I started off in activism, much in the same way every other activist starts, with a young, optimistic, incredibly naïve idea of what I could accomplish if I tried hard enough. The problem: children were being abused, suffering horribly at the hands of people who violated them in ways that would viscerally incense anyone possessed of a conscience. Surely the problem was one of ignorance. It seemed to me, as it seems to many young, upstart activists, that when apprised of the horrifying reality and pervasiveness of child sexual abuse, people of conscience, people who are otherwise God-fearing fellow Orthodox Jews, could possibly stand idly by and allow such injustices to continue. No, it must be ignorance, I figured, and ignorance can be educated.

At the time I was confused about my place in the Jewish faith. I’d been raised solidly Charedi in Boro Park, taught from a young age to keep shabbos and kashrus, to daven three times a day, to value torah, and to respect gedolim. Gedolim were the closest thing we had to prophets. They didn’t talk to God, but after a lifetime of devotion to God, the study of Torah, and living piously, living as an example for the rest of us to follow, surely they were the most qualified to tell us what God wanted of us.

But that sort of devotion surely must come at a price, a certain detachment from the mundane, from the day-to-day of our lay-lives. It’s no wonder they didn’t care for anything about the rampant sexual abuse in their communities, no wonder that when they were handed a case to adjudicate they made the incorrect choice. It wasn’t their fault, they simply didn’t understand the exactly nature of the problem they were adjudication. They simply didn’t understand what it means for a victim to feel so abandoned, betrayed, and violated by their friends, family, and community that the only apparent way out is suicide. They’d surely they’d never experienced being in such a mental space.

Surely they’d never been in so much pain that the only way to numb it, to make it somewhat bearable, survivable, was to stay drunk or high for long enough to function. Surely they’d never felt so out of control that were compelled to stuff themselves to make themselves feel full of something other than pain only to empty themselves out again with a well placed finger down their throats; surely they’d never felt the need to exert a similar control over something – anything – in their lives by not eating.

No, they couldn’t possibly be very experienced these things. And why would they? They were holy, as close to perfect as a human being could be, and God rewards those who follow God’s law so devotedly. It wasn’t their fault that they’d never experienced such pain. They’d worked hard for their rewards. Their lack of perspective wasn’t a flaw, but a testament to their righteousness. Their detachment was both a byproduct and a reward of the lives they’d led.

But surely these paragons, once informed of the pain we were experiencing, once confronted, not adversarially but respectfully, unlike those other activists who were just out to shame them, mock their torah, they’re communities, and their devotion to both, activists who were simply self-interested, ridiculing people who by contrast made them look like the pleasure-seeking self-justifying sinners they surely were – if they were approached by someone who walked in both sets of shoes, a survivor and a devoted member of their community – surely they’d have to take notice and act to help us.

I started to talk to people about getting me some meetings with the men I’d grown up revering. At the time I’d started writing, but still didn’t have my own blog, so I’d hand my articles to other blogs for publication. In Novemeber of 2012, Avi Shafran wrong an article for Cross Currents titled The Evil Eleventh, in which he responded to a 2006 New York Magazine article by Robert Kolker, which speculated that abuse in the Orthodox Jewish world might be more prevalent than it is elsewhere. Shafran, in his response, contended that since there are no statistics, Kolker’s speculative assertions were an “unmitigated insult to the Judaism,” and likened it, due to his reliance on information obtained by a handful of advocates and survivors, to “visiting Sloan Kettering and concluding that there is a national cancer epidemic raging.”

The rest of his response was a classic example of deflecting by focusing attention on the Jimmy Savile case in England, and engaging in No True Scotsmanism, declaring anyone who would do such a thing ipso facto not a religious Jew, thereby – somehow – making it not our problem.

Respectful as I was of gedolim at the time – many of whom Shafran represented as spokesman for Agudath Israel, and by extension the Moetzes Gedolei Hatorah, and distrustful to the point of disdain, at times, of the advocates and activists involved in the issue of child sexual abuse, I nevertheless wrote a response which I intended to publish on a friend’s blog. I figured, however, that it was only fair to send an advance copy to Shafran for comment before publishing.

After emailing back and forth about the article, it seemed that he agreed with my main points, and that my article, as I had intended to publish it, was unfair. He seemed like someone I could talk to, a reasonable person who genuinely cared about the issue, and, given half a chance, would do what he could to help. I told him I would not publish my response, and we set up a time to talk on the phone.

We ended up talking for four nights over the next two weeks, each conversation lasting a couple of hours. I had prepared notes. I knew I wouldn’t get anywhere on many of the topics I raised, but I figured I’d raise them anyway.

Issues like sex education in yeshivos, acknowledging the harm done – whether anything could be done about it or not – in segregating the sexes until marriage, acknowledging – whether anything could be done about it or not – the problems caused by our general reticence to use proper terminology when discussing physical anatomy or sexuality, refusing to discuss sexuality as a topic, and how much harder it makes discussing non-consensual sexual encounters when even consensual encounters are considered taboo. Then there was the fact that teachers, and yeshiva administrations in general are unwilling to allow students to discuss issues they’re having in their personal lives with faith, with the opposite sex, drugs, depression, etc, without fear of expulsion, and that by the time they reach a yeshiva that does allow such discussion between students and faculty, it’s too late.

Then we moved on to the problems caused by sexual abuse, and the terrible suffering it causes to its victims. I ran him through all the problems, both mental and physical, caused by sexual abuse, some which I’d developed having been abused myself for years.

Throughout all of it, he listened sympathetically, sometimes even empathetically. He acknowledged all of my concerns. He admitted that there were issues with the way our communities raise children, and he acknowledged the damage caused by all of these concerns. I thought I was getting somewhere. I thought, finally someone who’s on my side, who has access to gedolim, who can actually help me change things for the better.

And then we got to the psak.

Shortly following the 2011 Agudah Convention, Shafran posted the following psak on Cross Currents, which operates as Agudah’s de facto blog. The psak was posted by Shafran as an official Agudah statement:
  1. Where there is “raglayim la’davar” (roughly, reason to believe) that a child has been abused or molested, the matter should be reported to the authorities. In such situations, considerations of “tikun ha’olam” (the halachic authority to take steps necessary to “repair the world”), as well as other halachic concepts, override all other considerations.
  2. This halachic obligation to report where there is raglayim la’davar is not dependent upon any secular legal mandate to report. Thus, it is not limited to a designated class of “mandated reporters,” as is the law in many states (including New York); it is binding upon anyone and everyone. In this respect, the halachic mandate to report is more stringent than secular law.
  3. However, where the circumstances of the case do not rise to the threshold level of raglayim la’davar, the matter should not be reported to the authorities. In the words of Rabbi Yosef Shalom Elyashiv, perhaps the most widely respected senior halachic authority in the world today, “I see no basis to permit” reporting “where there is no raglayim la’davar, but rather only ‘eizeh dimyon’ (roughly, some mere conjecture); if we were to permit it, not only would that not result in ‘tikun ha’olam’, it could lead to ‘heres haolam’ (destruction of the world).” [Yeshurun, Volume 7, page 641.]
  4. Thus, the question of whether the threshold standard of raglayim la’davar has been met so as to justify (indeed, to require) reporting is critical for halachic purposes. (The secular law also typically establishes a threshold for mandated reporters; in New York, it is “reasonable cause to suspect.”) The issue is obviously fact sensitive and must be determined on a case-by-case basis.
  5. There may be times when an individual may feel that a report or evidence he has seen rises to the level of raglayim la’davar; and times when he may feel otherwise. Because the question of reporting has serious implications for all parties, and raises sensitive halachic issues, the individual should not rely exclusively on his own judgment to determine the presence or absence of raglayim la’davar. Rather, he should present the facts of the case to a rabbi who is expert in halacha and who also has experience in the area of abuse and molestation – someone who is fully sensitive both to the gravity of the halachic considerations and the urgent need to protect children. (In addition, as Rabbi Yehuda Silman states in one of his responsa [Yeshurun, Volume 15, page 589], “of course it is assumed that the rabbi will seek the advice of professionals in the field as may be necessary.”) It is not necessary to convene a formal bais din (rabbinic tribunal) for this purpose, and the matter should be resolved as expeditiously as possible to minimize any chance of the suspect continuing his abusive conduct while the matter is being considered.

