I Urge all readers of the blog to take the time, immediately, and whenever possible, to contact Sol Werdiger and let him know the message we want him to convey to the Gerer Rebbe: that we are not going to tolerate any more coverups and whitewashings for Mondrowitz; that this man must face justice for abominable crimes; that anyone who aids or protects a criminal is morally as culpable as the criminal himself; and that we will be sure to expose anyone guilty of coverup just as we are succeeding in exposing the story of Mondrowitz. They might mention Pirkei Avoth, 4:5: "Whoever is mi'chalel Hashem in secret will be chastised publicly."

I think this man should hear as much as possible from as many people as possible who are tired of the coverup of Mondrowitz.

Mondrowitz is being held until NOVEMBER 27 (which is his 60th birthday, by the way) when there will be another hearing to determine whether he is to remain incarcerated or released with an electronic tracking device. His lawyer, David Ofek, argued today that the court will have to determine whether he can be held because of the "statute of limitations."

We have to be disciplined and focused in our response. So, for right now... let's hit Werdiger. Hard, and repeatedly. I want him to be so stunned in the next few days he'll be asking the rebbe to do something, anything to get him out of trouble.

DECISION



1. In the matter of the request to extend the detention of the Respondents pursuant to Article 7 of the Extradition Law of 1954 (“Extradition Law”).



2. In 1985 the Respondent was issued an indictment in New York, United States on the charges of sodomy and other sexual assaults against five minors between the ages of nine through fifteen. The authorities of the United States issues an arrest warrant against him. However, before they were able to execute the warrant the Respondent fled to Israel. That year, the American authorities requested that the Israeli Government extradite the Respondent back to the United States. At that time the treaty between the two countries did not allow extradition for the crimes the Respondent was accused of. The State of Israel decided to remove him from the country. During that process, the Respondent appealed to the Israeli Supreme Justice Court and the State of Israel decided to abandon the proceedings of his removal. From that time on, the Respondent has been living with his family in Israel.



3. During the course of the past year the protocols of the extradition treaty were modified in a manner in which the crimes that the Respondent stands accused of by the courts of New York became extraditable crimes. In September 2007, the United States authorities requested the extradition of the Respondent from the State of Israel.



4. The Respondent was arrested on November 11, 2007 pursuant to Article 6 of the Extradition Treaty. The Requester now asks for an extension of the Respondent’s incarceration for an additional 12 days for the purpose of obtaining an updated extradition request to amend the request filed many years ago.



5. A hearing of the allegations was held before this Court on November 16, 2007. The Representative today introduced the following additional facts. In May of 2007, a search was conducted of the Respondent’s home where four films containing child pornography were discovered. The Requester also argued that the likelihood of the Respondents fleeing is high if he is not detained, because of his recent knowledge of the change in the Extradition Treaty which now allows his return to United States. The Requester further argues that the Respondent is a threat to the public as evidenced by the above material discovered in his home.



6. The Respondent argued that there are issues of statute of limitations and extensive period of time that has passed since the initial extradition request was made and denied. The Respondent requests that he be released in a manner which assures that the Respondent will reappear once the extradition proceedings commence, even suggesting that the Respondent be released to house arrest and monitored via an electronic monitoring bracelet.



7. The first question to consider is if the Respondent is a candidate for extradition based upon the revised extradition treaty? (See paragraph 6 of the extradition treaty.) We need to answer this request in a positive manner. The treaty between the two countries today states that these offenses are extraditable crimes. The Requester holds affidavits given on behalf of the victims/complainers against the Respondent about the crimes that the Respondent committed. All this evidence is the basis for the indictment against the Respondent, by the Unites States government.



8. Regarding the Respondents claim as to the statute of limitations and the large amount of time that has elapsed, Paragraph 2B (a) 6 of the extradition law, the upholding of the law is conditioned upon the time of the crime or its punishment not exceeding the statute of limitations according to Israeli law. According to paragraph 9 (a) 2 of the Israeli criminal code of 1982, a person cannot be prosecuted for a crime (except in death penalty or life in prison cases) if a period of ten years has past since the day the crime was committed. According to paragraph 9 (3) the statute of limitations commences either from the time of the last day of the investigation, or the day of the indictment or the last day of the proceeding in a court of law, whichever comes last. In our case, all of the proceedings as stated in paragraph 9 (3) above, occurred over ten years ago. The Representative of the government expressed that the statute of limitations might be an issue, however the courts in previous verdicts have recognized other cases where the statute of limitations was frozen where the accused has escaped before prosecution. Based upon paragraph 94-1 (3) of the criminal code, we can come to reject the claim against the statute of limitations.

I have reviewed this case and concluded that there is a solid basis for the Requesters request regarding the statute of limitations; however this issue has some effect on my decision as to keeping the Respondent incarcerated as I will explain.



9. Another question that paragraph 6 of the extradition law raises is if there is a probable cause that an extradition request shall be filed? To that we answer in the affirmative, and the United States government has declared specifically that it will do so.



10. According to the previous decisions, in a hearing where the subject is in accordance with paragraph 7 to the extradition law, the court shall consider the regular arguments for keeping a person in custody, among them being the safety of the public, the concern of interfering with the investigation and primarily the fear of the accused fleeing, which is a permanent concern in a case of an extradition proceeding. In addition, the court shall consider the commitment that Israel has towards the requesting country – a commitment that is established in an international treaty that is the basis of the extradition law- to extradite the suspect and allow his extradition to the requesting country. This last consideration is a crucial one in a sense that at times it is justified to keep a person in custody even though general custody considerations state that he is to be released, because of the extra dimension that is as a result of Israel’s duty towards the requesting country. Banish (aka) see case #4422/03 Yitzchak Cohen vs. Attorney General.] These considerations are brought into account also during a proceeding of a requesting of incarceration prior to declaring a person extraditable [See case Jerusalem 11287/04 attorney General vs. Zev Rosenshtien.]



11. In our case, consideration for continued incarceration evolved from danger to the public and fear of the accused fleeing from justice. As to the consideration of danger to the public, findings of the investigation against the Respondent by the Israeli Police Department create a probable cause that the accused is still an active or potential pedophile. The fact that against the accused no criminal offenses have been brought does not negate the known danger of these offenses, especially in the ultra orthodox sector that the accused belongs to, because the victims and their families very often do not complain to the police because of the will of that sector to attempt to solve those problems internally without police involvement, to avoid humiliation to the family. I am not establishing that the accused has commenced any crimes in Israel, but I am not ruling that out either. The fear of fleeing from justice evolves from the revised treaty that allows the extradition of the accused to the United States, a situation that did not exist during the entire period of the accused’s stay in Israel. Additionally, one must bring into account the commitment of the State of Israel towards the requesting country that was established in an international treaty that is the basis of extradition law.



12. All of the above leads me to the conclusion to grant the Representatives request and to hereby order the continued incarceration of the accused. Nevertheless, due to the legality of the statute of limitation as I stated above, there is no room to rule out a potential alternative to incarceration as suggestion by the accused council.



13. Therefore, I hereby extend the incarceration of the accused as requested until November 27, 2007 at 12:00 PM. I am ordering a recommendation report of the Probational Service Office for consideration of a substitute for incarceration including house arrest with an electronic monitoring device. The report shall additionally consider the danger that the accused possesses. The report shall be submitted before the end of the term of incarceration. The report may be used by this court if an additional request for incarceration is filed according to paragraph 7A of the extradition law or if there is a request to declare the accused as extraditable.

14. The secretarial office shall send a copy of this decision to the probation service office.

JERUSALEM - A Jerusalem magistrate Sunday ordered a former Brooklyn rabbi accused of raping several boys 20 years ago to jail while American and Israeli officials finalize a U.S. request for his extradition.

