Holy Fight Ministries Loses Cockfighting Religious Freedom Lawsuit

From Judge Brian A. Jackson's opinion yesterday in Plumbar v. Perrilloux (M.D. La.):
[T]he Louisiana Criminal Code … makes it unlawful for any person to … "organize or conduct any commercial or private cockfight wherein there is a display of combat or fighting among one or more domestic or feral chickens and in which it is intended or reasonably foreseeable that the chickens would be injured, maimed, mutilated, or killed."
Plaintiffs … argue that the burden imposed on their religious practice of cockfighting is at odds with the Louisiana Preservation of Religious Freedom Act ("LPRFA"). They adequately summarize the core of their argument in the following syllogism: "[i]f the use of peyote, a Schedule I drugs [sic], is permitted…then it stands to reason that an exception should be carved out…for the Plaintiffs and their congregation [to engage in cockfighting] to practice their faith." …

Several photographs taken during a police raid were offered by [the government]. The photos depicted a cockfighting arena littered with discarded food and alcohol containers; a handwritten betting ledger; "cockhouse" fees and membership rules; rooster corpses; and other indicators of a commercial cockfighting operation. Signs were discovered in the area, including one reading "Milk Dairy Game Club House Rules," and another smaller sign reading "Holy Fight Ministries"—apparently the only indicator of any religious object in the facility. At oral argument, Plaintiffs argued that while they lease the premises from the Game Club, they are not a commercial operation and were not present the night of the raid when the incriminating evidence was seized….

[Plaintiffs] are unlikely to succeed on the merits of their claims [1] because Defendants have provided satisfactory evidence to show that the state has a compelling interest in enacting a law banning cockfighting and [2] because the evidence casts doubt upon the type of institution operated by Plaintiffs. In other words, the evidence suggests that the cockfighting activities were more commercial in nature than a bona fide religious ritual….

Because of all the revenue involved, Vermont is bending over backwards to accommodate Moshe Perlstein illegally just showing up with 800 kids

The Mountain Times is reporting that citizens are accusing Vermont officials of a cover up, completely relying on Perlstein's words for everything despite that his words don't add up. Perlstein farentfers for instance that anyone going to town for supplies has been quarantined & tested but offers no proof to back it up. And he clearly lied about how packed the buses were. They also have picture evidence of campers & staff not wearing masks.

And kafuy toiv Perlstein has even been creating new problems since arriving.

So the Town responded with the only language that Perlstein understands:

Town officials told residents Monday that inspectors are monitoring a youth camp on the former Southern Vermont College campus and working with the state to ensure that health and safety guidelines are followed.

But they added that the town's authority is limited to building and fire safety issues and doesn't extend to health issues, such as compliance with Vermont COVID-19 regulations for visitors from out of state.

Thus far, the town has found no violations of local building or other codes that are not being addressed by the Orthodox Jewish camp ownership, said Assistant Town Manager and Planning Director Daniel Monks.

He added that state officials the town is in regular contact with continue to believe the camp is meeting the governor's requirements for visitors during the epidemic.

However, Monks said during the board's videoconference meeting that noise complaints stemming from loud electronic music late at night have continued at times since the camp for about 350 girls from New Jersey and staff members opened on July 5.

"The noise issue is unresolved," he told the board Monday, adding that the town had compiled complaints to the police and is prepared to seek an injunction against the camp operators in Superior Court over noise ordinance nuisance violations if the problem continues. He said the camp, called Zichron Chaim, and its attorney were given notification of the town's intent.

Monks said Tuesday morning that there had been no further noise complaints to police overnight.

Perlstein's quip about not leaving the hotel's 15 acres actually raises a lot more questions than it answers.

If the 400 maydelach aren't stepping foot off the property then what the heck are they doing all day?

States have pandemic occupancy maximums for swimming pools. In NY it's 25 even if the pool is large AND the swimmers are all the same extended family.

I took a look at a satellite picture of the grounds. If they don't get attacked by ticks & mosquitoes, they will be bored out of their minds in about 10 minutes.

Vermont is very rural so even in the towns there are alpha predator and other dangerous animals roaming around including timber wolves which are twice the size of coyotes, bears and moose. Many small bodies of water from Vermont to Maine are also notoriously swarming with blood sucking leeches if they decide to wade through that tiny creek.

The closing of Gan Israel of Plano, Texas, on Tuesday night serves as a cautionary tale as schools look to reopen this fall. The camp, which according to its website serves kids ages two to incoming seventh graders, is run by Chabad, the Hasidic outreach movement.