While the first four clauses of the psak may not seem all that objectionable, despite the comparison of “reasonable causes to suspect” determined by mental health and law enforcement professionals to raglayim ledavar determined by average, untrained community rabbis, the fifth clause is what’s truly problematic about the psak.

The fifth clause seems to indicate that since the average person is not an expert in what constitutes raglayim ledavar, a rabbi should be consulted in every case, either to establish the presence of raglayim ledavar, or to affirm it. What that essentially means, to most people, is that regardless of whether or not your own common sense tells you that there’s clearly raglayim ledavar, you should consult your rabbi anyway just to make sure.

By then I’d been active long enough in survivor communities to have heard countless stories of survivors who had been browbeaten into silence by rabbis who were either ignorant of the damage caused by sexual abused and therefore felt more sympathy either for the abuser who could potentially face serious prison time, or the abuser’s family who would suffer if their loved one was arrested and publicly charged, or who simply persuaded and pressured survivors into silence because they had a vested interest in protecting the abuser. I’d seen the damage caused by this psak, and I wanted Shafran to address my concerns. Surely we could work something out.

I told him my concerns, and he told me that I had gotten the psak all wrong. That it didn’t actually mandate consulting rabbis in every case. That surprised me, so I asked him for specific examples of cases that would or wouldn’t require consulting a rabbi prior to reporting.

According to Shafran, if someone is the victim of abuse, they obviously have raglayim ledavar, and can report without consulting a rabbi. If someone is the parent or guardian of a child who clearly seems like they were abused, or clearly says that they were abused, then you have raglayim ledavar, and can report without consulting a rabbi. The only situation under the psak, according to Shafran, in which you’d actually have to consult a rabbi, is if a child tells you that something happened, but can’t or won’t elaborate, and you’re not sure what they mean.

While the proper protocol for such a situation is to take the child to a mental health professional for evaluation, this interpretation of the psak as laid out by Shafran seemed damned near reasonable. I was stunned. It actually seemed like a decent compromise, a promising starting point. The psak actually was progress. The advocates were wrong. But why did they have this misconception, and why didn’t Agudah do anything to remedy it?

I asked Shafran, still stunned by what he’d told me, why this psak wasn’t more widely publicized, more publicly explained? Why was this psak, as he’d explained it, published in mainstream Charedi newspapers, like Yated and Hamodia? Why was Agudah not taking out two-page spreads to both defend themselves against the baseless accusations of angry bloggers, and to make sure that children in the community were protected under this new, progressive psak?

Because we don’t want the laypeople interpreting the psak on their own and misapplying it.

That was the response I got.

But why do community rabbis not know about this psak? How are they expected to make the proper decisions if they don’t even know the framework in which they’re expected to operate? I didn’t get a good answer for this.

Alright, but what about having a dedicated panel that’s publicly known to adjudicate sexual abuse cases, and evaluate whether or not they meet the criteria of raglayim ledavar, a panel that would be accountable for the rulings they’d render?

Well, Shafran explained, firstly such a thing wouldn’t be legal. Secondly, no rabbi would want to be the one to step forward and take the lead on such a thing. It would earn them criticism, and cause conflicts with the institutions they lead or represent, jeopardize their positions, or the financial futures of their yeshivos, and no one would want to accept that kind of responsibility.

What if the gedolim came out publicly and did more to raise awareness? Surely, if they took leadership on this, if they all made the issue front and center as a problem that the frum community needs to tackle head-on, rabbis who wanted to become more proactive in fighting against child sexual abuse would feel more comfortable making themselves available.

It was then that Shafran managed my expectations of gedolim.

They have the same problem. They don’t feel they can take that risk, because they still have to worry about their communities, institutions, and positions.

And right there, at that moment, is when the gedolim lost my faith.

“I don’t understand,” I exclaimed bitterly, “Is the dog wagging its tail, or is the tail wagging the dog?”

After I’d calmed down a little bit, apologized for my outburst, and assimilated this world-shattering piece of information, I got back down to business.

Ok, well, if the gedolim aren’t going to help, what can I do to raise awareness in the community? Could Shafran help me get a foot in the door with some of the frum newspapers and magazines so I could publish articles about abuse, and raise community awareness?

Yated, Hamodia, Mishpacha, Ami, and Zman would never take them, he said.

Not even if they were told to?

No.

So what do I do?

Start at the bottom. Go to the Flatbush Jewish Journal. They’ll be more likely to publish something about sexual abuse, provided its written respectfully, in a way that doesn’t accuse the whole community of complicity. Start there. Work your way up.

Can you call the editor in chief and tell him that you’re sending me along?

No.

Can I tell him you sent me?

No.

Can I drop your name when I talk to him?

No.

So after four days of talking, after all the things we’ve agreed upon, after all the concern you showed, you can’t help me with anything? Even this? What have I gotten from this?

I’ve since been disabused of all the misconceptions I’ve had regarding gedolim. I should have known, but all the gedolim I’d tried to get meetings with had already met with survivors, had already heard everything I’d wanted to say to them, and their paid had similarly fallen on deaf ears.

I’ve since lost the illusion I had of gedolim as saintly beings with a holy disconnection from mundane reality. They know. But they’re people. They have self-interest. They have ambition. They like power, and money. They’re the same as everyone else. Nothing greater or lesser. Just regular people in charge of regular institutions. They don’t know God any better than the rest of us do. They don’t have any special insight that we don’t. Their ability to use their sechel isn’t any different from ours. There’s nothing innately special about any of them.

They’re gedolim because they have power. They run powerful institutions. They control powerful amounts of money. They have powerful amounts of influence. That’s it. Nothing special.

I lost a fair chunk of my innocence when I realized this. I no longer had heroes to look up to. I no longer had any paragons of virtue after which to model my life. But I’ve met some. There are people I consider tzaddikim. People who have literally stood between a gun and its intended target. People whose careers and public profiles have suffered tremendously because they refused to budge on their principles. People who have publicly acknowledged their complicity in protecting abusers in the past, but have since publicly taken accountability, apologized unreservedly, educated themselves about the issue, and have become some of the leaders in our cause.

Those are people worthy of respect.

And the key difference between them? They are respected but don’t demand respect. They are beloved but don’t demand love. They don’t command awe. They don’t command worship. They’re not the kind of people who would make you walk backwards out of a room they’re occupying so you don’t turn your back on them. They’re always willing to offer advice if asked, but would never demand that you seek their counsel.

They’re the real gedolim, but they would bristle at the title.

I only came to this realization about gedolim because I came close enough to see their weaknesses. Most people in their communities are too blinded by the mirages they see to recognize these weaknesses. That’s why we’re bringing the issue to the frum community. That’s why ZA’AKAH is protesting outside of the Novominsker Rebbe’s shul. To show the community that we’re not ignoring the issue just because the gedolim tell us to, that the gedolim are not operating in the best interests of our children, but the best interests of the institutions they lead, that there are people out there who see their pain, and care enough to do something about it, and that if they should choose to speak up, we’ll proudly give them a voice.

Join us this Sunday at 3 PM, in front of the Novominsker Shul at 1644 48th street, to protest agudah’s rape enabling policies. Because that’s all their psak does. That’s all Yaakov Perlow accomplished in issuing that psak. By requiring victims to consult a rabbi before reporting child sexual abuse to the authorities, all that’s accomplished is the enabling of coverups by community rabbis either too ignorant, or too biased to make the right decisions.