Avrohom Mondrowitz, a father of seven, faces extradition to stand trial in New York to answer a 1985 indictment on four counts of sodomy and eight counts of sexual abuse in the first degree.

Mondrowitz, 60, once a popular child psychologist and youth counselor in Borough Park, allegedly sodomized the boys after befriending them or after taking them on trips to the movies and amusement parks.

The U.S. extradition request, resubmitted in September after a change in the treaty between the U.S. and Israel, was delayed after one of the five complainants withdrew from the case.

The U.S. Justice Department is expected to file an amended request this week.

Mondrowitz was arrested early Friday morning at his Jerusalem home and arraigned the same day.

Judge Shimon Feinberg, vice president of the Jerusalem Magistrates' Court, found that Mondrowitz was a possible candidate for extradition and rejected defense arguments that the statute of limitations applied to the offenses, even though they were allegedly committed more than 20 years ago.

Feinberg granted a prosecution request to extend Mondrowitz's imprisonment until Nov. 27 after the prosecution told the court that an Israeli police raid on Mondrowitz's home in May had netted four pedophile movies.

Mondrowitz is due to appear in court again Nov. 27, when Feinberg will decide whether to extend his jailing until the end of the extradition proceedings, which could take several months.

Mondrowitz's wife, Raizel, declared his innocence.

"People can come up 25 years later and say all kinds of things about anybody. No one's had any complaints about him for the last 25 years. This is all old stuff," she said.

The debate about whether the Haredi or modern Orthodox leadership has been more negligent in dealing with sexual abuse and which abuser is worse is at best a side show. Thr Mondrowitz case has raised serious questions about how the Orthodox rabbinate responded to the many accusations that emerged twenty plus years ago in Brooklyn.

Since almost no one has denied his guilt, minimally a public statement should be made expressing sympathy for his apparently many victims (my sources say that he sexually abused essentially all the boys that were sent to him)and support for his being extradited. It is also neccesary that there be a thorough investigation of the reports that various rabbis discouraged Jewish children from cooperating with the police and were complicit in his fleeing to Israel after being indicted. If these allegations are false then no one should be afraid of the facts being uncovered.

Alexandria, Va. - Millions of children around the world are being sexually abused and molested. Billions of dollars are changing hands as part of a growing crime wave of child pornography. This is anything but a victimless crime. Children – some as young as infants – are being barbarically assaulted for the sexual gratification of their abusers and those who view their photos.

While inroads have been made in the fight against child pornography, the problem remains severe. We have much more to do.

The Internet has become a child pornography superhighway, turning children into a commodity for sale or trade. Analysts at the National Center for Missing & Exploited Children (NCMEC) have reviewed 9.6 million images and videos of child pornography on the Internet just since 2002. There are millions more such images in cyberspace that we have yet to find.

Law enforcement agencies are cracking down on this crime wave. In November, the chief operating officer of the National Children's Museum in Washington was arrested and charged with distributing child pornography over the Internet. Also this month, police across Europe announced they had arrested nearly 100 people linked to a network that allegedly produced and sold child pornography videos to 2,500 customers worldwide.

In 1998 Congress asked NCMEC to create a "9-1-1 for the Internet." We established CyberTipline (www.cybertipline.com), which has received more than 500,000 reports from the public and Internet service providers regarding child sexual exploitation. More than 460,000 of those reports involved child pornography.

What is child pornography? It goes far beyond nude pictures of children. It is the visual depiction – whether in still photos or video – of children being sexually assaulted. In some instances, rapes of children have been shown live over the Internet to paying customers. In 1982, the US Supreme Court held that child pornography is not protected speech but child abuse.

Some suggest that many people who view child pornography just "look at the pictures." But our work on these cases has led us to conclude that for most of those who view these images, sex with children becomes a compulsion and evolves into physical acts with real children.

When NCMEC analysts scour the Internet for child pornography, they determine whether website content is illegal, use search tools and techniques to identify and track down the distributors of child pornography, and then provide the information to the appropriate local, state, federal, or international law enforcement agency.

Law enforcement agencies and NCMEC have managed to identify almost 1,200 of the many children who appear in child pornography. We have found that 35 percent of the photos were taken by a parent, 15 percent by another family member, and 20 percent by someone close to the child or the family. We have provided more than 12,000 evidence reports to prosecutors and law enforcement officers to assist in prosecutions of those accused of these crimes.

Sadly, NCMEC has found that the children being used in these images are getting younger and younger, and the images are becoming more graphic and more violent. Of the children in pornographic photos and videos who have been identified, 58 percent had not yet reached puberty.

To stop the use of credit cards that fuel the child pornography industry, NCMEC created the Financial Coalition Against Child Pornography. Today this coalition includes 90 percent of the US payments industry, with growing international involvement. The 30 companies in the coalition include MasterCard, Visa, American Express, Bank of America, Citigroup, Microsoft, America Online, Yahoo, Google, and many others.

Thanks to the participating companies and extraordinary leadership from federal, state, and local law enforcement, we have virtually eliminated the use of credit cards in child pornography transactions. Although credit card logos still appear on some sites, now when consumers attempt to use credit cards, they either become victims of identity theft or are redirected to another method of payment.

In too many places around the world, the possession of child pornography is handled as a relatively minor offense. In fact, in 136 countries it is not even a crime.

Children depend on adults to keep them safe. We need to do more to protect them from dangerous, cold-hearted predators who want to harm them for pleasure and profit. We need to recognize child pornography as a crime against humanity that must be attacked more forcefully and that deserves harsh punishment.

They sheltered a predator of children and denied the victims justice for over twenty years, all the while endangering more children. If these rabbis were so dense that they didn't realize that doing that was wrong, then I can't trust their judgement on anything, from the meaning of a parsha to whether or not something is kosher. Since their "leadership" is based on their learning and judgement, and since that is now totally in question - they are no longer leaders. Their authority and opinions are now worth zero.

Further, real "leaders" are supposed to set an example for those who follow them, even if it means taking a risk. Remember Nachson at the Sea. Everyone else was afraid, and he jumped right in. These "leaders" were either too stupid or to afraid to do the right thing. They let their fears overcome them when the chips were down, and through this, more children were endangered. So, on yet another count, they abdicated and thus invalidated their leadership roles. They are no longer anyone's leaders. If you trust them, then you are following people of questionable judgement and who have already abandonded the threatened in our community before, so how can you expect them to do the right thing or make the correct decisions now?

Trader Joe’s pulls Empire Kosher poultry from Western stores

The Trader Joe’s specialty-food chain decided recently to pull the products of the world’s largest kosher poultry provider and distributor, Empire Kosher, off the shelves of some 150 West Coast stores.

Officials from both companies declined to say why Trader Joe’s, a 216-store chain, decided to cease selling fresh Empire Kosher chicken and turkey in five Western states. The move comes after 14 packages of Empire skinless, boneless chicken breasts were removed from the shelves of a Central California Trader Joe’s market on March 18 after a random county inspection found they weighed an average of 9.8 percent less than their labels stated.

Trader Joe’s vice president of marketing, Pat St. John, declined to discuss why the company’s West Coast buyer decided to replace Empire with its kosher competitor, Rubashkin’s Aaron’s Best. St. John said Empire “could no longer supply our needs” but would not elaborate because “they are still a valued vendor to Trader Joe’s.”

The chain continues to sell Empire chicken and turkey in 68 stores in the Midwest and on the East Coast.

Empire’s new president and CEO, Robert Van Naarden, said packages of meat can carry incorrect weights if the company’s scales become miscalibrated. Asked if that had occurred with meat sent to Trader Joe’s, he responded: “I don’t know. It might have,” but emphasized that any problems had been remedied.

Empire’s products are packed, weighed and labeled for sale at its Pennsylvania plant.

