not afforded a voice in these important proceedings that determine their future. As a result, nothing short of a major overhaul of the family court system will suffice.

Here in California, home to some of the most egregious cases, the Center for Judicial Excellence and its partner organizations in the Safe Child Coalition recently worked with State Sen. Mark Leno (D) of San Francisco to unanimously pass an audit request through the California legislature to address this growing problem.

The request asks the state auditor to investigate the procedures used by family courts to appoint, train, evaluate, and discipline the plethora of professionals they use in cases in Marin and Sacramento counties.

The legislature should also pass two sensible bills in 2010. Assemblyman Jim Beall (D) of San Jose has proposed a bill that would outlaw PAS in state family courts, and a bill by Assemblywoman Fiona Ma (D) of San Francisco would allow children to have a voice in family court proceedings.

Other states must open their eyes to this problem. Family courts are being manipulated in ways that tragically undermine their mission.

We must ensure access to justice for all who find themselves in our nation's family courts. There are at least 58,000 reasons to get serious about reform today.

Leib Tropper Delusional Sociopath - Eternal Jewish Family Fraud - Part Two

Tropper tries to overcome isolation in Monsey.

There are a few reasons why R Nochum Eisenstein of Israel would need Tropper. Tropper has access to big bucks. He could and did assemble the big rabbis and promote Eisenstein cause. But it backfired when Eisenstein used his time on the EJF stage to attack some of the RCA type rabbis there, causing them to cut all ties to Tropper and EJF that they may have contemplated. But the real crux of the issues between Tropper and Eisenstein stems from the schizophrenic aims of EJF itself. Tropper has an outreach type of agenda to convert as many gentiles that fall into EJF hands while he also preaches a doctrine of "universal standards" meaning the highest possible chumras in geirut. Tropper is able to flip back and forth and use both as arguments when one fails he uses the other. Whatever works. While on the other hand R Eisenstein does not give a crap about converting anyone. If he had his way he would pull the conversions of all converts except a handful he knows about.

He proved this when he orchestrated with Rabbi Sherman in Israel the annulment of nearly 17,000 conversions that had been performed by Rabbi Druckman's Religious Zionist Batei Din of the Israeli governemnt's sanctioned Conversion Authority. So while Eisenstein's frame of reference is the ongoing conversions machlokesen in Israel, Tropper's focus is about taking his personal philosophy outreach and self-grandeur to a new level by reaching out to gentiles who want to convert many from intermarriages. Eisenstein hates this and has tried to stamp it out but he cannot because it was a pet project of Guma Aguiar and Tom Kaplan who were funding EJF and Tropper to the tune of tens of millions of dollars and making the haredi bigs come and pay attention at the EJF conferences in the first place and now it's what Tom Kaplan alone is funding, so Tropper has no choice if he wants Kaplan's millions to keep on flowing into his EJF and other coffers, but Eisenstein couldn't give a darn about Kaplan or Tropper's "great leader with blind disciples converting the world like a fake messiah" befitting Shabtai Tzvi meshugasen.

So to keep his own visions of grandeur rolling Tropper has tried to break out from isolation in Monsey, reaching out even to rivals and former enemies: Eternal Jewish Family - External Links.

His greatest grand scheme to do that has been the EJF scam itself.

But on a smaller scale he has tried to weasel his way back to some outreach organization who are obviously cash strapped in some ways and he has dragged in the Gateways organization, that basically like Tropper only shares a Monsey address, but has no campus or following to speak of, just a glitzy PR driven lecturing machine with weekends at hotels (plenty of known hanky panky at Gateways events too) that cater to mostly spoiled frum people.

Tropper has tried to reach out to his old nemesis of Ohr Somayach in Jerusalem and they have taken the bait for their own cynical reasons, but they have still not let him set his foot into their own bais medrash, while they conduct programs with him in far off Ukraine, and a few others from Israel who need to break out of their isolation, so they think that Tropper will help him, but it's like a prisoner who imagines he is breaking out of his jail cell only to find himself having landed up in the jail cell next door. While it helps Tropper get over his isolation and virtual banning from Monsey, it helps the others who now hold hands with him nothing.

There is an unspoken common understanding in Monsey, NY, Tropper's is dangerous and a fraud and most of his students are weird and cultish. Yeah sure, he trains many of them to think super-yeshivish and even to learn a blatt well. But that only makes matters worse, because it's just replicating and reproducing Frankenstein-like monsters who can spout Tropper's sicko ideology of hating other rabbis that they are convinced is true "daas toireh" when it's just the cultish ramblings of brainwashed BTs practicing sinas chinam and machlokes at the feet of the master.