The only proper response to abuse is reporting to the authorities. And let no gadol tell you otherwise.

Startup Org Shines New Light On Abuse Policies


Sacred Spaces expands focus from helping abuse victims and exposing offenders to reshaping institutions.

In his first summer as director of Camp Ramah Berkshires, a large Conservative sleepaway camp in the rolling hills of upstate New York, Rabbi Ethan Linden is intent on ensuring that all the camp’s policies and procedures are up to code.

That includes, among medical policies, security policies and fire safety procedures, measures to prevent child sexual abuse.

“The core mission of the camp is to care for children,” said Linden, who will have 750 campers under his supervision over the course of the summer. “Coming in new, it was a good opportunity to work with someone who has expertise in preventing the sorts of nightmare scenarios that keep camp directors up at night.”**
“People are not thinking through these issues in advance,” said Berkovits.
Shira Berkovits, founder and executive director of Sacred Spaces, a nonprofit launched a year ago that aims to help Jewish communal institutions develop policies and training to prevent and respond to abuse, is that someone.

“People are not thinking through these issues in advance,” said Berkovits, a lawyer, psychologist, consultant and Jewish educator. “When an issue comes up, people are scrambling to come up with fixes. If we had a code — just like a fire safety code — our community could start to think about the issue of abuse in a different way.”

The presence of Sacred Spaces, which is now working with 10 institutions, mostly in the New York area, is being bolstered by a just-released study by the innovative nonprofit support group Jumpstart that documents “critical gaps” in schools’ and camps’ anti-child sexual abuse policies. (See exclusive story.)

Taken together, the study and Berkovits’ work appear to be signaling a shift from what has heretofore been a focus on helping abuse victims and exposing offenders to reshaping institutions. Though Sacred Spaces’ first cohort of institutions is focused on preventing child abuse, Berkovits hopes future initiatives will tackle a wider range of abuse issues, including sexual harassment and elder abuse.

Today, Berkovits wants camps, schools, and synagogues to be less “reactive” and more “preventative” by putting in place policies based on best practices. She envisions, in the not-too-distant future, an accreditation system for communal institutions.

Though the Jumpstart study did not focus on synagogues, a 2013 study conducted by Berkovits found that 67 percent of 112 synagogues had no policies on child sexual abuse prevention at all; 82 percent of youth directors had never been offered training.

Her results focused on the three largest denominations (Orthodox, Conservative and Reform). Though Orthodox synagogues had the highest percentages of an absence of policies and training — 91 percent of Orthodox youth directors had no training on child-abuse prevention, and 75 percent of Orthodox synagogues had no policies on the matter — Conservative and Reform synagogues also proved sorely lacking.

Sacred Spaces’ guide for synagogues suggests some of the training Berkovits’ research recommends. One such hands-on example, a bystander intervention workshop intended for synagogue congregants, details a scenario: At a kiddush lunch, you notice a congregant help a child to reach a cookie. As the congregant gives the child the cookie, the congregant strokes the child’s bare arm and kisses the child’s head. The child squirms and looks uncomfortable.

The question: How does one effectively intervene? Congregants will conduct a role play, discuss what might hold someone back from intervening and discuss the most effective way to get involved.
The workshop, and others like it, is part of a process that includes a review of current policies and procedures, interviews with staff, parents and children, a building and grounds assessment, the development of new policies and ongoing evaluation.

The chair of the child protection committee at a medium-sized New York synagogue that is working with Sacred Spaces said that he was “surprised” by the lack of knowledge among his fellow synagogue leaders on the topic.

“The stigma around sexual abuse is a huge challenge,” he said. (He, like several institutional officials contacted by The Jewish Week for this article, requested to remain anonymous to shield the synagogue’s identity; they did not want their cooperation to imply that their institutions had an issue with child sexual abuse.) “Educated, well-meaning individuals were dubious. They think this [sexual abuse] is something that happens over there, not over here.”

The committee chair — himself a practicing pediatrician who has worked on matters of child protection for years — said the process of instituting policies to protect children from abuse was “eye-opening.”

“I can barely imagine how challenging it might be for someone not initiated to the topic,” he said. The synagogue — which he described as “very proactive about inclusion and protection” — began taking the abuse issue more seriously after Rabbi Jonathan Rosenblatt, former rabbi of Riverdale Jewish Center, became embroiled in controversy over his habit of inviting young men to go with him to the sauna.

“We realized the importance of establishing red lines,” he said.

After nearly two years of consulting with Berkovits, working through policies with the board of trustees, and introducing the initiative to the community though small discussion groups, the synagogue in nearing the implementation stage. Policies are set to take effect in September.
Berkovits hopes to use the synagogue’s policies as a model for other synagogues.
“The issue is very charged. People have put up all kinds of defense mechanisms to believe it couldn’t happen in their community,” the chair said. “The truth is, it can and it does. But changing a culture takes a lot of time.”

Not (only) An ‘Orthodox Problem’ 

Though the charedi community has shouldered the brunt of negative publicity on the issue of abuse, Berkovits said that she has been “surprised” at how receptive Orthodox communities are to initiating the conversation — often more so than “more liberal communities.”

Abuse, she stressed, is not an “Orthodox problem.”

“The fact is that institutional abuse, sexual abuse, abuses of power, they are not (only) Orthodox problems, or even Jewish problems; they are human problems impacting every community. Unless a community has invested significant time and resources to address this issue, they will not be prepared to responsibly handle abuses of power when they occur — and they will occur.”


Support for Berkovits’ project spans the denominational spectrum. Rabbi David Ingber, the senior rabbi at Romemu, a Renewal-inspired congregation on the Upper West Side, plans to work with Sacred Spaces to evaluate his own synagogue; he also hopes to serve on the advisory board of the organization.
“The Jewish community is radically unprepared to deal with this issue,” said Rabbi Ingber. “I’m galvanized by what Shira is doing — people need to know that her work can help avert so many future disasters.” He referred to the work as pikuach nefesh — saving a life. “If you can save one child, you can save a whole world … we can no longer stand idly by.”

Rabbi Judah Isaacs, director of community engagement at the Orthodox Union (OU), the largest Orthodox umbrella organization, said Berkovits’ work is critical to help congregations navigate tricky situations, like how to respond to someone convicted of child abuse if/when they want to rejoin the congregation. The OU has worked with her on a case-by-case basis over the last five years.
“Shira has helped our synagogues navigate that difficult space,” he said. “It is critical that our synagogues have professional help, and don’t try and navigate these situations themselves.”

Changing the Culture

Guila Benchimol, a consultant for Sacred Spaces with a master’s degree in criminology and criminal justice policy, is working with a large Orthodox day school in Toronto to establish abuse-prevention policies. This month, it will be piloting a detailed list of policies and protocols developed with help from Sacred Spaces. They include: limitations on students riding in cars with staff members; limitations on students being alone in the building with staff members; methods of communicating with parents about concerns; and involving government agencies to work with school on reporting abuse. (The problem of self-policing — reporting abuse to rabbis rather than law enforcement — has been particularly troublesome in the Orthodox community, though there are indications that this is changing, Benchimol said.)

Today, that’s changed, she said. “Now, people want to know more. When you talk about what needs to happen, that’s when resistance starts.”





According to a new exclusive study, 
40 percent of Jewish day school 
have no policies to prevent child sexual abuse. 


Still, it is the responsibility of leadership and staff at Jewish institutions to start “changing the culture.”

“In the community, abuse is still a difficult story to tell,” she said. “But it should not be the responsibility of abuse survivors to force us to change. Their stories should not have to shock us into action. The onus is on us — to take initiative, to change our institutions, so there doesn’t have to be another story.”