“I believe there are other factors at work here,” he said, suggesting that the chain’s West Coast buyer wanted to make room for non-kosher products. “That doesn’t mean I won’t work to fix what they say are problems.”

Van Naarden, a member of a group of investors who purchased Empire Kosher several months ago, said consumer demand would prompt Trader Joe’s to abandon Rubashkin chicken.

“If they [Trader Joe’s] want to go to an inferior product, it’s up to them,” he said. “Their customers will tell them.”

Empire, a privately held company, has been selling kosher poultry since 1938 and supplies more than 50 percent of the kosher chicken sold in North America, Van Naarden said.

“Trader Joe’s may have seen some things they don’t like. Fair enough,” Van Naarden said. “I respect them. … All the things Trader Joe’s is concerned about, as are other customers, are being addressed every single day.”

Trader Joe’s, which prides itself on offering an array of high-end gourmet and imported items at bargain prices, sold Empire’s fresh boneless, skinless chicken breasts; eight-piece cut-up chickens; ground turkey; and turkey breasts. In many West Coast communities that lacked kosher grocery markets, Trader Joe’s was the sole outlet for fresh kosher poultry. And, in some areas, the kosher products at Trader Joe’s were priced lower than comparable frozen products in other supermarkets.

An informal survey conducted by the Forward of employees at five Trader Joe’s stores in Northern California indicated that at some stores Empire had continuing problems with spoilage and inaccurate package weights, resulting in incorrect pricing for customers. Employees at two Trader Joe’s outlets in Northern California told customers that Empire was unable to consistently supply enough stock. “It’s frustrating and it makes us look bad,” said an employee in Trader Joe’s Los Altos store.

The loss of the Trader Joe’s West Coast account occurs just a few months into Van Naarden’s tenure at Empire. He described Trader Joe’s decision to cease sales of Empire at most of its stores as “temporary.” He said his company would increase inventory at other supermarkets in the five-state area where it had been shut out of Trader Joe’s stores.

Neither Empire nor Trader Joe’s was fined after the March 18 inspection, but they were asked to correct the problem. State law requires packaged meats to weigh no less than 97 percent of the weight stated on their labels.

The breasts sell for $5.49 per pound, so a 10 percent error on a pound of meat would result in a 55-cent overcharge.

Robert Lopez said it was the first time in his 13 years as a weights and measures inspector for San Luis Obispo County that he had to prohibit the sale of Empire products.

Ken Lake, program supervisor of the California Department of Agriculture’s Division of Management Standards, said the mislabeling appeared to have been isolated and was quickly corrected. “Even the best packers have some things removed from sale,” he said.

St. John said Trader Joe’s has no plans to reinstate Empire despite a four-year relationship. She would not say whether the chain will switch all its stores to Rubashkin’s.

Empire poultry disappeared abruptly from Trader Joe’s refrigerated shelves after Passover.

Rubashkin’s Aaron’s Best, a meat vendor that added poultry to its offerings in 1992, was delighted to pick up Trader Joe’s West Coast account. Its arrival this month marks its debut in the West Coast market.

“When they contacted us, we had no idea they’d already booted Empire out,” said Heshy Rubashkin, vice president of marketing and sales for Iowa-based Agriprocessors, which makes Rubashkin’s Aaron’s Best products

PORT WASHINGTON, N.Y. (MarketWatch) -- Whether the Federal Reserve realizes it or not, the United States economy is reeling from a one-two punch of plunging real estate values and a full-blown credit crunch that might not be alleviated with additional rate cuts.

While the Fed might have had a role in creating what has come to be known as the subprime mess, because of the way it has evolved, the Fed's ability to deal with it is rather limited. There are a number of reasons for this.
First and foremost is the fact that, on the real estate side, the damage has already been done.
Because short-term interest rates today are well above the 45-year lows plumbed from the middle of 2003 through mid-2004, those mortgages with adjustable rates have -- or will -- reset to much higher rates even if the Fed decides to lower rates by a quarter of a point or even more.

As a consequence, there will likely be more delinquencies and foreclosures, which, besides causing pain for those homeowners, will result in more homes on the market, thereby depressing their prices.

In turn, this will affect other homeowners -- even those with fixed rate mortgages and who and are current with their payments. They will likely be unable to use their homes as ATMs, tapping the equity to supplement their incomes.

They can't turn to savings, either, since, collectively, the nation's homeowners have been spending more than they have been earning for the past two years. The last time this happened was at the bottom of the Great Depression.

This alone is why consumers are reducing their outlays on all kinds of goods and services -- luxuries and necessities alike. Indeed, you know there's a problem out there when Starbucks (SBUX:Starbucks Corp SBUX 22.95, -0.15, -0.6%) reports a decline in traffic in response to -- among other reasons -- a 9 cent hike in the price of a cup of coffee.

Another reason why the Fed alone will not be able to ameliorate this crisis is that its main jurisdiction is over the banks -- and the problem is now centered in the financial markets. This is because the banks no longer have these loans on their books, having turned them into securities and sold them to others.

In turn, these mortgage-backed securities were used as collateral for the issuance of debt, whose value, as you know, is far lower than originally thought.
This has caused massive write downs by holders of these securities, cutting into their profits -- but, more important, depleting confidence in the financial system. And this reduction in confidence is spreading beyond the financial markets and residential real estate to commercial real estate as well.

To the extent the banks are involved (by holding on to some of these securities), their capital is being reduced and thus their ability to make new loans.
I need not remind you that the ability to borrow money is the lifeblood of not just business --but consumers, too.

Not surprisingly, the combination of lower real estate values and reduced availability of funding is beginning to reduce business spending on new plants and equipment. This is overwhelming the positive effect that the lower-valued dollar is having on our exports.

So while the Fed is preoccupied with communications and forecasting, the financial markets remain frozen while the economy is melting down.

Talk about fiddling while Rome burns.

As is being widely reported, longtime fugitive from justice Avohom Mondrowitz has been detained in Israel in anticipation of his extradition to the United States to answer to charges of sexual abuse that were lodged against him 22 years ago.

According to the Israeli court decision ordering his detention, Mr. Mondrowitz fled to Israel following his indictment in New York in 1985 on eight counts of child abuse and five counts of sodomy involving five boys ages 9 to 15. The court decision notes that because Israeli extradition law was recently revised, Mr. Mondrowitz can now be extradited to New York to stand trial on the charges for which he was indicted. Though there are questions as to whether the statute of limitations has run on the charges, his detention and probable extradition are all to the good. The charges lodged against him were of the most horrific nature, and it is inconceivable that he should not be required to answer for them in a court of law.

Due, however, to the apparent disinclination to come forward on the part of the parents of Mr. Mondrowitz’s alleged Orthodox Jewish victims, he was indicted in 1985 only in connection with the charges made by the parents of non-Jewish children. Thus, even if the statute of limitations is ruled not to have run out and he is made to stand trial in connection with those charges, it does not necessarily mean any indictments can now be presented against him involving yeshiva youngsters.

We can’t think of a more powerful argument for the necessity of a new, more honest approach to the very real problem of pedophilia and abuse in the Orthodox community.

We must avail ourselves of all legitimate resources – which would include intra-community counseling as well as unhesitating resort to secular law-enforcement authorities. Our children deserve no less.

An Israeli court's decision last week to extradite an accused pedophile to the United States is giving renewed impetus to another sex-abuse case that activists say has languished for more than two decades.

Activists concerned about sexual abuse in the Orthodox community held a news conference last Friday in New York to renew pressure for action in the case of Avrohom Mondrowitz, who fled to Israel in the 1980s to escape prosecution for abusing several underage boys.

The news conference comes just days after a Jerusalem court ruled that Stefan Colmer, who was indicted on charges that he abused two haredi Orthodox boys in Brooklyn, should be extradited to the United States.

