This isn’t the first time Mostofsky has tried thuggish tactics to suppress the truth about child abuse in the Orthodox Jewish community.

I have received a notice from Google that someone is claiming that the post below infringes a copyright (they haven't told me whose copyright, or how it's being infringed), and are "asking" me to remove this post by Sunday, April 13, or else they'll take action themselves.

DO YOU SMELL A RAT?

I have consulted legal advice and I cannot understand how any copyright is infringed by the post below... in fact, I can't help wondering whether the holders of any copyrighted material that may be referred to (news accounts, magazine articles) are actually complaining about it at all.

I AM FIGHTING THIS!

I've had my lawyer write to Google demanding to know who is claiming an infringement, on what grounds, and why whoever made the complaint is authorized to make the claim on behalf of a genuine copyright holder. I will continue to fight for my rights -- and your rights -- to freedom of speech and the telling of truth!

Read the post, if you haven't, and tell me if I'm nuts -- could anyone honestly claim a violation of copyright law here? Whose? I've already learned that Susan Rosenbluth of the Jewish Voice and Opinion (whose May 2005 article is referred to several times in the post) is not complaining, hasn't authorized anyone to complain, and is in fact reportedly furious that the post is being threatened.

I can't say much more until I have solid evidence of who is behind this . . . but this much I will say. IF it turns out that someone falsely claimed a copyright infringement as a way of suppressing some inconvenient truths -- or if I learn that the person making the complaint was not authorized to do so by a valid copyright holder -- then someone may have broken the law, and I intend to hold whoever it is fully accountable! I have rights under the Digital Millennium Copyright Act, as well as the Constitution, and I will defend them!

I invite anyone who finds a factual error on my site to let me know... I'm not too proud to correct myself if I do make a mistake. The same goes for an actual copyright infringement: if anyone finds one on my site, tell me and I'll remove it. But let me say, for the record, that I detest liars, cowards, bullies and hypocrites who work secretly, using bogus claims and illegal or dishonest tactics, to suppress an honest discussion of outrageous behavior we all must know about, as Jews and as human beings... and that's just as true even if the malefactors should turn out to be associated with, let's say, a major Orthodox Jewish organization . . . Not that anyone might suspect one in this case . . . Anyway, I'm not saying that this is what happened -- too many facts haven't been made available to me -- but I promise to let you know what I learn as I learn it!

By the way, it is obvious that whoever made the "copyright infringement" claim against the post below is conversant with the detailed and technical provisions of the Digital Millennium Copyright Act. Now, it just so happens that the lawyer for Young Israel -- whose lay president is one Steve Mostofsky -- over a considerable period has been Martin Samson. Samson (as described in the May 2005 JVAO article mentioned already) reportedly tried a legal hatchet job 3 years ago on Rosenbluth and the book written by Amy Neustein and Michael Lesher about how family courts have failed abused children -- after Mostofsky himself (who played a prominent role in Neustein's own abuse/custody case) threatened Rosenbluth to no avail because of her writing about the book. Martin Samson is also an expert on Internet law. Just a fact, my friends... Just a fact... I say no more... yet.

It seems that Steve Mostofsky, Young Israel’s lay president, is Agudath Israel's legal fix-it man for the burgeoning Hersh scandal. But this isn’t the first time Mostofsky has tried thuggish tactics to suppress the truth about child abuse in the Orthodox community.

In the late 1980s, Mostofsky was law clerk to the notorious Brooklyn Family Court Judge Leon Deutsch. One of Deutsch’s cases was that of Dr. Amy Neustein, whose 8-year-old daughter was switched to the custody of her divorced father by Judge Deutsch, despite strong evidence that the father had sexually abused her. (An eyewitness, a leading child sex abuse expert and the girl’s own statements provided some of the evidence in support.) When an astonished State Senator (now Governor) David Paterson held legislative hearings into that case and others like it in 1989, Mostofsky – as Paterson later told the Village Voice – appeared at Paterson’s hearing, notebook in hand, “with the intention of intimidating mothers whose cases were before Judge Deutsch from testifying to the committee.” Paterson filed a formal ethics grievance as a result.