Bottom line, Monsey has not been kind to Tropper and the Jews of Monsey don't like him, his views or the type of fanatical students he puts out, when he puts them out. This is not because Monsey does not like kiruv or BTs. On the contrary, Monsey is a very welcoming and tolerant community. A lot better than the tough Brooklynites and far better than the unfriendly Boro Parkers not to mention Willimsburgers, or the nutty Crown Heighters, the Monsey people are good people. That is why Ohr Somayach of Mosney has had so much success there as it's been welcomed and staffed by people from the Monsey community. Just that they don't like Tropper and his skwered approach at his forever hanging by a thread Kol Yaakov aka Yeshiva Yedei Esav.

Could it be that they were privy to the public breakup of his first marriage while he was living there? Or that they saw and heard about his private predilections and rumors of womanizing and taking advantage of females when on the road with his "horizons I am the greatest gift to mankind" lectures on campuses all over America? Or how he suddenly met and reeled in a pretty young thing model who wasn't even religious and after refusing to give wife number one a Get for a long time, he suddenly saw the light and ran to dump her so that he could marry wife number two soon after a couple of months of number two's brainwashing at a girls seminary? These are things that matter and they cannot be kept from one's neighbors.

Gossip is a reality of life and when it is a supposedly prominent rabbi who is preaching high and mighty things and looks down at the world because "he knows better" that the gossip takes on more traction and becomes a window into the world of truth and reality that reveal a hypocritical monster at work, this causes your neighbors to stay far away from you.

These too must be at least some the reasons that Pinny Lipshitz owner of the Yated Ne'eman and long time resident of Monsey stays as far away from Tropper as he can and tries to sanitize his paper by running as little news about EJF and Topper as he can and very obviously letting the world know, that as far as the Monsey based Yated is concerned, Tropper is held at arms length or better yet like a figurative putrid rat held by its tail while the rat catcher holds his own nose with his other hand as he tosses the rat as far out of the window as he humanly can waving it goodbye and good riddance as it scampers off to bother other papers and publishers like at the The Jewish Press and at the Hamodia attention-starved news rags that will post anything that comes their way, especially if it's backed up by the big money that pumps artificial life into EJF and keeps Tropper flying all over the world creating mayhem and machlokes in his trail.

Pinny Lipshitz (editor Yated Ne'eman) has letely welcomed a column based on weekly Torah thoughts from lectures by Rav Moshe Sternbuch the Raavad of the Eida Hachareidit's Beth Din who just so also happens to be the staunchest hakchic authority and Torah scholar opposing every shred of what EJF is trying to do and who frightens the heck out of a Tropper. Neat and very smart trick by Lipshitz to arm himself with choshuve Sternbuch against the low-life Tropper bullying aparat.

Tropper fails to build his own Torah community on home ground in Monsey, New York, USA.

All Tropper has in Monsey after working day and night in outreach is a dinky little place that often barely has a minyan and a handful or more of wacko students.

After about 30 years of living, working and basing himself out of Monsey, NY, Tropper has gone nowhere.

People there don't like him. His original Kol Yaakov yeshiva (Yedei Esav) never seems to grow beyond a handful of students. Perhaps it's because he "mainstreams" them well meaning brainwashes his new recruits so quickly and so efficiently that they then move on to be absorbed into other yeshiva communities in Israel and America, and Tropper does have a nice little group of his alumni meaning disciples living in Israel.

But it still does not account for the fact that in Monsey, NY -- which by now is itself a huge Charedi community with both yeshivish and Chasidish people by the tens of thousands moving in and living there, that after three decades Tropper has not been able to do a simple thing for him like building a core community that one would think should be the natural outgrowth of his thirty years of attracting people to himself and setting himself up as their supreme leader.

What is the matter here?

And to double the shame for Tropper is that his arch-rivals and former employers Ohr Somayach set themselves up in Monsey about the same time he did, and by now they have a huge campus overflowing with students who are referred to them from all across America and the world, while they have built up a very strong kehilla of their own that revolves around the Ohr Somyach campus in Monsey.

Why hasn't Tropper been able to replicate this same level of success?

The answers are not that hard to follow by now. One is that Tropper is by nature restless and on the go and since he is a control freak and insists on micro-managing every last detail of his yeshiva's and students' lives, he is in effect his own worst enemy because no student or couple will invest time in a rabbi who is flying around America and the world seeking his own kicks and thrills and they sense he doesn't give a darn about their more mundane and human needs on earth itself.

But of course, two is the real reason that Tropper is simply too obnoxious and self-centered for any group of people to put their long-term emotional and spiritual lives into the hands of someone as selfish, bombastic and cruel as the menacing Machiavellian Tropper macho machine.