Colmer, 30, who fled to Israel to avoid arrest, is the first American to be returned under a revised treaty that permits the extradition of suspected sex offenders charged with crimes less severe than rape.

Mondrowitz, an Israel native who lived in Brooklyn before fleeing, was indicted by a Brooklyn grand jury on eight counts of sexual molestation, including sodomy. The Brooklyn district attorney at the time, Elizabeth Holtzman, requested Mondrowitz's arrest, but the request appears to have floundered due to a technicality of Israeli law.

Last month it emerged that the current Brooklyn district attorney, Charles Hynes, issued a new request for the extradition of Mondrowitz.

According to Hynes' office, the request was issued early this year, in January or February, after the U.S.-Israel extradition treaty was amended.

But according to a copy of the indictment, the charges against Mondrowitz included forced sodomy. As a result, claims Michael Lesher, a lawyer for several of Mondrowitz's alleged victims, Mondrowitz could have been extradited since 1988.

A cable dated that year from the U.S. Embassy in Tel Aviv, obtained by Lesher, similarly argues that a new Israeli law made the Mondrowitz case worth pursuing.

Nevertheless, Hynes did not pursue the case until this year.

Swept Under the Carpet?
Critics charge that he was influenced by a group of Orthodox rabbis who informally advise him.

"I'm certain of that," insisted Lesher. "We know that the Orthodox community didn't want this case pursued. Even today, I'm experiencing a lot of reluctance from rabbis familiar with the case."

Hynes' office refused to comment.

In recent years, sexual abuse has been a mounting concern in the Orthodox community -- a trend propelled by several high-profile cases of rabbis with long histories of abuse that allegedly were swept under the carpet by religious leaders.

The efforts of several activists, as well as bloggers whose anonymity provided abuse victims with a venue to speak about their experiences with discretion, have brought a number of instances of abuse to light.

"I think that the Colmer case would have gone a similar way," said Lesher, "if it hadn't been for the fact that a lot of people behind the scenes were so fed up with cases like Mondrowitz that they were willing to work with victims and with people like me to see that the case did go public."

Activists with United Food and Commercial Workers stood outside kosher supermarkets and Trader Joe’s stores around the country last Wednesday, distributing fliers that purported to be a “Kosher Food Safety Alert.” The fliers cited controversial reports — many of them published in the Forward — about food-safety issues at the Postville, Iowa, slaughterhouse.

Perhaps most provocatively, the flier claims that in 2006, AgriProcessors was cited five times for “violations of ‘mad cow’ safety rules.”

The UFCW echoed these claims in full-page advertisements in Jewish newspapers and in automated phone calls to thousands of households in Orthodox neighborhoods

The debate stems from a series of documents released by the United States Department of Agriculture after a Freedom of Information Act request from the UFCW. These documents show that the plant was cited for violating rules designed to control mad cow disease

The food-safety concerns are only the latest controversy that has beset AgriProcessors. The slaughterhouse has also been criticized for the labor conditions at the plant and for the treatment of animals there.

KosherToday, a trade publication that has defended AgriProcessors, wrote about the UFCW’s campaign this week and said that it had not hurt AgriProcessors sales and in fact may have helped.

“The net effect of the onslaught against Agri was that sales of its products in some stores have risen by as much as 30% and it has opened an unprecedented number of new accounts,” KosherToday wrote.

Rubashkin’s letter alleged that the UFCW is going after AgriProcessors because the workers at the plant have not joined the union. Rubashkin accused the UFCW of orchestrating “a textbook campaign… to force a company into submission to unionize a plant even when it is against the wishes of the workers.”

A spokeswoman for the UFCW, Jill Cashen, told the Forward that AgriProcessors had never asked employees if they wanted to unionize

In the materials it handed out last week, the UFCW cited two major meat recalls that AgriProcessors has made during the past year. In his letter, Rubashkin wrote that no “raw, fresh or frozen poultry and beef products” had been recalled. Cashen called this response “technically correct but extremely misleading,” noting that the recalled products were precooked frozen foods.

I haven't seen the union's newspaper ads of flyers yet, and I did not receive an automated telephone call, so I'm relying on what others have reported. Still, it seems to me the union overreached, and their ads and calls were tone deaf. Why did this happen? I don't know. I suspect the union relied on Jews who are not familiar with Orthodox communities to set the tone of the ads.

All in all, the union did not lie. Rubashkin did not either, although his responses regarding recalls and mad cow disease are very disingenuous.

I heard some people talking in shul there is already an attorney on the case. Can that be the reason why Rabbi Belsky was so protective over Kolko?

Arizona police are offering a $2,000 reward to anyone who can help them catch the suspect who allegedly raped a 1-year-old Russell Terrier, MyFoxPhoenix is reporting.

The dog was found abandoned near an animal hospital and when veterinarians examined the tiny pooch, they immediately called police.

Yesterday I saw something that literally made me sick. Someone made the most possible odious, repulsive, puke-inducing and repugnant comments about our saints of saints, Yaakov Avinu and Leah Imeinu. I can’t even repeat what the putrid coward hiding behind the blog D.B. said. Go see for yourself if your stomach is strong enough.

Quite often we witness people outraged at their Rabbis being denigrated, or even not addressed with proper respect. Sometimes numerous articles are written if the title is “mistakenly” ommitted by this or that journalist or bloggers, or if one chas veshlom dares questioning this or that decision of one’s Gadol. A flurry of angry comments flood the site after such a snafu, and the war of words rages for days on end. The fierce defenders of torah stand up with fire in their eyes to protest the disrespect showed to their Leader by that nasty individual, who must immediately apologize… or hang.

Yet… yet here… total silence. Not one protest. Not one condemnation, not an iota of outrage showed. I know. I know. There are a million excuses. He wants the attention, it’s better to ignore him, etc.

Are we really that shallow? What are we standing up for when we protest a Rav’s humiliation? Are we really standing up for Torah or that rabbi or gadol? Or are we standing up for our own little narcissitic ego? How come a little carelessness about a contemporary rabbi generates such emotions, yet when Yaakov Avinu is dragged through the mud, called a swindler, when Leah Imenu is compared to a Playboy bunny no one has anything to say? How can we not go crazy when we hear such utter defamation taken directly from ageless classic anti-semitic propaganda? How can everyone keep quiet when one who proclaims to be an observant Jew quotes from Third Reich’s textbooks and pub-mob?

I think this is precisely our problem. Our idiotic sectarianism isn’t about truths anymore. It’s not about priciples. It’s about me and myself and I and my. When a rav is insulted it is not the insult of Torah or righteousness we protest. It’s our own insult we stand up against. That’s how low we are. Yaakov Avinu doesn’t matter anymore. Apparent;y, he’s not a treasured figure in our History. Apparently, he’s not a fundamental part of Yiddishkeit.

I'm not making any of this stuff up. It is an open secret that the non-gerrer chasiddishe community in Israel WILL NOT take a gerrer boy due to all the restrictions that i mentioned.

Furthermore the gerrer girls school - Bais Yakkov D'gur in brooklyn was formed with the intention to have shidduchim for the gerrer boys in america. Until that school was formed gerrer boys had to be meshadech with a gerrer family in Israel.

The gerrer and non-gerrer chasidishe girls in NY who were going to a bais yaakov (or any other chassidishe girls school like Tomar Devorah) DID NOT want to marry gerrer boys. Again, that's the reason why the girls school was created.

Rabbi Dovid Cohen was the rabbinical advisor of Ohel at the time. He was the first rabbi informed of Mondrowitz’s atrocities. He was given first hand accounts in 1981 and did absolutely nothing except advising Ohel to stop referring clients to Mondrowitz.