When Dr. Neustein was slated to appear on Geraldo to discuss her case in December 1987, Mostofsky reportedly called the program’s producers that morning claiming, falsely, that Dr. Neustein was “a paranoid schizophrenic” (there was never such a diagnosis) and that the program would be greatly embarrassed if it persisted in having her as a guest. Rivera was not impressed, and the Neustein case went on to become, in the words of New York magazine, “the best-known cause celebre of its kind,” in which evidence of child sex abuse was allegedly hushed up through the efforts of influential members of the Brooklyn Orthodox community.

But Mostofsky wasn’t finished. Years later (2005), when Dr. Neustein and Michael Lesher published a book on child sexual abuse and family court reform, Mostofsky (by this time the lay president of Young Israel) again tried bullying tactics to suppress the truth. When he learned of the book’s impending publication from an article in The Jewish Voice and Opinion, he personally called the magazine’s publisher and – according to her – “screamed” at her that he would sue her, Lesher, Neustein and even David Paterson for daring to make any statements about the Neustein case or any criticism of Judge Deutsch. At the same time, Young Israel’s lawyer, Martin Samson, wrote threatening letters to the magazine and to the publisher of Neustein and Lesher’s book (though he denied having been asked to do so by Young Israel’s boss Mostofsky). Lesher also took a threatening phone call from David Pollock, assistant director of the Jewish Community Relations Council, who did not deny working in cooperation with Mostofsky. Mostofsky, asked repeatedly to comment, did not deny his role in threatening Lesher – in fact, he would not comment at all.

In the end, no lawsuits were filed. It is worth remembering that Mostofsky had had no official connection with Deutsch or the Neustein case for nearly 15 years, and could not point to a single inaccuracy in any statement Lesher or Neustein had made about the case (or others like it that Judge Deutsch had handled). Yet Mostofsky was prepared to use his prestige – and his lungs – to try to suppress discussion of a case involving allegations of child abuse by an Orthodox Jewish father.

Jeremiah McKenna, former chief counsel to the New York State Senate’s Committee on Crime and Correction (who investigated the Neustein case in the 1980s), was publicly quoted in May 2005 as calling Mostofsky’s actions part of “a continuing conspiracy to conceal the truth of what happened in this case.” And Lesher publicly challenged Mostofsky to explain why the lay president of Young Israel should be trying to suppress a book on child abuse -- (From Madness To Mutiny) -- and the family courts by two Orthodox Jews. Mostofsky did not respond.

And now Mostofsky has reportedly helped orchestrate the arrest (or at least detention) of three concerned professionals whose crime was caring enough about young Isaac Hersh to visit him and obtain his account of his allegedly abusive treatment at Tranquility Bay (for which the boy’s father, Mostofsky’s client, reportedly shelled out some $40,000). The point is that Mostofsky isn’t just another matrimonial lawyer taking another custody case. He’s not even just a lawyer who, with his partner Harvey Jacobs, has on a number of occasions represented Ohel Children’s Home (a bulwark of Orthodox Jewish Brooklyn), and therefore might be expected to help abused Jewish children, not to contribute to their abuse…

No, the Agudah – which he says picked him for this job – knows his history better than that. And so should we. If someone is looking to cover up a nasty story of possible child abuse within the Orthodox Jewish Brooklyn community, well, Mostofsky is a natural. And judging from his record, he doesn’t seem to have many scruples about his tactics.

Maybe it’s time Mostofsky was required to answer some questions – publicly – about his behavior, past and present. Certainly - The Agudath Israel Of America - that bastion of fraud and deceit - also known as Cover-Up Central for child rapists and their enablers - has created yet another link to their infamous and criminal behavior - under the guise of daas Torah.

