Violent Turn in Abuse Case More Than 3 Decades Old

SAN JOSE, Calif. (AP) — William Lynch’s life has spiraled out of control in the 35 years since he says he and his brother were molested by a Jesuit priest. He struggled with depression, had nightmares and tried to kill himself twice.

The authorities say they believe that the anger and pain erupted last spring when the Rev. Jerold Lindner was lured to the lobby of his Jesuit retirement home and then beat severely in front of shocked witnesses.

Mr. Lynch, 43, was arrested Friday and booked on suspicion of assault with a deadly weapon in the May 10 attack. He posted $25,000 bail and will plead not guilty at an arraignment next month, said his lawyer, Pat Harris.

During a confrontation at the Jesuits’ Sacred Heart retirement home in Los Gatos, Calif., Mr. Lynch repeatedly punched Father Lindner in the face and body after the priest said he did not recognize him, said Sgt. Rick Sung, a spokesman for the Santa Clara County Sheriff’s Department.

Mr. Lynch and his younger brother settled with the Jesuits of the California Province, a Roman Catholic religious order, for $625,000 in 1998 after accusing Father Lindner of abusing them in 1975 during weekend camping trips in the Santa Cruz Mountains.

Mr. Harris said the boys, who were 7 and 5 at the time, were raped and forced to have oral sex with each other while Father Lindner watched.

Father Lindner, 65, has been accused of abuse by nearly a dozen people, including his sister and nieces and nephews.

Investigators connected Mr. Lynch to the attack using phone records, Sergeant Sung said. A half-hour before the episode, a caller identifying himself as Eric called the home and said someone would arrive shortly to inform Father Lindner of a family member’s death.

Father Lindner was able to drive himself to the hospital after the attack. He did not return a call left on his answering machine.

He has previously denied abusing the Lynch boys and has not been criminally charged. The abuse falls outside the statute of limitations.

Father Lindner was removed from the ministry and placed at the Los Gatos retirement home in 2001.

He was named in two additional lawsuits for abuse between 1973 and 1985, according to the Archdiocese of Los Angeles. The cases were included in a $660 million settlement struck between the church and more than 550 plaintiffs in 2007.

The Rev. John McGarry, the provincial, told The Associated Press that Father Lindner had recovered and resumed his work at the retirement home, where he helps care for 75 infirm priests. He is not allowed to leave the home unsupervised, he said.

“As you can imagine, it’s very emotionally distressing to go through something like this,” Father McGarry said. “He hasn’t spoken a lot about it. He’s living a quiet life of prayer and service within our community.”

Mr. Lynch declined an interview on Friday, but in a 2002 article in The Los Angeles Times, he said he had had nightmares for years, had battled depression and alcoholism and had attempted suicide twice.

“Many times I thought of driving down to L.A. and confronting Father Jerry,” Mr. Lynch said. “I wanted to exorcise all of the rage and anger and bitterness he put into me. You can’t put into words what this guy did to me. He stole my innocence and destroyed my life.”

As a gathering organized by the rabbis, it's obvious that blogging and blindly following the rabbis will be spoken about ad nauseum. Let's see if a lack of achdus and areivus towards abuse victims make it on their list. According to the Gedolei Eretz Yisroel, these two issues are the root causes of Chicago's problems.

At least HFBA allows volunteers to clean up the cemetery in Staten Island. This must be because Zohn doesn't have complete control like in Brooklyn & Queens where David Jacobson lets the places disintegrate while they are fenced off from the public who might take pictures of kivrei yesomim being dug up to be resold for profit.

The two yeshivos were Torah Vodaas whose rosh yeshiva gives hashgocho to Rubashkin & Bais Yaakov of Brooklyn, which is Balkany's school. Maybe he was going to redirect the money to the defense fund for his shvogger Sholom Rubashkin.

There has to be a limit to the chutzpah coming from the mouths of these heimishe defense lawyers like Nat Lewin & Ben Brafman.

A Brooklyn rabbi ran an unholy scam on a $16 billion hedge fund because he knew that its founder was "Jewish and . . . rich," a prosecutor told jurors yesterday.

Rabbi Milton Balkany demanded $4 million from SAC Capital Advisors founder Steven Cohen by threatening that a prison inmate he was counseling would go to the feds with insider-trading allegations against the firm, Manhattan federal prosecutor Jesse Furman said.
Balkany -- whose "statements were lies, pure and simple," according to Furman -- was videotaped pocketing checks from an SAC lawyer and saying "that Mr. Cohen and SAC were in the clear," Furman said in the extortion trial's opening statement.