Sacred Spaces received start-up grants from several organizations, including the Natan Fund, a giving circle of young Jewish professionals, which gave the organization its first foundation grant, and the Jewish Women’s Foundation of New York (JWFNY) which provided a $15,000 general operating support grant.

“We hoped that this grant would not just provide financial support as Sacred Spaces got off the ground, but also serve as a statement about the importance of this issue and the great promise of this particular approach, envisioned and executed by these excellent leaders,” said Felicia Herman, Natan’s executive director.

JWFNY’s executive director Jamie Allen Black said she is “proud to partner with [Berkovits] on this important work.”
 
Berkovits, 33, began thinking about ways to keep children safe as a youth director for the Hebrew Institute of Riverdale in 2005, and later as a consultant for the OU.

“At Sacred Spaces,” Berkovits said, “we see our mission of creating healthy Jewish organizations as a positive commandment that goes to the core of our Jewish values and tradition. … One cannot claim to be religious and turn a blind eye to abuse.”

Berkovits was prompted to write a book after being “inundated with phone calls” following a 2013 resolution put out by the Rabbinical Council of America — the largest body of Orthodox rabbis — calling upon all synagogues and schools to adopt policies geared towards preventing sexual abuse.
Even as organizations understand that the work has to happen, there is still a long way to go “in our communal conversations and awareness,” said Berkovits.

“Part of our work with organizations is helping them to shift their assumptions and approach to prevention, so that they take pride in their efforts,” she said.

“Organizations worry that by taking preventative steps they might somehow be perceived as having ‘an issue with abuse,’” she continued. “What everyone should understand is that taking steps to prevent abuse is not something that should be reserved for those who have had incidents of abuse.
“By then,” she concluded, “it is too late.”

**In 2016, a former camper at Camp Ramah Berkshires (identified by the pseudonym John Doe in legal papers) filed a lawsuit against the Jewish Theological Seminary and the National Ramah Commission alleging that a counselor forced him to perform a sex act in the woods one summer as a young boy. The suit accuses camp officials of aiding in a coverup and allowing alleged abuser Harvey Erlich to sexually abuse four other boys during the 1970s and 1980s. The plaintiff is seeking $20 million in damages. 

JTS told the Jewish Week that they filed a motion to dismiss the case late last year and are still awaiting a decision.

We all have been there; the defining moment. If we are honest with ourselves, which is difficult and painful, we feel intuitively, in our soul, when that moment arrives. Some act, most don't! It can be in our personal lives, in our community roles, in our business or profession; it's there for us to seize - if we are daring! It comes perhaps once or twice in a lifetime, in each area of our lives.

The moment should have come to you - in your lives as Jews - right after Yehuda Kolko got arrested - and right after the Agudath Israel Convention - where they boldly pounced on the opportunity - to declare - there is NO child-rape problem in the Orthodox Jewish Community! "One - perhaps slipped through our fingers - but we are dealing with the - NON-PROBLEM - according to the Torah!"

But --- you went back to work and about your lives - believing that if you wish it away - it will not be there in the morning! You missed the point - fellow Jewish travelers. The problem - besides the illness of child-rape that has permeated our ghettos - was at that moment - that very period in time - it should have been crystal clear that we are doomed as a viable community.

But you missed the other point! The big other point! YOUR LEADERS ARE GANGSTERS, LIARS, THIEVES AND ROTTEN SEWAGE! They will say ANYTHING and DO ANYTHING to keep you from realizing what low-lives they truly are!

So now you're out - $100 - $500 - on Lipa Shmeltzer tickets and you're outraged!--- BIG-TIME!--- We had it!!--- Right - sure you did! You idiots woke up because you lost a few dollars! Now - your Pesach entertainment may be affected - this is out of control! Now - this is crazy - we need to do something about this!

Implement these changes over the next two years and you may survive:

1-Stop supporting the Agudath Israel - call for a disbanding of that fraudulent - pitiful group of bozos! Put these idiots out of their misery!

2-Limit the Lakewood yeshiva to 1000 students including kollel - or stop their donations!

Install a lay board of heimeshe accountants to monitor every dollar in every yeshiva! You're more than entitled to know where the millions upon millions of dollars a year are going.--- Don't trust them - they're thieving.

3-Require yeshivas to give your children a first-rate secular education - or send your children to Rabbi Yitzchok Elchonon!

4- Keep your children - male and female at home - eliminate all Israeli seminaries! Not seeing what they're doing - is a cowardly act as parents. Most kids are not able to deal responsibly with their freedom. The rabbis and the morahs - do not consider your kids a priority - please believe me!

5-Limit wedding attendance to 200 people - PERIOD! In a year - it would be totally accepted.

6-Stop purchasing and eating all meat and poultry products - for one week - starting Sunday - the week of March 30 - until they drop their prices by 25% - and Yisroel Belsky is removed from the OU! You can survive on fish, dairy products, fruit and vegetables for a week! Pigs! That's just before Pesach when the Jewish Cow Mafia jack up their prices by 25%! Tell them you will now take control of the "kosher" meat industry, by regulating prices and hashgochos!

7-The only children that would be exempt from college/trade schools must past a rigorous examination (farher) by a board of honest and intelligent rabbis. The ones that would pass the the UOJ smell (literally and figuratively) test!

8-Do not build new schools and shuls - expand and renovate the existing ones. Building funds - is when millions of dollars are siphoned off in kickbacks to the builders and yeshiva owners!

9-(from Steve) Insist that all yeshivos adopt the RCA resolutions regarding child sexual abuse. DO NOT PAY ONE CENT OF TUITION UNTIL YOUR YESHIVA AGREES TO THIS! Also, continue to lobby the NY State Assembly to pass these laws that protect our children from molesters: mandatory background checks, fingerprinting, sex offender registry and mandatory reporting.

Only you can save yourselves - from yourselves - do it!

This is the "defining moment" for the Orthodox Jewish community. If you leave things in place - the ugliness will keep compounding and feeding on itself. More children hurt physically and emotionally. More welfare - basket cases -- in our communities. More singles crisis, and more kashruth scandals, more of all kinds of scandals. More money stolen from you - as the "rabbis" build financial kingdoms for themselves and their families....

And you will have nobody to blame but yourselves!

How to Digest Sludge

After leaving the Ultra-Orthodox community she grew up in, Leah Vincent finds a way to break free of years of abuse and trauma she endured as a child. The secret lies somewhere between science and religion.

"I went to therapy. While it was a relief to talk about my suffering, a painful distance remained between adult speech and childhood trauma. Self-harm worked better. From the ages of seventeen to twenty-two, I cut my arm and leg, tearing the inviolable and poking at my tender innards. I see now that this was a symbolic reenactment of Mendy’s and Kaila’s violations but I could not see that then. I only knew that cutting provoked the response in myself that I wished I had once received from my own mother: a rush of pity for the gashed child I was, a dose of care for the wound.

Eventually, I stopped cutting. Self-harm only managed the sludge’s spread, it never actually transmuted the original material. And it scared people. Instead, I play-acted my experiences of rape with men that I loved in an attempt to grapple with some of what had been done to me. I found pleasure in safely enacting my powerlessness, but no healing. Next I turned to words, building my own language to work through later layers of sludge left by the violence I encountered after I left ultra-Orthodoxy. I wrote a memoir. I was brutally honest about the stories I did tell, but I did not talk about my molestations. I did not even think of myself as molested the way other people were molested. I had not yet codified those experiences as stories. They lived in the wordless darkness of my childhood mind, mired in confusion and shame."

Israeli cop charged with sexual assault against minors


This was not the first time that the police officer was suspected of inappropriate behavior with minors.

The Police Investigations Department filed an indictment against a 37-year-old police officer from Ariel, Boaz Mishori, on suspicion of indecent assault of four minors ages six and eight while he worked as a noncommissioned police officer and summer camp counselor.