Incidentally, anyone who wants to read the (very) full article from the May 2005 issue of The Jewish Voice and Opinion can find it on the “Press and Presentations” page of Michael Lesher’s web site, www.MichaelLesher.com. Some people have issues with that magazine and its reporting, but Michael Lesher vouches for the accuracy of everything stated there.

A 27-year-old Yonkers man was arrested on March 30 after he allegedly posed as a cab driver and then came close to striking a police officer and several pedestrians before crashing into another vehicle, Queens District Attorney Richard Brown said.
Chevon Cole, who does not work as a cab driver, was allegedly offering a $40 ride to arriving passengers at John F. Kennedy Airport's Terminal 6 around 11 a.m. when the officer approached his car, the DA said.

The defendant allegedly sped away and nearly hit the officer, who jumped out of the way of the vehicle, a spokesman for the DA said. Cole also allegedly came close to hitting several pedestrians before slamming into another car, causing an estimated $250 damage, according to the criminal complaint. Cole then allegedly flailed his arms to avoid being handcuffed, according to the complaint.

The defendant, whose bail was set at $10,000, was charged with reckless endangerment, attempted assault and unlawful solicitation of ground-transportation services, the DA said. Queens Criminal Court Judge Mary O'Donoghue ordered the defendant to return to court on April 15.

If convicted, he could face up to seven years in prison, Brown said.

Rav Rubenstein a"h once saw me dreying zich in Westchester. He ran over to me, simply because he saw a frumma Yid, and displayed a varmkeit & geshmakkeit I cannot forget. We exchanged some words and he told me where I could find a mincha minyan which was very helpful. I was horrified to learn of his petirah at the young age of 58.

It shows how important it is to have functional smoke alarms.

The National Weather Service told the Fire Dept that Rabbi Rubenstein's house was likely hit by lightning. Because lightning can theoretically knock hardwired smoke alarms offline, my wife wants us to add battery powered smoke alarms to our hardwired ones.

R' Yudel Shain is reporting tonight that Rubashkin gave Weissmandel a 25% raise bumping his pay up to a quarter million from 200k.

How does Weissmandel earn it? According to R' Yudel, whenever an issue arises that casts Rubashkin in a bad light, Weissmandel comes to his defense and counter-attacks someone else as a smokescreen.

Today, the Young Israel of Scarsdale community laid to rest our beloved Rabbi Jacob S. Rubenstein and his devoted wife, Deborah Rubenstein. With sorrow and anguish in our hearts, we said goodbye to Rabbi Rubenstein, our leader, our teacher and our dear friend, who transformed our community from a small group to a vibrant congregation of over 400 families.

For nearly 25 years, Rabbi Rubenstein guided us with strength, wisdom, kindness and vitality. He touched people of all backgrounds and levels of religious upbringing; his dynamism, compassion and affectionate nature enabled him to connect with everyone from scholars to those with little formal religious background. Our Rabbi had a unique relationship with the children in our community, whom he loved perhaps most of all. Rabbi and Deborah Rubenstein were extraordinary individuals whose faith in God was unshakeable.

We extend our condolences and love to the Rabbi and Debbie’s family. Ultimately, our thriving community is the legacy the Rubensteins have left us. If the gripe site allows outsiders to contribute comments, counsel should consider posting a response to the criticisms.

Another tack is to send a cease-and-desist letter threatening legal action. A letter alone can be sufficient to persuade a Webmaster to shut down his site. And there are a number of legal rights on which such letters can be based. Be sure your letter is respectful, however, because the griper will probably post it. An undiplomatic letter will do little more than anger the griper.

In-house counsel can also attempt to have the Internet service provider (ISP) that hosts the griper's site take it down. All ISPs have terms of service that Webmasters must abide by. These agreements generally prohibit posting offensive material or content that infringes on trademarks.