Avrohom Mondrowitz, a member of the Gur hasidic movement who faces several counts of child sex abuse in the United States, was arrested in Jerusalem and awaits extradition to Brooklyn

He has been in Israel since New York police issued a warrant for his arrest in 1984 on charges of abusing underage boys, including acts of forced sodomy.

Just hours after his arrest, four activists in the fight against child abuse in the Jewish community met reporters in the Manhattan office of Michael Wildes, an attorney who also serves as mayor of Englewood.

“I don't see this as a moment for celebration,” said Michael Lesher, a Passaic attorney who said he represents some of the alleged victims. “There is so much more to be done to ensure that Mondrowitz is in fact brought back and that justice is in fact served. But it is a moment for gratitude for victims who had the courage to come forward and expose their pain, despite the fact that many rabbis from our community who should have been there to support them did not.”

According to Lesher, who said he confirmed the arrest with a spokesperson for Israel's Ministry of Justice, Mondrowitz was scheduled to have a hearing on the afternoon of Nov. 18.

Amy Neustein, a sociologist who has been outspoken on the issue of child sex abuse in the Jewish community, said, “Pedophilia has not been redressed by law enforcement and the systems we have in place to do it. Instead, rabbis were discouraging victims from coming forward. Today is a day of sunshine. With Mondrowitz coming back, it is my hope and my surmise that he is going to point a finger at others.”

Rabbi Mark Dratch, a former vice president of the Rabbinical Council of America and chairman of its Task Force on Rabbinic Improprieties, said there had been a “cover-up” of child abuse in some parts of the Orthodox Jewish community.

Dratch is founder and director of JSafe, the Jewish Institute Supporting an Abuse-Free Environment.

Speaking of the principle of lashon hora, which he defined as “derogatory or slanderous speech,” Dratch said, “Sometimes it is a tool to silence victims. Victims come forward with complaints and they are told, ‘Don't speak lashon hora.' This kind of approach is inappropriate.”

Mark Weiss, 40, said he is still haunted by the week he spent at the Brooklyn home of Mondrowitz a few months after becoming bar mitzva in 1980.

Weiss, who now lives in Highland Park with his wife and two sons, told NJ Jewish News that as a boy he “didn't fit the mold” and “had trouble fitting in” with the religious life in his North Side neighborhood in Chicago, where his father was “a rebbe in a very, very black-hat shul.”

Meeting with a reporter at a kosher restaurant on Manhattan's Upper West Side last week, Weiss spoke softly of being placed by his parents in a series of yeshivas in the United States and Israel before being sent to live with Mondrowitz, a rabbi “with a reputation for helping out kids who are having trouble fitting in.”

“He picked me up at the airport, and he wined and dined me. He took me to an amusement park. It was awesome, like this total attachment. He knew exactly how to push the right buttons, and I was this naive little kid. I wouldn't know a predator if he hit me over the head. I was just soaking up all the love.”

When they returned to the Mondrowitz home in Brooklyn, Weiss said, he discovered the rabbi's family was vacationing in the Catskills.

The man and boy were alone. Weiss said the rabbi proceeded to molest him and continued to engage him in sex acts during the week they stayed together.

“That happened every night,” said Weiss. “I remember thinking that once he started making moves on me that maybe this was a little strange, or maybe he was just being a little friendly and making me feel comfortable and affectionate. I didn't think twice about it. It's like when you have an animal that is out in the wild and has no natural predators, it will walk right over to something that wants to kill it and not know any different. You point a gun at a dog and the dog doesn't run away. It doesn't know any better.

“That was what I experienced, this nightly routine, and it never registered on the radar that this was a problem. It sounds unbelievable now.”

Weiss said he only revealed the events a few years later, when as an 18-year-old he discussed them with his parents and the head of the yeshiva he was attending. Weiss said nothing came of his allegations.

Weiss had not been aware of the original investigation that led authorities to indict Mondrowitz in 1984 on four counts of sodomy and eight counts of sexual abuse. Weiss came forward in 2006 to press the case for Mondrowitz's extradition.

Weiss said he is “not a vindictive person, but I do have a sense of justice. I'd like to see him go to prison and get a taste of his own medicine, but I'm sure if he were to go to prison he would not be alive for long.

But the bigger thing is this sends a message that the sins of the past cannot be buried by the people in the community who are all the enablers. They make the system wrong

I have personally seen Mr. Moshe Eisemann inappropriately (to say the least!) laying a hand on a student right in the Bet-Medrash, in the presence of the holy Torah and Hashem's Shekinah!

That was a real shock for me. A minute ago I would NEVER! believe him to be a child molester. Furthermore - I would be the first one to defend him against such "false" accusations! However - אין לדיין אלא מה שעיניו רואות (בבא בתרא קלא:א) "The judge is constrained by what his eyes see" (Bava Kama 131a).

I'll tell you the truth - I didn't want to believe what I saw. My Lubavitcher friend told me that he had the same feelings when the last Lubavitcher Rebbe (whom he believed to be the Messiah) died. He couldn't believe it, he was broken, he thought that Hashem was about to make a miracle for the Rebbe to come back. Reality is a cruel thing. It blinds some people, but it also offers the gift of sight to others...

I started to observe Mr. Eisemann more closely. I noticed that he is not omnivorous like the other child molesters. When it came to his victims, he never rushed after every kid Mondrowitz-like. As an elegant professor of Ethics, he had his preferences. So it proves nothing if he never caressed you, you simply were not the one he sexually desired, that's all. But I do know people who suffered greatly at the hands of Mr. Moshe Eisemann.

Last week, Andrew Buerger wrote in the BJT that "Law enforcement authorities are investigating alleged molesters we've brought to the public eye." There is much more going on now in Baltimore than you, dear "Anonymous" defender of Moshe Eisemann, know. The era of Moshe Eisemann's impunity is almost over.

Again, fascinating given that the important series was written by our frum Executive Editor, Phil Jacobs.

It's overly simplistic to say we're doing our job if both the Reform and Orthodox think we're picking on them. In reality, we're doing our job as journalists to deliver the truth, which helps affect positive change. We continue to shine a light on our system's challenges, not to embarrass people but to ensure improvement.

Since the sexual molestation series, local rabbinic counsels and day schools have implemented changes to protect innocent children. Law enforcement authorities are investigating alleged molesters we've brought to the public eye. The molestation pieces have included tips to protect our children and stories on how some Jewish survivors are coping.

Meanwhile, the Jewish Times also has covered tough issues such as teenage and adult substance abuse. This isn't done to harm people, but to help make parents aware of the problems so that their kids don't become another overdose statistic.

In the coming months, the Jewish Times will be bringing you more questions –– and hopefully even more answers to those challenges in this rapidly changing world.

We may tackle some uncomfortable topics and highlight some problems we'd rather pretend don't exist. But then we'd be straying from our mission of enhancing the Jewish community. I think by going after Tropper financiers boycott style you achieve nothing. They don't, and can't evaluate reality based on little shmucks like us who send them letters and threaten them. In fact, it may only embolden him. "Boo hoo hoo", he'll say "the shkotzim are attacking me". What needs to be done is getting serious rabbis to oppose him on halachic grounds. Remember, he claims to fix a very real problem. There are many corrupt or ultra-liberal rabbis doing phoney giyurs en masse. Many of them would in fact rather see Tropper go ahead than being themselves scrutinized.

The Mishna Brura poskens that a bochur should hold from the crown when pishing as it's the least sensitive part.

Shichvas zera levotola is also a serious problem in yeshiva dorms. I can't tell you how many guys I caught trying to get themselves off in high school, beis medrash and even one guy I interrupted in the act when I walked in & surprised him in Lakewood.

The Acharon, Sefer Peleh Yoetz goes so far as to say that yeshivos should appoint shomrim to check on bochurim at night who move too much under the covers.

You know I personally do not like the Baltimore Jewish Times for a few reasons.