Mishori sas also charged on Thursday with obstruction of justice, breach of trust, and seeking to harm a witness, for allegedly seeking retribution against an officer who was involved in a prior molestation investigation against Mishori in 2015.

Attorney Kobi Palomo, who represents the defendant, said his client denies the charges against him and advised against “jumping to conclusions.”

According to the indictment, the officer took advantage of his role as police officer and counselor at an Israel Police summer camp.
 
“As part of his duties as a noncommissioned officer in the Israel Police, the defendant was in frequent contact with the residents of the area, including lecturing children in schools and kindergartens on various issues, including road safety and activities of the Israel Police,” the indictment stated, “In addition, the defendant served as a counselor at a summer camp held by the Israel Police.”

Mishori also allegedly took advantage of his close relationships with Ariel residents to assault their children.

When Mishori was arrested last month, the Israel Police said that this was a “serious and exceptional case,” and that the police “forcefully reject any criminal behavior.”

I Didn’t Realize

I didn’t realize that ten minutes could change someone’s life permanently.

I didn’t realize the harm that could be caused by someone who abuses a child.

I didn’t realize that the person who I had come to befriend had battled with suicidal thoughts and attempts for my whole lifetime.

I didn’t realize that when I first went up to Albany to advocate for the Child Victim’s Act, that I would see the world and certainly people differently.


I didn’t realize how long, deep, and permanent the damage is of children who have been abused.


I didn’t realize the extent of the problem.


I didn’t realize that it was systemic.


I didn’t realize how many communities and organizations have allowed this to happen.


I didn’t realize that most children have no idea that they are being abused nor that they had been abused until age 40.


I didn’t realize that New York State only allows until age 23 for a young adolescent to prosecute their aggressor.


I didn’t realize how uncomfortable it makes people to talk about abuse.


I didn’t realize.


But now I do.

New York State is one of the two states with the worst laws for children who have been sexually abused. Currently, individuals have until age 23 to file a claim against their abuser. The Child Victim’s Act would extend the statue to age 28 in criminal cases and age 50 in civil ones. But the bill has been stalled from coming to a vote on the New York Senate floor for more than a decade.
We are not protecting these victims.

This year, Governor Cuomo has made his support known to all. The State Assembly passed the CVA. The last hurdle was the state senate.

What stands in the way? According to what I’ve gathered from Assembly people and their staff on multiple trips to Albany this year, it is the Religious Right. Our own.

Large institutions on the Religious Right fear the number of claims that would be filed against them by adults who were abused as children if the statue were to be extended to age 28 or 50. These institutions have silently (or, not so silently) put pressure on the senate to prevent the bill from coming to a vote.

If you didn’t realize, now you do. It takes a village to enable child sex abuse.

Please do not stand by silently. Contact your New York State Senate representative and urge them to bring the Child Victim’s Act to a vote during the senate’s next session.

5 of the 6 suspects in Tel Aviv Belz abuse case Sentenced


 
One year after six teachers from the Belz Cheder in Tel Aviv were charged with physical and sexually abusing 22 children aged 3 to 10, five of the teachers have been sentenced.

Yisrael Haim Shapira, Haim Fishgrund, Moshe Hirsch, Menachem Albershtein and Avraham Pinchas Deitsch were sentenced to a varying lengths of suspended prison terms and community service and were ordered to pay thousands of Shekels to the victims.



These five teachers were charged with various acts of violent abuse and assault on the pupils for a decade or more.

The main suspect, Avraham Rosenfeld, was charged with numerous acts of sodomy against the boys at the Talmud Torah Mahzikei Hadat elementary school and preschool
 of the Belz Hasidic community, as well as other indecent acts, extortion and threatening pupils. He has thus far denied all charges and turned down a plea bargain that would see him pend 16 years in prison.

Rosenfeld is accused of ordering boys to come into the recess room, where he would offer them candy, then carry out a variety of sexual acts on them. In addition, he is charged with beating pupils with sticks all over their bodies in front of the class.

Rosenfeld is further charged with tying children to their chairs with ropes and plastic strips, placing a spoonful of black pepper or soap in their mouths, and forbidding them to spit it out, leaving them to cry. He is also accused of prohibiting the children from going to the bathroom, instead ordering them to restrain themselves or relieve themselves in their pants, after which he would order them to clean it up.

Rosenfeld is additionally accused of abusing animals in front of the boys, once allegedly abusing a cat and ultimately killing it in front of them after the cat entered his classroom. He is further charged with abusing his son and threatening his wife.

East Windsor rabbi takes plea deal in sex assault case and avoids jail (Updated) 

 

From the outside, Rabbi Menachem Chinn of East Windsor observed the strictures of his Orthodox Jewish faith, from his beard to the head covering that stood in marked contrast to the yellow jail uniform he wore to his court appearance Friday morning.

Chinn, a 40-year-old married father of six children, admitted he had sexually exploited two young boys — who were students of his at separate times in 2005 and 2012 — when they were under the age of 13. One of the incidents, Chinn admitted, took place in the school where he had taught, the Shalom Torah Academy. The victim in that case, now a young man, was sitting in the courtroom of Mercer County Superior Court Judge Peter E. Warshaw, in Trenton, to watch Chinn finally admit his criminal actions.

“It was very hard, but at the same time, he’s getting what he deserved,” the man said of watching Chinn in court.

In return for pleading guilty to two counts of second-degree endangering the welfare of a child, Chinn will avoid going to prison, getting two suspended five-year-terms to run concurrently, but he will have to register as a Megan’s Law sex offender and be parole supervised for life.  His sentencing is scheduled for Oct. 13.

Asked about why Chinn will not be going to prison, Casey A. DeBlasio, spokeswoman for the Prosecutor’s Office said by email, “Actually, under the terms of the plea agreement, he will be sentenced to five years of prison time, but that sentence will be suspended as long as he meets all of the conditions. Should those conditions not be met, or he commits a new offense, he would then serve that prison time.”

China was due to be released from jail Friday, although his travel outside the home is restricted to such things as visiting a doctor or attending religious services. He cannot have unsupervised contact with minors, including his children.

“We’re just grateful for the continued support of his family, his wife and the community,” said Chinn’s lawyer, Steven D. Altman, outside of court afterward.

The case against Chinn evolved quickly, even though the victims waited years to come forward to law enforcement. In April, he was charged with sexually assaulting a then 12-year-old-boy in Chinn’s home in 2012, the Mercer County Prosecutor’s Office and East Windsor Police announced.

Subsequently, a second victim claimed that Chinn had sexually assaulted him in 2010 and 2011 as a teenager. The same victim in that case then alleged an earlier incident, in 2005, when he was of a middle school age.

The Prosecutor’s Office and  Chinn’s lawyer sought to reach a plea bargain to end the case in a matter of months. Originally due to be in court Thursday, Chinn had his appearance rescheduled to Friday.
In handcuffs, he walked into Warshaw’s courtroom under the watch of sheriff’s officers, as the victim in the 2005 case and others stood in the hallway watching.

By late morning, Chinn appeared before the judge, who wanted to make sure that Chinn was pleading guilty because he had, in fact, committed the crimes as opposed to trying to get the matter past him.
“Are you pleading guilty because you are guilty,” the judge asked.

“Yes,” Chinn replied during the proceeding.

Later, Altman walked Chinn through the factual basis to lay out what he had done, first in the April 2012 case that occurred inside Chinn’s East Windsor home. The victim, who was not in the courtroom, was under 13 years of age at the time and a student of Chinn’s.

Then, he pleaded guilty to the earlier incident, from November 2005, at the school.

“After all these years of being victimized, I can only be thankful that he’s no longer going to be able to put anyone else at harm, within the community and as well as outside the community,” said the victim in the 2005 crime.

His lawyer, Craig Hubert, was also in court and said afterward that the victim and his family feel that “justice was served.”