If the site is not in compliance, an ISP may be persuaded to remove it. Start by urging the ISP not to aid the infringing activities of the griper. Mention your claims of contributory or vicarious trademark infringement. ISPs get very little income from hosting individual sites and thus do not have much incentive to fight.

If the ISP removes the site, however, it may be only a temporary remedy. Gripers typically take their sites to another ISP.

Legal proceedings are the final step against the operator of a gripe site. Unlike ICANN, courts can consider the site's content and can award damages, including statutory damages for trademark infringement and, in the "exceptional case," attorneys' fees. Because of the costs of defending a court proceeding, simply commencing one may prompt the griper to take his site down.

If you actually proceed to judgment, the outcome is not guaranteed. Courts have not reacted uniformly. The more egregious the conduct, however, the more likely it is that the action will be successful.

You have several possible courses, depending on the site's content and its use of your trademark. If the site has your trademark in its domain name or includes it excessively in its meta tags or content, you may claim trademark infringement and/or dilution under the Lanham Act or state law counterparts; unfair competition under federal or state law; or that the griper's conduct violates the Anticybersquatting Consumer Protection Act (ACPA), also found in the Lanham Act.

If the content of the site is defamatory and is leveled at an individual affiliated with your company, you can pursue defamation claims. If the site attacks your company, you can pursue trade libel or product disparagement claims. Defamation claims are notoriously difficult to win, particularly if the subject is a "public figure." Trade libel and product disparagement claims typically require evidence of actual damages.

If a Webmaster merely posted third parties' complaints on his site, he may be immunized from liability claims by the Communications Decency Act (CDA).

If the site includes confidential information posted by current or former employees, other remedies arise, including breach of fiduciary duties and employment contracts. In the trademark realm, the griper is likely to assert that his use of your company's mark is a fair use protected by the Lanham Act and the First Amendment.

There is a concept of policing by rabbonim that is mandated even in Shulchan Aruch. We can't lose sight of the legitimate needs just because some corrupt rabbis have abused the process. The question also begs what parents in their right minds would allow their young sons to have access to filthy porno? Oh, I forgot, the same lowlives who won't pull their boys out of YTT.

The reason why Chen fled to Canada is in case he is needed to "discipline" Isaac Hersh, should Isaac return to Canada. Chen brought all of his tools like his claw hammer and salt and turpentine for wounds.

Yesterdays New York Magazine published the following article:

Passover, which begins this year at sundown on April 19, commemorates the Israelites’ exodus from Egypt to freedom. Even so, it’s a big deal among the unfree at the medium-security federal prison in Otisville, about 75 miles upstate, which is known for its well-attended and rigorously run Seders. “Otisville is very close to New York City, so it has more access to a Jewish population, to rabbis, and to kosher food,” says Rabbi Menachem Katz, director of prison programs for the Jewish-outreach Aleph Institute. “The Bureau of Prisons kind of unofficially designated it to meet the needs of Orthodox Jews.”

Considered a haven for white-collar criminals, Otisville is one of only a handful of federal institutions to have a full-time Jewish chaplain. It also boasts a kosher kitchen and weekly Shabbat services, religious perks that led Forbes to name it one of the “12 Best Places to Go to Prison.” This year, about four dozen prisoners will sit down to kosher-for-Passover chicken, potatoes, and the Pesach fixings—horseradish, handmade matzo, boiled eggs—for a full, inmate-led Seder.

Otisville’s Seders are held in the prison’s cafeteria; the festival meal is served on white tablecloths in airplane-style prepackaged trays. Each participant gets his own Haggadah, and the prison provides the necessary items—shank bones, charoset—for a Seder plate. It’s unclear how many of Otisville’s 1,189 inmates are Jewish. The warden says 58; Chaplain Gary Friedman, chairman of Jewish Prisoner Services International, says it’s at least twice that. In the past, prisoners paid to be bussed in from other institutions for Passover, though this practice has stopped as similar services have been introduced elsewhere. Otisville still offers one of the more traditional Seders in the prison system.