Defense lawyer Benjamin Brafman countered that Balkany -- who won dismissal of an earlier fraud case by paying back $700,000 in misspent government grants -- had merely engaged in a "stupid plan" to help two cash-strapped Orthodox schools in Brooklyn.

He added that the feds and SAC lawyers used "scripted" conversations to "keep Balkany coming back and talking, so that, eventually, they'd conclude he committed a crime."

"You want to find him guilty for using bad judgment?" Brafman asked. "For that, we plead guilty today."

Involved in this is a lawyer named Steven Friedman who also happens to be the rabbi of Ramath Orah on the Upper West Side. This is probably the most left wing shul in the world affiliated with the OU. They have a woman assistant rabbi and women are given roles in davening.

The Takana forum published a statement Thursday describing the investigation against Rabbi Mordechai Elon, who is suspected of sexually abusing his male students.

The statement says that in July 2005 a married man complained that Elon had harassed him as well as others. The forum says Elon admitted to wrongdoing but claimed mental distress had caused him to perform the acts.

The former director of operations for a Boca Raton philanthropy has been arrested for the second time this year, again charged with using stolen prescription forms to obtain more than 2,700 Roxicodone pills, according to a report.

Records show Helene J. Kramer, 47, of suburban Delray Beach, was arrested Monday afternoon and is charged with three counts of trafficking in opium or derivatives of 4 grams to 30 kilograms, three counts of trafficking in hydrocodone of 14 to 28 grams, and 14 counts of obtaining a controlled substance through fraud.

Kramer was arrested on Monday. This morning, Palm Beach County Circuit Judge Krista Marx ordered Kramer held in lieu of $72,000 bail.

The August sheriff's report indicated Kramer was director of operations for the Boca Raton-based southern Florida regional office of the Jewish National Fund.

The Palm Beach Gardens couple accused of paying to have eight neighborhood ducks rounded up - after which they were sent to their deaths - have been found guilty of petty theft this afternoon by Palm beach County Judge Laura Johnson.

The judge has yet to announce their sentence.

Blain and Robert Aymond have been charged with theft, as the ducks were property of their Frenchman's Landing Homeowners Association.

Last week, the couple argued during a trial that they had a right to remove the ducks because they were a nuisance, wrecking their prized orchids, defecating on the lawn and quacking loudly.

Brooklyn real-estate mogul Rubin Schron is fighting his former lawyer for control of a national nursing-home company in a battle that pits one of the city's largest and most secretive landlords against an attorney who was a trusted adviser and business partner for years.

The dispute shines a rare spotlight on Mr. Schron, 72 years old, who has largely avoided the public eye despite building up an empire of skyscrapers, warehouses and apartment complexes worth billions of dollars.

The focal point of the fight is SavaSeniorCare, an Atlanta-based nursing-home chain with 18,000 patients and 20,000 employees that Mr. Schron says he has the right to buy for $100 million—far less than what it's worth—from his former lawyer, Leonard Grunstein, and a banker, Murray Forman.

Mr. Grunstein insists the option isn't valid.

But the rift between Messrs. Schron and Grunstein runs deeper. Mr. Grunstein first represented Mr. Schron in the 1980s, according to court filings. Today the two sides can't even seem to agree on whether they used to be friends.

Mr. Schron's complaint says that the relationship between the two men "eventually extended beyond business" and that "Grunstein attended the weddings of a number of Schron's children."

Mr. Grunstein's wife Chana Grunstein said of Mr. Schron: "My husband made him not a millionaire, a billionaire…and he's not happy."

NY writer admits suicide attempt during arrest in sex abuse case, says it won't hapen again

A New York writer accused of sexually abusing young women he lured from overseas has told a judge he won't commit suicide if released on bail.

Joseph Yannai (YAH'-nay) testified Wednesday at a bail hearing in Brooklyn that he had tried to kill himself with sleeping pills earlier this month when federal agents came to arrest him at his home in the suburbs north of New York City.

The 66-year-old Yannai told the judge he was feeling hopeless at the time. Since then, he said, he has decided he wants to fight the charges.

The judge agreed to release Yannai under house arrest once he posts a $500,000 bond secured by real estate.

Yannai wrote a reference guide called "The International Who's Who of Chefs 2004-2005."