He said his client “will continue to be guided by his family, friends and community through therapy and treatment for the emotional traumatic harm that he continues to live with on a daily basis.”

Chinn, a native of Israel, finished high school, and had been a teacher at the school and involved in the National Council of Synagogue Youth. Though commonly referred to as a rabbi, he is not ordained.

Technically, the statute of limitations had run out for a charge of endangering the welfare of a child, in the case stemming from 2005. As a result, Chinn had to agree to waive that limitation.

A Look Into Haredi Textbooks Shows Hatred and Racism

Textbooks used to teach students at ultra-Orthodox schools in Israel portray Reform Jews as the enemy, while seculars, Zionists and leftists also receive hostile treatment, a comprehensive study published last month by the research center IMPACT–SE found.

The study, conducted by Dr. Eldad J. Pardo and Tehila Gamliel, reviewed almost a hundred textbooks used in Haredi schools to teach literature, history, geography, civics, science and Bible studies.

The study found scathing criticism of Zionism in ultra-Orthodox textbooks: “Late nineteenth century anti-Semitism led to cohesion within the ranks of the assimilators, who created their own organizations. These organizations gave great power to assimilated Jewry, which no one could withstand,” according to History of Recent Generations, a textbook for middle school.




“Assimilation of individuals cannot harm the Jewish people as a whole… But when assimilation is a guiding principle of an entire public or organization that discards the people’s values, it warps the image of the people in its entirety. That is what happened, for example, when the Zionist Organization was founded. This organization jettisoned most of the people’s values and claimed to represent the people.”

Furthermore, the founding of the State of Israel is described as a sin against the Jewish people: “When olim (Jewish immigrants) from Middle Eastern countries came to Israel, something happened that the Haredi community had feared when the state was founded. Political activists, Histadrut (National Workers’ Union) and Jewish Agency emissaries, and other functionaries abused their power and (effectively) distanced the immigrants, especially their children, from their (Jewish) faith,” the same middle school textbook determines.

The ‘hollowness’ of secular education

Secular people, according to Haredi textbooks, applied any means necessary to secularize the new immigrants arriving in Israel. “They cut off the payot (sidelocks) of Yemenite children, claiming that they harbored lice; they withheld work arrangements from parents if they refused to send their children to secular schools; and deprived them of all other necessities, such as food, housing, and sanitary conditions,” according to the History of Recent Generations textbook.

“At the center of every immigrant settlement, they built a new and handsome building for secular cultural activity, while synagogues were set up in wretched sheds on the outskirts of the camps so that only the old and sick would go there. In this way, the children were cut off from their parents and from their parents’ faith.”



On secular education, the textbook’s authors explain that “During this period of fierce struggle over the Jewish character of every sphere of activity and every institution in Israel, the hollowness of secular education became obvious. The Ministry of Education director frankly admitted the failure of secular education, whose outcomes could be seen clearly in our generation, stripped bare of ideals and sunk in the depths of materialism… The academically educated also demonstrated the failure of secular education; many who did not manage to attain the ‘affluent society’ lifestyle, left the country.”
 



Empty chairs instead of women

In two other areas, there were no surprises: the attitude towards women and science and scientific discoveries. Haredi textbooks on nature and science make no mention of Darwin’s theory of evolution, but there is a limited reference to important scientific discoveries, with an emphasis put on the religious and miraculous aspects. Behind every discovery stands the Creator, and clues can be found in the Bible for every invention.

Women, meanwhile, have seen a change in their status in recent years as they became the main providers in the Haredi home while the men went to study at the yeshiva. This is also how women are portrayed in ultra-Orthodox textbooks.

A poem in the textbook In Good Time for first graders describes “Mother” as one who “leads the home with wisdom and insight,” but also one whose role is “To wash the dishes and listen to stories / To hang the laundry and sing us songs.” Furthermore, the mother “respect(s) Father and serve(s) his plate first.”

The father, meanwhile, is described as one who “understands many things / And many people consult with him.”

However, the most prominent aspect in Haredi society’s treatment of women is their exclusion from the public eye. The ultra-Orthodox attitude toward women is succinctly described in the saying “All glorious is the King’s daughter within.” And so, there are no photos of women in  Haredi textbooks, though there are drawings depicting women.

One absurd example of this exclusion appears in an English textbook for the second grade, where students are asked to answer questions about family relations. The book features two photos—one of the male members of the family, and the other of the female members of the family. But instead of the women, the photo presents empty chairs.

Meanwhile, textbooks from the state education system or the state-religious education system, which come out in special editions for the ultra-Orthodox sector, mostly censor drawings and photos and exclude any mention of boys and girls coming into contact.

Also almost entirely absent from Haredi textbooks are Ethiopian Jews. And while the ultra-Orthodox textbooks harshly criticize slavery in the US, they are most likely the only textbooks in Israel to still use the word “kushim,” a Biblical word that was common and non-pejorative in the 1950s and 60s, but is no longer acceptable since it is now translated as “Negro.”

Exclusion of Mizrahi Jews

None of the textbooks examined in this study make any mention of Mizrahi rabbis or the historical events and the rich Jewish culture in the countries of the Mediterranean basin.

Sephardic rabbis of the older generation, such as Solomon ibn Gabirol and Judah Halevi among others, are covered extensively in Haredi textbooks. But from the end of the Sephardic Golden Age to this very day, Haredi history textbooks focus almost exclusively on the Ashkenazi community.

If this was the case only in the Ashkenazi ultra-Orthodox education system, which is known for its racist tendencies, that would be one thing. But it appears even at schools belonging to the Shas Movement—which claims to represent the Sephardic Haredi Jews—textbooks appear to ignore Mizrahi culture.

The study found that teachers at Shas’s independent El Hama’ayan (“Towards the Fountain”) educational network use textbooks written by Ashkenazi Jews, which deal only in the Ashkenazi cultural world. And when Mizrahi Jews are mentioned in the textbooks examined in the study, it is done in a condescending manner.

For example, “Bracha with Bracha,” which appears in the fourth-grade textbook Our Childhood, tells the story of a father from an Ashkenazi family who starts working as a teacher at a refugee camp and tries to help the parents of his students find work. Bracha, an emigrant from Yemen, comes to work at the Ashkenazi family’s home as a laundress.

While Bracha is industrious and thorough, she also quite chatty. “When I was 23, I already had five children, may the evil eye not affect them, because in Yemen women were married off very young, practically girls. And that was so the gentile neighbors won’t want, God forbid, to marry them. I was also married when I was about 14, and now I have 10 children,” she tells one of the family’s daughters.

Later, Bracha tells an Ashkenazi girl with “gaping eyes” that, “We Yemenites are very quick and we aren’t afraid of any work.”

Other than briefly mentioning the absorption problems experienced by emigrants from Muslim countries in the State of Israel’s early days, the Ashkenazi education system—both Lithuanian and Hassidic alike—hardly touches upon the discrimination of Mizrahi Jews in Israel, and significant events like the Wadi Salib riots or the Israeli Black Panthers Movement are not mentioned at all.

Furthermore, while the textbooks are filled with stories about the foundation of Haredi yeshivot in Israel, there isn’t a single mention of a Mizrahi yeshiva, not even the Porat Yosef Yeshiva, which is the leading yeshiva in the Sephardic Haredi sector.

Even Rabbi Ovadia Yosef, the most prominent religious leader and ruler among Sephardic Jews, is missing from Haredi textbooks. While the textbooks examined in the study deal with many influential rabbis, they are all Ashkenazi. Rabbi Yosef’s photo only appears in one textbook, and even then it appears as part of a story about another, Ashkenazi rabbi.