1. How many years has it taken them to write these stories? I know for a fact that Phil Jacobs has been sitting on the Eisgrau story for close to ten or more years. It's not like it's been a deep dark secret that the community has a problem.

2. It's interesting how Phil Jacobs is taking all the credit for exposing sexual abuse in Baltimore. If I remember correctly The Awareness Center has been doing it for the last five or six years.

3. Why is the Baltimore Jewish Times continuously promoting programs associated with Jewish Family Services and also Jewish Big Brother / Big Sister? If I remember correctly Aviva Weisbord is the head of the program. She's part of the problem. Phl, don't you remember how she lacked the professionalism to keep confidentiality with the Eisgrau daughter?

Weisbord has access to every person mental health records who goes to Jewish Family Services. My bet is that when ever anyone makes an allegation of sexual abuse she is notified and makes sure she notifies the rabbonim of our community.

My wife and I saw the film on our computer yesterday and want to express support and appreciation for your work. It is a remarkable accomplishment for a young man working with such limited resources. I am unfortunately well aware of the problem of sexual and other kinds of abuse in the Orthodox community and of the denial that protects abusers and hinders helping survivors. I work at Yeshiva University in New York and will try to arrange a showing for our students. As you know better than I, film is a powerful medium of communication. Progress has been made in getting some acknowledgement that religious Jews, even rabbis, can be abusers but there is a long road ahead.
Younger rabbis are often more aware and this should lead to a change in communal responses. Your sensitivity to the mores of the community, no physical contact, profanity and sexual language adds credibility and will help in getting people to see the film. Copies of the DVD will circulate in places where no one will openly mention that there is a film. I learned this from Menachem Daum has put out films about the Hassidic world. In general people who have been abused should get professional help. Only a few can cope on their own even with support from family and spouse. Your film was true to much of the Orthodox world in Daniel's not considering it as an option.

As far as shmiras Shabbos on Kings Hwy there is a Shabbos parade once a year that all Flatbush yeshivos & Chassidusen participate in. It is an old minhag from the Chofetz CHaim and they sing his niggun: Volt ich geven bekoyech volt ich geshrigen Shabbos, heilige Shabbos. I haven't been to it for years but it sounds like the kind of thing that Eckstein would push his way to being in charge of to speak to the storeowners. Eckstein is not the only loser who works for Puretz. Puretz likes to hire rachmoness cases.

Some Jews demand better treatment for birds.

Yesterday, 24 New York City households served turkeys that were not only free-range, organic and raised on a nearby family farm--but also 100% kosher. For that, their guests can give thanks to Simon Feil, a 31-year-old actor who has devoted the past 1 1/2 years to starting Kosher Conscience, a "kosher ethical meat co-op." The co-op, which 90 people have expressed interest in joining when it begins regular poultry and beef deliveries in a few months, will offer kosher meat that has been treated humanely "at every stage," he says.

Judaism's taboos on pork and shellfish, as well as the requirement to separate meat and dairy products, are well known even among gentiles. Yet for many contemporary American Jews the taboos can feel arbitrary, cumbersome and devoid of meaning (only 17% say they keep kosher homes). At the same time, some Jews who do find spiritual meaning in the dietary laws have become frustrated that kosher food production does not always reflect their values.

Amid reports that animals destined to become kosher meat are raised in the same conditions as their nonkosher counterparts--along with recent allegations of abusive labor practices and unsanitary conditions at Agriprocessors, one of the world's largest kosher slaughterhouses--some Jews are re-examining the laws governing what is "fit" to eat. "We are not in any way changing the traditional meaning of the word 'kosher,' but are asking, 'What does it mean to be kosher in the 21st century?' " explains Leah Koenig, editor of jcarrot.org, a blog on Jews, food and contemporary issues. "Food that's drenched in pesticides or grown with unfairly paid migrant workers, . . . is that consistent with Jewish values?"

The blog is one of many projects launched by Hazon, a Manhattan group at the forefront of what it calls a "new Jewish food movement." Since 2004, Hazon has helped start nine Jewish community- supported agriculture programs (CSAs) nationwide (and one in Israel), in which individuals buy shares in a local farm in exchange for a weekly portion of the harvest. Hazon's second annual Jewish Food Conference next month will feature the slaughter of a goat to spark discussion about kosher meat.

All of this has met a groundswell of interest among a range of people, from Modern Orthodox to those who have little other connection to organized Jewish life. Hazon received 27 applications this year from Jewish groups wanting to start CSAs.

Is "ethical eating" a Jewish value? Judaism's sacred texts have much to say on the treatment of animals, not to mention employees. "The responsibility for having an appropriate work environment--from hours to pay schedule--are part and parcel of Jewish tradition as much as the laws of kashrut," says Rabbi Kenneth Brander, dean of Yeshiva University's Center for the Jewish Future.

For centuries rabbis and scholars have puzzled over the reasons for keeping kosher beyond simply that God commanded it. Some have argued that the laws--particularly the ban on pork--were about health, while others have claimed that kosher slaughter is more humane than other methods. Religious leaders and scholars today tend to point to kashrut's effect on keeping Jews from mixing excessively with members of other religions and on reminding Jews that everyday life is holy.

Rabbi Avi Shafran, the director of public affairs for the fervently Orthodox Agudath Israel of America, is concerned that some people are "subjecting the word 'kosher' to a subtle redefinition." "There may be a plethora of considerations people can, or even should, take into account when buying their food," Rabbi Shafran wrote in an email. "But kashrut is determined by the Torah's ritual laws, and is not dependent on whether factory workers were unionized, an animal was hoisted or pesticide traces are above or below a certain parts-per-million measurement."

Not surprisingly, many officials in the kosher foods industry prefer to stick to a narrow definition. Rabbi Menachem Genack, CEO of the Kashrut Division of the Orthodox Union, the largest kosher certification agency in the U.S., says matters of health, safety and workplace conduct are "not trivial," but their enforcement is better left in the hands of federal and state governments

In 1983 a meeting was held at the home of Yaakov Perlow (the Novominsker). The purpose of this meeting was to relate individual accounts of the horrors being perpetrated by Mondrowitz and to request action by those in attendance.

Rabbi Avrohom Pam, Elya Svei, Yaakov Perlow, Chaim Dov Keller, Aharon Schechter, Shia Fishman and Moshe Scheinerman all attended this meeting.

At the conclusion of the meeting Svei announced the decision of the group.

In light of the fact Torah U'Mesorah had prior knowledge of Mondrowitz's deeds and did nothing, to do anything now would place Torah U'Mesorah in legal jeopardy. He continued; Torah U'Mesorah's legal counsel advises them to do nothing and that is what they will do. Nothing.

Eckstein does not put up signed letters unless they are from thugs like Belsky who attacks innocent people like Greenwald & Bitton.

AAMCO is not an officialy sanctioned commandant of the gerorist regime. The poor dude thinks that he will redeem the world a la jesus christ if every boy goes ger. he doesn't even teach in ger anymore. Unless you know otherwise it would be unjust and unfair to name and mock a private fella who to our knowledge has never hurt a fly. Du u know that to his credit, even though he was a very good rebbi in the gerer cheder he never accepted a tip from a parent.

This incident kind of reminds me of when a certain pediatrician in brooklyn was accused of molesting a patient. Turns out the boy didn't know that testicular examination was required physician protocol and when cooler minds prevailed amongst the hysteria to explain this in context the boy apologized in the public forum online where he made the accusations and all was well again.

I in no way intend to diminish Boog's integrity. In fact I have been from those campaigning for boog to appear here more regularly. Rubashkin's: will it never end?

Yeshivaworld has received dozens of emails in the last 12 hours telling us that they have received anonymous, automated phone calls telling them that Rubashkin Meat has Mad Cow Disease - amongst other things. Yeshivaworld has learned that these phone calls have been made to thousands & thousands of homes.