“Once you’ve been at a prison Seder, it’ll never be the same on the outside,” says Friedman. “The Haggadah has a line that reads ‘Tonight we are all free men,’ and for the duration of the Seder, they are.” Sort of: Where the Seder calls for four cups of wine, at Otisville, says the warden, “they get four cups of grape juice.”

Even so, it’s a big deal among the unfree at the medium-security federal prison in Otisville, about 75 miles upstate, which is known for its well-attended and rigorously run Seders. “Otisville is very close to New York City, so it has more access to a Jewish population, to rabbis, and to kosher food,” says Rabbi Menachem Katz, director of prison programs for the Jewish-outreach Aleph Institute. “The Bureau of Prisons kind of unofficially designated it to meet the needs of Orthodox Jews.”

Considered a haven for white-collar criminals, Otisville is one of only a handful of federal institutions to have a full-time Jewish chaplain. It also boasts a kosher kitchen and weekly Shabbat services, religious perks that led Forbes to name it one of the “12 Best Places to Go to Prison.” This year, about four dozen prisoners will sit down to kosher-for-Passover chicken, potatoes, and the Pesach fixings—horseradish, handmade matzo, boiled eggs—for a full, inmate-led Seder.

Otisville’s Seders are held in the prison’s cafeteria; the festival meal is served on white tablecloths in airplane-style prepackaged trays. Each participant gets his own Haggadah, and the prison provides the necessary items—shank bones, charoset—for a Seder plate. It’s unclear how many of Otisville’s 1,189 inmates are Jewish. The warden says 58; Chaplain Gary Friedman, chairman of Jewish Prisoner Services International, says it’s at least twice that. In the past, prisoners paid to be bussed in from other institutions for Passover, though this practice has stopped as similar services have been introduced elsewhere. Otisville still offers one of the more traditional Seders in the prison system.

“Once you’ve been at a prison Seder, it’ll never be the same on the outside,” says Friedman. “The Haggadah has a line that reads ‘Tonight we are all free men,’ and for the duration of the Seder, they are.” Sort of: Where the Seder calls for four cups of wine, at Otisville, says the warden, “they get four cups of grape juice.”

I've come across a poll by The Barna Group - very telling -

"By the time is a child of 13 years - the faith of his/her fathers' - is so ingrained - and the converse is true - if there is no disposition or good reason to believe - they eventually will leave their faith. (or the practice)...."

Extrapolating that to the next logical step: if a traumatic event occurred in the first 13 years of their life - that would question their faith - chances are - that person will stop - believing or practicing - sometime in their life!

Everything I've come across supports the above findings!

Moving man Avinoam Damti ripped off hundreds of customers before the law caught up with him.

The companies he owned used different names like New Start Moving or Starving Students Moving and Storage.

But his scam was always the same: Promise a low price, but triple or quadruple it after the van was packed and it was too late to cancel the job. If people didn't pay, he held their possessions hostage in his Greenpoint, Brooklyn, warehouse.

The estimate for Timberli Heath and Earl Munroe's move to Jacksonville, Fla., from Far Rockaway, Queens, was $1,500. But the price was jacked up to $6,800. They couldn't pay - and everything they owned was locked up for a year and a half. When they finally got their possessions back, a $3,000 entertainment center was destroyed, baby pictures were gone and their children's clothes were covered with mold.

The couple were among a dozen victims to testify in Brooklyn Federal Court when Damti was tried along with colleague Ofer Yosef for extortion. After delivering a guilty verdit, outraged jurors called the two convicted crooks "scum."

Damti and Yosef were sentenced in October 2003 to more than 12 years in prison and ordered to pay more than $400,000 in restitution. Damti was fined $1 million as well.

The two are now doing time in federal prisons - Damti in Morgantown, W. Va., and Yosef in upstate Otisville.

But consumer advocates warn that there are countless other movers hoping to spring similar scams on unwary city residents.