First of its kind study

IMPACT–SE, which is based at the Hebrew University in Jerusalem and was founded by Middle Eastern affairs expert Yohanan Manor, will soon mark 20 years of research work, almost all of which is dedicated to analyzing the content of textbooks, particularly in Arab nations. All of the institute’s studies are based on a condensed version of UNESCO’s standards for peace and tolerance in school education.

The report about the Haredi textbooks, meanwhile, is the first of its kind. The study, which examined 93 textbooks used in all grades over the last year, took months, mostly due to difficulty in figuring out which of the books were actually taught in the ultra-Orthodox education system. Furthermore, ultra-Orthodox education differs in the Lithuanian, Hassidic and Mizrahi sectors, making the study even more challenging.

“The problem with Haredi education is that it’s different to any other sector,” said IMPACT–SE CEO Marcus Sheff. “In the Israeli education system, like the one in Iran, Saudi Arabia or any other country we study, everything is organized and available online. With the Haredim, there’s a gray area. There are many different types of education: Recognized official education, recognized unofficial education, unrecognized…

“There is a list of textbook available in the Education Ministry’s records, but it’s hard to tell which of them were actually taught at the schools. That is why we focused on  Haredi textbooks that were definitely taught in the great majority of the educational institutions we’re familiar with. Of course, in many of the institutions meant to boys over 13, most if not all of the studies are religious.”

Sheff noted that while the study examined textbooks from the last year, “most of them have barely changed since the 1950s. This is not surprising, considering the fact that ‘the new is forbidden by the Torah,’ as Chazon Ish (Rabbi Avrohom Yeshaya Karelitz) said. Modernity is an enemy. Because of that, the Haredim view the Reform Movement as the biggest threat they face. They fight with everything they’ve got against Moses Mendelssohn, a man who died 230 years ago. When looking at the Western Wall and conversion crises, you can find the root of the problem in this study.”

Gaps between Haredi  textbooks and reality

Rabbi Bezalel Cohen, the founder and head of the Haredi high school Yeshiva Chachmei Lev, knows these textbooks well. “The Haredi narrative is very clear, and continues throughout history,” he explains. “Those who left the tradition—the Jewish Enlightenment, Zionism, the Reform Movement—they are all a direct continuation of the Hellenists.

“This is exactly what we’ve been seeing recently with the Reform Movement and the Western Wall crisis, or the conversion crisis. The ultra-Orthodox are confident that anyone who thinks differently does so out of malice, stupidity, or indifference toward the Torah, piety, and the people of Israel. And that is a problem,” he continues.

According to Cohen, the absence of the Mizrahi narrative is not necessarily a result of racism. “The history books teach about central figures in the historical narrative, and Sephardic ultra-Orthodoxy continues that story, because it copied the model of ultra-Orthodoxy developed in Europe,” he explains. “In this narrative, Mizrahi figures play no significant role.”

What kind of impact does this narrative have?

“Like any narrative, its impact is mostly felt when the children grow up and realize reality is different to what they’ve been told. For example, a history textbook I taught for the Haredi matriculation exams tells the story of Sabbatai Zevi, whose claim of being the Messiah was rejected by Israel’s greatest religious leaders, but the people still flocked to him. Then one of the students raised his hand and said, ‘But many of Israel’s greatest religious leaders also followed him.’ I said, ‘That’s true, but the writer (of the textbook) doesn’t want you to know that.’ And what happens to a student who comes across this dissonance? He realizes the history he has been taught is not true, and then he questions everything he was taught. To me, that is a big problem.”

Jerusalem police arrested two residents of the capital Monday night, on suspicion they sexually assaulted an underage female relative over the course of several years.

The two suspects, both in their 20s, are the uncle and brother of the alleged victim, say police, who filed a complaint against the suspects on Sunday.

According to the complainant, the two men sexually abused her for years, committing a number of different vile and indecent acts on her.

The girl, 15, told investigators the assaults usually took place in the basement shelter of her family’s apartment building.

After suffering years of abuse, the teen said she could no longer bear to go on, and with the aid of her school guidance counsellor, turned to the police with a plea for help.

“The girl could no longer bear these acts and decided to turn to the guidance counselor at the school she attends, who then immediately accompanied her to a police station to register a complaint,” a police spokesperson said.

“The girl spoke with a female investigator from the police youth [division], exhibiting courage but also a great deal of pain as she shared with her the terrible sexual assaults she had suffered for years from people close to her.”

After opening an investigation into the two suspects and gathering evidence for an arrest, police took the girl’s brother and uncle into custody.

The suspects linked themselves to the crimes during interrogation, police say. The two will be brought before a Jerusalem court later on Tuesday for an extension of their arrests.

An initiative called Din Ve’Cheshbon, or “Settling the Score” in Hebrew, has been launched to encourage victims of sexual assault in the haredi community to come forward and demand compensation from sex offenders and persons who supported their attackers or helped keep their offenses quiet.

The project coordinator Nachman Rosenberg says it began with haredi businesspeople from abroad who have become increasingly outraged at the growing number of news reports regarding sexual abuse against women, children and youths in the community which are not appropriately dealt with.

In March, for example, the police apprehended almost two dozen suspected haredi sex offenders in Jerusalem and three haredi-majority cities, after having previously arrested the head of a so-called Modesty Guard committee in the haredi community who was found to be in the possession of numerous records of men who had committed sex offenses.

In the majority of cases, the head of the Modesty Guard would instruct the perpetrators to get some form of therapy within the haredi community but would not report their crimes to the police.

 
“The common denominators of incidents in the haredi community are that frequently the abuse went on for a long time, people knew about, it was suppressed and because of that hundreds of kids affected,” says Rosenberg. “This makes haredi children very vulnerable.”

The businessmen behind Din Ve’Cheshbon, who Rosenberg says wish to remain anonymous at this stage, have donated some NIS 500,000 to finance civil lawsuits against sex offenders or anyone who helped support a sex offender or hush up his crimes.

The money will be used to provide victims with the professional and legal assistance to conduct these suits, as well psychological help if necessary, and is provided for free.

Rosenberg says that following the launch of Din Ve’Cheshbon earlier this week, the project received dozens of calls and messages from people with a story to tell about sexual abuse within the community.

A website at www.dinvcheshbon.com with an online form to submit a report about sexual abuse has been created, as has a Facebook page where reports can also be filed.

“Have sex offenders harmed you? Did institutions and community wheeler-dealers silence you? Did the authorities abandon you? They should pay, dearly,” reads an advertisement for the organization.

Rosenberg said that the uniqueness of the initiative is its emphasis on tacking the culture of silencing complaints which creates “a fertile environment for sexual offenses.”

“Unlike what happens in criminal proceedings where only the offender pays a price, in civil proceedings those who did not act responsibly and morally and in accordance with the law regarding an incident which they became aware of [do],” he said.

“Teachers, educational advisers or school principals who violate the duty to report sexual assault; employees of welfare departments who gloss over cases and do not handle them according to the required procedures; or an institution that continues to employ an offender while aware that this offender may continue to inflict more harm every day – they should know that there’s a heavy price to pay for this.”

A disgraced rabbi who admitted to criticising victims of sexual abuse has been appointed principal of a school which allegedly covered up sex crimes.

Meir Shlomo Kluwgant resigned as Australia's most senior rabbi in 2015 after admitting to calling the father of a child abuse victim a 'lunatic' who 'neglected his own children'.  

Kluwgant will now head Melbourne's Adass Israel School, which has been previously accused of helping a former principal flee to Israel amid allegations she sexually assaulted students, a letter allegedly distributed to staff and published online shows.

'We are pleased to advise that we have appointed Rabbi Meir Shlomo Kluwgant to assume Dr Herszberg's role. They will be working together collaboratively for the remainder of the year, to ensure a smooth transition,' the letter reads. 

It tells staff the controversial Rabbi was chosen after a 'global recruitment process', and with 'the full support of the Board and Executive'. 