This was followed by a reader who took offense at the fact that an outside organization whose motives were not pure would use scare tactics as a means of putting pressure on Rubashkin for their own purposes.

This in turn generated a defensive response from Sholom Rubashkin, a vice president of the company that is both true... and misleading. He claimed they have never had a recall of their raw meat. True. But they did have a recall of some of their processed meat. One that the USDA termed a high health risk!

Now I seriously doubt that Rubashkin’s products have been tainted by Mad Cow desease, although it’s possible. But to defend oneself by misleading statements calls into question the integrity of their entire enterprise.

It is also unfair for Yeshivaworld to present a one sided view of this issue. They should have given the union an opportunity to present theirs.

Here is the way my source put it:

To imply that the USDA has never found reason for a recall is IMNSHO far below the level of honesty I would expect from a kosher food supplier.

Okay, so maybe the message is starting to sink in - after the arrests of members of the Rubashkin family (on unrelated charges), several outside - disinterested- reports of various misdeeds in the plant, the Orthodox community is just beginning to perhaps think about maybe suspecting that all is not perfectly cricket. Well, maybe in another decade or so something will happen. Just maybe. Or maybe it will just increase their sales more.

Oh, and I hereby initiate the new "Rubashkin's" category which I threatened in my last post on these shysters, since this seems to be nowhere close to an end...

Libelous claims that Kosher is Cruel have dogged us in one way or another for over a thousand years. In most cases they have been simple anti-semitism, designed to make it impossible for Jews to keep kosher.

What Rubashkin’s is doing, therefore, is real Chillul HaShem - between its health violations and labor violations, and even its carelessness with the animals, it gives creedence to the “Kosher is Cruel” charge. I would contend that the plant’s very existence and methodology runs counter to the intent of the laws of Sh’chita, because I cannot see a way that an assembly-line shochet can bring any Kavannah to the act.

Now the problem with what outside organizations are doing is that it triggers the Jewish community’s almost reflexive response to view as anti-semitic any criticism that comes from outside the community, regardless of its truth or value. Seems to me, though, that the kinds of criticism leveled against Rubashkin’s is no different than that leveled against any of the larger abattoirs since Fast Food Nation raised people’s awareness about the diffidence big-meat shows toward the safety of its product.

All in all, I regard Rubashkin’s as a significant evil, because it’s goal is to destroy local shechting, and build a kosher meat monopoly. I guess I would like to see Shochets working with local organic growers to produce meat for local communities.

MONDROWITZ EXTRADITION REQUEST SAT AT US DOJ FOR 7 MONTHS – DELAY CALLED HIGHLY UNUSUAL

Early coverage of the pending extradition of Avrohom Mondrowitz noted that the Brooklyn DA asked the US Department of Justice for Mondrowitz's extradition immediately after the new treaty between Israel and the US went into effect in January 2007. Later, the DA's office clarified that – the extradition request was sent to the DOJ in February. Jerry Schmetterer, the DA's spokesperson, confirmed this with me today, insisting February was when the request to the DOJ was made. It turns out the Brooklyn DA's office did not get confirmation of the new treaty until late January. This accounts, it seems, for a February request.

Enter the DOJ. It's spokesperson, Bryan Sienna, confirmed what all later news coverage has reported – the US Department of Justice did not ask Israel for the extradition of Avrohom Mondrowitz until September 2007. The exact date according to Sienna is September 7.

This means there is a 7 month gap between the Brooklyn DA's request to the DOJ and the DOJ's request to Israel.

Without specifying the case or any details, I asked a federal legal professional who has dealt with foreign extraditions about normal practice. Is there ever a gap between the local request to the DOJ and the DOJ's request to the foreign government?

It's normally very fast, he told me. I asked him if 7 months was an unusual delay. Unheard of, he said. Highly unusual. From his experience, there should be almost no time between a request made by state or local law enforcement and the formal request made by the DOJ to the foreign country involved.

I called Jerry Schmetterer back. He again insisted the February date is firm.

So what happened here? Why was the DOJ's request delayed by 7 months?

I don't know.

I looked to see if anything unusual happened in late August or early September, something that might have removed an impediment to the process. So far, I've only found this: US Attorney General Alberto Gonzales resigned his post on August 27, 2007. As you know, Gonzales was implicated in both the US Attorney firing scandal and in other inappropriate activity. Gonzales' resignation was effective September 17, 2007.

Is the Gonzales resignation linked to the Mondrowitz extradition request?

I don't know. But I do know a 7 month wait for the DOJ to ask a foreign country for an extradition is extremely unusual, and that unusual delay ended almost immediately after Gonzales resigned.

There was a reason for UOJ to make a big deal over Mukasey's appointment. Appointees are aware of their potential nominations way in advance. Besides, A phone call to the DOJ from a man of Mukasey's caliber, would have gotten their attention. I'm telling you, there's a method to UOJ's "madness". He was perfectly clear in June that his goal for the summer was to get Mondrowitz extradited. He has not been wrong yet.

Last year, an article appeared in New York magazine that told the tawdry tale of an alleged serial Orthodox child abuser.

The New York writer did more than salaciously detail an alleged victim’s accusations. He went on to share with readers his own consideration of the prospect that such ugly behavior is “more common in the Orthodox Jewish community than it is elsewhere.”

“There are no reliable statistics,” he admitted, “

Employing the trusty journalistic tool of ascribing unfounded speculations to anonymous sources, the New York writer went on to reveal that “There are some who believe” that “the repression in the ultra-Orthodox community can foster abuse.” By “the repression,” he helpfully explained, he meant things like the strict forbiddance of sexual relations before marriage and the Jewish family purity laws that regulate when married couples may and may not engage in intimacy. The “few outlets for an Orthodox man with compulsions,” those unnamed “some” believe, create “a fertile environment for deviance.”

Those comments go to the crux of the matter of why Orthodox Jews should care about any of this. After all, why not just ignore it all? Just as unfounded negative assumptions about Jews in general are popular in much of the non-Jewish world, so are Orthodox Jews unfairly maligned in the larger Jewish one. Do we really have to make a fuss?

Well, I believe we do. Because there is a subtext here. The maligning is not of Orthodox Jews alone; it is a maligning of mitzvot, of modesty, of Torah. It is a claim, in effect, that dedication to Torah doesn’t help prevent sin, that it even leads to it.

I believe – and it is Judaism’s belief – that Torah is transformative, that human inclinations are harnessed and controlled by Torah-life and Torah-study. To be sure, there are Jews who lead publicly observant lives yet who are not truly committed to Torah, who have not internalized “fear of Heaven.” And so, there will always be anecdotal evidence of Orthodox wrongdoings of many sorts, with perpetrators identifiable, and duly identified, as Orthodox.

But the vast majority of observant Jews take Torah seriously. And it does elevate them, and empowers them to live exemplary lives. That is part of why the Torah-observant population is greatly underrepresented in the realms of societal ills like rape, AIDS, prostitution and marital infidelity that affect their less “repressed” neighbors. Although it is certainly possible that rates of child or spouse abuse in the Orthodox world are equal to those of general American society, I would expect a similar underrepresentation in those realms as well.

The writers are entitled to their cynicism. But all Jews who respect Torah are entitled – I believe obligated – to expose it, along with offerings of unfounded, bias-born speculations as facts.

With regard to our community’s unwillingness to take part in such surveys, I believe it’s unfortunate. In the 1950s and 60s, Cleveland State sociologist Israel Rubin did a study of Satmar in Williamsburg. He noted at the beginning that he was going nowhere until he met with the Rebbe and the Rebbe gave the study his approval. Suddenly, the community opened up. The result was “Satmar, an Island in the City.” If we can find the studiers who will be truly objective and careful, what can we lose by learning something about ourselves?