"This is another 'buyer beware' situation," said Robert Nardoza, a spokesman for the U.S. Attorney in Brooklyn, who prosecuted the case. "The consumer needs to do some due diligence on companies - before hiring."

International millionaire's family opposes daughter's marriage to young Jerusalem resident, rabbis object in harshly-worded manifest, but young couple claims victory and weds according to Jewish law

The bride's parents objected, rabbis protested and the public took to the streets – but the young couple refused to give up. Against all odds and despite violent demonstrations outside the wedding hall, a young ultra-Orthodox woman from overseas and her Jerusalemite fiancé were married in the capital Tuesday evening.

It all began when an international millionaire, a renowned haredi philanthropist, sent his 19-year-old daughter to study in an ultra-Orthodox institution for girls in Jerusalem.

In Israel, the daughter got involved with a young haredi man, but according to sources familiar with the affair, the woman's father objected to the relationship from the very beginning, claiming that the young man was a "shababnik" (a yeshiva dropout).

From the moment the bride's family overseas learned of her desire to marry the young man, her relatives began sending messengers and public activists to the Holy Land in a bid to persuade her not to go ahead with her plans.

The family also appealed to the most prominent Orthodox rabbis, asking that they exert efforts in a bid to cancel the planned wedding. The rabbis even issued a manifest against the engagement, but to no avail.

According to the sources, messengers on behalf of the bride's family visited the groom's father in a bid to convince him to call off the wedding. The father, the sources said, promised he would work to cancel the engagement. Shortly afterward, however, an engagement ceremony took place, at the father's presence.

Prominent rabbis get involved

At the beginning of the week, the family discovered that the wedding would take place Tuesday evening. Claiming that the young man's family had exploited wealthy families in the past, the woman's family managed to convince prominent rabbis to issue another manifest against the wedding.

Leaflets slamming the marriage were hung in haredi neighborhoods, carrying the signatures of Rabbi Chaim Kanievsky, Rabbi Nissim Karelitz and Rabbi Michal Yehuda Levkovitch.

Addressing the groom's father, the rabbis wrote, "After hearing from important scholars that your son is about to marry a girl as opposed to the Torah's wishes, we demand that you prevent this marriage which will not be held according to our dedicated Jewish law.

"Who can tolerate such a marriage with such great sorrow on the part of the daughter's mother and father? It is a defamation of God to marry a person from the street considered problematic like the groom."

The announcements called out, "An act of villainy being carried out in Israel," claiming that the groom's family did not listen to the rabbi's demands to call off the wedding, and urging the haredi public to protest outside the groom's home and outside the Jerusalem wedding hall during the ceremony.

At around 5 pm Tuesday, announcements were sounded across Jerusalem's ultra-Orthodox neighborhoods, calling on the public to go out and protest. The groom's family, upon hearing the calls from its home, located in the heart of a haredi neighborhood, rushed to leave the house before the demonstrators' arrival.

When the protestors realized that the family was not at home, they continued towards the Beit Hakerem neighborhood, where the wedding ceremony was being held.

Several yeshiva students stood outside the wedding hall, carrying signs protesting the event. A violent scuffle erupted between the protestors and the wedding hall's security guards, and police officers were dispatched to the area.

The skirmish did not interrupt the bride and groom's plans. They were married, and celebrated with their guests into the night. What will happen next? Time will tell.

It sounds just like the early 80's when I went to college and the professors declared that all they were preparing me for was graduate school. If I wanted a vocation I should go to a professional training school instead. I was exposed to filth, drugs, ideas bordering on sedition. I learned more in 3 years in high school then I learned in college and was treated better in high school.
I'm sure that many of my fellow classmates can say the same about the college experience. No I didn't grow up in yeshiva or chassidshe circles. I grew up with the help of real people who saw me for more than my earning potential and potential contributions. I'm dubious that this system has an exit plan for a child. Does any one ask the question - after 12 years of schooling what do we want to see and how do we get there?