Former principal Malka Leifer allegedly abused at least eight girls while she was principal of the Elsternwick school between 2003 and 2008.

When the allegations came to light, Leifer fled Australia with her family in the middle of the night, allegedly with the help of school officials. 

She remains in Israel and has refused to return to Victoria were she would face prosecution for 74 sexual abuse offences against former students. 

In 2015, former student Dassi Erlich, now 30, brought a civil case against the school – which was ordered to pay her $1,024,428 in damages.

On Sunday, Ms Erlich penned an emotional open letter urging Adass Israel to reconsider the appointment of the controversial rabbi.

'A letter I never thought I would have to write,' Ms Erlich began the letter, addressed to the members of the Adass school board.

'I implore you, please do not make the mistake of hiring Rabbi Kluwgant. When you hire a principal it is not merely an administrative matter, it is a statement of your moral code as a community. 
'I was hoping my case encouraged change in your culture of silence. This new appointment tells me nothing has changed.

'Is it your intention to make it that much harder for the already terrified victims to come forward, with this additional hurdle to overcome?'  

Once the president of the Organisation of Rabbis of Australasia, Kluwgant resigned just days after appearing in the witness box at the royal commission into institutional responses to child sexual abuse.

Sorting Through The Rubble - The Message Is Clear!

Don't take my word for it!

Don't believe a word I say - unless I can logically and factually back it up. And the same goes for anyone with a message, any message from any messenger. It's either true and can be established, or it's hyperbole and rabble-rousing by clown-type imbeciles, costume and all, with nothing else to say but "trust me", I know what's best for you, your children and everyone that I/we deem a Torah-true Jew.

This has been the mindset for at least two decades, certainly since the passing of Rabbi Yaakov Kaminetzky z"tvkl. And Rav Yaakov saw this era coming, the era of Yiddishkeit being distorted and shredded by people with absolutely no sense of reality, and the lack of understanding and caring that what was good for the individual, the yachid - was good for the klal - the masses --- and not the other way around.

So, if thousands of kids were herded through a flawed yeshiva system, a system that did NOT care for the individual child, but rather thrived on numbers, and raised funds based upon being the "biggest" yeshiva, with great numbers of kids in their system, the individual - mostly regular great kids, very normal kids that needed unconditional love and attention, would get lost in the shuffle.

Rav Yaakov understood that, Rav Elya Svei did not. The Lakewood gang did not and we are now paying the price; thousands of families that were emotionally forced to engage in this fraud called kollel, are now poverty stricken, and a great deal of them, their parents, and their children paid with their souls. This community induced poverty was a desperate attempt by the Establishment to reel in the masses under the control of a few. If you need organizations and yeshivas to sustain you and your family, who would bite the hand that feeds you?

Entire families are disenchanted with Judaism, not just children. I guess the Agudath Israel can now develop a new government sponsored program -- call it Project NO - and have it headed by one of their own, someone who talks the talk, walks the walk, but when it comes down to the underlying failures of the program, for the inability to comprehend and address the real issues, old and new, he will toe the line of the establishment, rather than standing up for the brutal reality, and those victimized and re-victimized.

It was not that long ago when an acquaintance of mine, a true ben Torah with a large family living in Lakewood, took a chainsaw, and decapitated himself. Other contemporaries of mine have confided in me that they despise what has become of them, and hate waking up in the morning. They have been totally neutered, by them having to rely on their wives supporting them, and regularly signing documents to enable them to receive Welfare in one form or another.

A bright high school buddy of mine died oh so young, by intentionally destroying his body with food and alcohol and God knows what else he consumed to put himself out of his misery. He was not a flunky kindergarten rebbe, he founded and headed a large school.

Another former yeshiva friend, was instructed by his rosh yeshiva to go on a taanit dibbur, stop speaking entirely, until he purged himself from his inclination to gossip and speak loshon hara. He cracked up and spent years in a mental institution. He lives in Lakewood, the last I heard was that he is permanently emotionally disabled.

These are not isolated cases, there are countless horror stories similar to the above that I am aware of.

My educated and informed guess is that Shua Finkelstein in Lakewood put himself out of his misery, because the Lakewood Mafia protected his molester. His molester is part of a family that donates large sums of money to Lakewood - Beth Medrash Govoha. The Lakewood philosophy of dealing with child-abusers in a "respectful and dignified" fashion, in my opinion, played no small role in Shua's death.

It is no coincidence in my mind, that David "Fifi" Zahler, who over the last years developed a close relationship with Moshe Eisemann on the Ner Israel campus in Baltimore, intentionally jumped to his death. Nobody dares to say this publicly, that's why I will.

The System is broken, it collapsed under its own fraudulent weight; the evidence surrounds and envelops you, but you refuse, or are too petrified to deal with this reality!

"Once we could say we didn’t know. Now we know." Borrowing from David Zwiebel's "confession" -- David, we now know as well, you and your organization, Agudath Israel, are pitifully corrupt and morally inept, nobody should be trusting any important life and death issue to you and your cohorts! And that's believing for a brief moment that in fact you now know because you really know or because you were "forced" to know, rather than choose to know. In either case, evidence of sexual child-abuse in Orthodox Jewish schools and camps has been festering out there for some fifty years, including in your own summer camp and in hundreds of your directly affiliated schools, and yet you did nothing to protect these violated children, and did everything to protect the vile child sex-abusers and the criminal, despicable rabbis that protected them.

You all have lost any moral authority on this issue -- and worse, you all deserve to be held criminally negligent and responsible for the thousands of troubled lives and God only knows how many related, self-destroyed lives by children who could no longer bear the pain.

So, I'll have none of your continued lies; when I chose to dig deep into the authenticity of what else you and the likes of you were selling; I became aware of the extent of your involvement in covering up these unspeakable crimes, and I, to my horror, discovered that except for a handful, the rest of you are petty, conniving, mind-thieves without a scintilla of a moral conscience.

The message is so apparent -- none of these rabbis should be able to dictate to you what's in your best interest -- because they are destroying our Jewish heritage to cover up their own crimes, where "d'racheha darchei noam" should be first and foremost; instead they are damning our children and ultimately us, all of us, to an unsustainable and self-destructive life that is causing misery and desperation to the vast majority of Orthodox Jews. We must set up a bulwark that will prevent the espousing of poverty and misery as a way of life, foolproof systems of protecting our children, in and out of yeshivas, from those that would destroy them by enfeebling their minds with their self-manufactured religious rubbish, and not protecting their physical and emotional well-being that were entrusted to their care; that not only is the antithesis of everything Jewish, but it is anti-Jewish!

Rabbis and their underlings, that would protect pedophiles and their enablers at the expense of our children and our families -- whether the crime occurred yesterday or forty years ago, must be treated as amongst the greatest enemies that ever faced the Jewish nation.

These rabbis stand stark naked before us -- and it is ugly! They must be taken down!

CLICK ABOVE PHOTO! Rabbi Moshe Feinstein states the very marriage of a gentile woman to a non observant Jew, is equivalent to an open declaration that she will not observe the precepts. This is so, because it is highly unlikely that the gentile member of such a union, will be more committed to Judaism than her remiss Jewish husband (certainly when they are living together prior to their marriage). Unlike mental or tacit negations, explains Rav Feinstein, open declarations do invalidate conversions. When such cases appear before a rabbinical court, its members actually become witnesses to an acceptance declaration that is not sincere. Therefore, it is no longer a tacit insincerity, but rather an obvious one. As such, they are forbidden to sanction the conversion. Regardless of what this Jewish court may declare, the conversion is invalid and the person is not deemed a member of the Jewish nation. In Iggros Moshe, Letters of Moshe (Yoreh De’ah, no. 157), he writes that “According to the Law, it is certain that one who converts for the sake of marriage, does not intend to keep the commandments, and is not a proselyte at all.”