According to a recent article in the New York Times,"overweight people have a lower death rate because they are much less likely to die from a grab bag of diseases that includes Alzheimer’s and Parkinson’s, infections and lung disease. And that lower risk is not counteracted by increased risks of dying from any other disease, including cancer, diabetes or heart disease."

Ich halt this is a carte blanche to snork out at the trough.

Agudath Israel of America employs a spokesman, Rabbi Avi Shafran, who is eager to defend his community from perceived attack. Rabbi Shafran seems to believe haredim do wrong at a lower rate than non-haredim and non-Jews. Why? Because, Rabbi Shafran writes, the Torah is "transformative;" it "elevate[s] [haredim], and empowers them to live exemplary lives." When haredim do commit crimes, Rabbi Shafran says, those criminals cannot be said to be representative of haredim as a whole.

For example, when a hasidic businessman is arrested for fraud, we cannot say fraud is endemic in the hasidic world – even if there are many other examples of fraud perpetrated by hasidim for us to call on. Why? Because, Rabbi Shafran says, the evidence is all anecdotal – there are no statistics to back up the claim.

What Rabbi Shafran does not tell you is those statistics do not exist largely because haredi leaders refuse to cooperate with such information gathering.

He also does not tell you that anecdotal evidence gathered from professionals who work with a population sample on a professional level carries far more weight than raw speculation, and there is much anecdotal evidence drawn from professionals to support the claim that child sexual abuse and other ills are widespread in haredi communities.

So, for example, social workers, welfare agents, doctors, and other professionals anecdotally report high levels of welfare and other social service fraud among their haredi clients. Rabbi Shafran wants us to disregard this information.

Those same professionals speak of sky high levels of child sex abuse among their haredi clients. Again, Rabbi Shafran wants us to disregard this.

According to Rabbi Shafran, when haredi victims of child sexual abuse speak out, they are tragic, individual cases. They certainly are not representative, Rabbi Shafran says, and he knows this with some certainty because – drum roll, please – there are no studies to prove it and the anecdotal evidence is not to be relied on.

[Here, where there is a study, Rabbi Shafran lists his problems with its methodology and seeks to rebut its conclusions. What he does not do is call for any substantive measures to correct the actual problem – sexual abuse of women and girls in haredi communities.]

Rabbi Shafran is also quick to point out that when there has been no trial and therefore no conviction, the rabbi is to be presumed innocent. To Rabbi Shafran, this apparently holds true even when there are dozens of victims and years of "anecdotal" evidence, and even in cases where police were unable to make headway because the haredi victims, acting on orders from their religious leadership, refused to testify against the rabbis who abused them


Rabbi Shafran makes no mention of meetings held by haredi leadership to "deal with" particular rabbi-abusers, meetings that instead ended with implementation of coverups.

Further, rabbis – including some of those Shafran represents – are alleged to have told victims and their families not to go to the police or media, and then shamed and intimidated these victims into compliance.

Jewish and non-Jewish children alike were abused by rabbis who walked freely on the streets of Brooklyn because haredi leadership, intentionally or not, made it so.

Children are being hurt by predator rabbis. One way to weed out these abusers is to have mandatory criminal background checks for all teachers in religious schools. In New York State, this is the law – but only for public schools.

Religious schools are exempt because two powerful religious groups oppose mandatory background checks in their schools – the Catholic Church and Agudath Israel of America.

The number of abused children in the haredi community could be reduced dramatically if mandatory background checks were law.

So, Rabbi Shafran, for the sake of argument, let's say you are right. We will disregard all anecdotal evidence, and we will say these types of deviant abuses are less common in haredi communities than elsewhere. Still, even one incident of preventable rabbi-on-child sexual abuse is too much, don't you think, Rabbi Shafran?

In an ideal world, which we all want and we all should work for, there would be no incidents – our children would be safe, our children would not be abused.

The haredi community can come closer to that goal by supporting mandatory background checks for all teachers and employees of religious schools. And it can come closer faster by unilaterally implementing those background checks now, without waiting for the law to change.

Let Agudath Israel of America's Council of Torah Sages rule that these background checks are mandatory for all schools in the haredi community. The ruling can be enforced by issuing bans against those schools and their leaders who fail to adopt this much needed standard.

Our children need protection now. It is time to act, swiftly and decisively, to protect them.

Anything less, Rabbi Shafran, is just so much hot air.

Despite all he has done for "the cause," UOJ is hardly the omnipotent, omniscient being you (and for that matter, he) imagine him to be. In fact, the activity we have seen with respect to this issue is the result of the hard work of many people, some of whose identities you will never know. I do not point this out to take anything away from UOJ but to emphasize the amount of effort, cooperation and courage it takes to achieve the kind of social change we must pursue, and also to discourage a dangerous, blind reliance on seemingly more powerful others, which is what got us into this mess in the first place.

There are no coincidences. The timing is too perfect. I'm certain UOJ is not perfect nor did he ever make that claim. Things just don't happen by itself after 23 years of nothing.

Agudah will most definitely change their position. But it will come after torah temmimah and some other yeshiva collapses. It'll come after "chosuva" rabbis have to give some very uncomfortable testimony. And of course it'll come after some of the major molesters are convicted and locked up.

WOW!! Don't we all feel so much better now!! Thank you Avi! UOJ, there is no need for this blog anymore. Tell Elliot Pasik that there is no need for all the fuss about background checks, fingerprinting, registry and mandatory reporting. After all, we are "underrepresented" when it comes to such things as child molestation! Tell all the victims of clergy sexual abuse that they really don't matter, you are "underrepresented".

How this moron continues to write such gibberish and gets away with it is beyond me. It's been a year and a half since that article he's referring to, and forty years since Kolko started his molestation career. Do we have anything in place from the Agudah or Torah Umesorah that will give our children one iota of protection? Why is it that public school children have this protection and our children have nothing? Will Avi L. Shafran or the Agudah ever address these questions head on, or will we continue to hear how wonderful the Orthodox world is, and that we are "underrepresented"? It's like the false prophets before the first Temple destruction, telling the people how wonderful they are.

Until there is a tremendous outcry from the community and a demand for change, we will continue hearing from these false prophets. If you care about your children and grandchildren, start putting pressure on the Agudah, Torah Umesorah and your local politicians. Mandatory background checks, fingerprinting, sex offender registry and mandatory reporting MUST BE ENACTED IN THE YESHIVA SYSTEM AT ONCE!!! I am sorry to say that we are underrepresented when it comes to people crying out for the children. Avi, you are wrong, we have more than our fill of perverts!!

Project Eden (which has its own troublesome history) developed a program to train mikvah attendants and sheitel machers to recognize victims of spousal abuse. When word of this made it into the Jewish Week, the organizers and potential participants were threatened with boycotts by community leaders, leading to the cancellation of the program.

As a criminal defense attorney I have represented some Hassids in criminal spousal abuse. If my experience is reflective of the society at large I must say I see far fewer Jews in proportion to their numbers. As to "white collar crimes" I cannot say.

Despite my dislike for Chabad however, the clients in question were given an intense defense. I was able to get the charges dismissed and the family was reunited, thank G-D. Hassids are people too.

I also did pro bono work for a very fractured family. Actually I represented a mentally ill Lubavitcher man who would not give his wife a Ghet. The wife withheld the children and alienated affections of the children. It was a horrible situation. A very fine orthodox (non-Chabad)psychologist tried to help my client through his problems. A very fine attorney who is very much attached to Chabad represented the wife. It was a mess. Fighting tooth and nail. I finally was able to get a judge to allow for visitation.

This case went one for a couple of years. I believe I donated over one hundred hours. My beef is not with individual human beings who are flawed but with those in the Jewish hierarchical establishment who enable abuse, turn away, or otherwise ignore the situation.
